IR-1 / CR-1 Spouse Visa Process & ProceduresWife traveled to the philippines with an expired green card help!
QUOTE (kentfin @ Jul 30 2009, 12:47 AM) <{POST_SNAPBACK}>
Well we got the ticket and will be picking up the letter on the 13th and flying out the 15th. For some reason it takes up to 10 business days to prepare, so there will be a 3 week delay in her return. Oh well it could of been a lot worse.

We still have to get though Immigration at the airport hopefully the boarding letter will help.

I will have her paperwork ready for her to sign and mail when she arrives.

Things will go OK, maybe a small delay at NAIA. You may want to call the airlines and let them know so that they can enter some notes on her reservation for the check in agent to see, something to back up her testimony.

The Embassy should provide her will everything necessary to get through the airports, and back to MSP.

When she arrives, you may wat to consider meeting her inside Lindbergh Terminal at the west end of the baggage claim area. By exit door 6 there is a set of sliding glass doors where she will be coming through after clearing US Customs. International Arrival Area.

Bring along your marriage certificate, your written notes about this ordeal, and other documents as you see fit, just in case she gets hung up coming back in. Have your cell phone with you and have her tell any officer that you are waiting downstairs.

Please let us know when she is home, save and sound.

We will be interviewing in Montreal for my wife's CR-1 this month. She has been stressing out about her English. She is worried that her speed in answering questions, incorrect grammars, accents, etc. will make her answers seem less convincing. The fear of not understanding what's asked of her is nerve-wrecking as well. I tried to calm her down but I am hoping any advice or tips you may provide based on your experience on this can ease her nerve a bit.

Any advice or tips? Should we get an interpreter on our side just in case? (I have inquired and Montreal allows us to bring interpreter)

Thank you.

I would be surprised if an interpreter is not available at the Embassy and also if the CO does not speak French. Call them and find out otherwise bring your own. You'll be OK.

Whoops, I wrongfully assumed that she was French Canadian simply because of Quebec. My bad.

IR-1 / CR-1 Spouse Visa Process & ProceduresTaxes

Any advice on filing US taxes when your spouse lives outside of the US and has no social yet?

I think I am required to file as married, since we maried in Dec, but not sure how to handle this.

I think the 2555 form is only for US citizens or residents, so not sure if I am suppose to include his foreign income or just file marry filing separately?

Somone told me married filing separately is the worst way to file for exemptions, etc.

Anyone familiar with this?

thanks,
Karen

You file for an ITIN number in place of a social Security number by sumbitting a From W-7

A couple of links:

http://www.irs.gov/i...d=96287,00.html

http://www.thetaxguy.com/itin.htm

Married filing separately typically is the highest tax rate. Filing jointly you most always can take you foreign spouse's general deduction as well as your own, roughly another 5 grand you won't pay tax on.

K-1 Fiance(e) Visa Process & ProceduresIf K1 is denied, senator or lawyer?
QUOTE (Maverick64 @ Jul 22 2009, 03:00 PM) <{POST_SNAPBACK}>
Just out of curiosity, if the K1 is denied what is the best route to take? Try and keep the case at the embassy and immediately get your senator involved or get a lawyer. If lawyer, an in-country lawyer or American. I am just curious. Also would it be of any help , if the petioner happened to know someone who was "high up" in politics (ie: former congressman, former presidential cabinet member, lawyer) to contact that person to see if they can do anything to let the Consulate know that the case is being watched? Sorry if I am being deliberately vague here. Please no flaming. Just some hypothetical questions.

The CO at the Embassy interview has the ultimate authority to approve and deny. A Congressional inquiry would not go unnoticed, but by itself can change very little.

Not many cases are flat out denied, rather they are put on Administrative Review when more information may be requested, or for the Embassy to verify documents, etc. This "hang time" could take months and rarely will they let you know exactly what is going on, or what item(s) they are questioning. Most reasons for inadmissability are found on the back of trhe DS forms. Discrepancies found at her medical interview will be passed along to the Embassy as well.

A checkmark on the 221(g) from given after the Embassy interview, "WAIT UNTIL YOU HEAR FROM US" is the sign that you are under Admin review. If you can be present with your fiancee' at the time of her interview, you probably will be able to find out more than they are able to tell her.

If you are aware of something that may be grounds for denial, proactivly research for a waiver that might excuse the situation.

Good luck, soon all the anxiety and waiting will be in the past.

yes, its been approved an she has been interviewed and approved (at us embassy in peru) but has not stamped the visa until she sends in the information with her passport. (by mail) the joint bank account (mancomunadas), some more pictures (on kodax) and bank transfer trasaction receipts.

ps not us embassy in us, department of homeland security immigration services

OK, the list is getting longer, sounds like they are simply asking you for more evidence of relationship; more photographs on real photo paper, e.g. 4" x 6" prints, and evidence of support, such as Western Union, bank wire and other remittance receipts. The GDP in Peru is less than $6K USD, you are helping her out aren't you, a couple three hundred every now and then, right? Well, send all those receipts, more photos, and maybe you can get a letter from your bank officer on bank stationary stating their requirements for a joint bank account and why you were denied one.

Additionally, it may have come down to a bank letter anyway as in my experience, joint bank account statements list, and are addressed to the prinicpal owner only, the person whose SSN# is listed for tax purposes.

An idea may be to order an extra Visa/MC card from your existing account in her name, photocopy both cards together and scratch out the last 4 digits for safety. With luck, the new card may even come in the mail addressed to her, send that also.

How about this https://www.walmartm...t/Products.aspx

Head down to Walmart and pick up the Walmart MoneyCard SharePak. Sign up for the primary card in your name, get the second card in her name - First, Last name + DOB is all thats needed for the 2nd card. 7-10 days later you have twin debit cards.

Your local bank had prepaid Visa debit cards also, load the account with $20 or so, get two cards, one in each name, or one card with both names.

Good luck,

NM

To Nutmagnet:

You gave some of the best advice (Gary & Jim were also good). You could have used "Enry Iggins" for your handle.

I'm not sure if the OP was addicted to texting but just may be dyslexic or have some kind of neurological disorder
not indicative of lack of intelligence. Some people have a problem where they want stuff to come out straight but
it just comes out garbled, no fault of their own. A spell-checker would be strongly advised (I guess spell checking
is done on my browser courtesy of the browser as others have hinted, not courtesy of VJ. I doubt the problem is
related to age.

What we've seen is nothing but sentence fragments and bad spelling/punctuation/grammar,
but I can't rightly say what the cause is. Let's hope she gets this sorted out in the right site.

I saw you joined in 2005, but I don't see any particulars in your timeline or story.

If you'd rather keep that private, no problem.

Thanks for the kind words and an idea for a future nic, however the current one still shines on just fine and fits to a tee (with or w/o crumpets). wow.gif

I got the Higgins reference, and his story turned out to be a happy ending as long as the cameras were running and close curtain. Seems that you can not polish a #######, yet sometimes the kind intentions of a person will be recognized after deep thought and heartfelt examination. Just so it fits in two 3-reel shipping containers, the distributors won't mind handling the show.

Interpersonal magic as portrayed on film or stage is part of this fantasy world the media tries to ram into our heads, sensationalizing its existence by attenpting to combat the boredom in this world.

How can a person be expected to practice honesty when we have been taught to believe and accept fantasy? Santa, Easter Bunny, dreams, social security? With the current widespread behavioural goals being centered around how clever one must be, there is little room for honesty to prevail. You need to be honest in order to trust an honest person. If you want a friend, you have to be one yourself, and ultimately, you can not bowl without a lane.

No time line, photos or details listed anymore. I signed up in '05 just prior to submitting a K1 petition for a woman who lived about 20 degrees east of your flag. Now she's about 20 minutes in the same direction from my house. Still waiting for things to come to their finale'. Alone again...naturally.

I wish you chock dee mak mak in your own endeavours.

Your response truly made my day, tnx. cool.gif

This must be a new aberration of the Queen's English or an intentional embarrassment thereof. This is not a cell phone hunney. If you want adult answers please address your situation accordingly, the better for this forum in trying to help you.

In any situation, happy birthday and sorry for your miscarriage.

God executes his wisdom in mysterious ways for the betterment of all. Its all about faith.

Your USA fiancee needs to work and to start his new job, it is very unlikely that anything can be accomplished by him being there in person, emotional support notwithstanding.

When dealing with any government agency, expect delays and incompetence. It seems that you are approved and your visa will be issued in due course.

Stress is part of the game when going through the visa process, anyone who has been through this process can testify to the headaches involved.

Keep strong and take care of yourself. You say that your visa has been approved, so its only a matter of time and waiting. Tough and painful waiting, however all this heartache will be forgotten when you fly across the pond and become reunited with your fiancee and start your new life.

Good luck always,

NM

After reading this post I called my cable company and they do have an international plan a lot cheaper than the calling card I was using. I got rid of my movie channel and will pay for the international calls instead. Through Comcast I will get 300 minutes for $14.95 per month to call 100 Countries. I didn't realize I could already call Canada and PR for free. Also I can request phone logs with the number I called and the minutes.

Thank you guys for all your help because it is so important when you get to the Embassy stage to have proof of ongoing relationship.

How can you make calls through comcast?? I have comcast but know nothing about it. And you can call the middle east??

Comcast is a Cable TV company that is located in various parts of the country. They also offer Cable Internet and local phone service. For the local phone service, they usually attach a large grey modem box to the exterior of your house where the electric and old land line service enters. They coordinate with your local Telco about transferring your existing phone number to their service. They splice into the same wires entering your home that provided your old land line service.

Technically it is VoIP that modulates at a different frequency than the TV or Internet service you have with them. It is full bandwidth phone service what is unaffected by your TV or Internet use. Sound quality is equal to Telco's land line. Your phone service will go down with any electrical power outages in your neighborhood, same as your Cable TV service would - and you are watching a battery operated TV.

Vonage and other VoIP companies like Google Voice, Yahoo Voice, Gizmo5 who use a "soft phone" application on your computer to make and receive calls use a part of your allocated Internet service bandwidth for phone calls. If you are doing some heavy downloading, the quality of your phone calls will decrease. Comcast's local phone service is unaffected by your Internet or Cable TV use.

They always are offering promo deals, and package offers to get new customers. Beware of contracts and hidden costs.

If you are simply looking for cheaper phone calls, try one of the "rechargeable phone card" services as found on the Internet, then use your exixting phone to place the calls. www.pincity.com and www.idt.net have been the most reliable in my experience with no monkey business and hidden charges.

The lowest cost service will probably give you the lowest quality service and cost you more in the long run. Connection fees, rounded minutes ex. 6 minutes minimum for all calls even if you only talk 1 minute, weekly service charges, no online call date records, are all part of the phone card game.
Its a savage industry with phone cards, they seem to work fine for some people who can burn up a $5 card all in one shot.

Most Telcos, cellular and cable telephone providers offer an International Calling Package, where you get a competitive rate on overseas calls for around $5 extra per month. Mind you that these utility based outfits also will charge you local and federal tax plus other fees that will make the $0.21 per minute call to the Philippines actually $0.33 when they add in the taxes. This is why I stick with my choices for overseas calls - no extra taxes! Skype and Gizmo5 are also good if you want to make calls from your computer, but remember to close down all unnecessary programs when using these "soft phone" services.

Hope this helps!

K-1 Fiance(e) Visa Process & ProceduresCalling card proof?
Many companies to choose from. And I have tried 10 or so before sticking to one service. I like www.pincity.com you can track the calls right away online and they keep 3 months worth of history online that you can print out with date, time, phone number called, & cost. They have a Live Chat to customer service online and they have always have issued credit for poor transmission and the occasional 1 minute calls they didn't connect properly. Many local access numbers throughout the USA and also 800 # access - at a slightly higher rate.

JackAndWhitney: If you cant get funds into your account in time to cover the check, perhaps you could call the bank and arrange for a small line of overdraft protection credit.

Believe it or not you may be able to call and give them your credit card number.

How in the hell will you damage your credit by asking?

I can think of several ways one's credit score will be lowered by performing inquires. Filling up loan applications, i.e. asking to borrow money is one.

Could you please post the credit card payment phone number for the benefit of the readership? The original post is about 2 1/2 years old and it may have changed by now.

Hi all,

I'm a new poster here, but long time reader.

I got a letter in the mail yesterday saying that my fiance petition had been denied due to lack of signature. I've check over everything 100 times and have found no missing signature. I'm starting to wonder if I confused the original with the photocopy (all look the same to me). Fair enough if this is the case, but the letter doesn't state anything to indicate that the problem is due to the lack of an original signature. It just seem to say there isn't one at all. It also only make reference to the petition or application itself. No mention of specific forms (e.g. G 325a).

What I think I should do is resend the package with a new I 129F form with today's date and a brand new signature. Should I fill out a new G-325A as well though? It never made reference to this form, but I'm paranoid now. It just said 'application or petition'. My fiance isn't here now, so I'm a bit screwed if we have to fill those out again. I tried that 1 800 number, but they were no help.

The anxiety is seriously setting in here mad.gif as I'm sure it is for many others of you.

read the pinned topic above about how petitions are handled. For a missing signature they do not DENY the petition. You get an RFE. When you get the RFWE you will see exactly what is missing...provide what is missing and get back on track. Do not send anything until you have the RFE in hand. Anything you send without that will only confuse matters.

Hey Gary!

this part of this process confuses me when does he get the packet that u can not open? will it say do not open on it?

After the interview and once the Visa has been approved - the beneficiary is sent a package (some countries it's to be picked up by the beneficiary) - inside the package is their passport with the visa inside and another envelope that says "Do Not Open" - this envelope is to be carried on the airplane and given to the CBP officer when clearing the POE.

It contains (for those terribly curious) most of the forms etc that you have sent in to this point (so nothing you haven't already seen before). star_smile.gif

ok now I have a question do you have to fly into a POE or can you drive to one, see my fiance is in Mexico and I think it would just be easier to drive there and get him since we only live about 10 hrs away from the border???

No reason why not. Keep in mind that they are most likely are not always prepared to do that sort of thing at border crossings. They may make you wait while they review their procedures. LOL!

So you will drive to the border, park your car in Mexico, walk through Immigration into the US, then what? Leave her sit and then you cross the border again to retrieve your car?

Driving up with a person to be processed in the car may make them sweat a little bit.

I think I would seriously make a phone call and get a better opinion.

Once she is processed, I believe that she will need a I-131 Advance Parole before crossing back into Mexico. Hence, stuck in USA until you marry, file for AOS, and get the advanced parole.

Waivers (I-601 and I-212) and Administrative Processes (221g)LPR gave birth abroad
i was just talking to a couple while waiting for my turn for infopass.
and they're having an issue that i can totally relate!!!

>>> WIFE gave birth in the Philippines during vacation for 4 months. and they were not able to bring their baby over when they came back coz they were just thinking that they cant do that since they are still LPRs and will have to wait 2 more years for citizenship!!!

SHE WAS WRONG!!!! she could have went to the embassy and asked for a CHILD WAIVER FOR LPRS

They will give visas to child born abroad during mom's visit as long as

a. child is not 2 yrs or older during visa application
b. its MOM's first trip back to US after giving birth
c. proof of pregnancy (prenatals, ultrasounds, doctor's certificate, pictures ...lots of pictures!!!)
d. child and mom will be back in the US 30 days after child's visa issuance

the visa process will take 10 working days after applying and should be in person at the embassy.....

believe me!!! i did all these even if i didnt know that its possible. i thought USC mom's can only do that..... but NO!!!

K-3 Spouse Visa Process & ProceduresI-130
QUOTE (karen_ann @ Jul 30 2009, 09:15 AM) <{POST_SNAPBACK}>
hi,

my husband is currently in the US and is a LPR there. he filed the I130 with G325A last Nov 2008, and he get back to me like this Feb of 2009 asking for pictures since i think the center has notified him.
With this, may i ask if how long does it take to process this kind of visa??

hoping for reply...from anybody....appreciate your reply...

hi karen ann
if you dont mind, can i ask which country are you from? coz im a LPR and file i-130 for my spouse in the Philippines way back in july 2007 and till now i havent receive anything except the receipt! so your husband is a LPR too and its just been a year and hes getting stuff from USCIS already??? what did he do??
coz as far as im concerned, it'll take 4-5 years to process i130 for LPRs.

US Citizenship General DiscussionN400 Reject Notice due to application error. Pls help with suggestions
heres my own senario and just check if this could help you... last May of this year i file a I-90 application for GC renewal. a week after i mailed in my application i found out that they changed the address where the application should be filed... i use LOS ANGELES address which is their previous address and just to found out they changed it to PHOENIX ARIZ.
without having second thought i decided to make a stop payment on that check and was thinking that im just going to mail a new application to the right address which is in ARIZONA. while i was finishing up my second application, a notice from lockbox Phoenix Arizona arrived that they got my application and a receipt number... i USCIS callcenter but they cant help me unless they can see a status of my application online. 2 weeks after, i called the same number again and they forwarded me to finance department and they lady that i talked to was telling me that THEY WILL JUST MAIL ME AN INVOICE STATING HOW MUCH I HAVE TO PAY w/ $30.00 penalty because of the stop payment, they said that i just have to follow the instructions on that invoice and should pay within 14 days.

2 weeks later, i called again letting them know that i havent received any invoice yet, and the lady from finance department just told me that the invoice is on the way.... that i could make a phone payment through my DEBIT card a week from that call.

while i was waiting for my invoice, a letter for my fingerprint appoinment came, now i was soooo worried knowing that i havent paid a penny and now they are still processing my application, i made an INFOPASS TO SAN BERNARDINO BRANCH and the officer was advicing me to just mail a new application. i called finance department right away and telling them what the immigration officer has adviced, and they adviced me not to do that, which will just complicate things more.
i made a phone payment and still went to my finger printing.... just last week i got a letter that they are on the process of my card's production...

so i would advice you to call that 1-800-375-5283 hotline and ask them for the finance department number and call them... they should tell you whats going on with all your checks....

but i was told that when you mailed a check to USCIS as long as they cashed it, there's no refunds...

hope that helped you a bit and ssooo sorrrryyy for the long story......

Philippinescorrections after I-130 was filed
hi, im just been very worried! been thinking a lot of times already on how to ask this issue here. but oh well, i hope you guys will understand me, im just a wife and mother trying to make things perfect to make this family whole in one place!!! .... the more i make sure nothing will be a problem in the fututre, the more i had errors on my petition!

i filed my i-130 petition for my husband in july 2007 and did got the receipt aug 2007. im sure it'll still be a long way, years and years more even until im going to hear anything about it since the whole process will total to 5yrs or more.
as i was trying to just scan and read my photocopies of the things that i sent, i found out that

first --- when they were asking to list all the children of the recepient, i put the name of my stepson and put STEPSON
as the relationship instead of SON since he's the son of my husband.

2nd --- we both put the WRONG PLACE OF MARRAIGE... wasnt thinking right back then. but sure i did mail an
euthenticated marraige contract from NATIONAL STATISTICS OFFICE.

how will i make corrections on these errors??? or i just have to wait till my petition will be current and then make the corrections???
pls my VISAJOURNEY FAMILY help me with this issues... been bothering me since the last time i check my records... thanks!!!

i even envy all the petitions here for I-130 citizens filing for spouse overseas since it'll just take less then a year for the process for your guys.... unlike mine will take forever and half but well, there is time for everything....

thank you all in advance.... thank you!!!

PhilippinesWow, the Philippines!
i agree with that fellow that was trying to say that we didnt have to marry an american to be rich and have a better life... i dont know enough to say it all!!!! whoever is trying to marry an american to be rich and just to come here in the US.... i assure you... you will have a bad life here in the US.
im a filipina married to a filipino but what im saying is, there are filipinas out there that are really just DYING to come here no matter what it takes.... and whoever started this thread.... you are missing a lot!!!! hahahahaha... i bet you! you are the one making your dinner after getting off from work huh??? us filipinas? if we're not working and just stayed home the whole day? youll feel like you are eating in a nice, fancy, expensive restaurant when you get home!

this is a VISAJOURNEY FAMILY.... make comments that can uplift all of us while waiting to reunite with our loveones... and to some people make your time useful posting comments that will help this family and not to ask why most k1 are from the philipines... you'll get a lot from us. and we can get you too.

Philippinesgoing home
i can 100% relate to you!!! the reason why im not eligible for citizenship is because of the numbers of days stayed out of the country. me and son stayed in PI for 10 months to be with my husband and spend precious time and we got back feb of this year, when we got married, i stayed in the Phils for almost 2yrs but with a reentry of course since i was taking my nursing degree at the same time. its too hard, really hard.... i have to go back and forth to spend time with my husband while my i-130 is still on the process and will take forever and half for him to come and be together forever.

good for you coz you already have your husband, and kids with you..... but of course the rest of the family is still there....
i even made a promise to myself that i will throw a huge party for all the people from this site who can come if my husband will be here in the US. but thats not till maybe 3 yrs from now...

i always think of it as "THERE IS ALWAYS TIME FOR EVERYTHING"

GOOD LUCK THOUGH AND TAKE IT EASY....

Philippinesask lang ko about wedding diri sa US
hi sweetFM
congratulations!!! i know a little bit w/ regards to weddings... mao man gud na among negosyo diri sa Lomalinda me and my friends have this association for wedding planners and thats what i do here in socal for a living. about registry, this is when you can go to any of your favorite store... let's say target or bed bath and beyond and ask them that you wanted to make a wedding registry. they will give you a small merchandse machine where you can select all the things that you like/want/need and that will register in their system. you can tell your wedding guest that you are registered at target for example and they can choose their gifts to all the stuff that you selected with that merchandsr machine.
in this way you will have those things as a gift, and also to avoid duplicates. i hope i helped you in a little way... again congratulations and best wishes!!!

taga asa diay ka sa pinas???

PhilippinesCan my fiance apply K1visa after his wife died?
i read all the thoughts, opinions, reactions that was said and shared from the beginning of this thread and its giving me goosebumps.
i cant imagine myself listening to my husband's to be ... CRIES, MOURNINGS, STORIES, ETC about his wonderful life with his wife ( like he talks about her and even talks to the late wife's picture everyday?) and here i am, a fiancee and is willing to listen to all that?

but, as what one above said, there is no time limit for healing and its not my business to say whats best for you and your situation.
think it over KAPAMILYA! as what they've said, "IF IT'S MEANT TO BE, IT WILL BE", " THE END DOES NOT JUSTIFY THE MEANS",

maybe give it time for you and your lover to think and pray for it..... no rush.... USCIS will always be here till who knows when and is always ready to process any application any time.... no time limit to file K! visa.... ponder and unwind...

Good luck kaibigan!!! and God bless to your fiance too.

PhilippinesFast Way to Send money to Fiance in Philippines?
THANK GOD I FOUND THIS FORUM. just had a verybad experience this weekend. i had to send money to the Philippines and used xoom.com and i didnt know that if checking account is being used, it'll take 5 working days for the money to get to the system of ML lhuiller where my hubby can claim the money. i didtn know that... all i was relying to was their ad on tv. they should have mentioned about that... but now??? ill try to go to wells fargo and get some info on the 2.50 charge for money transfer... and also, how can i get that paypal that mentioned on the previous reply?

been using western union for 3 yrs now but its getting expensive already.. we just realized they are charging $1 for the receiver to claim the money and $12 for the sender.

its getting too much!!!
