Patient, I would suggest getting the tax transcripts anyway. They are very easy to obtain, just have the USC call and they can fax them if they aren't too many pages or send them in the mail (just a few days to receive). Have the USC call 800-829-1040.

I was hoping to see an answer to this question.  What we did was say none since my husband hasn't left the states since arriving, even though it was 3 years ago.  We did not include any time prior to him arriving in the US. Fingers crossed that this is correct.

Haven't been on VJ for quite a while. Hubby's temporary green card expired Dec 15, 2012. Can't remember our NOA1 date (think it was Sept 20 or so) and biometrics were on Oct 17. It is at VSC so expecting a long wait from what I am reading here.............

Good to see you on here again! I see that everything is going well for you two. I was wondering where all the people were who applied for visa's the same time as us. This seems to be a much quieter wait than the visa process--almost boring! :yes:

Yes, i called the MDV in Phoenix and told them of the situation, they advised me to call the supervisor in my home town MDV and they told me to come down and they will see what they can do, and they sorted it for me. Was imperative that I get my license back as I run my own company and cant work without it.

If you have received your NOA that is also enough evidence for them to extend your license.

One little tip, if you have a SSN then they legally can not refuse to extend/renew your license (unless you have a bad driving record) as it is against something called the real ID act.... my attorney told me about this, never heard of it before lol.

my wife's license expired the same day as her green card..she received an extension notice in the mail before that asking to submit proof of legal presence to recieve her extension. We returned that with a copy of her NOA, but the DMV stated that her NOA is not valid until her green card expires...therefore they were unable to process her DL extension until everything had expired! Fortunately, we were able to get them to issue a temporary license in the meantime, until she received her new DL. All of this is done by calling the Legal Presence division of the DMV in Sacramento, since the local DMV was useless. Here is the # for you to call:

We had to call a few different times to get it all sorted out. Hope that helps!

I can't even begin to tell you how much the bold, underlined statement is TRUE! I hope no one here works for the Vallejo DMV...

speaking of employment, do you need to fill out a new I-9 to show that you got the extension letter?

That is a good question and in my experience the answer has been no. If you ever need to apply for something (for your job) that will require a background check or proof of legal presence again, then this may come up but most employers won't go back and require this.

When I got here in CA, I received a 5-year DL by showing to the DMV my passport and my EAD, and it won't expire until 2015. It didn't make much sense to me that they would not tie it to the validity of my papers, but who am I to challenge the DMV? Did you receive a license valid for a shorter period of time?


So since the permanent residence expired 10/31/2012, they made the DL expire 10 days before that. We thought that by sending in the extension, we would get the DL extended for a year as well. Not so...

I had that issue also in AZ. What I found out was this......

My 2 year conditional GC expired 09/20/2012, I did not file my ROC till the 19th of Sept (Yes, i'm a male and leave things to the last minute lol), anyway, overnight ed it to them and went down 4 days after my license expired (The same day as my GC). They first told me that I have to wait till I get my new GC after telling them that this could take 6+ months they said tough, that is their rules. So, I went back to my shop and called the main office in Phoenix, they advised me that because I filed in time I can call the supervisor at the MDV in my town and ask them to do a check with my A# to see that I am still in status....after telling the Sup this they told me to come down and they will see what they can do. Went down there and they just signed the form (didn't do a check on me) and got my DL renewed for another year........

I see now why you can't find that info. It is in the NOA letter, which is a separate notice from the Biometrics appointment notice. It seems that you have not received the NOA, based on the table of Sept I751 filers.

If I were you, I would call USCIS about this. Because that NOA is what you present to prove that your permanent residency is still valid for another year. You can show that to your employer, to prove that you are still legal to work; and you can use that at the border/port of entry when you re-enter the US, if you decide to travel.

You are not the first one I've read on here who has not received NOA. Let's hope someone who was/is in your situation replies with what they did. In the meantime, calling USCIS and asking them what you can do, might be a good shot.

Didn't the NOA automatically extend the Permanent Residence status for a year? It is mentioned in that notice. Or at least in mine (?)



I guess you got Bio letter on 9/22? If you send your package on 09/11, you should have gotton NOA letter (receipt notice) already...
silvermug is correct. NOA = extension letter.


Okay, maybe I need to read it again but mine didn't seem to say anything of the sort on the letter. Was it a one liner that I could have missed? And yes, it was the biometrics notice. :help: :help: :help:

Hello fellow VJ members. I must confess that VJ is the best thing that has happened to those who are in process of passing through immigration process in the US since slice bread and butter. My only regret though is that I did not realize this till some few days ago despite the fact that my friends have been telling me about it since january, 2010.
This is my situation and question:
I sent my I-129F application in January 27th, 2010 and received my NOA1 02/07/2010.
Since then, there has not be any action on my file. I registered online and have been checking the status on a daily basis.
Just yesterday, I read in VJ that you can contact your congressman and without wasting time, I downloaded the release form and sent it to my congress rep. I got an email today from USPS that the letter has been delivered.
My question is:
1. Is it too early to take this line of action?
2. Will this enquiry be part of the package when they send it to the embassy?
3. If answer to Qu2 is yes. How will this be looked at at the embassy? Will it help or hurt my fincee interview?

I am just thinking out loud and would appreciate if any experience member can through a light into this.

Hello NSH, I don't have the answer to all your questions but I would say that yes, it is a bit too early to take any action. I would suggest looking at timelines on here and seeing the time it took for others who filed around the same time as you. I am sure you'll see that others are still waiting for their NOA2 as well.

I did the IR-1/CR-1 so I'm not an expert on the K1 process but I would suggest you read through the guides. They provide quite a bit of information.

I know that the request needs to happen at the consulate in Osaka, I was just hoping that someone would know if it could be done after the IV bill is paid (I'm expecting to get the bill within the next few weeks) but before the case is sent to Tokyo, or if it must wait until after Tokyo recieves the case file.

Well, I had sent in my request AFTER paying the bill but I hadn't sent in the DS-230 yet so my case is still at NVC. When I spoke to the operator, she didn't mention anything about timing but if/when you get a definitive answer, I would love to know.

I requested that the interview be done at a different consulate because my husband, the beneficiary, moved back to his home country while waiting but I didn't fill out any such document. They just told me to send a note requesting the move with supporting evidence. At first I just sent an email request and rec'd the following response. This is for your info so you'll know what to send. Hope it helps!

Hello, did anyone ever respond? My husband had moved to Yemen after our marriage (for work) so we filed stating Sanaa as the location. He has since moved back to his home country of Nigeria and I would like to change where he has his interview there because it will be too hard to travel back to Sanaa. Any suggestions? That's exactly what I did regarding the DS230 and it was fine. As for the interview, she will be interviewed in the language that you communicate with her. This will attest to your validity of your relationship. My husband had proof of all of our conversations in French, thus this was the language he was interviewed in.

ARREST RECORD: If any applicant has prior arrest record(s), he or she should submit police certificate(s) showing a record of all arrests, the reason for the arrest(s), and the disposition of each case. The documentation must cite the section of law covering the offense

Consular officers know from which countries and under which circumstances police reports are available or not. (Google "reciprocity by country") If you have used the prescribed procedure and were officially informed a police report was not available to you through the source stated on this DOS website, provide that official notification in lieu of the report.

Oh and just to let everyone know, I'm not the type to not read directions and just ask questions so I won't have to read! I read all of those guidelines and contacted the Department of Justice (for Vietnam) by phone. I was hung up on 7 times and then finally given a website that was entirely in Vietnamese so I couldn't read any instructions. In case anyone can help with translation, the website was www.congan.com.vn. I also sent them an email with my husbands passport copy and details of his time in Vietnam. Still waiting...

Thank you pushbrk. The issue now is just getting that sentiment in writing. From Bangladesh I was told that they don't provide police reports to foreigners but they haven't agreed to provide me with a letter stating that as of yet. Still waiting on Vietnam though!

Has anyone NOT sent in the police reports/clearance certificates for a country because they were no longer in that country and NOT gotten an RFE? I am asking because trying to get a police clearance for a foreigner from both Vietnam and Bangladesh have been just about impossible, especially when we both live outside of those places now.

i perfectly understand your comments. there is a fine line between anxiety, panic, and sillyness. i just joined today and already posted several questions some of which i get confused of because of "overthinking."
when i started my journey, i told myself keep it simple, read the instructions... then sometimes, the more you know, the more you get confused as well... good thing there's VJ.

So true triaxxx. I tried to "keep it simple" but I don't think the process will let you. There are things that aren't explicitly written that I've had to learn from VJ. Thank goodness for the site!
