My K-1 visa was given NOA2 on September 7th and then forwarded to my local embassy on September 16th. My medical is booked for October 4th.

Being that it’s impossible to predict when a visa will be completed, my fiancée and I have planned to have a informal unofficial ceremony with friends and family in the US on November 12th – I’ll be flying out on November 10th. I have a flight home booked for November 20th, with the intention of completing my application then (not realising the process would be as quick as it has). I now realise there is a minute chance that I could get my visa before I go, assuming everything goes ok.

If that could happen, it would be much more preferable to us; our unofficial ceremony would become official and I would just cancel my flight home. I’ve come to question 18 on the DS-157 form – have I made any specific travel arrangements? Obviously I will tell them about my flights, but is it appropriate to write here that if there’s anything that can be done to get my visa before I go, it’d be greatly appreciated? Should I just say I’ll be coming back on the 20th and not mention at all that I’d like to get the visa beforehand so that I didn’t have to? How do you think I should put it?


It's highly unlikely they're going to change the processing time for your case just because you've already made arrangements. In fact, they're pretty adamant throughout the process that you don't make any prior arrangements until you've got the visa in your passport. It looks like the consulate in London is running about 2 1/2 months from the time they receive the petition until the interview. There's a chance your interview will be scheduled in the middle of the time you planned your visit to the US.

If I were you, I'd cancel your plans for November, and tentatively reschedule for January. I would then write on the DS-157 that you hadn't made any travel arrangements yet.

Arrested??? That at first I heard that. As long as you are married within 3 month, you are fine. While you do need to file for AOS the sooner the better, you are not really out of status. Since you complied with K-1 Visa Requirements


Yes, a K1 visa holder is out of status when the I-94 expires, even if they've married the K1 petitioner. Being out of status does not affect their eligibility to adjust status.

Being arrested is unlikely unless you like to tempt fate and journey close to the southern US border, or otherwise have an encounter with CBP or ICE. Being dragged in front of an immigration judge is even less likely. DHS policy is not to attempt to remove someone if they are clearly eligible to adjust status. About the most serious thing likely to happen is you'd be jerked around by ICE for a few hours, and then released with an admonishment to file the AOS.

A word of caution about AP...

Many K1's are scheduled for an interview at a local USCIS office when they adjust status. The interview letter often comes soon after the EAD/AP are received. If the alien leaves the US with their AP and then gets scheduled for an interview then they need to be prepared to return in time for the interview. If they miss the interview then the AOS will be denied and the AP will be revoked, leaving them stuck outside the US without permission to reenter.

If your wife uses the AP then make sure her plans are flexible, and that she can return to the US on relatively short notice if needed.

Be careful! You're going to need the NOA2 approval notice for the adjustment of status filing. Since you've already gotten an RFE that means an adjudicator already has your petition. It probably won't be long before it's approved, presuming you don't get another RFE. Even if you fire your attorney now, there's a good chance the NOA2 is going to be sent to him. If his terms say that he isn't required to surrender any documents to you then you might have to pay to get another copy of the NOA2.

I would cool my heels a bit and wait for the approval. Once the petition is approved then the attorney is out of the picture for the remainder of the K1 visa process. Try to get the original NOA2 from the attorney. If they won't give you the original then at least get a good quality copy of it. A second generation copy will probably be good enough for AOS. Once you've got that then you can fire your attorney without any future negative consequences.

If by "plane tickets" you mean boarding passes then those are good, provided they have the date and the passenger's name. On the other hand, if what you've got are essentially receipts for tickets then those are not so good as they only prove someone bought a ticket, but not that they actually traveled. If the boarding passes involve international travel then having passport stamps to back them up is extremely helpful. Things sent through the mail are not evidence you've met.

The pictures do not have to be mushy or overly personal. You should both be recognizable in the photos when compared with your passport pictures. This doesn't mean the photos need to look like mug shots, but they're not of much use if either of your faces are obscured. The USCIS adjudicator will only care if the pictures show you two were together, but selecting pictures that show you're enjoying each other's company can be helpful at the interview.

Relationship evidence isn't required with the petition. If you choose to include it then you're frontloading for the consulate. Whether frontloading will help and what sort of evidence is good to frontload will depend on which consulate you're dealing with, as well as your own personal circumstances. When someone chooses to frontload I usually suggest they do so sparingly (the CO isn't going to look at 100 pages of IM transcripts or Skype records), and to frontload evidence that addresses what you believe might be red flags in your case.

Well I have a few questions to ask members of this board. Let me start with my story.
I met my fiance in Hue Vn. 2008. We had our Dinh Hon "engagement cerermony" April of this year.
I sent my K1 petition the following month and the us embassy in Vietnam replied to her begining of Sept.

They requested 2 forms sent to them to set up a interview date, form Ds 230 can't remember the other form number.
Wedecided its best to send it out mid November because she is due Dec. 6 were having a baby girl yay.
Well My question is how long does the u.s embassy in Hcm take to complete the Report Birth overseas document?
I plan on being in Hcm during my fiance interview. Im pretty much clue less on how the process works.
Maybe someone here can shed some light on this situation. Another thing is I told my fiance to leave the baby at home with her grandmom in Hue.

She dosen't want to,So how many days do you all think I need to be in Hcm to complete all the paper work so she and my wife can have a visa to enter the us? I'm leaving the end of November and plan on returning after Lunar New years Jan 25 2011! Well do you think I should extend my stay there until they both have visas? That way I won't have to make a second trip home to bring them here.

She won't get a visa until after the CRBA has been issued. First, read the CRBA instructions for the consulate in HCMC:

All three of you should attend the CRBA appointment if at all possible - you, your fiancee, and your baby. Make sure you have all of the documents listed on that website page.

I've seen a CRBA completed in HCMC in as little as three weeks and as long as three months. You don't have to wait in VN for the process to be completed. You just need to try to be there for the initial appointment.

The child will not be getting a visa. It will be getting a US passport. I suggest you also get a VN passport for the child. If you don't then you'll need to get an exit visa from the VN government or the child won't be able to leave VN.

You want to tell me where USCIS has ever said anything about money transfer receipts? In fact, where has USCIS ever said they want "proof of relationship"? Proof of a relationship is not relevant for approving a fiancee visa petition. USCIS only requires proof that you've met within the past two years. Anything else you send is frontloading for the consulate. That also means that it's going to depend on the consulate whether or not it's good evidence.

I've seen this evidence work both ways at the consulate in Saigon. I saw one case where the petitioner was introduced to the beneficiary by a relative of the beneficiary's who lived in the US (that's considered a red flag at that consulate). The petitioner barely had enough income to qualify as a sponsor. The beneficiary produced receipts for monthly remittances from the petitioner. The consulate concluded that the relationship was a sham for immigration purposes. They concluded that the petitioner could not have afforded those monthly remittances on their income, and they were probably getting the money from the beneficiary's family in the US in order to help manufacture evidence for the interview. The "mail order bride" scenario never comes up in Vietnam. There is an abundance of beautiful young girls there who would jump at the chance to get a visa to the US. If somebody were looking for a "mail order bride" then they wouldn't have any trouble finding one without having to pay anyone.

The scenario where the beneficiary's family is working behind the scenes the help the beneficiary immigrate is common in east Asia, but not as common in other parts of the world. Regular remittances in some African countries might be seen as an indication that the petitioner is being manipulated to support a ghost family that's waiting in the wings for the beneficiary to help them immigrate to the US. In some former Soviet Union states it might be seen as evidence that the beneficiary is a gold digger, though in those situations the beneficiary usually drops the relationship and moves on to greener pastures without ever actually applying for a visa.

The only way to know for sure is to know the totality of the circumstances for the petitioner and beneficiary, and to know how that particular consulate views evidence of money transfers under those specific circumstances. In many cases, the best advice is to keep the evidence but don't present it unless it's specifically asked for.

Let me reiterate, filing an amended tax return and claiming fewer exemptions IS NOT ILLEGAL! We've given this exact same advice to some VJ members who were self-employed, and had more than sufficient gross revenues, but whose total income after business deductions was below the minimum requirement. We've told them to bite the bullet and file an amended return with fewer business deductions, take the tax hit, and get a tax return that shows sufficient total income.

The tax laws permit you to take exemptions and deductions which you're legally eligible for in order to reduce your tax liability. The tax laws do not require you to take any exemptions or deductions, even if you're qualified to take them.

It doesn't sound like the attorney is trying to get her to change her household size. He's trying to get her to reduce her exemptions on her tax return, thereby increasing her taxable income to make it sufficient to qualify. This is not illegal. You aren't required to claim every exemption or deduction you're eligible for. You just aren't allowed to take exemptions or deductions you're not qualified for. There are millions of divorced parents who have children for whom they don't declare an exemption because their divorce settlement gives that privilege to their ex-spouse. Those children are still considered part of that parent's household size, even though the parent doesn't claim the children as dependents on their tax return. The only exception would be children who are too old to impose a child support obligation, or a parent who has lost their parental rights as well as any potential obligation for future child support.

In short, declaring someone as a dependent on your tax return automatically makes them part of your household size for the affidavit of support. NOT declaring someone as a dependent on your tax return increases your taxable income, which may help you reach the minimum income level for the affidavit of support, but it does NOT automatically exclude that person from your household size.

This attorney has a fundamental misunderstanding of how the affidavit of support is evaluated by the consular officer. The attorney is presuming that they will focus only the tax return in determining if her affidavit of support is sufficient. There's virtually no point in pumping up prior tax returns since she's currently unemployed. Her situation seems straightforward - get a job or a joint sponsor.

The AP is not because he's male and a Muslim. It's because he's a male from Pakistan. The AP would still have been likely if he'd been a male Christian from Pakistan. It would have been less likely if he were a male Muslim from Indonesia or Malaysia. Being a Muslim is not a potential inadmissibility. Being a member of a terrorist organization is. Being from certain countries increases the potential that he might be a member of a terrorist organization. That's why the CO specifically asked about Afghanistan. An Afghan who migrated to Pakistan would have a higher chance of being a member of a terrorist organization than an Afghan (by race) born and raised in Pakistan. Virtually every Afghan Taliban member currently living in northwest Pakistan fits the former description.

To the OP: Go to the consulate and request that your passport be returned so that you can renew your visa in Ireland.

It states this requirement in every instruction file for every form that you will ever file with the USCIS

"COPIES: Unless specifically required that an original document be filed with an application or petition, an ordinary legible photocopy may be submitted. Original documents submitted when not required will remain part of the record, even if submission was not require."

So submit photocopies as the originals will be kept and not returned--then all you are left with is a copy assuming you made any. I make it a point ot never give up an original unless I have a very very very good reason to. I try to see if a photocopy or a certified copy will work because once that original is gone it is gone.

For the interview you should take in the original and a copy. Typically they will look at the original and take the copy and make a note that it is a true and exact copy of the original. If you only have the original they may make a copy of it or they may take the original.

For the petition package, the only things that need to be original are documents or forms that either the petitioner or beneficiary must sign. Everything else should be a photocopy.

People occasionally get an RFE for an original document after they sent a photocopy. Usually, this is because there's something unusual or suspicious about the copy - perhaps it looks like there was a correction made on the document. If this happens then send the original along with an additional photocopy, a brief letter asking that the original be returned to you after they inspect it, and a self-addressed and stamped envelope. After they examine the original document they'll return it to you and keep the photocopy in the file.

Originals should also be brought to any interview, for the same reason as above. The CO or IO may wish to examine it. They usually won't keep the originals unless they don't have a copy for the file, and you didn't bring an extra copy for them to keep.

To play Devil's advocate a bit here - If you met this man at home in New York, you had known him for two months, you were able to see him every day, etc... - ask yourself honestly, would you be planning to get married? Would you be even thinking about it yet? There are MANY factors involved here, and the transition to a new country is not easy for anyone - Your fiance will not be able to work for 6-8 months after he arrives, or even start looking for work - He won't be able to drive, he won't have any friends here at first, there will be many aspects of life in the US that he just doesn't get at first - These are all huge challenges to get through - even something as simple as the difference in food - in order to make it through all of this as a couple, you need to have a truly strong foundation - one that takes time to build.

We all know how hard the distance is, but it takes time to develop a solid enough relationship to survive the struggles of this process - If you love each other, that love isn't going anywhere - Why not get things sorted out here first - find a place to live, ensure that your income is enough to support you both, visit a few times, deal with your family, etc... - before thinking of filing?

Since we have met and I don't have a passport, is it a must to attach a photocopy of my passport for the G-325A? I am not sure whether my birth certificate is good enough to proof my US citizenship. Please advise. Thank you.

I have never seen anything that says you must have a valid passport to file the I-129f. You generally use your passport to prove that you have visited your fiance's country, and it can double as proof of citizenship. But since it is a requirement that you send your birth certificate, I image that the birth certificate carries far more weight as far as proving your citizenship then your passport does. Hopes this helps.

We did go back to social security and I found out that Homeland Security actually entered him as an F-1 visa and not a K-1 though they wrote K-1 on his I-94. So social security is just waiting for Homeland Security to fix their error so they can issue a number to him.

We tried to get SSS at embassy no go. Two weeks after entry to us, they will have information in computer to get SSS. With SSS you can most likely get drivers license.

Wish it was that easy. California DMV doesn't want to give him a license until he receives his employment authorization.
They did have his info in the system. Just not sure what the 30 days is about. :huh:

She doesn't know her job. Go back and do not leave until you have a receipt for your applocation. You may have to hack your way through several untrained employees. There is an SS administration directive here at this site. Print it and bring it with you so you can train them

DO NOT allow ignorant government employees to make this more difficult than it has to be. YOU need to know the law and makw sure THEY follow it.

My wife had her SS number 16 hours after arriving and the card in her hand 6 days after arrival, anything else is not correct

I didn't think it needed to be that difficult. So should I send him back? Or wait a week or two?

SEVIS is for student visas, so the person was confused (which is de rigeur at SS offices). Hopefully she didn't input you as a student visa holder. The approval notice you need is the NOA2, the approval for the I-129F.

Also, should be posting in the AOS forum! :)

I thought SEVIS was for student visas. And she asked him questions about when we are getting married and stuff like that so I am pretty sure she realizes he is not holding a student visa (I hope).

My fiance went to obtain his social security card today and the lady took his information and also asked for a SEVIS number :blink: What is this and should we have one? She went ahead and collected information from him and just said the rest is up to Homeland Security and it may take up to 30 days. Is this normal?
Also should we have been given sometime up approval letter when we were approved at the consulate? Looks like we will need something like this for AOS and we didn't receive anything like that. We found out we were approved via their website and all they gave him was his visa.

our visa process was a difficult one because of the wrong and at times unnecessary information users share from time to time.case in point,the other day i was going through k-1 form,trying to catch up with the new information and possible changes that i thought uscis might have made.i came accross a post from a member asking about information regarding AOS and how long the time frame to file aos in was.some member mentioned that AOS has to be filed before the visa expires which is wrong,because its true that if you dont file for AOS before your visa or other cards and information expire,the time you spent in the US is considered over staying,but its forgiven base on the marriage when you do file for AOS.
needless to say when i saw that i started doubting and wondering whether or not that was true.
to sum it up,i spent 4 sleepless nights looking for that information,so from an old member to the new ones, double check each and every piece of information you see on this website

Was I involved in that conversation? :blush: Because I posted something like that and was corrected by another member in the same forum and how grateful I am for that. It is true, none of us have much experience outside of our own and I think common sense says you should look at information here as well as other places until you are certain you have the correct info. But these forums do give us the opportunity to learn, share and teach others. But again common sense should prevail and everyone should check and recheck the info they read here and correct others when the see an error.

First time reson for refusal was cuz my dad filled petition F2B for me, the other time when i asked for b2 visitor visa the "tourist agency" who filled Application(cuz my english was so bad) for me DS-156 didnt said that i was in past asked for B2 visitor visa or that i have pending F2B visa, but this is not reson for refusal my visitor visa, the consular office said thet i not have ties in my country, i not have the job,... I'm now engage to US citizen, he filled i-129f Apllication for me, but the problem is my incorectly filled visitor denied visa, does it look like misrepresentation under section 212a(6)©(i), am i elgable for K-1 visa, please someone help me. All I know that if you file for several visas or even file for a specific visa several times and are refused, this can raise flags. That is all I know. The more you apply and especially with different types of visas the more desperate you appear to come here.

I've always called my fiance with a calling card. I called the calling card company today and they told me I could not get records, if I wanted them I would have to contact an attorney. I immediately set up an international calling plan with my cell phone company (they provide records online), but I have no way to prove past calls from calling card. I have the calling card and proof that I used it on my cell records, but it does not show who the calls were actually made to. My petition is at NVC now, how long will it take until the interview? How many of months of phone records should be provided at the interview? Will the calling card and proof of use on phone records count for anything??? I'm so stressed!!!

Whatever you have will have to do. Try not to stress about what you cannot control (easier said than done I know). I would like to suggest to you though, I know cell phone companies usually charge an arm and a leg for international calls, I used Pingo to call my now husband and pingo gives you an online account and you are able to check your phone records for up to one year.

I called the NVC and they received our petition today. The lady said allow 10-20 business days for it to be processed. Does it really take that long? From other people timelines it looks like it's in one day and out the next!

I really does depend. But usually it doesn't take more than a couple of days (check out our timeline). When I called to talk to NVC they were always very friendly and helpful. They told me that NVC is basically just a stop for our case, that they basically enter our information in the system and send it out it's way. I know at this point in the process you feel really antsy, especially after waiting for your NOA2. After NOA2 the process is pretty smooth for most. So don't worry untill next week. hi guys thanks for the answers got another question am about to start my K-1 soon this week but been collecting details as with the proof of current ongoing relationship whats most important to include and up to how far back i should provide the info. As for me we do alot on facebook communication and yahoo chats so should i include all that and what about the phone and texts how far back and how many is adequate without it being too much coz i have tones of phone records and texts .Guys please i would appreciate your help thanks good people.

In our K-1 packet I didn't provide proof of our ongoing relationship. All I provided was my boarding passes, passport stamps, hotel and ATM receipts from my visit.
However, many people think that a petition should include this information and best advice to keep the petition "light" so to speak would be to include bits and pieces basically. Chat logs, phone records, etc. from the beginning of your relationship, maybe a quarter of the way through, half way, three quarters, and something recent. Just gap it out a little, that way they see the contact over an extended period, but not in great detail. As far as email and facebook, you could just show an inbox printout, that is what we did for the interview.
Ultimatly though, you have to include in your petition what YOU wish. You are paying them money, you should include what you like. If it helps you sleep better at night knowing you sent them 50 pages of proof, then do it. It's your petition, do it your way, just making sure to include exactly what the have asked for and everything else is extra to make you feel better.

Where does all the information coming from on this site.I know other visa people but what about the time line information does this site have insiders and how come I going down on the list and not up as people get approve?

The information here is mostly a culmination of people's experience. That is what we do here, share our stories, ask questions, and rant and rave if we need to. You shouldn't take everything here at face value, not everyone knows the right answer. I have unknowing answered questions wrong on here, but fortunatly someone seems to always come along to correct another's mistakes and everyone learns.
As far as the timelines go, the previous posters are correct. The timelines are averages based on the members personal timelines. You cannot use them for accurate projection, but they can help to give a basically a ballpark figure of when you should recieve an approval.

As in all our cases, the burden is to provide PROOF that is convincing that you are truly a couple (in love) and with the intent to remain together after the foreign partners entrance into the US.

Whether that love is 1 month old or 10 years old matters little (except that the longer relationship has more tangible evidence if they have visited one another).

The only requirement is that you have met within the last 2 years. My fiance and I only knew each other for 6 months before we filed.

just received my I 797c and realized I made a error on my fiances year of birth 64 verses 63. Her G325 is correct. The 797 shows the incorrect year due to my typo. The 797 says you can call to change a error? should I call or what should I do?

Then I would call to change the error if that is what the 797 says. It is best to do it now instead of them bringing it up later.

The Texas Service Center received our K-1 package on September 9, and I have not received any notice of payment processing since then. Is this the normal turnaround time, or should they have taken the payment already?

I am aware of the 2-3 week waiting period until the first NOA, but my fiancee has informed me that the payment processing period is taking peculiarly longer than other cases we observe. I appreciate any help!

Sometimes they take longer. Don't get worried just yet. I would say give it a few more days. Maybe call USCIS on Friday and see what they have to say about it.

Is it crititical to have over 5000 dlls in bank account for the affidavit of support? I have a stable job and am way above the poverty line limit. I got a letter from my employer, and i own a home, do i still need the bank account statement? And how much do i need?

We tried to play at safe. We included everything we could think of to establish proof. But tax transcripts from the previous 3 years should be proof enough.

Hello,

If someone can help me to understand, i would greately apprciate it. I called the USCIS but they dont know (which is strange).

So, i recieved this notice, I-797 Notice of Action letter. It is an approval notice for the K1 petition and it has valid dates saying from this date to that date. What do these dates mean? Are they saying my fiance has to get the visa within these dates or she get an interview or make the appointment for the interview? In my case, we can only make appointment for the interview. After that who know how long it will take.

If this date is not enough time, can i request for an extension?

I don't know the exact answer to your question, but I can tell you that you have nothing to worry about. They will extend it on their own if it comes down to it to the best of my knowledge. I have seen this question before just can't remember the explanation for why they do this, but I do know you need not stress about it. Hopefully someone will come along with a more informative answer or you can try searching for something similar here on VJ.

Hi guys! I know its another week for NOA2 approvals... We're not expecting ours anymore... I know in God's time it will come unexpectedly.. I just wanna know if there someone in here who has the same experience as mine.. I studied in Sydney, Australia for 2 years and now im back here in Philippines so my fiance could file for fiance visa.. So, it means i should get a police check from there right?? (so stressed out on how to get one :( ) But i talked to some friends who had their interviews already and they said that the interviewer won't ask the police clearance from abroad, what important is the NBI clearance only?? :D Is that true at all?? Please enlighten me about this... thanks guys! :help:

To the best of my knowledge they want a police clearence from every country you have lived in for 6 months or more since the age of 16. Of anything find the number of the police department where you were and ask them how you may request one. It's best to have all of your bases covered.

I was looking at http://www.visajourn...m/content/times, how is the "USCIS Processing Time Statistics" on the right obtained? Couple of days ago, "processing time CSC: 66", and now it's 105. It can vary this much in such a short time? Thank you very much!

I would assume because your in Cali it would go there, ours did anyway. The statistics on VJ are obtained from the information members input here regarding their cases and an average is figured to the best of my knowledge.
