OK guys, as you all know from a post I made a few weeks ago, I was procrastinating about sending in my I-751. After much ado, and some 200 odd pages of photocopies, I have it ready to go...(dont panic, I did a duplicate copy, what Im sending is only about 110 pages,...lol). Always pays to have an exact copy of whats sent, so if any questions are asked, or it gets lost in the mail, you already have a head start,... :thumbs:

I have to thank Meauxna for some words of encouragement, and logical answers to probably some stupid questions, but non the less, Thanks MEAUXNA!!!

I have one last question, and my brain is fried,.....whats the best way to send this thing in, so I know it gets there. It was a just over two years ago I sent in my AOS and other stuff, but I honestly cant remember how I did it. Being overseas on a military base, we do have USPS facilities, though somewhat reduced in services offered. Can anyone refresh my memory as to how I send this thing,...so as I get a response that its been delivered to the PO Box at Laguna Niguel CA.

and one more question,...Can it be tracked at USCIS online, or no???

Removing Conditions on Residency General Discussionwithin 90 days of anniversary ?
You need to file within the 90 days before the second anniversary of your
conditional permanent residency (Green card) status date .

So if you get conditional residency in Spt 06, you need to think about filing sometime between Jue and Sept 2008, depending on the actual date in September you were approved. That date will dictate the earliest you can file in June 08.

For example,...
My conditional residency was approved On July 26 04, and the earliest possible date I could of lodged the I-751 was April 27. I lodged mine eventually on June 22.......

Find a date calculator online to actually determine the correct date. The USCIS will not accept any Removal of Conditions paperwork prior to that 90 days.

The Interviewing officer for me actually gave me a piece of paper with a date already worked out on it when I was approved, dont know if they do that with most approvals these days being without interview....

Good Luck with it all. I just completed mine and it only took 48 days start to finish to approve it through CSC. So dont trust the processing dates online. Also,..you cant actually check its progress online!!

I never got a re-entry permit,..never needed one, thats what Im telling you, but if you feel better getting one so be it. YES, you can apply to lift conditions while you are here, its exactly what I did, and I have been approved. Im going back next week to go into the USCIS office to hand in my photos, so they can simply issue the card for 10 yrs. You need to apply to lift conditions with your local office according to your residential address you maintain in the USA. I lodged my i-751, with the CSC because , we have a residential address in California, we used his parents address. You need to maintain some sort of residential address in the states for this purpose.
You just need to remember you can lodge all the paperwork here, but if they call you up for Biometrics, you will need to go back to the US. I have only ever had my fingerprints etc done once, and that was when i first loged my AOS back in 2004, they never requested them this time. I did send pics with the application, but they have requested I attend an office stateside at my earliest convenience to hand them in. I rang them, and said it would be a few months before I could do that, and they said thats fine, as long as I go in before the expiration of the one yr extension they gove you on your card after you apply to lift conditions.

Here's the link,..A Guide to Naturalization,...and scroll down to pages 20, and 21 of the actual document,..not the page number listed on the adobe reader,...there is a part that starts with" if you are,..the spouse of a U.S citizen who is one of the following,....find that and read it,..in fact probably easier to print the document out,..it clarifys that you dont need to maintain residence in the USA because you are stationed with your hubby....Happy reading,..

And I'll let you know how I go,..Im about to go to the states on Thursday for Xmas,..and my Greencard is expired, I have a copy of the orders showing he is one, stationed in Germany, a letter supporting it from his command, my passport and sofa card, and my mil ID card.

I have an appointment to fix my 10yr card while Im there, I have already been approved for it, and lodged all the paperwork from germany, but you already know that.

Easy answer,..NO. I simply took my greencard, and a copy of my husbands orders stating he is stationed in Germany, showing me on them stationed with him, everytime I travelled back to the States. That and the fact you will also have your sofa card also.

What yu and dan said is technically correct for non-military dependants but, we dont need to do this. I verified it with the USCIS in Frankfurt, before I travelled last time. We also are not subjected to the Residence rule, when it comes down to it, because we are covered under the oreders of the US Government for being out of the country. Rule of thumb is that when we reside overseas, and living in military accomodations, we live on US soil anyways. I sent you a link once before showing you the residence thing....I'll see if I can find it again for you.

ok,...as you all know, I had my 10yr greencard approved in August. I came home to California for Christmas, and had my Infopass appt yesterday to finalise my I-751, albeit nearly 5 months later. All went smoothly,I arrived 10 minutes prior to appt time, got in, got out, all in 30 minutes,..Just had to hand over 3 passport style pics, sign a form, and have an index finger print taken. They did ask though if I had received a letter for Biometrics, and said No, I have not had a request for any more fingerprints since the day I had them done for the AOS. Apparently I was the second one yesterday to have a letter like like, with no biometrics request. I mentioned I was a military dependant, and stationed in Germany, and they said, maybe thats why...I have the stamp in my passort, and my new 10yr Greencard should only be a matter of weeks away. Over all, a very friendly experience in Fresno, CA.

ohhhhhhhh, Just to add, No biometrics, or fingerprints were requested. I had those done the day we lodged the AOS application as a walk-in in Los Angeles, in Feb 2004. (Special circumstances for that- see timeline).

Thanks Meauxna for the info, will certainly look it up....Would be handy to know, as with hubby nearly ready to deploy again, We were kinda hoping to avoid a "rush" trip home just to deal with this....that and $$ is certainly a factor too at the moment.
But, if it comes down to it, and I have to go, we'll make a family trip of it during his pre-deployment leave, and visit family too and leave the road trip to Italy that was planned for pre-deployment, till he gets home again,..and have it as a farewell Europe trip,..as not long after he returns home, we finally return stateside!!

And to think, all that procrastination initially, and now, it's finished,..

ok,...without further ado,...

Let me introduce you to the USA's latest Lawful Permanent Resident!!!!!

ME,...... :dance: :dance:

Got a letter from the USCIS today, which was a huge surprise.

So heres the time line to refresh:

Sent I-751 from Germany on June 22, 2006.
Received by USCIS June 28 2006.
Notice I-797c generated June 29, 2006, according to date on notice.
Notice I-797c sent from Laguna Niguel July 17 2006.
Received I-797c in Germany July 25, 2006.

And finally received in Germany a "Notice of Removal of Conditional Basis of Lawful Permanent Resident" August 23, 2006, with a decision notice date of 15 August 2006. It was sent from Laguna Niguel same day 15 August.

Now,....all I have to do is get a flight home to the states for a week or two. Because the only downer of it all, is I have to appear in person at the USCIS office in Fresno, CA to present three passport photos again (even after I sent them in with the application), and my passport to have it endorsed, until, my new 10YR green card arrives....

Wondering about Fresno though, cause all my other stuff has been done through Los Angeles Office.

SO much for the anticipated 330days on my I-797c......GO CSC GO!!

So in total, it took,.....48 DAYS, (1 month 18 days) from the day they received it to the approval date on the Notice of Removal letter.

OR,...

62 DAYS from the day I sent it, to today, when I received the notice. Have I set a new record or what??

Noted to add:...When I attended Fresno office on December 18,..they did ask me if I received a letter to have Biometrics done, I said no, that I was expecting one, but figured considering my prints are on file in the US Mil system, and were therefore not required....She said no, I shoulda got a letter and I was the second one to not have them requested that day,..she proceeded to take one solitary fongerprint, and that was that, I paid no extra bio fee, and only ever did that once at Aos stage, mind you, I had old style manual printing done cause the electronic scanning would not work on my prints,..lol..

Special Instructions: the $70 biometric fee is included in the $275 fee listed


I meant to say that on the form it states the the fee is combined,...ie...205 for the application, and 70 for the biometrics. no seperate bio fee anymore. And no sending in of pics anymore,....

Not that that made a diffrence anyways...I sent in pics( before the change to the form) and they sent me an approval stating I still had to attend an office Stateside to submit pics,..which i did On the 18th Dec, when I came home for Christmas...

Just a continuing update,..

After changing my address, about a week later, I got a Receipt Notice in the mail,..An I-181??..####### is this I'm thinking,...A creation of record of lawful permanent residence,.....I look at it and it has a receipt number on it,..THE SAME RECEIPT NUMBER that was on my NOA for my 2 year Green card,..Double #######!!!... So, I sit and wait, wait wait, on my 10yr Green card to arrive in the mail,..

So , today, I rang the Customer Service Line, and once again, theyre as helpful as they can be, and then say, "we'll lodge a service request to find out whats going on",..So I rattle off the address, and Ohhhhhh, Ma'am, I cant get that address to take, i'll transfer you to an immigration officer,..and before I could say Ok, I was on hold.

Again, Im thinking, What?...I just got a letter from you, and now I am reciting the exact same address you just sent the last receipt notice too, and it wont take,..C'mon now!!

Ok,..Officer M. gets on the line,..I go through the whole story from original I-751 lodgement to now, and then ask, what is this notice they have sent,..."I think that was sent in error Ma'am,..It was sent the same day, an Address change was filed with us",...Ohhhhhhhhhh Myyyyyyyyyyyyyyy Goodnessssss, Im thinking to myself,...She then goes on to tell me, that my new Welcome to America letter, was sent and returned to them, and so was my 10yr Green card, on FEB 12th..FEB 12th!!!

So, we review the address, and somewhere in between, the First incorrect NOA, that had nothing to do with my current case, that made it to me, and the welcome letter, and green card mailing, my address had been altered,..WHAT??????????

Ok,..So we go through the procedure again,...Address correct, Check! Notify CSC to resend to me the returned card sitting in my file, Check! Double check, Address, Check!

Ok,..So I went from 48days, from Filing to Approval of I-751,..that was sweet,....Now, if I could just get my hands on the elusive piece of Plastic!

Oh, and the thought of an N-400 in a few months from now,...Scary!!

Ok, as most of you know, I sent my I-751 in to CSC in Late June 2006. I was approved mid-August 2006. Received the approval notice also mid-August stating I needed to appear at Fresno office at my earliest convenience, to hand in 3 passport pics, have a fingerprint taken for my new card, and have my passport stamped. I rang them, explained that I lived in Germany due to military orders, and they said, as long as you make it, within the year that we extended you for, your all good. N.B ( I did originally send in pics with my application, but they wanted them again, *sigh*).

So, at Christmas time, I went home to California, had an infopass appt with Fresno office for Dec 18, handed in my pics, had my one finger print taken for the actual card, passport stamped and left. Was told that my card would be 6-8 weeks. While I was there I also advised them of a change of mailing address, because the military decided in their wisdom, to move our individual unit mailboxes, whilst our spouses are deployed. The officer also gave me an AR-11 to complete, so I did that also.

Today, I decided to ring the Customer Service line. First operator I spoke to said, I cannot access any personal information in regards to your application because your case is approved, so I'll have to transfer you to an officer who may be able to assist you. So, I was transferred to an immigration officer, Officer Simons. What a lovely lady she was. I explained my whole I-751, from start to finish, and explained what I needed to do, which was confirm my mailing address. She told me, that it was yet to be updated, but would do it for me right now. After that, she advise me as a courtesy, that my file had been received back by CSC on January 13 from Fresno, according to notations online. She said, she could see that my card had not yet been issued and that my 10yr G/card should not be too far away from being issued, now that CSC have the file back.

I joked and said, well, at the end of the year, I will have to change this again, once we return stateside. She said, its no big deal, now that your case is completed, you need only send in your AR-11, which goes to a central processing area, for general updates on all files, it doies not update active or pending cases. I only need ring them, if I have an actual case pending or active, to update the actual active case file at that time.

Another successful experience with USCIS.....

I suggest you read the I-751.First page under the section biometrics,..

It actually states there not to send photos anymore, becasue they take them , along with fingerprints etc.


2. Biometric Services.
Applicants will now have their photograph, fingerprints andsignature taken by USCIS. When you file Form I-751, USCIS will notify you in writing of the date, time and location whereyou must go for the required biometric services. Failure to appear for the biometric services may result in a denial of your application.NOTE: Because USCIS is now taking photographs of applicants, you no longer need to submit two passport-stylephotos with your petition.

Also,..take the time to read the USCIS website. It often has news releases and change of policy etc...which is released as a news release under the press room link, on their page.

Include acopy of the U.S. Government orders assigning you and yourspouse abroad.


What Is the Fee?

The fee for this petition is $205.00.

The fee for biometric services is $70.00.



You may submit one check or money order for both thepetition and biometric services, for a total of $275.00.NOTE: Each conditional resident dependent, eligible to be included on the principal applicant's Form I-751 and listed under Part 5 of Form I-751, is required to submit an additional biometric services fee of $70, including dependents residing overseas pursuant to military or government orders, regardless of age.

YOU do need to file with a centre stateside. I live in Germany too because my hubby is on Military orders, and did all my Removal paperwork from here. I used my in-laws address and my "home of record" in the states is the closest service centre to that address.
Yes, if you get called for interview, you will need to travel back to the states. When you and hubby originally filed paperwork, a US address would of had to of been listed somewhere on the paperwork, even if he was military overseas...

Future Expiration Dates
Future expiration dates may appear on the employment authorization documents of aliens, including, among others, permanent residents and refugees. USCIS includes expiration dates even on documents issued to aliens with permanent work authorization. The existence of a future expiration date:
1. Does not preclude continuous employment authorization;
2. Does not mean that subsequent employment authorization will not be granted; and
3. Should not be considered in determining whether the alien is qualified for a particular position.
Considering a future employment authorization expiration date in determining whether an alien is qualified for a particular job may constitute employment discrimination. (See Part Four.) However, as described below, you may need to reverify the employee’s eligibility to work upon the expiration of certain List A or List C documents.
Reverifying Employment Authorization for Current Employees
When an employee’s work authorization expires, you must reverify his or her employment eligibility. You may use Section 3 of the Form I-9, or, if Section 3 has already been used for a previous reverification or update, use a new Form I-9. If you use a new form, you should write the employee’s name in Section 1, complete Section 3, and retain the new form with the original. The employee must present a document that shows either an extension of the employee’s initial employment authorization or new work authorization. If the employee cannot provide you with proof of current work authorization (e.g. any document from List A or List C, including an unrestricted Social Security card), you cannot continue to employ that person.NOTE: List B identity documents, such as a driver’s license, should not be reverified when they expire.
To maintain continuous employment eligibility, an employee with temporary work authorization should apply for new work authorization at least 90 days before the current expiration date. If USCIS fails to adjudicate the application for employment authorization within 90 days, then the employee will be authorized for employment on Form I-766 for a period not to exceed 240 days.
NOTE: You must reverify an employee’s employment eligibility on the Form I-9 not later than the date the employee’s work authorization expires.
Reverifying or Updating Employment Authorization for Rehired Employees
When you rehire an employee, you must ensure that he or she is still authorized to work. You may do this by completing a new Form I-9 or you may reverify or update the original form by completing Section 3.
If you rehire an employee who has previously completed a Form I-9, you may reverify on the employee’s original Form I-9 (or on a new Form I-9 if Section 3 of the original has already been used) if:
1. You rehire the employee within three years of the initial date of hire; and
2. The employee’s previous grant of work authorization has expired, but he or she is currently eligible to work on a different basis or under a new grant of work authorization than when the original Form I-9 was completed.
To reverify, you must:
1. Record the date of rehire;
2. Record the document title, number and expiration date (if any) of any document(s) presented;
3. Sign and date Section 3; and
4. If you are reverifying on a new Form I-9, write the employee’s name in Section 1.
If you rehire an employee who has previously completed a Form I-9, you may update on the employee’s original Form I-9 or on a new Form I-9 if:
1. You rehire the employee within three years of the initial date of hire; and
2. The employee is still eligible to work on the same basis as when the original Form I-9 was completed.

Employers always have the option of completing Sections 1 and 2 of a new Form I-9 instead of completing Section 3 when rehiring employees.


So, as long as his social security card doesnt have the restriction on it,..he can use that to reverify.

This is straight from the Employers manual issued buy USCIS to Employers. Last updated 11/1/2007. Document M-274




Q. My employee's DHS-issued employment authorization document expired and the employee now wants to show me a Social Security card. Do I need to see a current DHS document? A. No. During both initial verification and reverification, an employee must be allowed to choose what documentation to present from the Form I-9 lists of acceptable documents. If an employee presents an unrestricted Social Security card upon reverification, the employee does not also need to present a current DHS document. However, if an employee presents a “restricted” Social Security card upon reverification, the employer must reject the restricted Social Security card, since it is not an acceptable Form I-9 document and ask the employee to choose different documentation from List A or List C of the Form I-9. A restricted Social Security card may state “not valid for employment” or “valid for work only with DHS authorization.”


This basically says he does not need to provide a current DHS document, upon reverification of I-9 documents.

List A (Documents that establish both identity and employment eligibility)

United States Passport
Permanent Resident Card or Alien Registration Receipt Card (I-551)
Temporary Resident Card (I-688)
Employment Authorization Document (I-766, I-688B, or I-688A)
Foreign Passport with temporary I-551 stamp
For aliens authorized to work only for a specific employer, foreign passport with Form I-94 authorizing employment with this employer

List B (Documents that establish identity only)Driver's license issued by a state or outlying possession
ID card issued by a state or outlying possession
Native American tribal document
Canadian driver's license or ID card with a photograph (for Canadian aliens authorized to work only for a specific employer)
School ID card with a photography
Voter's registration card
Military card or draft record
Miltary dependent's ID Card

List C (Documents that establish employment eligibility only)

Social Security account number card without employment restrictions
Original or certified copy of a birth certificate with an official seal issued by a state or local government agency
Certification of Birth Abroad

Form I-94 authorizing employment with this employer (for aliens authorized to work only for a specific employer)

"Employers must update or reverify certain ID documents at or prior to their expiration date. This does not apply to US Passports, which can be used even if expired, nor to already presented and accepted non-expired Permanent Resident Cards when they reach their expiration date, nor to any List B documents, e.g. state driver's licenses and state ID's. The USCIS website, in the Employer section, Employer Bulletins, lists the limited requirements and allowed instances for reverification."


This has been mentioned before on many a post, I just cant find any at the moment to back up that statement,..

Hold up,..just found this on the USCIS website,.

"GREEN CARDS”
The terms Resident Alien Card, Permanent Resident Card, Alien Registration Receipt Card, and Form I-551 all refer to documentation issued to an alien who has been granted permanent residence in the U.S.. Once granted, this status is permanent. However, the document that an alien carries as proof of this status may expire. Starting with the “pink” version of the Resident Alien Card (the “white” version does not bear an expiration date), and including the new technology Permanent Resident Cards, these documents are valid for either two years (conditional residents) or ten years (permanent residents). When these cards expire, the alien cardholders must obtain new cards. An expired card cannot be used to satisfy Form I-9 requirements for new employment. Expiration dates do not affect current employment, since employers are neither required nor permitted to re-verify the employment authorization of aliens who have presented one of these cards to satisfy I-9 requirements (this is true for conditional residents as well as permanent residents). Note: Even if unexpired, “green cards” must appear genuine and establish identity of the cardholder.

I had those electronic scanning prints done back in 2004, when we did AOS. They had too take mine 3 times, all on the same day though. I never did fingerprints again when we Lifted conditions. I just had to fly back from Germany to California to attend Fresno offce at the time, too have just one index finger done the old fashined way, and sign a signature card for the new greencard. Thats before the rules changed for when you lived overseas..now, here you can get them done at the overseas UCIS office..

But the point is,..I only ever had the electronic scanning done once.

dont know the weight, but it was 110 pages,...
But being military and no utility bills, or rental agreements and the like, I had to make up for proof in lots of other ways,..therfore the excess,..
