K-1 Fiance(e) Visa Process & ProceduresK1 Check cleared
QUOTE (khmerguy @ Jan 15 2009, 01:38 PM) <{POST_SNAPBACK}>
Just check my online bank today and my check cleared. good.gif yea baby......
Question:

1) When will i receive NOA1?
2) Do I need to do anything or just wait until NOA2 approve and that's when I start to send all paper work to my fiancee in Cambodia?
3) where is the case number? is it start with EACxxxxxxxxx?

Thanks all.

If you can see the back of your cashed cheque your case number will begin with either EAC or WAC. You can then register for an account with USCIS here https://egov.uscis.g.../jsps/index.jsp where you can see if your NOA1 has been sent.

Isn't there a question on the VWP form about ever being denied a visa?

I'm pretty sure there is, in which case you would have to answer "yes" and that may cause problems at POE.

It is and you have to state when and where. It is also a question on the ESTA application.

F) Have you ever been denied a U.S. visa or entry into the U.S. or had a U.S. visa canceled?
If yes: when
where

CSC did not have any new NOA2 approved yesterday either based on Igors list. This was why I was curious as this is abnormal for CSC lately. VSC we know it is normal - ha.

I meant with weekly approvals. Unless people were watching the inaugeration on tv. I doubt it would affect it though.

Well back to the long wait. We are all in similar boats waiting for acceptance of what to me is a basic human right. Which I believe is in the US constitution.... something about the pursuit of happiness being an inalienable right. Hmmm does this apply to us aliens..... which I believe to be such a derogatory expression to call what is in all regards potential US citizens. Perhaps we could be referred to as citizens from across the pond...whatever pond you may choose Ha!

Best wishes to all

Who said it wasnt? But for California to be processing November applications already and Vermont to be in August and not moving is the problem. That is an inefficient process currently and should be resolved.

Vermont is moving, abite very slowly. Not long ago CSC was the slow centre, they seem to swap and change.

Laura+TomFemaleUnited Kingdom2008-12-08 07:33:00
K-1 Fiance(e) Visa Process & Proceduresdo i need police certificate
From Embassy website:

If the applicant is living in their country of nationality at their current residence for more than 6 months then they need a police certificate from that country (over age of 16)

If the applicant lived in a different country for more than 12 months then they need a police certificate from that country (16yrs or older at the time)

In your case you do not need one if you lived there less than one year. But you didn't say how long you lived there for.

EDIT - If you were arrested for any reason, regardless of how long they lived there then you will still need a certificate.

Your fiance does not fill out an NOA2, he will receive one to show your I-129F was approved. Your case will then be sent to NVC for further processing then onto the embassy, this may take several weeks.

You can check your embassy's website for all the forms and documents required at interview.

So is it true that you can only spend 180 days per year in the USA? And as I mentioned earlier is that Jan - Dec or "rolling" (march - march for example)?

I think the immigration officers deam what is acceptable with regards to how many days you spend in the US. They can turn you away if you've only previously spent a week there if they suspect anything. I tried to find whether there was a set amount and came up with nothing.

Hmmm okay. I also ask this because when my fiance visited last November they nearly refused him at immigration because he said "girlfriend." Also, Continental doesn't let you print out all your tickets at once so he couldn't prove he had a return ticket.

Sometimes it depends on the officer. Some can be really grouchy but some can be friendly. Last trip I did I said I was seeing my boyfriend and we had a really nice chat on why he was there and I wasn't and what we did for a living.

Hi there,

I'm just wondering if time spent in the USA can affect your K1 application in any way? I've had a K1 pending since October and I've just returned to the USA a week after staying 86 days and am probably going to stay for a similar period as my financial situation allows it. Can this affect anything?

Thanks

Wow! You didn't have any trouble at immigration? I was told by an immigration lawyer that they can see that you have filed the petition know you're engaged which makes them really sketchy about letting you in, especially for more than a week.

Nich-Nick contacted Customs and Border Patrol and asked whether POE can see that you have a I-129F pending and was told no. It has been discussed recently in the UK forum and here is her post on the matter http://www.visajourn...p;#entry1948785

The process won't go any quicker if you use a lawyer or do it by yourself. Some lawyers have been known to say that you will only wait a couple of months before approval. This isn't true as once it is submitted to USCIS it's out of the lawyers hands. You will still have to collect all the documents yourself and fill all the forms out, the lawyer will just check them.

If you feel you need help they by all means get a lawyer but many many people have used the guides and done it themselves successfully. If you ever need help you can always post a question here and get an answer from one of the many people to have gone through the process. Personally I think it's better to get an answer from someone who has actually gone through what your going through.

Good luck.

NVC will send the case to the consulate. Then the consulate should send out Packet three to the beneficiary. This should consist of the forms the beneficiary needs to fill out and details of any documents needed to collect. It may not be the same for all consulates though. If you find your embassy/consulate here http://www.usembassy.gov you should be able to find more details on the process.

Hello everyone!

This is my first post ever here! However, if it wasnt because of this website I do not know what would I have done with myself! It is so freaking helpful that it is not even funny.

Anyways I am going to make my question simple. I sent my application for fiance visa for my fiance who lives in Cuba last friday 2/6/09 and to my surprise the check was already cashed today. What does this mean? It has only been 1 week, does this mean they are already reviewing the petition? Because I think it was wayy to fast or is this the right timing? Keep in mind I have not received any letters from them or anything? Please anybody help! I am so excited! Or should I not be?

It means the envelope arrived, they opened it and cashed the check, nothing more. Well, except that you paid the correct fee.

And that they will probably soon be issuing the NOA1...which contains your case number to be able to review the status of your case online. They also put the case number on the back of the check, so if you have online banking you will probably be able to get that case number now. The NOA2 is what you are really really looking for...and what so many of us are still waiting for. Get in line and pray for patience! good.gif

I just saw a number on the back of the check they cashed. However, whats the web site where ones checks the status of ur case?

There is nothing to stop her coming to visit under the VWP just make sure she has plenty of ties to her home country. And as said before ultimately it is up to POE whether they let her in or not. There are numerous threads on this subject if you search for them.

Wait I was under the impression that you could still come to the country of which your fiance resides and see them. In my case, the US and my fiance from Canada. Are you talking specifially for South Korea or overall cause I've had alot of people tell me that once we send out our I-129F packet that she could come be with me. We've even talked about her being down here for a few months while we work on the process as well. She wouldn't be working nor doing anything illegally and she would be honest at the POE. Please correct me if i'm wrong but I don't see where its a bad thing. I even did a post where I asked if there were any consequences at her interview. As long as we kept them posted of the address where we would be ( Me no problem, but my fiance ) then it was okay. We would also need mail forwarded to us as well. Let me know

Jared

Yes you can visit with a pending I-129F as long as there is no overstay, but ultimately it is up to POE.
