K-1 Fiance(e) Visa Process & Proceduresinterview not scheduled even in april
You don't re-validate it, the embassy automatically extends the petition validity.

Have you been in contact with the embassy to ask them about the hold up? or with DOS to ask them the issue?

K-1 Fiance(e) Visa Process & ProceduresIs this document my NOA 2?

Just called this number as well, and the packet is en route to BKK.

Next question: where does ths put me on the timeline? Waiting on Embassy receipt and for Miew to get packet #3.

Yep waiting for the embassy to get it then start the stuff for P3. Lots of times it can be downloaded ahead of time and filled out so everything is ready to be sent back the day you get P3 in the mail. Check out the US embassy website for BKK and see if you can get any of the stuff done now and ready to send when they have it.

K-1 Fiance(e) Visa Process & ProceduresIs this document my NOA 2?

Thanks.

Is the "Case Number BNK**********" on this letter different than the 'BKK case number'? I had never seen any case number befoe this letter, only the INS Receipt NUmber. This is the first I'm seeing this. If I have this case number already, can I call now to the NVC? and if so, where can I find that number.

Thanks again,

wait they put the actual BKK number already on your letter? If so then call DOS the US embassy probably already has your case right now. 202-663-1225 Ask if the US embassy has your case and if you can start your forms and etc now.

K-1 Fiance(e) Visa Process & ProceduresIs this document my NOA 2?

Yes, I was able to expedite (though was never told my expedite request was approved).

So is the letter an indication that I was approved and the NOA2 is imminently forthcoming? It says the NVC has recently received the aapproved I-129.

The letter is signed:

Sincerely,

Bureau of Consular Affairs

You should be able to call NVC in a couple days and get the BKK case number then you can go about getting your medical and forms ready and interview booked etc.

-
Actually my bad its probably already left NVC since that mail was dated 23rd. Call NVC or DOS and get your BKK case number and see if they already have it at the US embassy.

K-1 Fiance(e) Visa Process & ProceduresIs this document my NOA 2?
No that is not an NOA 2.

The NOA2 comes from the USCIS and it says your case has been approved. It is a 797 notice. You should not ask about " NOA2" on the phone because they don't know what it is the NOA2 is used on VJ as a term for the notice of action that is approval of the case.

K-1 Fiance(e) Visa Process & ProceduresNew here! My concern is...

So does anyone has an idea of how long it will take for the Canadian Embassy in Hong Kong to process her request? I hope some Canadian members out there could see this and provide some information! :help:

Do you think I should ask my fiance to call up the Embassy and ask? Thanks!

Canadian embassy will not process a police certificate. She needs to apply online thought the police or the commissionaires and provide finger prints and it can take months to get the police certificate back. Canada specific questions should be asked in the Canada forums section so you can get a proper answer.

Take a look at the guides, and please disregard the K-3 visa. If you look at the comparason chart the Cr-1 spousal visa is actually roughly $800 cheaper than the K-1 although it takes slightly longer, the Cr-1 allows for immediate work and travel.

Good luck

Take a look at the guides under the "what visa do I need". The comparason guide will help you

It took us 10 months, so approx. 8- 12 is about a fair estimate.

So possibly by November, but that is cutting it close

Good luck

K-1 Fiance(e) Visa Process & Proceduresprimary or secondary evidence?

I'm praying that it wasn't too much of a risk.

Well, if you got your NOA1, I guess it wasn't. :)

Where were you in Nicaragua? I was there in Nov. :) It's a beautiful country isn't it!

Managua, Rivas, and Leon. It was so hot in December, and yes, a beautiful country; I stayed at an absolutely beautiful hotel. Very different though, but the people were SO nice even though I didn't understand most of them when they tried to talk to me (I felt bad!) And the taxis are amazingly inexpensive. Good old cordobas :) except calling cards and calling collect were way too expensive!

K-1 Fiance(e) Visa Process & Proceduresprimary or secondary evidence?

I asked basically the same question in January and got a totally different response than you have gotten. I submitted without a letter of intent from my fiance but included one from me. I didn't have one from him because I missed it in the instructions and didn't wait for him to send one from Nicaragua. If you mailed the petition without a Letter of Intent to Marry I wouldn't worry to much. I was really worried but many people reponded to me that they hadn't included one from either party and were still approved without getting a RFE. I was advised that we should both submit on at the interview. Good luck! ^_^

That's interesting. I guess I just didn't want to risk our package being sent back - more waiting time. Maybe it depends on who goes through your stuff.

BTW, Nicaragua?! I was there a couple of months ago. Cool :)

K-1 Fiance(e) Visa Process & Proceduresprimary or secondary evidence?

Hi! I know some might consider this as a dumb dumb question, but i would just like to ask if the Letter of Intent to Marry is considered as a primary or a secondary evidence? Do you get an RFE if you fail to submit one? And does the service center put the petition on hold until you submit the letter? thanks so much :)

wife2be

Seemed like one of the REQUIREMENTS to me, rather than primary or secondary evidence. It only took about 5 min for me to write mine and sign it. Not a big deal. The longest thing about it was sending it to my fiancé in the mail.

Doesn't hurt to get things together sooner rather than later as you'll need a lot of stuff! :) start looking into how long police check will take because the turn around time could delay you if you're not sure. :) good luck!

K-1 Fiance(e) Visa Process & ProceduresCan you interrupt with the K-1 with a marriage?

I did read some place about someone who married a Romanian, then went to the US Embassy with some papers and manage to obtain a visa for her in 2 weeks'time.

Maybe so, but remember, visa does NOT equal entrance into the US...

K-1 Fiance(e) Visa Process & ProceduresCan you interrupt with the K-1 with a marriage?
Sorry hon, if you wanna be together, you'll have to wait like everybody else! There is no such thing as "fast" when it come to USCIS. NO matter which way you do it, there is still gonna be a lot of waiting involved, so I suggest you get used to that idea before you commit to one another as it is very very hard sometimes.
Good luck to you

interview is for the alien. Beneficiary should answer all questions unless CO purposely addresses Petitioner.

K-1 Fiance(e) Visa Process & ProceduresIts true that......

This is probably true for Canada or France, but not in high fraud countries, where cheating is found to be an indication of a sham marriage/relationship and fraudulous intent.

Indeed. That's why I believe I mentioned it probably varies.
GnBnLFemaleCanada2012-03-31 19:21:00
K-1 Fiance(e) Visa Process & ProceduresIts true that......
I don't think they care if you're cheating. HOw can they define your relationship....for all they know, maybe you guys are swingers! I think they are only concerned with law-breaking. It probably varies country to country, but I believe they have bigger fish to fry than worry if you're cheating.

Thanks so much just wanted to make sure. As I will need a reliable cosponsor we have only two people who may be able to help us with this. Hopefully my family member will be willing tho..

My fiancé just sent out i129f now were thinking of possible cosponsor for me the beneficiary..... It CAN be one of MY family members right?? And it doesn't matter where they live in the us? I'm hoping my family member will be willing to do this for me and that it is acceptable as we do not have many options for cosponsors..

instead of making actual photocopies of our K-1 petition.. what we did was print out 3 copies of all forms for the i129f petition and signed all three the same.

maybe im just thinking too much! UGH STOP IT BRAIN...

K-1 Fiance(e) Visa Process & ProceduresAm I Going To Get Banned?
They should not question you about it. Especially since you never overstayed the 6 months. I am in the same boat right now. My fiancé and I have a 2 year old together who was born in the us with him. I have never even come close to overstaying 6 months on one entry but back in January I was denied entry to the us due to lack of ties to Canada. That motivated us to get the k1 going.

Most likely they'll only ask you questions they already know the answer too. They shouldn't ask you anything about your travel history and entry denial. I looked into this because I have been denied, and a entry denial will not affect your visa application.

I was under the impression that you technically were allowed to do what you did. I stayed in the us for 1 or 2 months then came back for a week then returned to the US.. never had a problem till that denial 2 months ago...

Good luck to you fellow Canadian!!!

OK great info thanks!

as for the IRS he is all paid up doesnt owe any money at all.

ill ask them both for the last three years, just incase. thanks so much!

K-1 Fiance(e) Visa Process & ProceduresThinking ahead to interview
takis, my fiance does not meet the guidelines that is why i have a co-sponsor, right? at least the poverty guideline he does not meet. ok so 2 of you said different things about tax returns. one said last 3 years a copy and another said only the most recent.

my fiance from his tax return for 2011 owed the IRS all that money, so he did not get a return. although i am sure he got a transcript of the money he should have gotten had he not owed it from a dumb mistake he made the year previous.

will this in anyway affect our k1 visa, if, infact i need to provide transcripts from him for the last three years?

K-1 Fiance(e) Visa Process & ProceduresThinking ahead to interview
yes my uncle is a USC. has lived/worked there and has been a USC as long as i can remember. i was under the impression that ANY USC can be the co-sponsor... doesnt matter if it is my family member, his family member or just a friend.

let me know now if i am wrong...

also i was under the impression that since my uncle lives in a different state than my fiance, this also doesnt matter the co-sponsor can be from anywhere in the US....
WitherwingsFemaleCanada2012-03-16 15:11:00
K-1 Fiance(e) Visa Process & ProceduresThinking ahead to interview
OK so basically since i have a co-sponsor, they'll be looking at the cosponsors finances and not my fiance's??? this would be freakin awesome news for me. cuz i have literally spent the last month everyday hounding him to get a bank account.

so my cosponsor would have to provide his taxes paystubs bank letter and all that??? and my fiance too????? CONFUSED
WitherwingsFemaleCanada2012-03-15 22:21:00
K-1 Fiance(e) Visa Process & ProceduresThinking ahead to interview
OK.. so im just thinking ahead to my interview wich wont be for months and months. but i want to make sure my fiance get as much covered as we can.

my fiance is the USC and is only working part time as of now. my uncle has said he will be my co sponsor so thats one good thing, since my fiance diddnt meet the required 125% above poverty line on his taxes.

now, my fiance doesnt have a bank account right now because he owes overdrawn fees and is pretty much refusing to pay them right now. is a bank account required for him on his affadivit of support? or am i freaking out on him everyday for nothing?

K-1 Fiance(e) Visa Process & ProceduresEmails / Chat in Spanish
I was going to say!! I don't think Canada would have Spanish translators. But that's great I don't need a certified translation. I am more than capable of translating everything myself. If I need help my fiancé will tell me in English exactly what he wrote in Spanish. He is good at speaking in both languages but Spanish is his first language and his spelling in English is not the greatest.

So I'd rather him write properly in Spanish, than writing in broken English lol

Also another thought. For the i129f we sent a copy of my finances US birth certificate. It is in Spanish and English... That's fine, yes?
WitherwingsFemaleCanada2012-03-17 19:30:00
K-1 Fiance(e) Visa Process & ProceduresEmails / Chat in Spanish
My fiancé the USC always communicates with me in Spanish, I am starting to compile proof of ongoing relationship and just wondering if I would have to translate all emails

I've been trying to get him to write to me in English so save me the trouble, but he is not so good at writing in English. It would be much easier to keep in Spanish.

Just wondering if I would have to pay for translation of all emails and Skype chats.

K-1 Fiance(e) Visa Process & ProceduresRelationship Evidence for Interview
I know we have just started our journey! And I am looking at every angle so that we can be prepared for everything. I am so sorry to hear that it has been so long since you have seen your son! My daughter is waiting here in Canada with me until we get to the us with her papi. I feel so bad for him because he misses her so much!!! While she is free to travel to the US at anytime she has no one but me to bring her and therefore she won't see her papi in person until my visa is approved.

Hmm about the program u use.. It strictly on your phone right?

I wonder if there may be a way to find the old logs that aren't there anymore. There's always a way!

Anyways I wouldn't sweat it, you still have a lot of evidence!

K-1 Fiance(e) Visa Process & ProceduresRelationship Evidence for Interview
Hey Miami, so nice to see someone is in the same boat as me!! Good luck to you on your interview! My fiancé and I also have a 2 year old together! It's so hard when families are split like ours are!

The baby is the best proof there is that your relationship is legit.

As for the Skype logs, might I recommend that you take screen shots while you are talking showing the date and all. That way the CO has a visual of you chatting on Skype.

I am planning on printing out all Skype logs as well as a few screen shots of us talking on webcam. I also will be providing further evidence of screenshots of me and my daughter talking to my future step daughter.

Just one extra thing to keep in mind!!

You have more than enough evidence already! Just print it all out, figure out how to organize it and your all set!!!!
WitherwingsFemaleCanada2012-03-17 17:55:00
K-1 Fiance(e) Visa Process & ProceduresCRAP! should we prepare for RFE?

Stop second guessing, your making me start to freak out. I have two (one more, and I'd have to check that dreaded little box) drug related convictions and one of them is similar to what your fiance has. The lawyer said that "trafficking" is relating to human trafficking. Your fiance has only ONE conviction related to controlled substance. Correct? Your fiance will be approved, just as I will be approved. I meticulously followed the instructions on how to fill out the i-129f and i am sure your husband did the same as well. I got my certified police reports and all the certified court documents before hand, just in case. At first I was debating if I should just send them in along with the -129f packet. I came up with three reason not to 1. it said... check the box only if i had THREE OR MORE convictions relating to controlled substance (i only have two) 2. Im following their directions, crossing the Ts and dotting the i's, if I'd had checked off the box or send in the material when i wasn't asked to, that would only delay the process and give the official more paperwork 3. Don't tell on yourself if you don't need to.

Just have the certified court papers and police record for his conviction ready just in case they ask for it. We WILL get a approval...it will just take awhile if that RFE is requested.

thanks so much for that reply. its exactly what i needed to hear!

i think i need to take up knitting or some other hobby to keep myself busy whenever i start to think too much into this stuff!

he hasnt gottn the court/police records yet but ill tell him to just incase an RFE for that stuff that way the delay wont be longer than necessary.
WitherwingsFemaleCanada2012-03-21 22:15:00
K-1 Fiance(e) Visa Process & ProceduresCRAP! should we prepare for RFE?
this is the problem with the long wait for the NOA2... i cant stop thinking about every possible thing that could go wrong. and it sucks!

i know it asks if 3 or more drug possessions, but another paragraph just stated "trafficking" and i was told it applied only to human trafficking and now im second guessing that!
