Hey, congrats :) (and congrats on the 10 year GC too!)

The online status for my AP only switched to "Approved" last year (2 years after the fact) -- and for some reason, when I filed my I-751 app, the first thing that was "touched" was my Employment Authorization application from 2004!! I agree, stuff like this needs to be shown to the powers-that-be so that they have first-hand evidence of how incompetent the USCIS is. I actually sent a rather ranting email to my congressman and both senators a while ago (complaining about the complete ^&$* up that is the USCIS and how we are spending a fortune on a truly abysmal 'service'), and did get a really nice response back from my congressman asking if there was anything he could do to help with my current application. My reply was "not right now, but you'll likely hear back from me next year when I file my N-400 application"...

Thanks for your update -- it's good to know that everything went smoothly (I'm travelling to Europe next week, and then again in August, and unless Vermont suddenly manages to process everything this week I'll be using my extension letter). I'm not sure I'd be as calm as you though if faced with some idiot telling me I should update my GC!!!

richie -- my experience is that whilst you certainly don't need to show anything pertaining to US residency when entering the UK, it's when you're leaving -- i.e. checking in for your flight back and dealing with all the paranoid pre-check-in security gubbins -- that you have to show the clerk your greencard as non-immigrants now need to fill in a form with the address for where they'll be staying on arrival (which us immigrants don't need to fill in). I suspect this is when the whole letter thing came into play. I'll be doing it in Milan, so things should be interesting, given I don't speak a word of Italian... ;)

I just returned from a trip abroad, and while it took a few extra minutes to get through immigration (Philadelphia -- had to go to the "special processing" room with my NOA) everything went smoothly. I was asked by the immigration officer why I didn't have a I-551 stamp, so I responded that my understanding is that the NOA is sufficient (and I don't know if the Boston office even gives them if you have your NOA), which he agreed with. He didn't give me an I-551 stamp and was somewhat surprised at the length of time it's taken thus far for my 10 year GC to be processed. I muttered something about Vermont being slow... I'm going out of the country again in 2 weeks time, so am keeping my fingers-crossed that by some miracle I will have my new GC by then... ahh, wishful thinking... :P

Oh, he didn't give me an I-551 stamp btw, just the usual entry stamp.

Have a fun trip -- you'll be fine getting home -- just don't forget your GC and NOA letter!!! :)

Quick update: Unfortunately, I didn't receive my GC before I left for Europe, but returning with my expired card and NOA letter was a breeze at Boston, presumably because they're used to seeing NOAs from Vermont filers who have been waiting aeons for their applications to be processed smile.gif However, I am now the proud owner of a 10-year GC (my photo is atrocious, I think it sums up my feelings about the USCIS!!), so it's au revoir to the USCIS until Feb next year when I send off my N-400 application.

You shouldn't have any problems -- I worked for 6 months on an expired GC and NOA extension (thankfully, since I'm the breadwinner!!). My company didn't even want to see the NOA! I told them the situation and they didn't seem remotely bothered. You should be fine, just make sure everything is filed in good time and don't leave anything to the last minute. Probably a little late for this quesion, but do you mind if I ask what types of backup you sent with your I-751 application?

By the way, it looks like your original GC may have expired before you got the permanant one, right? What happens in this case?


By backup, I assume you mean the evidence? Our evidence package included:
- copies of our joint tax returns for the past 3 years (it took them over a year to process my initial AOS application, so we have 3 years of joint returns)
- copy of our mortgage agreement
- copies of previous rental agreements (showing the leases in both our names)
- copy of our car registration and auto insurance, showing both our names
- copies of random bank statements from the past 3 years for our joint checking and savings accounts
- copy of my health insurance showing my husband included on the plan
- copy of my life insurance showing my husband as sole beneficiary (he's the USC, but since he was a student up until March this year, I've actually been the one supporting us financially since we were married!)
- 2 notarized letters from friends
- copies of miscellaneous photos of us with friends and family taken since we were married

Mostly, we sent them proof of our financial "mingling" since we were married. They like to see lots of evidence of this.

Yes, my 2 year GC expired on May 9. I sent my I-751 package 90 days before my GC expired (so Feb 10) -- the USCIS then sent out a Notice of Action ("NOA") which extended my GC by 1 year. When you are travelling abroad, you must ensure you bring your GC together with the original NOA extension letter, otherwise you will have problems when re-entering the country. I just returned from a trip to Italy and I had no problems at immigration with my expired GC and NOA extension letter. Good luck!

Yay! Now all I have to do is keep my fingers-crossed that the card arrives before Saturday (I fly to the UK on Saturday and it'd be great if I didn't have to deal with the NOA letter again at immigration) and that all the info on it is correct... Well, I now have a 6 month respite from the USCIS before the N-400 is filed, hurrah!

We included a couple of letters, one from our best man and one from my hubby's boss, which were notarized for free. I don't think they will have made a difference either way on the approval, but we wanted to make sure all our bases were covered to avoid getting any RFEs later on (we didn't get any). Good luck!

What a truly awful experience -- I've encountered rude, hostile immigration officials before but this is unbelievable!!! I would definitely complain. I'd also write a letter to your congressperson -- people who are legally here shouldn't have to deal with this sort of hostility.

When I came in through Philadelphia with my expired GC and extension letter, I was sent to secondary inspection and the officials there seemed to be confused as to why I didn't have an I-551 stamp in my passport -- I told them that Boston doesn't do this if you have the extension letter (they didn't get this, I had to explain twice) and they then told me to wait while they checked everything. About 10 minutes later they seemed satisfied that everything was in order and I was allowed to go to the luggage hall. Coming through Boston, on the other hand, was a breeze -- I suspect that the GC+extension letter thing is a fairly common occurrence there due to the delays at the dear old VSC...

I hope your 10 year GC arrives soon!!!

US Citizenship General DiscussionShould I include near-future trip in part 7C (time outside of the US after becoming permanent resident)?

Hi everyone,

 

I am about to send out my N400 package in the next week, and have a small question regarding Part 7C in the form, where it asks for all the trips of more than 24 hrs outside of the US:

 

I am going to Scotland for 2 weeks at the end of September, which is going to be over a month after I plan to file for N400 but not long enough for it to be approved. Should I include this prospective trip in Part 7C of the form, or only the trips that had been actually taken up until the time of filing?

 

It would be easier to wait until after Scotland to file N400, but since my husband and I have a few European trips mapped out for next year, I would like to try to get a US passport as soon as possible so that I won't have to apply for travel visas again (which can take a considerable amount of time and money)

US Citizenship General DiscussionHow long did letters take to arrive after email/text notices?

Did everyone get two separate letters for NOA and Biometrics appointment? How long did they take to arrive after the email/text notices?

On 8/23 I got an email saying my application has been accepted, and a case number was issued. They suggested that I wait for the actual NOA letter, which would arrive in 7-10 days, before checking My Case Status online.

 

Impatient as I was, I went on to USCIS website on that same day and added the case to my portfolio with the given case number. My case was already updated in the system, and the last updated date was shown as 8/21.

Then on 8/28 I got a text and an email saying that an appointment notice for biometrics was sent out.

 

I have received neither the NOA nor the appointment letter. I am a little worried, since the biometric appointment was to be around 2 weeks from the day the letter was sent out. If they'd sent it out on 8/28 then my appointment might be on or before 9/13, which would be most unfortunate because I am scheduled to be in Scotland until the end of that week.

 

At the same time, not having the letter and the actual date in hand, I am unable to make a decision whether to do a walk-in before leaving the country, or to reschedule for a date after the trip.

 

I did not count on USCIS to be this efficient in processing my N400, considering that during ROC it took them almost 8 months after NOA1 to send me an RFE.

 

Neither did I think I would ever complain about them being too efficient.

 

Oh the irony!

Removing Conditions on Residency General DiscussionMy RFE - requesting for feedback (warning: long post)

Hi Victorian221b,

 

Do you have mutual friends or family that can write affidavits to attest to the fact that you are in a bonafide marriage relationship? I imagine that you do since you have been together many years. I know that personal affidavits may seem very weak as proof, but they worked in my case.

 

I was in the same boat as you not too long ago. I sent in my ROC package in Oct 2012, did the biometrics in Nov, and heard nothing from USCIS until they sent the RFE request in May 2013 (took them almost 8 months to do so)

 

In the RFE letter, they also said that the evidence we had initially sent was not sufficient to establish a bonafide marriage relationship.

They listed what we had originally sent (last 2 year leases with both names, utility bills, car insurance, checking, credit, investment accounts statements for every quarter since getting my conditional GC, joint IRS tax return transcripts as married couple for 2010 and 2011, photos with family throughout the 2 years, etc). I also only included documents starting from my conditional GC date (bank documents were just continuation from our AOS package as we have had the same accounts since)

 

Here is the funny part: the RFE letter then went on to suggest what we could send in as our response, and they were exactly the same items as we had sent in originally, except that their suggestion included birth certificate of children which we don't have (not yet!) anyway.

 

So what we did was ask a mutual friend and my father in law to write affidavits confirming that to their knowledge our marriage was legitimate. By that time, our 2012 tax return transcript had also become available, so we included that, plus the latest statements for all financial accounts we had even though we had already sent in quarterly statements for ROC.

 

I was approved in August less than 2 weeks after sending in our RFE response with no interview. We waited until almost the end of the 89 day allowance to send it, because all that time we couldn't think of anything else in addition to the documents we had sent before. Then we decided to go with affidavits. They were the only thing that was not included in the original application package (not counting the latest tax transcripts and financial accounts etc).

 

I was pretty sure that our RFE response wasn't going to be good enough and that we were going to get an interview, but apparently the affidavits was good enough for USCIS and they promptly issued the approval.

 

I would not have minded if they wanted to take their time, because I would become eligible for naturalization application a week after that anyway. 

 

I am sorry for writing such a long post. If you get through it, I hope my experience will help a little bit.

I'm getting myself geared-up for the final stage of this long and arduous journey...

So I was just reviewing the recent timeline posting and was pretty horrified to see that Vermont seems to be desperately slow at processing N-400 applications, whereas California is processing in a matter of weeks. Is this really the case??!! I'm rather hoping to vote in the elections next year, so need to know if I should get my application in the mail bang on February 8th (90 days before my 3 year GC anniversary). It took over a year for my initial GC application to be processed, so the thought of having to deal with the (insert expletive here) VSC again is making my stomach churn. mad.gif

If it really is the case (which I suspect it is) I guess I should also start thinking about the letter I'll be writing to my congressman, again... ho hum...

Just as an aside -- and just to rant a bit -- I think it's completely ridiculous how many times we have to provide our fingerprints during this process. I mean, fingerprints don't exactly change do they?! My husband looked into it (he read the Ombudsman's report, pretty damning stuff) and it turns out that the various organizations don't actually share fingerprint databases. I was also wondering about this question since the N-400 application is used for both the "normal" and "marriage-based" applications. Since we can apply after 3 years post-GC, rather than 5, counting the days for the past 5 years seems somewhat irrelevant -- especially since we only need to itemize the trips taken since we got our GC. Do we still need to do this or can we just count the past 3 years (which would make more sense given our circumstances)? I suspect it's the former, as I've not read anything in any of the USCIS literature to the contrary, but I wanted to get another opinion.

Acording to the uscourts.gov they hold 2 a month in boston.... sorry did not look at other towns in MA.
