K-1 Fiance(e) Visa Process & ProceduresTattoos on medical
My now hubby and I got tattoos matching 2 weeks after we first met, and before we were engaged. That kinda sealed the deal for me, that was back in May 2002. Nothing was ever said at my medical.

K-1 Fiance(e) Visa Process & ProceduresLetter from his commander? For I-129F packet
You will need a letter from his command, when it comes to proving his income for the financial support side of things. Even though Military only need to be at the 100% poverty level requirement, not 125% like most others, He will still need a letter to confirm his employment and state his yearly income, to support the LES ( leave and earnings statement ).

I know , my hubby was asked to include this, when making initial enquiries, for the K1 visa. Some people have chosen not to send this, but have been asked to provide it later on. The choice is yours!

K-1 Fiance(e) Visa Process & ProceduresCSC processing time :(

QUOTE(ding @ Jan 14 2007, 03:05 PM)
I read that Nebraska send their area's I-129F's to CSC. If so, maybe that is adding more and more time.

TSC and NSC have been sending their petitions to CSC for a long time now. It adds about 3-5 days to the process. Considering that average processing time is less than 3 months, it's not all that long of a process on the USCIS end at all. If you wanted to petition for a brother, for example, it takes more than ten years. Perspective . . .

I agree with everything both the above posters have stated.

I understand your frustration. We all at some stage have played a waiting game, some much longer than others. It can be difficult, hard, and often frustrating. You can use this time to your advantage. As your relationship, is still a relatively new one according to your timeline, this wating time allows you to continue to get to know your Fiance so much better, all you have is time, plenty of time to talk, and learn absolutely everything you can from each other. I knew and learnt more about my current husband, through daily phone conversations, and internet conversations, and cards and letters, and visits, albeit, long distance over a period of nearly 2 1/2 years, than I knew about my former husband through years of marriage. My delays were a combination of USCIS and child custody issues. Ask any person here in that situation,.. about the time consuming delays because of kids, and inconsistent ex spouses. Your case is running extremely smoothly from what your timeline reads. And be thankful, that once your fiances application is approved and with yopu, that you will no longer have to endure seperation. There are plenty of others in here, including myself, who are military spouses, and I for one, even though, we have been marrried 3 years in few weeks, am experiencing more seperation as he is currently on his second 12mth tour of Iraq.

Maybe this snippet from the USCIS today newsletter, along with what I said above will make you see things in perspective.

Backlog Elimination. USCIS has eliminated case backlogs of applications for immigration services and benefits through a combination of increased employee productivity and reengineered processes and automated services. The backlog was reduced from 3.8 million cases in Januray 2004 to less than 10,000 at the end of September 2006.

.

I think your lucky to not be a part of the 3.8 million,....lol

I am wishing you a quick resolve, and much happiness.

K-1 Fiance(e) Visa Process & ProceduresQuestion
I really suggest you take the time to research the questions you are asking here, on the USCIS.gov website.

A link directly to what you may be wanting to know is here,...USCIS.

I have cut and paste an excerpt from this link,...

Please note: Your fiancé(e) may enter the United States only one time with a fiancé(e) visa. If your fiancé(e) leaves the country before you are married, your fiancé(e) may not be allowed back into the United States without a new visa. (Please see How Can I Get a Travel Document? for additional travel information if your fiancé(e) will apply to become a legal permanent resident after you are married.)

This rule applies after marriage too, you MUSt apply for ADVANCE PAROLE, for your wife/husband, to be able to leave the USA, before AOS is completed....

K-1 Fiance(e) Visa Process & Procedures45 days delay, because of wrong spelling?
You need to realise,..

The people you speak to when you ring that national number, are simply call centre representatives. They have a very basic database from which they draw information from, and are limited in the way they can help you.

When they draw up a service request,..that request is sent through the computer system to the area relevant to your initial enquiry. Some areas requests are obviously going to have longer delays than others due to the type of enquiry. I understand your frustration with the standard 45 day spiel, but that is usually worst case scenario. Also, that centre is a NATION wide facility, and therefore take enquiries and requests from all over the USA, and worldwide in some cases, like myself. so they takes thousands of enquiries a day.

These people cannot even change an address a lot of the time, they are not allowed to. Every time I have had to ring them, my inquiry has been beyond their capability, and they have offered to transfer me to an Immigration officer, who has direct access to the USCIS, and DHS database, or put in a service request. I have opted for the earlier of the two, have spoken to an immigration officer, and had my problem in most cases rectified, because they have access, and are allowed to do more with your case file.

Immigration is a very frustrating process and I truly feel for you, but hopefully, that clarifies things a little for you.

And, always get a name of someone you speak to,....it often helps when recalling...sometimes they say their name and identifying number so quick, Idont hear it,..so I always ask them to repeat it, before I start my inquiry. This helped me recently, after being put through to an immigration officer, that officer, was a little stumped as to how to process what I was requesting...and I said I spoke to Officer such and such last time, if thats any help. She said, thank you ma'am, that officer is here now, just let me confer with her and I'll be right back. My problem was rectified, and I was happy...

Just food for thought,..

Good Luck,..

K-1 Fiance(e) Visa Process & ProceduresMarine in Japan
Jim,...

You can spend your entire career in the Army and never leave the USA.

I dont know what Army your talking about. But my Husband has been in for 14 years,..and had to commit from the get go, to at least one term of service overseas, or overseas deployment. Best you keep, your Military knowledge, or advice to that of what you know best, The USMC.

And for the record,..my Hubby has deployed twice to Iraq, and twice to Bosnia, and also served twice in Germany, as an MP. he just recently indefinately re-enlisted to retire from the Army,...and he does give a damn about his soldiers, thats the main reason he re-upped. He goes out on convoys daily, with his life on the line every single day.

it comes down to commitment and who you are.

That is the same for any branch of the Military, Not just the Marine Corp. This is why people get so damn riled up. It seems like every Marine, has the opinion, that the Marine Corp, is the Best and ONLY, and nothing else comes close. This Once a Marine, always a Marine, may be very much true,..but the attitude you display, is not commitment to your core, nor simply trying to teach this young man a lesson (which is not your job regardless), its disrespect to all other corps. Everybody has a "job" to do, or a commitment to fulfil, if thats more your wording of choice, no one, irrespective of title, job description or core or branch of service, is less important than the other. If you think otherwise, your judgement is clouded.

And times change...what once was YOUR marine Corp, may very well be different thing today, in this politically correct world. So what if the word contract was used,..Shiatttttttttt, maybe it was a poor choice of word, but who cares,..Really??

US Citizenship General DiscussionNew N-400 form& K2 question

Hello :)

I am curious about the new N-400 form (Rev. 11-23-10) & it's implications for our daughter. My wife & her daughter arrived in late 2006 on a K1-K2 visa.
We immediately married & adjusted status around Feb. of 2007. My wife & daughter both have their 10 year green cards, and now it is
time for my wife to naturalize.

If I send in a check for both of their biometrics fees ($170.00) & one check for the N-400 filing fee ($595.00), will that be sufficient to
allow our daughter (13 years old) to naturalize along with her mother on this one N-400 form?

Or, will the daughter have to wait 1-2 years until she can apply for the citizenship certificate?

I seem to remember that the previous versions of the form had a checkbox that would specifically state if you desired proper aged children to naturalize along with the parent......

Thanks :)

Nope,..no option for the kids on the paperwork, except to state their names, dates of birth,..and whether the child is with you or not...on the form you put "with me " as she lives with you.

I started mine in September, with previous form, and no spot to indicate for Children to naturalize along with the parent, simply because children under 18 automatically acquire it. I just have to provide my natz certificate, and marriage cert, and thier birth certs, to get their passports...oh and kids under 17 usually require approval from biological other parent by authorizing and acknowledging issuance of US passport. My kids are 17, but i am getting a letter from their Bio dad regardless, so we do not run into any problems.

I just noticed your daughter is 13,...after your wife naturalizes, she will have to get approval from bio dad for issuance of passport to the child. If father is not contactable, or can't be found, i think it says on passport site, a notorized letter stating that must be submitted.

US passport once issued is a form of proof of US citizenship fro the child. If you want a certificate for your daughter, you will have to submitt a N600 after mothers Natz is completed.

I should add, we have now finished, and I had my ceremony Thursday .

No fees involved for kids under 18 at all. they do not have to renounce anything, and mine get to hang onto their greencards for a souvenir...lol

US Citizenship General Discussionleaving the country (N-400 pending)
It wont hurt it,...

Have to ask though, have you had your interview yet?. Because if you haven't, they are are going to ask you everything off of the application you put in anyways, they even confirm overseas travel that you listed. That is your opportunity to volunteer that you also left for a week after paperwork was submitted. they will just most likely ask to see the itinerary, and passport as confirmation of what you said.

If you have had your interview, and are awaiting oath,..the N445 asks the question anyways. You have to complete it the day of oath and are asked to bring any supporting documents of you have travalled since your interview and oath. When you get checked in, they go through the questions on the back of the form with you,..and again, thats when you will provide proof of travel.

I know someone right now, who has left the US for Christmas, and gets back a week before their interview. It wont be a problem, as long as your honest about your travel, the reasons for travel etc.

Bob,

I appreciate and totally get your reply, I know your comments can be harsh at times, and they are good for a dose of reality,..it just seemed like you were kicking a man when he was down, even though I fully know that was not your intention...no harm no foul....;)

And Nick,..again...I totally get what your saying about the cost involved for a second rate piece of paper. But, I choose to live my life not worrying about the what-if's ya know? what if I leave it, and spill a cup of coffee on it, or my dog chews it etc etc.

Thats not meant to be a derogatory statement,...I just dont go around preparing myself, by trying to predict the what-if's, that's just way to much unnecessary stress.. I mean , we have savings etc,..but we don't have it for a just in case something goes wrong moment per se...

We are a spontaneous afmily, that live in the here and now pretty much.

I know Danny could of been more careful, but I am sure he was not expecting his two year old to specifically target a certificate, he had forgotten he had left somewhere , you know what I mean? His lil one, has probably done stuff like that before, on the odd bill, or empty envelope. The kid had no idea what that paper was.

With that said,....I hope you gentlemen have a lovely Christmas with your families...x.x

US Citizenship General DiscussionHelp!! Certificate

No, the certificate shouldn't have been on your desk. It also shouldn't have been in the safe. You should have dropped it off on December 17 or 18, or 19 at the post office when applying for a US passport. After you have done that, you wouldn't need to show the certificate again, ever.

Well, at this point, you may try to apply for a passport with it. If you get lucky, they'll accept it and that will solve your problem. If they don't try another passport agency first. if they both deny it, you will have to order a replacement.

Bob,

I know you mean well, but really was that all necessary.

He already established in his own comments , it was his own fault. Sometimes, things, like family ( particularly kids ) get in the way of what we SHOULD do. He wasn't complaining, just asking for advice,..not a personal berating.

Maybe he does not have the money right now to apply for a passport, I know I sure as the dickens don't! And I have to get 3 of them,..mine and my two daughters.
My certificate, is still in the porta file I took with me, which I conveniently tossed on the floor in the corner of my bedroom next to my bedside table, not the best place by far. But I will get around to putting it away. Now, I had better go move that cup of coffee from my bedside table, just in case....

DANNY, just call the passports office and ask if it will affect you getting a passport issued. If they say no, its fine you'll be sweet, and won't of wasted more money on something that really only needs to be used once.

Hubby's natz oath was today in Nashville. It was interesting and took longer than I thought it would - mainly getting everyone checked in. 60 folks from 23 different countries (hubby the only UKer). Got there at 7:30, left around 9:45 all told. Got piccys with the judge and all that. The natz certificate is pretty cool. Probably need to get a safety deposit box now to put it in, eh?

Congrats to everyone - hope those still waiting have short waits. :)

US Citizenship General DiscussionN 400 September 2010 applications
Ok, well it's been nearly a week so I should probably update you all on my oath experience. Our house to Los Angeles Convention Centre is 2hr 40min drive on a good day, but we were heading into L.A morning peak hour traffic for my scheduled time of 0815. So, in our wisdom, we decided to leave at 0330, so we could stop for breakfast on the way, knowing what traffic would be like further down the road.

We finally left base at 0340, and drove 35 minutes till we got to Denny's. Sat down, ordered, ate, bathroom breaked, and then got on the road again at roughly 0500. All was good until we heard an update on the radio that there was an accident on a highway we were meant to get on from the 210, so hubby, being from So Cal knew exactly where to go to bypass that mess. But it seemed like several others had the same idea, and the trip from there on in was a little slower than we would of liked. We eventually got to the Convention Centre at 0800.

The signage to the Convention Centre was awesome, and so was the signage to get to the Naturalization. Naturalization signs with arrows were every 100 metres or so along the road around the Staples Centre/ Convention Centre area along with people also directing the traffic, and asking all cars if that's where you were headed. We paid $12 and parked right next door and walked inside.

Applicants went one way, and family went the other. After walking in a line that seemed like forever, I finally made it inside. We walked straight through the Centre of the seating area to the far side of the hall where 36 lines with numbers had formed. We were told to pick the shortest line and wait to be checked in. I was standing in line, and we were all asked to have the N445 and green card ready. When I was looking around, I noticed everyone else had white coloured letters and mine was green, and I seriously mean I saw no one else with a green form. I got to the front of the line, and the guy took one look at my form and looked confused, then the guy next to him asked what was wrong. He said he didn't know how to process me. By this stage I was WTH? The other guy said it's all good, do it as normal then send her to table 36. Once again, I was silently thinking to myself WTH. So he asked me, if I had been arrested in the prior two weeks (the day of my interview till that day), and I said no. He asked for my green card, threw it in a bucket, scribbled a big red OK, across my form and said got to table 36.

I got to table 36, and they said have you been checked in already, and I said yes. He said, ok, just come back to this table when you have finished to collect your certificate. I said thank you, and then walked to the seating area as directed. We collected an envelope, with a letter from the President inside, and were asked to take seats, but to please have our letters still out. As I walked past the front row I noticed that they all had GREEN letters too. And they were military, military spouses and family members. So I again showed my letter and was directed to about 15 rows back along with the 2600 other applicants there. A small crowd in comparison to the usual 6000 they have. Seeing the military and green letters at the front continued to puzzle me, as my family was at the back of this big hall, and these people were all at the front. I just took my seat, and texted my husband to kill time. They then started asking for any military, in or out of uniform to report to the front of the hall. I just sat, as they were not specific about who should be there.

At 9am, the ceremony started. A USCIS representative took the stand, said a few words, and then introduced the judge. He went through his speech which we could barely hear, then were asked to stand, raise our right hands, so we could repeat what he said. You could tell when we could, and could not hear/understand him. When we all spoke loud, it was because we could hear what he said, when we all spoke soft, it was because we couldn't hear him at all. We all managed to stumble through it. Then he said congratulations, you are now all US citizens. Another USCIS person then stood up and said we would like to recognize the military here today, and read out the names and countries of birth of all the service members in uniform and asked them to step forward and be recognised. The whole hall applauded, and I felt a great sense of pride at that point. We then watched a video presentation from the President, plus another video. A lady then sang the star spangled banner and that was it.

They then said thank you, and were told to wait further instructions. They then announced all military, their families, and spouses that were naturalized to go collect their certificates and the rest of the hall would then be called in seating line order. I watched all the others at the front of the hall get up and head towards table 36, so I quietly excuse myself from the people next to me, and snuck out the side, and headed to table 36 also. I got my certificate, check it over and then left.

They had asked all family members to leave prior to us; I could see why as I walked out the door and down the stairs into a sea of people all clapping. My husband had texted me to say they were on the right hand side. It was awesome to hear the continual clapping as people continued to stream down the stairs. I was hugged by my husband, daughters and MIL, we all screamed WOO HOO, and left.

I came to find out, that I should have been at the front of the hall, along with my family. Apparently, that was a privilege afforded to military, spouses and military family, along with the collection of certificates at a special table for military only. That would have been nice, as my family said they could not hear anything from where they were at. Oh well, It's done now.

Thanks Jodes <3

Really about time! They took forever to send that darn letter! lol And it's perfect timing, since Pedro is going to Germany for Christmas and returns on the 12th :)

That is great timing! I know you were all worried about it conflicting with the travel plans,..
I know I am so relieved to be done with USCIS now...I am sure pedro will feel the same once its all done.

Just have to apply for passports for me and the girls, and update with the SSA.,..oh and the DMV apparently....

Thank you Jodee. Yeah our list is filling up good.

It's Danny's oath taking today. Congratulations in advance Danny!

[/quote]

Yeah, I hope he has some good news to report. It was my oath day too, But I am beat. I just wanted to check in and say everything went smoothly, will have a full rundown tomorrow, when my mind is clearer, as I have been awake since 2am,...we had a three hour drive which ended up being closer to 3.5, with Los Angeles traffic, plus we stopped for breakfast. Made it there after leaving at 0330 by 0750, for a time of 0815 on appt letter.

Updating my timeline,..will give full rundown tomorrow
Will say it does feel kind of weird with no green card in the wallet....:(

Ok, so I got the "official" N445 notice of oath in the mail today, for my ceremony on Thursday....Starting to get nervous, and also feeling a little melancholy...is that normal?

Congrats Danny and Jodee. Whow Jodee a special phone call... Lucky you! And a call with good news too. Was her number blocked? Good thing u got the confirmed email cuz don't u need to take the oath letter with you? A month from tomorrow will be my interview.

Funny thing, is that on Monday, I called the hotline, and explained what the IO had said to me about interview dates, the gentleman said to me, he could see I was in line to be scheduled but had no date for me, and had no real answer for me. I was asking more about the ceremony on base for today, as I would of needed to know, so hubby could get the time off to attend. he asked me my IO's name, then he said, here is her direct number. I was in shock! But I didn't want to call. I did not want to push it you know. She was
doing her best, and I was afraid that if I called and asked, I would be scheduled for Jan or Feb, when hubby is away on course, or March, or April even,..just for being impatient.

So i just left it, and then while I was upstairs yesterday, my cell phone rang, and I couldnt answer it, as I was right in the middle of wrapping a christmas present....and when I checked my voicemail, it was the IO, and she gave me her number again to call her. But yes, when I checked the call log, it was a blocked number.

She told me she hadn't forgotten but it was not possible to get me into the ceremony on base, but had scheduled me for the 16th in L.A. She wanted to give me enough time to get organized, on the off chance my letter did not turn up. She said if I did not receive it by mail Tuesday, to call her back,..and she would email me something to print out, confirming my attendance, and what I needed to take. She said if I didnt receive the letter, the email would suffice to get in, as I would be on the list.

She was even nice enough to send me an email yesterday after our call to confirm the phone call....

So there you have it!

Woooo Hooo, I feel special! I just got a phone call from my Interviewing IO. I have been scheduled for my oath ceremony on 16th December in Los Angeles. She just wanted to let me know in case I don't get my letter by Next Tuesday, so she could send me an email with all the required information. She did also just send me a email, to confirm our phone conversation.....OMG!

My N400 journey is 2.5 months from start to finish.

Hey guys!

I had my interview today at San Diego field office. Everything went great, questions were easy and the interviewer was nice enough. I was told to wait for the Oath taking appointment letter in the mail. The interview was over in less than 20 mins or maybe even less than 15. I wish everybody best of luck!! I'm so glad to be almost done with long and tedious journey!! Wahoooo!!

Great to hear manohara, our journeys are just about done!

Ok,..suppose it's my turn. I had to come home and nap, was soooooooo tired, had been up since 4:30am, only because I coudn't get my mind to relax.
We left at 0830, and stopped for McDonalds on the way. San Bernardino is a 1.5 hour drive, and close to 2 hours with traffic. We got there right on 10.30, and parked next to the building, paid parking but ehh, easier than parking anywhere else. We through security, and up to the second floor. I put my letter in the basket at 1045, and went and took a seat with my hubby and the roomful of people, about 100 others in the room. There were other military there too from hubbys base, he could tell by the patches they were wearing. Right on 11am, after sitting and watching for 15 minutes at a lot of others get called in, and secretly hoping I was not getting that IO, or that one or that one..(.the demeanors on these people were really off), a nice lady with blonde curly hair called me in to her office. She immediately made me feel at ease, asking how the trip from base was etc. etc. She asked me to take a seat after nearly walking right past her office, she laughed and was like,...oh...I always do that, I think it's further down the hall than it really is.

So,..we sat down,..and she said, let's get these pesky questions out of the way, then we can focus on the other stuff. So she asked me the questions.
1. Who is commander in chief of the military?
2. Name one state that borders Mexico?
3.To which political party does the president belong too?
4.Who wrote the declaration of independence?
5. Of the thirteen original states, name 3? ( I am betting this is the question danny can't remember!)...:)
6. Name the countries two major political parties?

I had to laugh when I read Danny's reply, as we had the exact same questions........what was the chances of that happening...??..lol

Anyways, I then did the reading and writing portions ( both related to Columbus Day), and then she said , ok now on to the good stuff. I stood up, I took the oath to tell the truth. We then went through all the questions on the application, and she asked to see my drivers license and green card.

After getting through all that, she said, great, I am approving you, and said congratulations. Sshe then proceeded to flick through my file again, and handed me a piece of paper, showing the recommendation for approval. She then asked if i needed to change my name. I said no, but mentioned that my last name was actually hyphenated, and it was not on my green card. I explained to her that I was told when it was issued, that my name could not be hyphenated. She said that was actually correct for the green card, but it could be amended now. So I did a Change of Name form, just to correct the hyphen between my last names.

I signed that, and she then said, you will be receiving an oath date in the mail. I asked her if she had any idea on when that might be. The IO then said to me, well there is a Oath ceremony on base late next week, I will see if i can get you into that. But she had a feeling that all the spots were taken by soldiers already. She then said, if that doesnt eventuate, you will take your Oath in December in Los Angeles.(the 16th). I smiled, and said, thank you that sounds perfect as my husband has to go away in January for 2 months, and we both agreed that my intereview was perfect timing then.

We then walked out towards the door, and she mentioned she just needed to take copies of my green card and drivers license, and told me to wait by the window. A minute later, she was out, I had my cards in hand, she said congrats again, and smiled at me and my hubby, and off we went.

I took advantage of the day out , to do some last minute Christmas shopping on the way home, went and had some lunch, and thenc ame home to have a nap....

So now I wait.....
