hello Vjers i need your help ASAP, my fiance was married to a Japanese national they got married in Japan, 4 months after her visa was ready and she followed to US but got divorce 16 years after, my question is on the affidavit of support (i-i34) on # 9. I have previously submitted affidavit(s) of support for the following person(s). If none state "none". and on # 10. I have submitted a visa petition(s) to U.S. Citizenship and Immigration Services on behalf of the following person(s. If not none state "none" does he have to put his ex wife's name on #9 and #10? thank you so much in advance.

650 pesos (for seminar and sticker)

note: she don't have to complete everything but as far as she can she should bring it with her since CFO are moody sometime and even reject applicants and not give them seminar if they don't have the docs they're asking. goodluck. :)

and the other thing you mentioned isn't applicable to her also since she's going to US not canada nor japan.

Don't forget to tell your fiance to do the CFO seminar and get the CFO sticker on her Passport, without CFO sticker they will not allow her to check in at the aiport or fly to US.

this is my other opinion concerning to the email of USEM to your fiancee, it seems it is a notice that they already got/collected the docs, i mean your reply to the 221g issue and that they got her passport also. and once the visa is issued they are going to send the packet at the said address.
i let my friends read it the one's that got 221g and they said it seems they just got your docs and her passport too. sometime it takes a week or 2 before USEM get the docs we send to them no matter how far or close the sender is.

At the interview they gave her a 221G for my current year W2. They denied the K1 and I asked what to do. They told me to just send them pay stubs from the past 6 months and that's what I did. After 2 weeks they asked her to send her passport to them and she did that June 20th. Last night she got this email. I'm just worried and confused if this is a denial or approval. I've seen where someone got an email saying that the visa has been printed. I hope someone can shed some light on this.

Thanks, because there are two sentences in NBI clearances. (1) "No derogatory record" which means you have no criminal record at all, clean of any charges and (2) "No criminal record", which means you either have a case or cases that have been terminated or dismissed before and the "hit", where case have the same name as yours. But if that is the case, i dont have to worry then. Now relieved. Thanks for the help.

Hello everyone, I am not familiar on how to check VJ previous topics about NBI so I thought of posting it here. My question is, will the US Embassy require explanation or affidavit if your NBI shows "no criminal record" which mean you have hits. I secured copy of my NBI last March and got several "hits", and done all the necessary court clearances to clear my name and had my NBI issued. Now, will the US Embassy require me of any affidavit and explanation regarding the "hits". Would like to know so I can prepare as early as possible. Waiting for our NOA2. Your opinion and advise are greatly appreciated. Thank you.

no, all NBI clearance should have no criminal records, if your NBI clearance say something aside from that then you have a problem. hits means there's someone same as your name that has some issue but now that you have your NBI clearance you're good to go, don't worry. you don't need affidavits. usually if you have "hit" you'll get you clearance after they check both your file and the file of the person that has name same as yours, but after some checking you'll get your clearance with the word "no criminal record" me too i always get hit everytime i get NBI clearance, don't worry too much on the NBI because you're ok, focus on more docs that you'll be needing on your medical and interview and CFO

Okay, so here's a question...I just re-did the DS 156 together with my fiancee via skype, and I was unaware of this, but you can actually save this document and email it. I thought you only had the print only option. Since i can save this, I assume I can just email it to her and she can print it and that's the end of our problem, right? So this way she doesn't actually have to sit down and do it by herself, and since we did the form together I don't have to put that it was "prepared by someone else" (question 39 & 40), nor do i have to sign it. Essentially we prepared the form together. I assume this question refers to if someone does the whole thing independently, like a lawyer or fiancee without any help from the immigrant?

Is this all correct? What am i missing? This seems like it's clearly the easiest option given our situation. Instead of her doing it by herself at an internet cafe and struggling with the English, we just did together while skyping and I email her the document, she slaps her photos on it, signs it, and that's it, correct? I mean, is there some way they can scan the bar code and they will see the IP address where it was created and then give her a hard time or tell her it's invalid or something?

I don't know..it just seems like this is clearly the easiest way to handle our predicament, and I'm curious as to why no one suggested it. Or maybe i'm doing something against the rules that I'm not seeing or understanding.

Any feedback on this?

it is ok that you're the one who filled the form :) nothing to worry, all my docs it was my fiance who filled it up and it is ok, now that we got noa2 i will let him fill the DS-156 for me, nothing to worry :)and oh don't worry about the prepared by someone else.

There is no problem on that..she just fill up the form honestly and truthfully because later on she will secure a police certificate of all the countries she lived in the past years. As long as she is legally work in Jeddah,there is no need to hire a lawyer.She can apply in the US embassy in jeddah.I am a filipina too,i worked in hongkong then work in Canada now. The US embassy in Vancouver just requested a valid work permit to prove that i live legally in Canada then provide the police certificate in the countries i lived in previous years. She might do slightly the same i guess. Just follow all the instruction with the help of this website and you two will be fine. Goodluck!

So I am planning on consulting an immigration lawyer this weekend in regards to our situation, but then I found this awesome site of yours so I thought I'd ask here first hoping someone could share some knowledge my way :) again our situation is this, I am about to file a K1 visa for my fiancee in the Philippines, as she was filling out her G325a she came across the part requiring her to list her place of residence for the past 5 years. Since her current address is in Jeddah Saudi Arabia, we started wondering if her living outside of the Philippines during the filing process would cause any problems? I am hoping that someone well versed with immigration laws or someone who has gone through a similar situation will be able to help answer our question. Thanks in advance and I look forward to seeing you guys around.. cos I'll probably be here often for the next 5 or so months :)

ok I don't know if this can answer your question, a friend of mine works in Qatar, they filed the i-129f while she's in Qatar, she wanted to have the interview here in the Philippines so she went back here in the Philippines BUT nvc sent their case to Qatar since her current address when they filed the petition was in Qatar, even they changed the address in uscis NVC didn't change it. so they had to do a request to transfer their case here in Manila USEM. it took them almost 3 months before USEM receive their case after that she receive an email from usem here then she continued her visa process and now already in US :)

Our interview was held on January 28, 2012. We were given a 221g form stating to provide proof that the petitioner currently lives in the US. We mailed it and received a letter confirming the embassy has received it. Then they told us our case is under AP. Today we got a call from the embassy stating to provide ANOTHER medical and ANOTHER police clearance and our appointment is within 10 days. Now, does anyone know, do we have to pay another $350 for the 2nd interview? Will my fiance be asked another round of questions? Thanks in advance!

yes you don't need to pay again, just do the new medical and the said Police clearance :)
they're not going to really ask her a lot this time, my friend experienced it too now she's in US already :)

I hope this is the appropriate forum! I am in need of some serious HELP!! Hahaha! This visa process will drive you batty!! I dont even know where to begin my long and sordid tale! Hahaha! Ok. Here goes. I met my girlfriend 3 years ago in Manila. I'm an American living in Australia, but I am returning to the USA and want to bring her with me.I am divorced so there are no issues there! As soon as MY DIVORCE was finalized she tells me that SHE TOO was MARRIED but she didn't think so, (that's why she never told me),because she was married to the father of her two children WHO WAS PREVIOUSLY MARRIED!!!! She went to Cenomar and was shocked to see her name there! So--she was married to a BIGAMIST! So she went to 3 lawyers and they said YES we can make the marriage null and void but its going to take A YEAR and $3000 and you have to show up for court every time!
This is ABSURD to me! Anyway-I need to get this woman to the USA to be my wife and get a job! Her passport says she is single. She has visited me here in Australia 2 times and returned ,as per her travel visa requirements! She has 2 young children in the Philippines.And no job. I support her and her family and we have heaps of photos together both here and in The Philippines as well as financial support via Western Union! I can get her to the USA on a travel visa, I believe-without too much ado (correct me if I am wrong!) And the 2 small children pretty much will assure her intent to return! And then my plan is to marry her the day after she lands in Las Vegas! Then we will apply for permanent residence status. So now what happens???? The US immigration authorities will check the Cenomar records in P.I.?????????? Do they care if she was in a marriage that will be null and void ANYWAY and we have the proof? Will MY MARRIAGE to her count? Does US law take precedence? Will she be a bigamist?? If they find out will they deny her the permanent residency, deport her and not let her back for 5 years??? I love her and want her with me in the USA and for her to be able to visit her kids once a year!! Any insight into my dilemmas is most appreciated! Thank you all!!!!

If I were you get her file annulment first it will take maybe 6 months to a year before she gets the finality and it depends on how the lawyer will handle it, and for the travel/visitors visa, once the CO finds out on her interview that she's going to stay with her BF/fiance she will be only denied, plus she have to prove she have enough resources to support her travel and that resources can't be from you, like her bank accounts they will check it also the statement or the history of the deposits she did, you can't put huge amount of money at once. but the safest way is have her get the annulment and file for k1 if you really love her, and if you want to see her she can visit you there in Australia or you can visit her here in the Philippines.

there's a lot of filipino that got their flights cancelled because they didn't had CFO sticker, when i attended seminar before there was a lady with us in the room with her luggage with her, she was about to leave but they didn't let her check in, so she re-booked her flight at nite time Glad they had flight for nite time(i know international flights are 24/7 hehehe)so after she finished the seminar she went to get her CFO sticker and headed back to the airport and finally she left Philippines :)

and addition to that you can attend the seminar even you don't have your visa yet or you're still processing the petition because there's no expiration on CFO seminar certificate, once you have your visa you can go back and get your sticker :), for my own opinion i think it is safe to do attend the seminar now because they're going to ask only few docs, unlike when you have the visa they're going to ask a lot of docs BUT i only base it on what i know, I really don't know why CFO is so strict nowadays :( i was scared too LOL my fiance is also divorced and they always asked for the copy of divorce decree at CFO office, when we think of filing the petition my fiance didn't get his divorce decree yet but i'm glad i have it in advance now, but i wish we'll get our noa2 soon :(

CFO stands for Commission on Filipinos Overseas, you need to do the pre-departure orientation seminar in any 3 CFO addresses here in Manila or there's 1 in Cebu, then after that you have to get the CFO sticker. they will put it on your passport without the sticker they are not going to let you check in or leave.

All I know is, if your USC boyfriend was once married here in the Phil, and had that marriage broken through a divorce in the US, and was NOW granted, he can file for a K1 visa for you. K1 only needs the both of you to be LEGALLY FREE TO MARRY IN THE US and not in the Philippines. Your petitioner is a USC and he's under the US law and not the Philippine law. It doesn't matter if he and his wife got married here in the Phil. As long as he's divorced now, that's okay. There will be a problem if its you (the beneficiary) whose married. We have consulted it already with a lawyer that's why I know. :) You and your fiance might want to seek professional help for assurance. It will give you peace of mind.. :)

I agree to that :) but if she wants to report their marriage here in the Philippines she can't because the divorce decree isn't recognize yet by any court here, plus the CFO might question it, yes he can petition her, go to her interview but nowadays CFO is making everything too difficult for the applicants. but in every problem there's a solution, i know she can make it :), but remember don't just get ready for the petition and interview only also for CFO because without CFO seminar and sticker on your passport you can't leave Philippines... it is so unfair after all the process but that's the rules and law...

yes he can petition you, but there is tendency that you'll have a problem on your interview, just to play safe tell him that he needs to file here in the Philippines court so that the divorce decree will be recognize here, but some of my friends they didn't have problem filing for k1 even their fiance had a filipina wife, even you get married in US once he gets you, you can never report your marriage here the Philippines because in philippine government they are still married. that is what happen to my friend. have your fiance file a petition for recognition of a foreign divorce decree with the appropriate court in the Philippines. BUT still he can petition for you :) you may be approved at the interview it will be the CFO who will give more probs they will ask a lot of docs before they allow you to get the seminar but as long as you can provide what they ask you are good to go, but for me i would ask him to file for it here in the Philippines court while you petition is on process :)

Divorce is not allowed in the Philippines and divorce secured anywhere by a Filipino is not recognized in this jurisdiction. If you’re a Filipino, it doesn’t matter where you get a divorce: such divorce is invalid/void in the Philippines. This is because under the nationality principle (Art. 15, Civil Code), all Filipinos – where they may be in the world – are bound by Philippine laws on family rights and duties, status, condition, and legal capacity. In certain instances, however, a divorce validly secured abroad by a non-Filipino may be recognized here in the Philippines.

Is there a legal provision that recognizes divorce in the Philippines?

Yes. On 6 July 1987, President Corazon Aquino signed Executive Order No. 209, otherwise known as the “Family Code.” Article 26 of this law, which took effect on 3 August 1988, reads:

All marriages solemnized outside the Philippines in accordance with the laws in force in the country where they were solemnized, and valid there as such, shall also be valid in this country, except those prohibited under Articles 35, 37, and 38.

On 17 July 1987, Executive Order No. 227 was signed into law, amending Article 26 of the Family Code, among others. Article 26 now reads:

ART. 26. All marriages solemnized outside the Philippines in accordance with the laws in force in the country where they were solemnized, and valid there as such, shall also be valid in this country, except those prohibited under Articles 35(1), (4), (5) and (6), 36, 37 and 38.

Where a marriage between a Filipino citizen and a foreigner is validly celebrated and a divorce is thereafter validly obtained abroad by the alien spouse capacitating him or her to remarry, the Filipino spouse shall have capacity to remarry under Philippine law.

What are circumstances that would make Article (Family Code) applicable?

We have a basic discussion on Article 26 of the Family Code. Included in that discussion are the two elements that must be shown before the second paragraph of Article 26 is applied:

There is a valid marriage that has been celebrated between a Filipino citizen and a foreigner; and
A valid divorce is obtained abroad by the alien spouse capacitating him or her to remarry.
Is this provision applicable to former Filipinos?

Yes. Article 26 was later interpreted by the Supreme Court to include cases involving parties who, at the time of the celebration of the marriage were Filipino citizens, but later on, one of them becomes naturalized as a foreign citizen and obtains a divorce decree. The reckoning point is not the citizenship of the parties at the time of marriage, but their citizenship at the time a valid divorce is obtained abroad by the alien spouse capacitating the latter to remarry. (Philippines vs. Orbecido III, G.R. No. 154380, 5 October 2005).

Article 26 provides that the divorce must be secured by the foreigner-spouse. What if the foreigner-spouse continually maltreats the Filipino/Filipina spouse, isn’t it unfair that the Filipino/Filipina can’t initiate divorce?

It may be unfair, but that’s the law, consistent with the State’s policy of not allowing divorce for Filipinos. This doesn’t mean, however, that the Filipino/Filipina has no other recourse. If the circumstances fall under the grounds for annulment/declaration of nullity, then the marriage could still be annulled or declared null and void from the beginning.

If there’s already a divorce validly secured abroad (by the foreigner-spouse or the Filipino spouse who became a foreign citizen, losing his/her Filipino citizenship in the process), can the Filipino spouse immediately remarry?

No. The existence of a valid divorce decree, however, does not automatically entitle the Filipino to remarry in the Philippines. The foreign divorce decree must be judicially recognized in the Philippines. This means that the proper action or petition must be filed in a Philippine court. For purposes of re-marriage, the divorce validly secured abroad is not automatically recognized here in the Philippines.

Isn’t it enough that I already forwarded the divorce decree to the Philippine Embassy (or the Department of Foreign Affairs) and the National Statistics Office (NSO)?

No. The foreign divorce decree must be recognized here in the Philippines; a process which may only be done through the courts.

Why should we waste money in filing a petition in court for the recognition of the divorce decree?

This is the requirement of law, unfortunately. The divorce decree must be proven, just like any fact, in court. The presentation of the divorce decree is insufficient. Proof of its authenticity and due execution must be presented. This necessarily entails proving the applicable laws of the jurisdiction where the foreigner-spouse (who could be a former Filipino) is a national. One of the requirements under Article 26 is that the decree of divorce must be valid according to the national law of the foreigner.

The petition will be rejected and returned. He can write a new check for the correct amount $340, and send it back. You are worried about the wrong thing.

Here is what you should worry about...

Your fiance did not know the correct amount to send and sent it using the logic of "too much is better than not enough" This is wrong. In many ways. I am guessing that it may have not been the only mistake he made. Just guessing. Did he have a CENOMAR from you? A signed letter of intent from you? A signed G-325a from you? Passport photos? Was all that included, translated if needed?

It will be a couple weeks before he gets it back so I suggest that HE come to this site and READ the instructions for the form I-129f and the guides on how to file a petition for a fiancee. Ask questions and get correct answers before sending it again. This will save you time in the long run. The correct amount to send is listed in the instructions



Do not send it back until you are sure everything else is correct. When the amount of the check you sent is wrong it indicates TWO things

1. No one read the instructions
2. Without reading the instructions it is virtually impossible to do this correctly

hi... :) yes everything is in the package it is just the check was wrong,i sent him my CENOMAR,birth certificate, my G-325a, letter of intent and 2x2 passport-type photo and it is all signed and dated, and on his part he did good also he followed the steps on VJ information, we got confused of the visa fee that is 350 and the I-129f filing fee is 340, you are right i was thinking over is good, now we have no choice but to wait.. thank you for the information. :D

just wondering once they return it to my fiance, do you have any idea how long before he can have it? he's using a FPO AP address, if they are going to send it back we want to send it back right away with the proper amount on his check :-)

hi again VJ members, my fiance just sent our package today to USCIS, i asked friends about how much is the fee for I-129f, some said 340usd some said 350usd and they also sent me link that showing 340usd and 350usd on the other link, so i told to my fiance to just put 350usd to make sure, i know i am stupid to think that is ok, then i was researching this morning and found out that it is really 340usd and the Visa application is the 350usd and i read this ("The Lockbox can not accept overpayment and make partial refunds") it was too late for me to tell him to change the amount on his check, does is mean they wont accept the petition? or they will accept it? we don't care about we are over by 10 dollars, but i am so worried now. need advice what to do... :help:

We appeal and now our petition is approved. Thank god! It only took less then a month. We sent it on second week of October and got approved November 1. We sent the necssary documents and also stated we are going to have a baby. Thank god they approved what we sent with our appeal.

one of my friends had her visa pending, but she is in the US now, they had to wait for the recent tax return, the CO asked her the recent one, they were not approved right away but not denied also, after they sent the recent tax return she just waited for a week and she got her visa and flew to US the next day. but as you've said you have co-sponsor, they will look for you co-sponsors papers if he/she can support your fiance and her daughter. :)
