After they send you the hard copy of NOA1 (which basically tells you that they received your application) they will send you another letter that will state eighter "approved" or RFE. This second notice may take 2, 3 ,4 or even 5 months from the day you got your NOA1 , or less, every case is different, some cases are processed faster , others- slower. Between the first notise and the second notice the mmigration services are doing a background check of you and your fiance, and it takes time. You just be patient, dont think of RFE , the second notice will eventually come :), it is just hectic to wait, but it is what it is... Anyway, wellcome to VJ


Actually, between the first notice and the second notice your petition is sitting in a box with a bunch of other petitions, in a room full of boxes containing petitions. Nobody is doing anything with it. It's just waiting it's turn to be reviewed by an adjudicator.

The background and security checks usually aren't started until an adjudicator pulls the petition, and it usually doesn't take very long. The adjudicator just runs the bio information for the petitioner and beneficiary through several law enforcement and security databases.

That form is optional. If you include it then you'll probably get email and/or text messages letting you know when your package has been accepted by USCIS. It's free, so it doesn't hurt to include it, and getting the notification can provide a little extra peace of mind. On the other hand, some of the document intake workers aren't very thorough, and don't always enter the G-1145 info into the system, which means some people never get the notice.

I was in a restaurant with my mother when I got the notices for my wife and step-kids AOS packages. Nine text messages, one after the other. I almost fell out of my chair. :blush:

A lot of stuff is getting glossed over here and it's confusing me...

I believe that the adjusted income I have is due to the oil spill money I receive for losses. Maybe a reason.


Then that money won't count because you can't reasonably expect that income to continue. Ongoing income qualifies. One-time settlement payments do not. However, if you've still got the money then you could declare it as an asset.

So basically I have to include my fiance, myself, and my mom(co spooner) plus the two dependents I declare as 5 in a house hold? Do I use the 100 % or 125% guide lines?

I will income 2011 next month. Can I use those taxes instead...


You must include anyone you have a legal obligation to support or that you've included as dependents on your tax return. I doubt this applies to your mother.

Others have pointed out the statement on the Department of State website that says the I-134 requires only 100% of the poverty guidelines. Ignore that statement. That threshold applies to people who are receiving other types of non-immigrant visas, and need a financial sponsor to qualify. K1's don't fall into that category because they are non-immigrant visas that allow for immigrant intent. The consulate will apply pretty much the same rules they apply to any immigrant.

You can use your 2011 tax return if you've already filed it and it's already been accepted by the IRS.

One reason I was told by a immigration lawyer was that I declared my niece in my income and so did my mother.


Woah!!! Are you saying that you and your mother declared the same child as a dependent on your separate tax returns? That's illegal! I strongly urge you to file an amended return pronto!

Another thing I was told that you can use as many co sponsors, there is no limit for i134.


Fire the lawyer. He's dead wrong. There is more than enough collective experience here on VJ to confirm that consulates never accept multiple joint sponsors with an I-134.

Here's the deal on what's allowed with the two affidavits of support.

The I-864 will allow a sponsor to include income on their own affidavit of support from qualifying household members. The household member must be related to the sponsor as spouse, adult child, parent, or sibling, OR any person whom the sponsor claims as a dependent on their tax return. The household member's income is added to the sponsor's income, and the household member is included in the sponsor's household size. The household member must submit an I-864A, which is a contract between the household member and the sponsor. This option isn't available for the I-134 because there is no corresponding I-134A, nor any provision in the law that allows for it.

The I-864 allows a joint sponsor to be used if the primary sponsor cannot qualify on their own. Only one joint sponsor can be used per immigrant. However, that joint sponsor can also combine income with their own household members. The joint sponsor submits an I-864, just like the primary sponsor. Most consulates will allow a joint sponsor with an I-134, but they won't allow household members to combine income with the joint sponsor. The joint sponsor submits an I-134, just like the primary sponsor.

You must have one, and only one, sponsor who qualifies on their own income for their own household size, including the immigrant. That sponsor can be the primary sponsor (the petitioner), or it can be a joint sponsor. This rule applies to both the I-134 and I-864. The significant difference is that the I-864 allows a sponsor to combine income with their household members, while the I-134 does not.

This means you need ONE PERSON who can fully qualify on their own, based on their own income, assets, and household size, which includes the immigrant. You cannot assemble a group of people who collectively qualify.

Another new question related to form I-134 part 7 way at the bottom where it states:

"I own a real estate valued at:_________________________"

"With Mortgage(s)or other encumbrance(s) thereon amounting $_______________________________________"


Heres the deal, "if" when filling this part 7 on I134, IF someone owns a home such as a house for example is this what they mean by real estate. Also, lets say that person is not yet owner of the house and still paying it to the bank?


Yes, a home is considered "real estate". They realize most people have a mortgage, and don't own their homes outright. This is why there's two lines on the affidavit of support. You enter the current market value of the home on the first line. You enter the sum total balance of all liens (mortgages) on the second line. The market value minus the total lien balance is the equity - this is what they will consider as an asset. For example, if the home is worth $250K, and the mortgage balance is currently $150K, then you have equity of $100K. They will consider that $100K as an asset that can be considered on the affidavit of support. If you currently owe more than the home is worth, like 1/5 of Americans currently do, then your home is not an asset - it's a liability - and it's worthless for an affidavit of support.

In order for the asset to qualify for consideration you must prove you own it, prove it's value, and prove the balance of the liens. A copy of a the title or deed will prove you own it. About the only thing they'll accept for proof of value is a recent appraisal from a licensed appraiser. They won't accept accept property tax appraisals because the tax collector rarely actually inspects your home to determine it's taxable value. They also won't accept "comparables" you got from Willow, or any other internet site that provides value estimates. Proving the balance of the liens can usually be done with a copy of the most recent mortgage statement.

Assets can be used to offset a shortage in income. If the immigrant is the spouse or minor child of the sponsor (a fiance counts as a spouse, for this purpose) then the asset can be used to offset income at a 1/3 ratio. In other words, $12K worth of assets will make up for $4K of income. If the immigrant is not the spouse or minor child of the sponsor, which would be the case for any joint sponsor you find, then the ratio is 1/5.

First course of action is to provide the US Embassy in the foreign country all the supporting evidence and make sure they receive it. Have you done that yet?
Your fiance was put on administrative processing review. This means the embassy is waiting for you and your fiancee to send them additional proof of your relationship.

You need to send them
-Photos of you two together and with family members
-Airplane tickets to visit him (vice versa)
-Skype chat logs
-Email logs



I would HIGHLY recommend you send the requested information to them soon, because the embassy will not provide an update or answer until they receive that information. Also, it does no good contact Vermont Service Center, it's beyond their control once it reaches the embassy level. You will need to contact the US State Department and they can provide you updates on the case. You need to give them the Case Number, Name of Beneficiary .

Be careful in providing info for another consulate, as they tend to do things differently.

Kingston has sent back MANY cases to USCIS for revocation based on relationship validity this year. If they told her the case was being sent back, they are done with it.

The only person I know who was able to get a second interview without having to overcome the NOIR was blessed that she was able to e-mail that very morning and address their concerns and promise to come immediately for a second interview. Everyone else has been told there is nothing more Kingston can do and to wait for USCIS to contact the petitioner.

Thanks for the advice, however all of the required evidence were submitted with original k1 petition and @ the interview.....pictures, boarding passes, mail correspondence, receipts, etc... As stated previously the Jamaican Embassy claimed that all the documents will be returned to the dept. of USCIS then I will be contacted by them when they are received... I guess now this another long wait...... :crying:

Hard truth: you are in for a long wait.
180 days is the estimated processing time on 221g refusals... and that is just the time it takes to receive word back from USCIS...

Best case scenario: the VSC sends you a NOIR (notice of intent to revoke) and allows you a certain timeframe (30 days) to respond to the consular's findings and prove the validity of your relationship. If the USCIS officer is convinced that the consular was mistaken, they will re-affirm your petition and send the case back to Kingston for a second interview.

Worst case scenario: you can marry in Jamaica and file again. (F)

But don't marry him yet, your K1 is still alive...

You need to know what exactly the consular was concerned about. You can get the consulars memo to USCIS by filing an FOIA here: http://foia.state.go.../foialetter.asp

Contact your congressman, they can also get details from Kingston as to why the consular questioned the validity of your relationship.

Get every detail (if you have not already) from your fiance'. What questions did they ask him and how did he answer??

Use all the information you gather NOW and prepare a response to the NOIR before it comes because even if they let your case expire and you have to file again, you will need to address why the initial petition was not approved. :(

Search the VJ forum and google for 221g refusal and NOIR.
There is plenty of info out there and there is always hope.


Bottom line you are alive, he is alive, and if you both truly love each other you can get through anything. (F)

from what I understand the address you put down on the I129 form is the address used to send you your notices and also the UCSIS centre. So if you have the CA address listed I think it will go to CSC. The I-134 form gets sent into the embassy not USCIS. Yes, you send it to your Fiance. He will need to check and see what the guidelines are for his embassy and whether they want it prior to or during the interview.

just signed up to VJ. I found the site whilst doing some research on the K1 visa and looking for success stories to keep myelf positive about the whole thing..this site looks perfect for this and the many questions i will probably come across along the road.


I am 27 years old and have been together with my gf Sue for two and a half years since we met online on that fateful day. She lives in Kentucky and i have been over there twice staying the full 90 days of the visa waiver. We are so madly in love that it is only something i think we both ever dreamed of..It has got to the point where it is going to be far too hard going over for 3 months and having to come back..time just goes stupidly fast and it becomes increasingly difficult being appart from eachother. Sue is an amazing woman, she is 38 and has 4 great kids with whom i have a great relationship..basically she is still married and has been trying to get a divorce for a good while now but it hasnt been easy with her husband being the way he is. We are hoping that the divorce will be signed off by the judge this thursday(fingers crossed)...

Will the fact that she was still married during the 2 and a half years we have been together have any effect on the visa application and the decission made...do they have a strong view on what on the face of things is adultery really due to the fact she was stil married when we got together even though the relationship with her husband was long over. He himself has moved on and had kids with another woman. I have told her to ask the judge if she will be free to marry as soon as the divorce is signed as one of the major requirements of the application is that you are both free to marry..i am also just really worried at the fact that there is an 11 year age difference between us (not that it really matters when it comes to love if you ask me)and she has 4 kids..we know the love is as true as it can be im just hoping the american government looks through these kind of situations..all i can do is prove and express as much as possible that we love eachother immmensely and thats all that should matter... i think im just looking for some reasurance from maybe people who have applied for the K1 visa with similar circumstances as myself.

I, too was married when I met my now fiance. I got my divorce approx. 6 months after we got engaged in January 2011. We planned to marry in Dominican Republic. I flew there for a week, in October, so that we could exchange vows. Everything was set: padrina, madrina, he had our engagement/wedding rings and honeymoon. But was refused because a woman must be divorced 10 months (now it's 8)before she care remarry. Here in the states there is no waiting period but he doesn't have a visa to go outside of DR. We were devastated!!! So when I dragged my self back here we decided to go for the fiance visa.

Anyway, like you, I hope that won't cause a problem. I didn't even mention in petition that we tried to marry there. Also there is an age difference of 9 years between us. And from what I've read that is another one of those "red flags"! but I am hoping and praying that they will see the evidence and know that we really love each other.

I was just wondering would you happen to know how to download MSN messenger chat histories? I have cut and pasted them but there is nothing really that proves it was an online chat. it has dates times and screen names but doesn't show if it is generated from messenger. need help with this in case the evidence I sent wasn't enough. I sent passport with stamps over 3 visits since January 2010, pics, boarding passes over the last 2 years, phone bills for the last year with calls and text messages. I am hoping this is enough...but for the interview I would like to have msn messages that go over the last 2 1/2 yrs.

You will absolutely receive an RFE for missing this question, as it pertains to IMBRA. When you receive the RFE, respond quickly and your petition will resume processing.

Not earth shattering, but this will cost you an additional couple of weeks.

Your RFE isn't "imminent". I'd say about 3-4 months away from receiving the notice. I'd review your complete I-129F once again and make sure there is nothing else missing so you'll be prepared to respond when you receive the notification.

Today, I was prompted by question here re: and RFE for this question. I went over my form again and just noticed I didn't answer the question re: three or more conviction relating to controlled substance....and I have already mailed in application :crying: . I looked at the example form on this site and that form didn't have a yes or no option but the I-129F I have did and I totally overlooked it hundreds of times! Does anyone know if this will result in RFE? I am certain it will...but wanted to know if anyone had done the same. I'm so disappointed because I feel a RFE is imminent just for that.

This website tells you the price it also tells you the location for the clinic and what your fiance needs to have the day he goes to do it and also the days in advance he needs to do it before the interview and when he needs to pick them up. Is good to know this type of information but you do know that the wait is a little long.

I do recomend you to tell your fiance that when he goes and takes his 2x2 pictures to have at least 8 of them since he would need it and it would save him few trips to the photo studio ( la gasolina ta cara lol ) he'll use them for the passport if he dont have one and for the police record and the one to send with the l-129F + some he would turn in the date of the interview. && the pictures have to be the USA 2x2 pictures for visas, since if he says 2x2 without expecifying they would give him the dominican style one and if sent with the l-129f you would receive an RFE and your process would be delay a bit and i bet you dont want that to happen. I tell you this because i read a situation like that with the 2x2 pictures in the filling form and it was from DR they where the wrong size.


Thanks alot again! Yeah, I was a little concerned by those photos and their size. Ok, then, will have to wait and see. In the meantime, I will encourage him to take more. Man, this process is truly something else and definitely stressing me out.

They must present a Dominican national identification card (cedula), 2 passport-sized photographs and the fee in cash (330 Dominican pesos as of April 2007). A photocopy of both sides of the Dominican national identification card is also required. The certificate is usually ready the same day and is handed directly to the interested party for presentation during the visa interview.

The format of issued certificates varies as of April 2007; however, post expects greater consistency to be implemented in the coming months. The information on the certificate can be verified by contacting the Fraud Prevention Unit at Embassy Santo Domingo.

This is country specific, some countries issue one general certificate covering the whole country, for others you need one for each state or province you lived in, etc...
Refer to this page on Department of State website for information. However I can tell you by experience that the instructions on how to obtain a certificate are not always accurate! Better ask in DR forum :)

before we had black berry messager and i printed those convos, now we have Droid phones and have whatsapp and i did export and print them because they are a type of communication. it's better to have too much than too little. my husband and i call, text, skype, email (hardly tho) whatspp message each other, send cards in the mail. it all counts i was told, but pictures ive herad is a must to prove.

Thanks for understanding...This is probably one of the most important things I have ever done in my life so it means a lot! And I'm doing it only with the help of you guys...I feel so blessed that there is a community that understands what I am going thru and can answer even the most trivial matters. Think about it. RFE is a Request for Evidence. Is all CAPS family name additional evidence?

Do not assume something was not lost. What you list is adequate and far more than I sent. Photos are secondary and dates should not matter, I sent ONE undated photo.

I would suggest carefully copying all the same things, and attach notes to each explaining what they are. Attach a letter explaining each meeting, where, when, how and reference the attached documents.

"on March 3, 2011 Jack and Iflew to Hawaii, see boarding passes, exhibit A attached" For example, then mark the evidence. make sure all the evidence is marked with your name, petitioner and his name, beneficiary and the USCIS case number.

Sounds like a pain but the next step is denial so you better spell it out for them

I simply do not see where you would have a problem unless something got lost or separated from your packet, and that is definitely possible.

I did include skype logs, but I may as well put in some of those other things you suggested too! Thanks! The thing that boggles my mind is (if the evidence wasnt lost) how are tthe passport stamps and boarding passes (with our names on them) showing us sitting next to each other on 4 flights not enough proof? crazy.

Yes and yes to those. My parents first thought was maybe the evidence was lost. Well that does make me feel a bit better actually if that might be the case! So i will just resend all of that, with the date stamped photos just in case. Thanks :)

In my first post I put exactly what the letter asks for. The only difference i can see is that my pictures are not film-dated, so I will go to Kinkos to get that done. But I am still worried, because all the other evidence I have I sent in. But that is a good idea about the bank statements, even though they didnt ask for that, should I send it anyway? As for emails, we don't do much of that :/ But thank you so much for the feedback so far, I really do appreciate any help I can get :)

For the intital evidence I sent in photocopies of both of our passports (he has been here twice within past two years and i have been to his country once within that time frame), photocopies of plane ticket stubs to and from hawaii for both of us which show us sitting in the seats next to each other, receipt of payment from expedia for a trip to hawaii including the hotel, plane tickets and car rental which has both of our names on it, copy of the engagement ring receipt (which shows he purchased it here in the states), a ton of pictures of us together in both countries with the location and exact date written for each, and also some other hotel receipts from both countries.

Hi all! Hoping someone can help me with my question :) I received the RFE today and it is asking for evidence that my fiance and I have met in person within the last two years, the evidence they want is airline ticket stubs and receipts, ATM and credit card transactions (that indicated name month day and year) Copies of passport pages and film-dated photos. Problem is, I sent in all of those things that I have...so I called customer service for clarification. I asked if I should resend those documents and she said not to, that they were looking for additional evidence...of which I don't have. She then told me if I was still confused to consult an attorney. HELP! Thanks :)

I am having a very similar problem! My RFE requested evidence weve met in the past two years, one of the options being time stamped photos. Everything else they requested I SENT IN THE FIRST TIME. I even sent in over 50 photos of us from both of our countries, only they were not time stamped. Let me know how yours goes!
