usually k2 uses the same MNL case # of k1, but you need to call USEM first to verify, you have to take your k2 with in 1 year, if you go beyond 1 year then it will be a different process before you can get your daughter, my friend has k1 but she left her son here in the Philippines, but when they got back here to get her son she went with her son at USEM,

if they are early at SLEC and there's no problem with their medical they will finish it in 1 day, but usually if you're late comers you'll finish the medical in 2 days :)

yes it is ok to include it since it is also an evidence of your relationship with him, just include some he will be needing that on his interview, i really don't know how it works there but here in PI remittance receipts are really helpful, i don't know but pre-screeners always ask for it, by the way when we sent ours we included copies of maybe 10 receipts :)

Yes he will send it to USCIS Dallas Lockbox. They will send it off to either California Service Center (CSC) or Vermont Service Center (VSC). Being he on the East Coast (Philadelphia), it will go to Vermont Service Center (VSC) for processing.

So our government is giving me grief.

I received NOA1 on Dec 12,2011 and still no answer from USCIS. Other people on VJ have received NOA2 so I called USCIS this morning since its just over 5 months. They said " CSC is 30 days behind and are proceccing I-129F from Nov 16, 2011". WHAT A BUNCH OF #######!

My question is what can I do to get some action from them since obviously they are processing I-129 from December?

Any suggestions???????

1. What are the specific laws that cover child custody for single moms in the Philippines?

If a child is born out of wedlock, the child is considered as illegitimate under the parental authority of the mother. You will find this in Article 176 of the Family Code of the Philippines. Child custody is one of the consequences of parental authority. Parental authority includes the right and duty of a parent to bring up a minor (below 18 years old). This authority cannot be renounced or transferred except in cases allowed by law (Article 210 of the Family Code).

Apart from the Family Code, a single mother may also read up on RA 8972, “The Solo Parents’ Welfare Act of 2000”) to find out her benefits as a single mom under Philippine law.

2. Are minors (or children under 18 years old) automatically under the custody of a mother? At what age can a child choose to live with either parent?

It depends. In the case of married couples, the father and the mother jointly exercise parental authority (and therefore, joint custody) of a child. However, in case of disagreement between the spouses, the father’s decision shall prevail unless there is a judicial order to the contrary (Art. 211, Family Code).

If the marriage is terminated by an annulment or declaration of nullity decree, there is a presumption in the Family Code as stated in Article 102 (6) and Article 129 (9) that any child below 7 years old is deemed to choose the mother, unless the court decides otherwise. In all cases, the court shall take into consideration the best interests of the child in making its decision.

For single mothers, they have sole parental authority over their child. The father of the child cannot be deprived of his parental rights to have access to the child in case he desires this. This can include temporary custody over the child.

We sent our I-129F at the end of April and just this Friday it had been returned because the payment we'd sent was for $350 instead of $340. (It costs >$10 to fix the problem. They spent $6 shipping the package back alone! Argh!)

It seems that some of the contents of the package have been removed, such as the cover letter, and some of the paperwork has been taken out of the plastic folder we sent the whole thing in, with other stuff left in the plastic folder. I don't yet know the exact list of things removed, but I plan on going through what they've sent back and cross-checking it with a copy of the cover letter we sent them.

But what exactly do we do next? Obviously we'll correct the payment to $340, but do we need to send a replacement cover letter or, if they've removed anything else such as photographs / passport photos, do we need to send new copies? Could it be as simple as removing the letter stating the reason for rejection which they sent back, correct the payment, and send the whole thing back? (Along with the package and rejection notice, they sent a green piece of paper which says "place this on top of your application when returning it so that it receives special attention" (paraphrased). When we do send it back, we'll be placing that on top.) If we do send a new cover letter, is it still fine to say "original submission for I-129F"? It's not technically an original submission. Does that matter at all? I would assume that their system of tracking applications will let them know immediately that it's a resubmission for an original submission. If that makes sense.

no you don't need to replace what they took from your packet, our petition was rejected before due to $10 over, all we do was we resent the packet with the right amount of check with the green piece of paper, they already reviewed our docs before they sent it back to us :) and they already have copies of our docs in their file you will notice some marks on the docs :)like numbers or something like that

Hello there? I'm just wondering if anybody encountered difficulties in accomplishing the DS-156. I know it has to be filled out online, but when I click 'Continue', I get a "Corrupted Content Error"... I've tried this in a computer cafe and still encounter a similar message... Even before I get to it, I receive a message saying that my browser does not meet the minimum required version (huh? but my Mozilla Firefox is updated!) or I do not have the minimum version of Adobe Acrobat installed (but mine's a 9, and they said they only require a 5!) And I can't believe that even the computer cafe at a big mall do not have those requirements! Oh, what am I to do? :help:

try the latest version of explorer or safari, if you have Netopia cafe there in your place try it there :)

I've been out of the states 12 years. He has no problem going back to Ghana but without a passport and being illegal here they will have to deport him before he was asylum in Spain and before that he was moving around north Africa hasn't been to Ghana around 5 yrs. I'm starting a new life again in the states so don't have a job there yet. I heard the petition costs 300$ is that true??

i'm not an expert with this topic. but i hear that retired people receiving pensions file their income tax yearly too. so, they have also 1040and have their 1099-R (like a w-2) and SSA-1099 for the social security benefit they receive.let's wait for those who have vast knowledge on this. but pretty sure with the 1099-R and SSA-1099 though. don't know with the disability and for that school allowance. maybe they give w-2 for that(school allowance)? it's a work, isn't it?

hello again VJers I'm here again :) there is something playing in my head now, now that my fiance is retired. when he filed the k1 petition he was earning more than enough, but now i don't know what will happen once we get our noa2 and what will happen on the interview, his retirement pay is little bit over $50k a year and 25% goes to his ex-wife, his disability pay will start on October and that's another over $50k a year, and he's going to start taking classes soon, my question is what are the financial supporting documents he needs to give me so that i can bring it once i have an interview date, he don't have a job for now he got out of active duty effective today, all he can show is he's getting money from his retirement pay and from school since they give him $2500 allowance per 5 to 6 weeks. i don't know if he can provide docs showing that he's going to receive disability pay starting October, now that we are reaching on 5 months bracket i am starting to feel so paranoid, i guess if he's still on active duty i won't feel like this. i already have his 2011 1040 and w2. but i know USEM will still check on his current income :( he has 2 dependents as of now i know he's above poverty guideline basing only on the money he's getting from retirement pay and school and few months from now from his disability pay, i just don't know what are the docs we will be needing as financial supporting documents. i hope someone can give me advice on what to do, when he filed the petition i never felt like this but now that we are reaching the 5 months bracket i become so paranoid :(

Wow I did not think I would get so many replies in one night.

Let me clarify a few things.

We will not be getting married in the US while she only has a b1/b2 visa.
We will file for the K1 while she is in the US however she will return to Thailand once it is done processing or her 6 months is up.
We will NOT get married in Thailand, we will only have a party with her family to celebrate our FUTURE wedding in the US.

Feb 2013 I fly back to Thailand to get married for her family then she flies back to the US with her K1 and we get married in the US for my family and to fulfill the K1 requirement.
that made the confusion, just say engagement party not get married it is a big difference if that so then you're still in good track, never get married in Thailand while she is in K1 visa. i am also thinking maybe it will be a problem if you go together in US, at the immigration they will ask who are you are you friends or gf/bf if they found out that you are going to file for k1 or something like that then she might get denied entering US using her b1/b2 visa. sorry for my english i am not that really good but i am trying my best to explain. i already have a friend that got denied entering US for almost the same situation, by the way good luck on your visa journey :)

Anyone here know if it is possible to have a religious non - legal wedding in the Philippines while waiting for the k1 visa? Situation is, me and my fiance are both catholic and would really prefer a religious wedding over a civil one however it would take 4mos seminar in US before we can apply for a catholic wedding and the k1 only allows for 30days stay :( I come from a very conservative Catholic family and they too would disapprove of a civil wedding over a religious one. My fiance, a wonderful person, would also want to honor and respect this tradition.

go to US get married there once all your docs are good go back to the Philippines and do the traditional wedding, or after getting married with in 90 days in US prepare for the traditional one. there is no such religious non-legal wedding in the Philippines, hmmmmm unless you're a muslim. muslim here in the Philippines specially in Mindanao when they get married there is no marriage license/certificate unless they register it, but in catholic church they will really register your wedding.

My fiance and I have been dating for almost 2 years. His ex wife and him had been separated more than two years and about 6 months before we started dating he officially filed for separation. He tried to divorce her a few times before we started dating and then when we got serious he tried again and his ex said she didn't want to waste her time going into court and she didn't care if she was divorced or not. So finally after more than 2 years without any of her help he was granted the divorce on May 31. I spoke to USCIS and they said it doesn't matter when the divorce went through as long as we had the proof he was divorced. I have everything ready to send in our application but I am waiting for the proof of divorce. My fiance will be receiving paperwork from the judge stating that they are divorced which has the location and date of divorce as well as my fiance's signature, his lawyer's signature and the judge's signature. Does that work as proof of divorce or do I have to wait for his actual certificate of divorce that should arrive in about 1 month? Also I heard some rumors that people have been denied because they haven't been dating for a long time before they got engaged. Is that true? I mean there were no requirements on dating when I read the requirements. I just want to make sure we have everything right and I am very nervous. Thank you guys in advance!

This is not true, please don't post if you don't know. US Consulate in Warsaw requires K-1 applicants to fill out DS-230 Part 1.



In Item 29 of that form you should to list ALL your children, no matter what their age and if they immigrate with you or not.
But if the children are not immigrating with you, do not list them in Items 31a or 31b, when asked who will accompany you to the US.

The form I-129F for K1 / part B ,line 13 says: list all children of your fiance(e).
The application DS-230 Part 1 line 19 says : List Names Dates and Places of Birth , and Adresses of ALL Children''
Well, my '' children'' are 29/30 years old. They are on their own, have own life, condos ect and not leaving country.
Shall we list them or not ? I appreciate your help and quick reply

ds-230 not for K1 it is for spousal so you don't need to fill up ds-230 and on i-129f you have choice either you put them or not, if her kids are below 21 then they can be her k2 and if you mention them on i-129f it will be easy for them to process the k2, if not it is ok also once your fiancee decide to get them there's another process for that.

don't be confused :) yes if your co-sponsor is not living with you then both of you needs to fill I-134 each, BUT basing here in my country if the co-sponsor is a relative and lives together, i mean the primary sponsor and the co-sponsor lives in one house then they need to fill out/up the forms i-1864 and i-1864a, the i-1864 is for the primary sponsor and i-1864a is for the co-sponsor, i just don't know if it is applied in your country too :)

Go to QC LCR. Bring the original birth certificate given to you by the midwife or hospital that assisted you in giving birth. Then ask the QC LCR to provide you a copy of transmittal report (proof that they already endorse the document to NSO). They will allow you to photocopy it. Then together with the 2 documents you have, go to NSO personally. There is a special place there for documents that need to expedite. Instead of waiting them to encode it to their system which will take 1-2 months, you will be the one who personally endorse it. Pay the BC fee, then go back on the date written on the receipts.

It also happen to me, after getting the raw documents, I went straight to NSO and personally endorse it. Ten days after, I already have it.

If this things will not work out in your case, go to NSO Office in EDZA. Just always bring the copy of BC given to you by your midwife or hospital.

addition to what they said if you have ever sent her money tell her to bring a copy of the money remittance, shhhhhh but she only take that out once they asked for it, i have over 500 friends(lol friends at usem fan page LOL) that is going tru the same process but 99 percent of them experienced either the CO or the pre-screener asked them about the money remittance receipt and if ever they ask for it she should just give few copies not a lot, it is a strong evidence that you care and willing to take care of her either here or in US, i know some will say NO to what I'm saying here but it is really different here in the Philippines and weird :) but i Love my country. i just notice they don't really look on the chat logs and even the phone calls they always focus on financial docs, pictures of you and with her family how many times you met and how long, about the FB, YM, ooVoo, skype and emails, 3 to 4 copies each month is good, as long as you establish that the communication never stops.
just imagine a friend of mine brought almost 5 inches think of paper with their conversations on it but they didn't even bother to look at it hahahah! but it is better to ready than to be sorry :)

is it good to print out my own passport photo, my fiance sent me email of his passport picture and im thinking to print it out like a normal picture will this be a problem and also what size should i print it in if this is ok??

me and my fiance has 20 years gap at first i didn't know he look so young for his age LOL, you won't really have problem in the interview as long as you provide enough proof of your genuine relationship with your fiance :)
