Hello Rajaa_Reda, how wonderful you have been writing President Obama and I pray he read at least one of you letters. I pray with a huge amount of letters he has no choice but to read or be told of the problem.

I wish this thread could be moved to a place where many can see it and help us out. I don't know what MENA is I hope they help and would not be against us. Bless you for all you have done to help us all out. I wish I would have known sooner myself.

I thought this would give people empowerment to help just beyond filling out a form and waiting for months on end. Hello everyone,

I came across President-elect Obama's page and I was thrilled to see how he thinks. I hope and pray he doesn't go back on his word and if we all send letters to him asking to follow through with what he has said, well, God willing he will help us all out. We need as many people as possible to write him so he can see there are a lot of us needing his help. If we can get everyone we know to do the same, he will be advised of this and take action. One letter will do nothing to help our loved ones be with us. But if we all come together then we can move mountains.

Step1. First, you need to have your letter or postcard to send Barack Obama (at this time packages are discouraged). It can be a handwritten note, typed or even printed on the computer.

Ok well this is the information I found I hope it helps you one in any way.

BE WARNED:
You must qualify to file for an I-130 in the US. Not everyone does, and in some cases doing so can be considered fraud and result in being deported and banned from re-entry into the US for a period of time. If you attempt to file and you do not qualify your legal status in the US can be placed in jeopardy. J1 Visa holders will almost always require a waiver and should consult with an immigration lawyer or the USCIS for more information. If you have any doubt, consult an immigration attorney.

If your fiance/fiancee came to the US on a tourist visa with the intent of immigration and marriage, and you are not yet married, then he/she should return to his/her home abroad, and the K-1 visa should be filed (using an I-129f) instead of the I-130 to avoid a denial, deportation, or even being banned from re-entry to the US.

If you are already married, and your spouse came to the US on a tourist visa with the intent of immigration and marriage, then he/she should return to his/her home abroad, and the I-130 (or along with an I-129f for a K-3 Visa) should be filed with the relative outside of the U.S. to avoid denial, deportation, or even being banned from re-entry to the US.

The above conditions are serious and can result in the separation of families for many years if not taken seriously.

Assembling the I-130 Package: Checklist

Note: Evidence of a Bonifide Marriage
The USCIS now requires that when filing an I-130 for a spouse that you include evidence of a bonifide marriage. They list examples of acceptable evidence as:
1. Documentation showing joint ownership or property; or
2. A lease showing joint tenancy of a common residence; or
3. Documentation showing co-mingling of financialresources; or
4. Birth certificate(s) of child(ren) born to you, thepetitioner, and your spouse together; or
5. Affidavits sworn to or affirmed by third parties havingpersonal knowledge of the bona fides of the maritalrelationship (Each affidavit must contain the full nameand address, date and place of birth of the person makingthe affidavit, his or her relationship to the petitioner ofbeneficiary, if any, and complete information and detailsexplaining how the person acquired his or herknowledge of your marriage); or
6. Any other relevant documentation to establish that thereis an ongoing marital union.

** an I-601 is NO FEE, if, and ONLY if filed WITH an I-485. Later filing DOES require a fee. Whether to file an I-601 is an important decision -- like the J-1, consulation with an attorney is recommended.



Add an overall cover page:
It is useful to add an overall cover sheet with the description of the package and pertinent information such as the applicants name and address. Make sure the cover sheet indicates the package is an Immediate Relative (Spouse) Family Based Adjustment of Status Application with a concurrent I-130 filing. List the major contents of the package (i.e. I-485 and evidence, I-130 and evidence, I-765, I-131,etc).

Where to File Everything:
Applicants are required to mail applications to a national mailbox (Chicago) as stated on the form (not your local USCIS office). The only case in which you may file at a local office is for the following locations: Dallas District Office, El Paso District Office, and the Oklahoma City Sub Office. Please read this notice if your local USCIS office is any of these locations.

Be sure to mail the package with return receipt requested / delivery confirmation. Send via USPS.

IMPORTANT!
Make TWO copies of the entire package before you send it in. This includes the money orders too. You want to have a perfect replica of the package you are sending in. All Forms that you submit must be originals with original signatures. Supporting Evidence that you submit may be photocopies. Retain ALL original supporting Evidence since the USCIS has the right to check them by issuing an RFE (Request For Evidence). If you receive an RFE, follow the direction exactly, and make two copies of what you sent back. During any future interviews the USCIS may also want to examine the original supporting evidence.


After Filing: What to do?

Now starts the waiting game. If you filed for an EAD, your spouse will get their Employment Authorization Document approved in 30 to 90 days and will be scheduled to have their picture taken and to have their EAD card issued.

After your spouse has received their EAD, the real wait begins. I-485's can take several months to couple years for approval, and often leaves the petitioner feeling completely hopeless of ever receiving approval. DO NOT GIVE UP! Though it seems like forever, the CIS will eventually get to your petitions!

Your spouse may also be required to have a medical sometime during the AOS process. The medical must be done by a CIS accredited doctor. Your CIS office should give you a list of CIS accredited doctors in your area, if not check with your local office to get one. The medical exam can cost anywhere from $100-200 dollars, many physicians will not take a check, but only accept cash. Be prepared of the cost before your spouse gets this done. It would be wise to collect their vaccination information before going to the appointment as the doctor will need to have record of them. At the appointment your spouse will be tested for TB, AIDS and Syphilis. If they do the skin test for TB, they will be required to return to the CIS doctors office to have the site checked before they finish the exam paperwork. Note: Some CIS Offices allow you to schedule your appointment when you want, as long as it is done before the AOS appointment, check with your CIS office to see how they handle CIS medical exams before filing your AOS paperwork.

Your spouse will be required to have biometrics taken at some point including fingerprints and photo's. This can typically precede the interview date by up to 15 months, however is ussually much closer. Eventually you will receive a letter from the CIS informing you of your interview date. You and your spouse will need to bring supporting evidence of the relationship... i.e. photos, joint checking account, joint lease, joint mortgage, and birth certificates of children if any etc. Also, it is very important to bring the current passport of the applicant, as the CIS will stamp his/her passport with the I-551 stamp if they are approved. This stamp is proof of permanent residency that can be used until they receive their greencard. This normally can take up to six months. The interview is fairly painless and may be video recorded and lasts between 15-30 minutes.

NOTE: If you are married less than 2 years, your spouse will have to renew his/her greencard 2 years from issuance by filing the I-751 to remove conditional status.

I would be careful to list the contents in their order of appearance in the stack. The check should be first and is not an application fee. It is a processing fee. You aren't applying. You're petitioning. Later your spouse will apply for a visa based on the approved petition.

There should be a G325a for petitioner and another for beneficiary. Passport copy should be "all pages", so your description should reflect that as well. You may use a copy of your birth certificate instead.

Item 5 should be a color passport photo but you need one for the beneficiary too.

A Stokes Interview is the name that has been given to a certain type of second interview where a beneficiary is applying for a green card (either the conditional green card or the permanent green card) through marriage to a US citizen. The couple has already had a first interview at a USCIS office in their area and for some reason the adjudicator is suspicious that the marriage is not real. They suspect fraud - that the couple is not involved in a real relationship, or that the circumstances of the marriage are not legitimate. Usually, they suspect that the US citizen is getting some sort of benefit for going along with the scheme, and the sole purpose of the marriage is to get the immigrant a green card. Sometimes the couple does not even live in the same house, and may not even have met before the marriage. Usually the evidence is fake. This type of interview is designed to reveal this.

The couple is separated and each one is interviewed separately, often quite extensively and for a number of hours. A Stokes Interview tries to make the parties in the relationship either 'prove' that the marriage is fraudulent by their lack of basic information about their partner or the relationship, or tries to get a confession from one of them, by threatening them, or saying the other has already confessed. It is like being grilled for a crime and iin this case the interviewers don't play fair. They can and do ask about all aspects of the relationship and specific details about the other person, about the daily routines together, about their job, their family, their past, their home - things that in most cases married couples generally (but not always) know about each other. Since they start from the premise that the relationship is fraudulent it is an uphill battle for the couple to prove that their relationship is valid. The objective is that only a real relationship will pass a Stokes Interview and fake ones will either 'break' or give themselves away.

You definitely don't want to go through a Stokes type interview.


No I wouldn't want to but it seems it's all up to the interviewer, so be it at least I know mine is on the up and up and they can't do a thing to us to make it seem a fraud since it's not. We married in Oct 15 2011 yes we hadn't met before but love is just that way. We are together living in a beautiful brand new apartment and are in heaven. A stokes interview is where USCIS has made the determination that something is fishy with your story, and they will grill both parties for hours until they discover if your telling the truth or not.

If you fail - you get deported. (the non-USC - however, the USC can be held on breaking the law or something similar)

If you pass - you stay.

Only people with weak evidence/conflicting stories, etc... have to fear getting a stokes.

If you are one of these lost souls - get a lawyer pronto.

Processing times for the 130 is longer then the K-1. The big advantage with the 130/CR-1 is once you get here you are finished.  No AOS to file like you do with the K-1. You have a green card and can start work from day one.

  Buy the way if I had the money I would go with a lawyer, my papers where returned to me because I forgot to sign

the forms.  Yup I forgot and that is the only thing I did wrong and lost a lot of time going back and forth. So for peace of mind no laziness I would go for it.

First of all, an attorney will not get you a visa any faster. It seems those with attorneys get just as many RFE's as those who work alone. Your file has to work it's way through the system. right now about 6 months with or without an attorney.

 

If you have a straight forward case. do it yourself.  If you hire an attorney, you are basically paying someone to fill out your forms. You still need to do the legwork and collect all the documents and information.

 

  6 months sweet, we have been waiting 9 months to see if they accept our I-130 :( .

But really do you honestly think a CO is going to view all of this in softer, kinder, gentler light? Whether you like it or not, your absurd pat answers to some very huge life issues are not going to cut it at the Egyptian consulate. You may be a nice, intelligent human being, in all kinds of ways, but you have got to realize how you come across. Because ultimately when it's interview time and a CO wants to know why your fiancé is leaving his kids behind, non sequiturs about MENA male migration for employment that have nothing to do with him aren't going to cut it. Bumbling through Egypt with a "spiritual contract" you've inexplicably signed but cannot define isn't the hallmark of someone who's thought out much of anything here. They've seen you before, they'll see you again. He'll probably end up with a visa despite all this. Success!!

  Egyptian men divorce all the time and leave their families it happens every day so that is nothing new and really shouldn't be a red flag under normal circumstances.  But the Embassy will make every little thing a mountain.   If you have nothing positive to add or any help to give then please keep your bitterness to yourself none of us need it right now.   Spare us your poisonous comments.

In that way they can find a lot of fraud relationship.

Maybe he doesnt used the usc, maybe he paid to the usc.
You know about many people do that, they are usc they get money for bring peoole from others country.
I have heard that people can pay a lot of thousand dollars for go to usa.
Who knows if he used or paid.


 

  If you paid the USC then you have committed fraud against the United States Of America and you both will be going to jail for a very long time then once your out your ### will be deported back to your country or origin.  I think we can most likely find out where your living with the IP and let Immigration know that you have stated the fraud you have committed.

i went to afghanistan a few months ago and then i got engaged on september 2013 in afghanistan while i was married in America and was waiting  for my citizenship and then i got my citizenship on january 2014 and now i dirovreced  my wife a few days ago so can i file for my fiancee in afghanistan or do i have to visit her again and then do engagement party everything once more and also i dont have money to travel again any suggestion any help

 

    Don't want to sound mean but prepare yourself to go back to live in Afghanistan because you may have fooled Immigration once but not twice.  I can guarantee you will not be given a visa for your new fiance or wife.  Just not going to happen.  I must say I don't blame them when they deny you, it's obvious you used your ex-wife to come to the USA and they wont make that mistake again.  Good luck back in Afghanistan.

    Well, God bless you for believing your lawyer, they have no clue.  My nephew is a lawyer and said they can't predict when you will get an interview because USCIS/NVC and the Embassies do things let's say in a discombobulated way.   They don't make any sense and they aren't fair.

I have sent off for the readiness of interview also.

 

The whole process has been from december for us and now were almost in august and still i havent heard anything regarding my interview.

 

We have a wedding booked and paid for on October 17th 2014 which is 2 months away.

I am getting all the forms together to start the process of immigration. I am filing out the I-129F and my fiance does not have a surname on his passport or birth certificate. He does have a family name, but it is not on any official documents and it will take too much time and money to change it in his country. For some reason the family name was not issued to his grandfather and some old records disappeared during WWII that make it very difficult to form a paper trail of proof. I can form the connection through his grandmother and great grandmother, who both have the family name, and it is was custom to marry cousins within the family to keep the family name.

 

What do we do?

 

Do we:

 

1) Fill out the application with his family name and explain everything in the documentation / cover letter?

-OR-

2) Fill out the application WITH OUT (LEAVE BLANK) his family name and explain everything in the documentation / cover letter?

    - If I leave the surname blank will he be assigned a surname? At what point? What is the process? How is it determined?

 

I called USCIS and they told me that is was up to the officer who reviews the paper work, I did not clarify with them if this was during or after approval. She did not say if either way was better, just said that whatever we submit, it is up to the adjudicating officer

 

Does anyone have any experience of this?

Only those with REAL knowledge need reply. If you answer with "might" or "maybe" you will be ignored as those answers are not helpful and only feed the confusion of the nightmare of this paperwork process. I can make (and have made) perfectly good assumptions on my own, now I want facts about the process.

 

This comment was not made to offend anyone that wishes to help. But I have read the forums about beneficiaries with no surnames and have seen posts like "If you leave it blank, they may think you forgot to fill it in, and RFE you.". Even though it is perfectly acceptable to leave it blank as per the current instructions. When you use terms like "may" or "maybe" or "might" your answer is not helpful, and therefore not acceptable. 

 

If you have been denied or returned for more information, please let me know. If you left the surname blank for your beneficiary please tell me what happened, if they have a surname name now and how it was given (except in the form of the wife taking the husbands name after marriage since my husband will not be taking my last name ;)

   Very easy this is common in the Middle East,   If his name was lets say Mohammed Abbas Masoud Elsayed then Mohammed Abbas would be his first name  Masoud his middle name and Elsayed his last name  or Mohammed first name Abbas his middle name and Masoud Elsayed his last names either way it works and is accepted.   Good luck. :)   M

I am so irritated with NVC. They still have not unlocked my AOS fee and although I know they said 20 business days, I'm sick of waiting and want to pay it already! Seriously, how hard is it for them to just press the button to unlock so I can give them money?

 

Ugh....anyway, back to waiting I guess . . . also, they keep saying that they don't see my DS-261 on file b/c the case is too new....whatever.

 

I hope this week is better although it's been slow since yesterday.

  I have a huge problem,  I lost pretty much everything when my computer basically reinstalled Windows 7 for some unknown reason.

  I think it was here in 129fs238648.gif AKA Saylin's thread someone posted a site were you give them the information on your degrees from other countries and not sure if they determine if it can be used in the USA or/and verifies the degree is transferable?  Something like that.  Does anyone remember that and have the link?
