K-1 Fiance(e) Visa Process & ProceduresK-1 Cancellation
Call USCIS and speak to a tier 2 officer not a phone jockey who answers the phone. Confirm that they got the letter request for case cancellation and that your case has been canceled.

No you don't need to do the K-1, you only do the K-1 if he intended on staying here and living here in the USA.

K-1 Fiance(e) Visa Process & ProceduresTax returns for interview?

Hey thanks but along with bank statements and letters from employers it should be ok right? We might not have time to get transcripts as she is currently here visiting me.

its fine they will accept either transcripts or the full tax return ( all pages 1040, 1099 if they have them and the W2s etc. )

K-1 Fiance(e) Visa Process & ProceduresGetting married Jamaica he's from Ghana?
K-1 visa requirement is to marry in the USA.

You cannot enter on the K-1 and leave and re-enter. The K-1 is a ONE TIME USE ONE TIME ENTRY.

K-1 Fiance(e) Visa Process & Proceduressubmitting documents to the NVC?

Doesn't the NVC let us know once they get our petition and when It is ready to send it to Consulates?

Never got any notice from NVC at all, I had to phone DOS and find out everything.

K-1 Fiance(e) Visa Process & Proceduressubmitting documents to the NVC?
The NVC only logs and assigns a case number to the case for the USEM. There is no documents or anything being sent to them.

K-1 Fiance(e) Visa Process & ProceduresInfluenza Vaccine

but its not a requirement for the K1/AOS... Td alone is good enough

"he or she is required to receive tetanus and diphtheria toxoids vaccine (Td) or tetanus and diphtheria toxoids and acellular pertussis vaccine (Tdap)".

I was commenting on the issue with the uneducated nurse saying that pertussis is not given to adults.

Both are very much on the list with the " or " between them and in Canada the panel physicians require you to get TDAP instead of TD ( for some reason!) But yes - was commenting on the fact the nurse said adults aren't given that vaccination when they are! lol
They even have commercials in the USA and Canada urging new parents to get the pertussis vaccination so you don't give it to your baby.
InkyFemaleCanada2012-03-03 10:08:00
K-1 Fiance(e) Visa Process & ProceduresInfluenza Vaccine

Is the influenza vaccination now a mandatory requirement? I thought I was up-to-date having had an MMR and TD last Tuesday, but it seems that the influenza has now become mandatory? Is this true?

Also, the nurse wouldn't give me the pertussis part of 'TDaP' because she said that it isn't given to adults?! Will the tetanus-dipheria alone see me through?

Thanks!

Pertussis is very much given to adults!! parents need it to not give pertussis to their babys / kids, That would kill them if they caught it from their parents. I know 5 American adults alone this year who got pertussis (not the vaccine the actual disease) already and its only early march.

That nurse is not educated properly.

K-1 Fiance(e) Visa Process & ProceduresHOW TO CANCEL THE K129f
Beneficiary would contact the embassy and tell them they no longer wish to continue with the process - or just not continue with the process and let it die.

Call until they give you the embassy case number then start contacting the embassy or DOS (faster response better response than embassy usually.) soon after that.

K-1 Fiance(e) Visa Process & ProceduresPenalties for marriage before K-1 approval?

This is just a hypothetical situation. But I was curious if anyone has done this and what the ramifications are, if any. Let's say you file your petition with USCIS. Then a couple months later you fly to your fiances country. You get married there. Does this affect the petition here in the U.S. or with the embassy in that country? Any opinions or expertise is appreciated!

Yes it certainly does affect it.

You are no longer eligible to get an K-1 FIANCE(E) visa.

You have to apply for a spousal petition new fees new evidence new forms bottom of the pile.

Thats how my husband answered it when we were filling it out - we had no issues with it at the USEM. Not sure why the form is giving an error, didnt give us one but you can always leave it blank and fill it in by hand after you print it out.

K-1 Fiance(e) Visa Process & ProceduresPaper cliping extra ongoing going relationship

Embassy? I have never heard that they they "rip" things up and throw them away at the embassy interview. From what I understand, they will ask you for specific things. If it is organized nicely so that YOU can easily pull them out when requested, that would be a good idea. In other words, a disorganized mess probably won't win you any points.

For our interview, I also got a folder with sub-folders and dividers plus a little zipper pocket to contain pens, chewing gum, chapstick, a couple of tissues, and I packed a couple of printed puzzles and trivia about his new home to read to make the waiting time less stressful. For the interviewer, you are just one in a long line of the daily work load. For you, it is a crossroads in your life that you hope can be passed with no bumps (or forks!)in that road. Make it easy on yourself in whatever way you can.

If you are asking about your application or possible RFE, clipping multiple-like-items together is a nice idea so that the person who compiles your folder has an easier time. It certainly is a polite thing to do that a good citizen and moral person would probably never question. If there aren't many items, then it probably isn't an issue.

Yes because they already have a folder with all your files in it. They throw away anything you put your papers into and put it in the pre-made folder in their own way. There is absolutely no point or reason to use any kind of binder or folders when they already have it set up. If you need to keep things organized just paper clip sections together and file them in an accordion folder. That way you can remove the parts when asked for them very easily without wasting your money and time making binders and stuff that gets thrown away.

WHAT I DID IS..I GOT A BINDER OR FOLDER WITH BRADS. AND JUST PUT THEM ALL TOGETHER.

waste of time and money. USCIS rips it all out and throws the folder away and uses their own.

K-1 Fiance(e) Visa Process & ProceduresAfter NOA2 - Where is my NVC number?

Also there is a line on my NOA2, "The above petition has been approved, and forwarded to the listed consulate...". I don't see a consulate listed anywhere... What consulate did they send this to?

They send it to the one you listed on the forms. There is no NVC number - there is an embassy case number though and you can get that by calling NVC or DOS.

Hey guys, quick question. Does the fact that the mexican citizen is not working right now have any effect on our k1 visa approval?or in our case, our waiver approval?

They could care less if the beneficiary is working. It doesn't do anything to the petition at all.

K-1 Fiance(e) Visa Process & ProceduresChanging Employers after K-1 was Filed

Hi guys,

I don't think this is a big deal, but just wanted to run it by you to double-check. :)

On my G-325A for the Petitioner, under "Applicant's Employment" I listed Company X for the current employer.

However, I have just now switched over to Company 123.

Is this a problem?

I would imagine that it is not and the most important part is to have at least 3-6 months worth of paycheck stubs, a letter from the employer stating the position and the salary and the bank statements showing Direct Deposits from the Employer, correct?

Thanks! :)

Not a problem because you will provide updated info at the interview.

K-1 Fiance(e) Visa Process & ProceduresFiling I-129 from outside US

By the way - A CR-1 won't help us as I understand it - we want to marry late this year in the US (elderly relatives there who can't travel etc.), then stay there (my fiancee's Canadian Visa runs out before the end of the year), with the alien (me) starting work as soon as possible (so we can eat :-)

CR-1 would require getting married now, in Canada, in order to enter the US by the start of next year.

The CR-1 gives you ability to work in the USA on entry. The K-1 you have to AOS and that takes about 4 months to get an EAD.

You are not required to marry in Canada. You can travel to the USA get married and go back to Canada and file the CR-1 petition.

K-1 Fiance(e) Visa Process & ProceduresFiling I-129 from outside US

Thanks for the clarification inky. So why would it be easier, as Krikit suggested, to file for the CR-1 as opposed to K-1 while they are in Canada? Would the petitioner be able to stay in Canada and move back with their spouse or will they have to move back to the US prior to the issuance of the visa no matter what?

They can stay in Canada till before the interview then have to move back no matter what to prove US domicile.

K-1 Fiance(e) Visa Process & ProceduresFiling I-129 from outside US

I thought proof of domicile issues were related to CR1/IR1 visas. I filed my K-1 while living overseas and moved back to the US with my fiance and then got married. We did need a co-sponsor for the I-134 as my foreign income did not count and I had been filing taxes every year but beyond that I didn't have anything to 'domicile' me in the US.

It can be helpful to move back before your fiance/fiancee but I'm not sure it's a requirement for the K-1. Is this Canada specific?

Yes.
InkyFemaleCanada2012-03-06 13:06:00
K-1 Fiance(e) Visa Process & ProceduresFiling I-129 from outside US
Canada is very hard on proof of domicile and you will have no proof unless the US citizen moves back to the USA and establishes themselves. They will stop the visa issuance until they have proof from the US citizen of the life establishment in the USA.

K-1 Fiance(e) Visa Process & ProceduresShould I mention I have his card?

These responses surprise me. I got a debit card for my fiance in her own name so she can use it to withdraw money and sent it to her and I was planning on her presenting it at her interview. You are saying this is a bad idea? What kind of new questions could arise from this?

Is he paying you to go to the USA?

Is he paying you to marry him?

Why do you have access to his money to use it freely?

All kinds of questions.

hi i was wondering if you can switch jobs while the 129f is being processed. since it will be a different job then the one shown in the g-325a. Thanks

Yes you can switch jobs whenever you want. Just make sure you can still meet the requirements to sponsor the beneficiary or find a co-sponsor.

K-1 Fiance(e) Visa Process & ProceduresAny medical examination problems/clearance issues for my fiancee with a mechancial heart valve?
It shouldn't be because a mechanical heart valve isn't contagious. She will need to bring medical records and a letter from the doctor with records and information on the medication she takes.

All NOA2 sheets say this. But that is not the case. All cases pass through NVC to be logged and given an embassy case number, after that they are sent to the embassy.

K-1 Fiance(e) Visa Process & Proceduresmedical exam
You can be denied a visa if you fail your medical exam. Generally due to drugs.

Other times when issues are found - the doctor will not sign off on the exam until you provide proof of the medical issue not being serious and being taken care of. Eg there was a woman who during the medical exam had found a large lump on her neck. She was told the medical exam would not be completed until she saw her personal doctor and had it checked out. This happened to someone in Canada and it put everything on hold until they got medical testing and provided results to the immigration doctors.

Its completely up to the doctor doing the exam. If he has an issue he should speak to the doctor right away about it - specially the questionable " black hole thing "

Get married file for AOS and wait for EAD card or green card to work. EAD can come 2-3 months after filing.

Have a look at the AOS guides.

K-1 Fiance(e) Visa Process & ProceduresGETTING MY HUSBAND A DRIVER'S LISENCE??
You need to file for AOS and EAD. He can use either the EAD or the green card to go get the license.

Also note the K-1 visa is valid for 6 months not 60 days. It also expires the day you enter the USA.

The I-94 is the important paper and it is valid for 90 days after entry.

K-1 Fiance(e) Visa Process & ProceduresTemporary EAD at JFK

Im not sure whats th I-9 is, but if youve recently applied for a K1 visa, you cannot work until you have your EAD card. It takes around 3 months from the time you file for it with your AOS after youre married.

You have to fill out an I-9 to be verified to get the job. On the I-9 form the stamp on entry is not acceptable for a K-1 holder to work with. Just the EAD or green card like you mention.
If you want to look at the I-9 forms you can find them on the USCIS website.

K-1 Fiance(e) Visa Process & ProceduresCase Status/USCIS Website problems

Thanks. But it worries us, because we seem to be the only one.

We will not rely on it. However, if this turns out to be a problem learing from other VJer's experences & responses. We want to try and solve it now to prevent it from slowing our process. We are open to everyone's comments and advise.

Not seeing your case status online has nothing to do with slowing the process or anything.

You are not the only person there are TONS of people who cannot view their case status online. Viewing it online is not even reliable and you are worrying and upset over this for no reason at all.
