N-400? I'm not sure where you think that comes into play. Your fiancee has no claim to US citizenship. Your child does, though. Let's deal with the child first.

You need to file a consular report of birth abroad. You'll need to prove that you are the biological father. You can start your research for this here:

Once the CRBA is approved then your child will get a US passport. The child won't need a visa to come to the US because it's a US citizen.

For your fiancee, it's your choice - K1 or spousal visa petition. The K1 is a tad faster to get, but it costs more in the long run because your fiancee will have to adjust status after arriving in the US and marrying you. The spousal visa takes a little longer, but she'll get her green card automatically shortly after entering the US - no adjustment of status.

Understand that she doesn't automatically become a US citizen after marrying you, whether she marries you in Mexico or the USA. She'll be eligible to become a permanent resident; i.e., to get a green card. Once she's had her green card for three years, and if she's still married to you, then she can apply for US citizenship. It will be years before you'll be thinking about the N-400.

It's ultimately up to the discretion of the consular officer, and there are many variables involved. If his pay is enough that he will clear the minimum requirements by a comfortable margin then that improves the chances they'll accept it. If he'll barely clear the minimums then the chances are less. More time on the job seems to help, as well. Many states allow an employer to give a probationary period during which they can drop the new employee for any reason. After the probationary period ends then they'd need cause to fire somebody. If a consular officer takes this into account then they'd be more comfortable with a sponsor who had gotten through their probationary period and still kept their job. Another thing that can set them off is if his prior income was erratic - up one year and dramatically down the next, for example. It also doesn't look so good if his tax returns show he worked for two or three different employers in one year, and two or three different employers the next year. That makes it look like he has trouble keeping a job.

The CO's in Manila seem to be pretty fickle about this stuff. Some people have gone in with an employment letter and six months of paystubs and ended up being turned down because last year's tax return wasn't good enough. Others have had virtually no prior work history, no taxes paid in the prior year, and only a few months worth of paystubs, and they got the visa. The thing is that the "public charge" determination for a K1 visa is entirely discretionary, and CO's often use the discretionary factors to deny when they feel 'iffy' about the case in general.

I'd say get the letter of employment and keep all paystubs, and then hope for the best.

The word around here is that the embassy in Manila almost never accepts a joint sponsor for a K1 visa. The exceptions to this seem to be if the petitioner has a very good reason for not having sufficient income, but has good potential for future earnings (a college student or recent graduate, for example), and if the joint sponsor is a close relative of the petitioner or the beneficiary (more likely they'll step up when it comes time to sign the I-864 for adjustment of status).

Tell your fiance to get busy and find another job.

I think he's clarifying that the visa is used to enter the COUNTRY - one time only. You don't need a visa to travel between the states.

If the home is jointly owned then they probably won't accept it. It doesn't have to be paid off, but she would have to submit proof of ownership, a recent appraisal from a licensed appraiser, as well as recent documentation of any liens or encumbrances (i.e., mortgages) in order to prove the amount of equity that's available. The problem is that the consular officer will probably not consider that equity to be available to her because she'd need the approval of the other co-owners in order to borrow against it.

Cars can be used, but not if it's the sponsor's only car. One of the fundamental requirements for assets is that the sponsor must be able to convert it to cash within 12 months without undue hardship or financial loss. Selling your only car is considered "undue hardship". In fact, it's one of the scenarios specifically disallowed in the I-864 instructions. If she owns multiple cars then she can declare all but one. Again, she'd need proof of the cars resale value and proof of ownership.

Life insurance can be used if it's the type that has a cash-out value, such as Whole Life. Term life insurance policies usually cannot be cashed out. Again, proof that she owns the policy and proof of it's cash-out value.

Some experts on K-1 visa suggest to front load in order to avoid delay. Give the USCIS more than they need, what they don't need they can disregard according to them. Any opinion on this? Is it really help to front load?


Spend some time studying this forum, especially the regional forum for East Asia. Front loading isn't intended to help get the petition approved. USCIS can approve the petition if you've met the minimum evidence requirements. Front loading is intended to help at the consulate stage because any evidence you include with the petition is going to be forwarded to the consulate. In order to be useful you need to know what to front load. If you know what circumstances might be considered red flags at your consulate, and you have any of those red flags in your own case, then you can front load evidence to address those red flags and make them less suspicious. However, if you front load the wrong evidence then it could backfire on you. Remember that anything you front load is information the consular officer probably wouldn't have if you didn't give it to them, so make sure you don't give them anything they can use against you.

Also, make sure your fiancee knows everything you've front loaded in detail. Often, when the CO asks a question they don't really know the true answer, and they're just fishing for some dirt. However, in the case of front loaded evidence, you've given them the correct answers. Your fiancee better know them, as well.

Do not send anything for your fiancee's kids. Just make sure they're listed on the I-129F. If they're under 21 then they'll be eligible to apply for derivative K2 visas at the same time your fiancee applies for the K1 visa. You're not petitioning for the kids. You're petitioning only for your fiancee. The kids eligibility is derived from your fiancee's eligibility.

The G-325A needs only one copy. An old version of the form required 4 copies, but that version was replaced a couple of years ago.

I am planning to use my step-father as my co-sponsor. He wants me to fill it all out on the computer and then he will check it over and sign it. I know that I will have to list him and anyone living in the home, as well as me n my hubby(beneficiary) in the household size section of the I-864. However, I am having some dificulty determining where I am supposed to include myself. Would it be :

Also....My mother has no income other than social security. I know that is not accepted on an AOS so do I just simply not combine hers with my dads or list her income anywhere on the AOS even though she is a member of the house hold and has an income?

Does your dad claim you as a dependent on his taxes? Do you live in the same household? If the answer to both of these is "no" then your dad does not include you in his household. He does include your husband because he's the sponsored immigrant.

There are only two ways to include income from someone other than the sponsor on an I-864. One is to include income from the intending immigrant, but only if the intending immigrant is the spouse of the sponsor or is living in the same household with the sponsor. The other is a qualifying household member who submits an I-864A. A qualifying household member is either a qualifying relative - spouse, parent, or child, or someone whom the sponsor claims as a dependent on their tax return. You don't include your mother's income (or anyone elses) on your dad's I-864 unless she's going to submit an I-864A and provide her own financial documents.

The OP is in the initial stages of a K1 petition, she has not even gotten her NOA2 yet, so it most certainly does not mean green card production in this case.

Have you been calling to check the status of your case?

VSC has been much slower than CSC so being transferred there is a good thing, but still you have waited long enough already!

If it goes 30 days past the 5 month mark you can get your congressman involved.

If you have not called USCIS already to complain about the time it has taken I would do so.

One of our members was past the 5 month mark, she called yesterday morning, and last night she got the NOA2 e-mail.

The best course of action is to educate yourself about the sponsorship requirements and explain them to a trusted friend. Namely, the requirement is NOT that the sponsor has to give the immigrant money, just that IF the immigrant uses welfare or the like, the government can ask the sponsor to pay that back. You, as the spouse will be the primary sponsor, so the gov will go after you first.

Your future husband can become a USC in 3 years if you remain married and the sponsorship your friends signed will no longer be in effect. Most chances are that nothing will change for them.

Many times if you can explain in detail what this person is signing up for they may feel more comfortable agreeing to do so. You could print up form I-864 and it clearly states above the signature what the signee is agreeing to. Print one out and show it to your friend.
And it is ok to be "desperate", though I don't view you as being desperate. This is the man you love and you should be trying to exhaust all avenues to get him here. If no one wants to sponsor for you, the only suggestion I have, is contact a church, tell them you need help and maybe someone will want to help. It may not work but its an idea and it also to gives someone the opportunity to feel like they made a difference in an otherwise struggling single mother's life. I'v been there and it sucks, but there are more people that want to help then we think. Keep up hope and keep fighting for your man and don't let anyone tell you different or call you "desperate".

We have our interview on October 27th in Ankara. We are not buying our ticket till after we hear approval. But my question is ...Does the flight have to be into only USA stops. I found a flight that would be Istanbul to Rome then to Orlando....Could he do this?

It shouldn't be a problem. My husband had a connecting flight in Hong Kong from Dubai. They gave him a bit of a hard time in Hong Kong because he did not have a round trip ticket and if he was not given entry to the US (even though they saw his valid K-1 visa) they were concerned with being responsible for his flight home. All ended up fine, but did cause a little stress. We both agreed it would have been better to take a direct flight. So if this is an option you may want to got this route and if you can't it should be fine. I'm not trying to worry you, I just wanted to share our experience to give you an idea of what the worst case scenario may be. Best of luck!

You will want to equip your beneficiary with any evidence you can get together proven your relationship chat logs, phone logs, etc. Make sure you I-134 is filled out and one for your co sponsor if you're using one. Well, after 208 days for the whole process, my fiancee leaves Paris for the US on Monday. Thanks to this marvelous forum and website for the help and info. Guess I will be moving on to the AOS questions pretty soon.

Lesson to be learned: Make sure you have ALL your police certificates from where the beneficiary has lived. Makes the process work a little bit faster.

hi iam under k1.i applied for my ssn yesterday with my husbands last name.but the lady said that there will be no middle name on my ssn coz there is no middle name that i put on my I94. well to those who fill up their I94 there is no space there to put your middle name right???so i didnt put anything, only my name and family name. So when i applied shes looking for my middle name on my I94. And the outcome is, on my ssn card my name and my husbands last name only. Will there be a problem on this when i apply for my ssn?did anybody experienced like this?any idea pls

My husband had written both his first and middle name on the first name line. Social security told us his name on his card would appear as though his middle name were also a part of his first name because that is the way it shows on the I-94. Honestly, I don't think it is a big deal. My original social security card only had my first and last name on it and now it has my first last and middle. I never had any problems and I was born here. So no big deal, don't worry and like the previous poster said, when you go back to apply for your permanant card insist they put your middle name.

Your case will be sent to NVC and shouldn't spend more than a few days there. NVC will then forward it to your beneficiaries embassy. After the embassy gets it, I don't know what happens, but check this link out http://www.visajourn...ines&cty=Manila
You do not need to be at the interview and some embassies will not even allow you to attend. I am not sure about your beneficiaries country, but I was allowed to attend the first portion of my husband's interview and some say and I too believe that it can be helpful to attend.

Hello VJ community,

This is my first post. I, a US citizen, am about to send in the paperwork for the K1 visa. However, my hesitation is that my fiance in Africa changed her birth date on her birth certificate and passport in order to increase her chances at employment in her country somewhat recently. Is this something that should be corrected before filing the i-129f? From what I've been reading in these forums, it appears that a serious attempt should be made to change it and if the change fails it must be documented. In either case the correct birth date should be used if I'm not mistaken. What are your thoughts? Am I on the right track?

All I can say is honesty is the best policy. If somehow some way USCIS finds out that that is not her actual birthday, then it was cause a lot of problems. I would try to get the correct birth date put on her documents before filing.

My fiancee is in Hong Kong and I need proof of relationship since she has no access to internet. I just signed up with Rebtel calling card and bought $25. I have an important question about this. On my account, it does show my number and it also shows my fiancee name and duration of every call on the history, But it don't show her number. Is that a problem, and how can I fix it. What did you do when you used Rebtel? or instead of putting her name on file, do I put her number? what do I do, plz let me know asap and once again thanks for your info and help. Rebtel is a paying service so can anyone answer me?

I do not know anything about Rebtel. But I did want to share with you that we used Pingo. With Pingo it shows all of your calls on a log that you can print. It shows a billing record and everything and was very inexpensive and easy to use. So if you can't get your situation figured out with Rebtel, Pingo may be your best bet.

If you tax transcipts reflect that you make that much money, your employer verifies your employment and you show a few months of pay stubs, I truely do not think you will have a problem. Also, if you are worried, line up a co-sponsor if you can just in case.

Hello all. Every time I think I have enough information to complete the paperwork I get stumped again. I think I'm almost there.

On the I-129F cover letter example it wants me to list the "Address of your service center". What is my service center and where do I find the address?

On the Fiance Letter(s) of intent it wants me to list the "USCIS service center address". Is this the same lock box address I send the whole package to, or is it a separate location? Underneath where it wants the "USCIS service center address" it says "or when submitting for interview" and then it wants me to list an embassy address. I'm kind of confused about all this. I also have a tendency to get anxiety and over-think / over-analyze things...so as you can imagine I'm stressing out about all of these little details. I just want to send the packet so we can get the process moving! :o

I'm also wondering about getting these documents and letters signed by my fiance....will they accept a 325ga form filled out by my fiance and signed but then faxed to me (so they aren't receiving the original signature)? Can I sign her name with her permission? Or must we really pay for a carrier and then wait for them to deliver the documents with her signature?
I know a woman who moved here on a fiance visa and she said she gave her husband permission to sign the form for her and they never had any issues. Is this one of those deals where you shouldn't do it, but there's a 99.999% chance you will have no problems?

I have a few more questions but for now we'll start with those. Thanks to anyone who takes the time to help me.

I have seen here that putting the address is not important. I put an address on our letters. I believe I just put the Dallas Lockbox address. I do not believe this is an issue that is going to cause your petition to be denied or delayed.
As for the forms, it is always best to play it safe, so have her print the forms sign them and send them to you.

I read a lot of differing opinions on how much stuff to send. I have no problem with meeting requirements In fact my thing is just how much over the Min do you need to list for assets. I really don't feel comfortable send a total finical disclosure.

And does anybody else worry at all about sending that much confidential info , Copes of Tax returns, Letters from banks, check stubs,. if that all fell into the wrong hands someone could really have a field day with it.

We used 3 years of tax transcripts, a letter from my employer and a few paystubs. I also printed out 6 months worth of bank statements. What I see advised most often here is tax transcipts, employment letter and paystubs.

I dunno what that is inside and what it says but I heard it will say "DO NOT OPEN". Only the authorized official is allowed to open it.

From what I have heard, it is basically most of the paperwork you have filled out. Not 100% sure, but I think they are just saving money by not sending back to the US themselves. You bring it, deliver it to DHS and they hand it over to USCIS. Like I said not 100% but it makes the most sense to me.

Everyone else who was interviewed at the same time has already received their visa. It's been a week now and we don't even have a DHL waybill number yet. What does this mean? Am I being paranoid or do I just need to wait more? I called the Dept. of State and the famous 703# and both say that it's "pending" and that there are no other updates. It doesn't show approved, it doesn't show administrative processing... just pending. What do I do now?

Can you call or email the embassy? If you cannot get a response from them you could always try DOS, they may be able to help. Sounds like everything is ok though. Just give a call.

morena_boricua is right. Call ASAP and talk to someone. Email do whatever you have to do. You may even want to call DOS if you cannot get anyone there. If someone is posing as your fiance and uses that visa that would be terrible.

We ran into this problem as well. Just go back, refill the form and when the print screen comes up opt to print 2 copies. Or you can just photo copy the form you already have. I am not sure how important the bar codes matching is. We just reprinted to make ourselves feel better and it seemed logical.

My hourly wage is 25/hour and I have been working for these employers since 2006 and have all my letters from them plus a letter from my trade union certifying my membership. :help:

The tax transcript still adds up to be over the poverty requirement. My actual wages (if you add up all the W2's) are $27,000 the tax transcript says $21,000. My average wages per year are $33,000 I don't need a co-sponsor. But I just don't want any little glitch like this to screw us up.

I'm gonna kill this tax lady :ranting:

Hey so the other day I was finishing up my I-134 form and patting myself on the back about how together I was...and how organized my packet is going to be for my fiance's interview next month...and then..ta da...I discovered a small problem.

My wages/salaries on my tax transcript come out $6,000 short of what my actual W2's add up to !!! I did some math and it turns out that one of my W2's (I have 4 employers) was never submitted to the IRS ! I went down to the IRS and got a Tax Statement and all of that is correct (my employers submitted everything correctly). It turns out that the person I paid to do my taxes forgot to submit one of my W2's !!!! I have 4 different employers so she must have forgotten to include one !

I am going to call her and have her submit an amendment but the IRS tells me that this could take 3 or 4 months ! Our interview is next month !

If I just submit my original W2's, current pay stubs and the Tax Statement should that work ? Should I submit the Tax Transcript and then explain that one of the W2's is missing and then submit a letter adding up all my income etc...

Ugghhhhh...whyyyyyyy !!!! :bonk:
