"Original" means the original document obtained from the government office; i.e., the paper which was stamped when it was issued. They realize the Amphur isn't going to give her the actual original document from their files.

22 CFR 41.122 deals with revocation of visas. The paragraph they cited says the CBP officer determined she was inadmissible and she withdrew her application for admission. The most common reason for this is that the CBP officer believes she intends to immigrate. Based on your description of how she previously used her visa, I'd say this is almost certainly what happened.

It won't affect her K1 visa application. The K1 visa specifically allows for immigrant intent. Basically, by revoking her visa the CBP officer was telling her to get the right visa if she intends to immigrate.

Many people file electronically now, so technically there is no "original" copy. All of the data exists only in computers. If the sponsor filed electronically and they choose to submit a copy of their return rather than an IRS transcript then they'd be printing a fresh copy from their computer (or their tax accountant's computer). Consulates usually insist that the 1040 form be signed by the sponsor, and some consulates ask that the signature be notarized. If the consulate's instructions (in packet 4) say to provide a notarized copy of the tax return then the sponsor should sign the form in front of a notary, and provide the original notarized form to the consulate.

This is a lot less complicated if you get a transcript from the IRS.

You only answer "yes" to question 11 if you've previously filed an I-129F. The question says "fiancee or husband/wife" because the I-129F can be used for K3 visas, as well. The question is specifically about tracking multiple I-129F filings for the IMBRA. If you previously filed an I-130 for an immigrant spousal visa then DO NOT answer "yes" to this question. As Rene pointed out, if you answer "yes" then they'll presume you previously filed an I-129F.

I recently got a PM from another member with precisely the same problem - they previously filed an I-130 but answered "yes" to question 11. Their NOA2 mentioned that the IMBRA multiple filing database had been updated with their info, and they'd need a waiver if they ever filed another I-129F, even though this had been their first one.

The Alex&Mari is right, MAKE COPIES! We just had our interview and those copies really came in handy.
All the other info given was great too, just one more thing I would like to add is: CHECK, RECHECK, HAVE SOMEONE ELSE HELP YOU CHECK and CHECK AGAIN!!! The last thing you want is an RFE for something dumb. Also one more thing, send it FedEx asking for a confirmation of receipt.

Hey guys,
I just got my NOA2 and am gathering all the documents so we can send package 3 in right when it arrives. I was hoping to get some advice about the police report and the medical.

My fiance (the beneficiary) has a old police report from 2008 already. Does he need to get a new one? I can't find anywhere where it says how recent it needs to be. Anyways, we are going on monday to the police station to get another one. But, I was wondering do you need to send that in with package 3 in order to get a interview date or do you bring that in to the interview? I was just thinking maybe we could send the old one in and say we are waiting for a new one? and what type of police report do we need?

Also with the medical...do you have the doctor send the records or can you take them yourself?

Anyone recently schedule a interview in sydney? how long did it take? we are trying to get him to the states as soon as possible! Sick of waiting! also, is sydney the only place they interview in australia?

I'm not familiar with Australia but I am sure someone will come along that is. However I am pretty sure the police report should be no more than 6 months old. I could be wrong, but I will say this, it is best to have the most recent of EVERYTHING. We applied a 30 day rule to ourselves, nothing more than 30 days old. Better to be safe than sorry. As far as when to turn it in, in our case it was to be brought to the interview. Look up consulate specific info here on VJ. Best of luck to you.

Filling out these papers and going through this process is a tremendous task and even after all is said and done with the initial petition it still goes on from there. More paper work and more fees. But in the end we all do it because what we have is worth it. It sucks, I know. It is long, I know, but is so worth it. I wish you the best! We were in AP for 1.5 weeks, the consulate website said AP was over and to turn passport in to receive the visa. So this past Sunday my fiance did just that and he as given a white paper that said, "Your case will be reviewed by a consular officer who will make the final determination on your case. Your passport may be pickup at 1:00pm August 15."
Sounds like he's getting the visa. But the first line is throwing us off. Can anyone clear this up for us? Is this just standard form or could the visa not be issued? We're afraid to get too excited and just want to know if anyone has seen this before. Thank you so much!

There are several addresses over the past 5 years where she does not have the complete street address, but has the name of the city and Provence where she lived. Any suggestions on how best to handle this? None of her friends or relatives she stayed with are still there and can not provide address either.

Where my fiance is they really dont have addresses, so we wrote what we could provide them with. This was not a problem for us, but I will say that I am sure that the Consular Officers are aware of this at interview time. Your forms need to be as complete as possible. If there were actual street addresses I would advise you to do your very best to obtain those addresses. If actual street addresses are not very common there it will be understood. Advice for your entire case as a whole BE AS THOROUGH AS POSSIBLE. I cannot emphasize that more. Do not leave anything up to question and you should not have any problems.

Some of the responses to Sannybel's thread about the rejection in the Dominican Republic got me wondering, how much of a red flag is a previous K-1 petition?

In my case, I petition for my then Canadian fiance in 1998; the K-1 was accepted and we went through the AOS process with no issues (and it was much quicker). The marriage ended in divorce in 2007. There were no children. She did not become a citizen, but as far as I know, still resides in the US as an LPR.

How much of a liability will this be for the petition I just filed? This was 13 years ago after all.

I was previously told and someone correct me please if I am wrong. You can file 2 K-1 petitions during your lifetime without a waiver. I have seen other cases on here where previous K-1s had been filed and it appeared that there was no problem.
I would say that considering your previous marriage lasted for nearly 10 years and I am assuming you didn't have any problems with it previously that it wouldn't be a big deal. You will just be asked about it. Provide as much info about it as you can. Be straight forward and honest about it, which I am sure you intend to do.
I honestly don't think you have anything to worry about. I wish you the best and hopefully someone that has some experience with this situation will come along and provide you with a better answer.

On July 18th, my I130 petition for my hubby was approved. On July 22nd, I received the letter from the California Service Center regarding the approval. About 7 days ago, I called the NVC office and spoke with a customer rep there. All I wanted to ask them was what were the chances that they might already have my case number, but the automated service just doesn't have it updated yet. She told me if the automated service doesn't have a case number for me by August 9th that I should call again and speak to a human being. Honestly, I'm terrified to call them. This perticular lady was very nice and I apologized for bothering her. She said, "It was no problem". Now, my question is, do I call them on August 10th if the automated service doesn't have a case number for me or should I wait until August 18th like it says in the letter before calling them again??? Thank you!

Ashlyn&Grevin are right. The people at NVC are super nice. I called everyday, seriously, everyday. Call as much as you want. The way I figure it is I am a paying customer in this process, if I want to call everyday I will. So don't feel bad and like I said they are super nice.

The DS-156 is filled out online and then printed. There is no PDF version to the best of my knowledge. When printed, this form contains a barcode which I assume is why it is not offered in a PDF fomat.

My fiance and I are currently trying for a K-1 visa. Prior to filing we had attempted twice to get a visitors visa for him to come visit me in the US and both were denied. For the first visitor visa I went with him and we were upfront and honest about our relationship. The second time his company was asking for him to come to the US for training but due to his previous interview with me and him confirming that we had an ongoing relationship it was denied again. Now as we are waiting for an interview date I am becoming more and more worried that these previous visa tries could affect the decision on the K-1 visa. Am I being silly for worrying?

I don't have experience with this type of situation personally. But it appears that your previous visa attempts were denied based on the fact that the consulate thought that your fiance may intend to immigrate to the US and not just visit. With this petition the intent is clear that he does want to immigrate, so I don't think there is a reason to deny him based on that. I would provide as much information possible at the interview concerning the previous visa attempts. I would think that they would understand the previous attempts and see now that you two are doing what you need to to be together. I would recommend providing lots and lots of proof concerning the validity of your relationship, because they may be under the impression that he is just desperate to get to the US. All in all just try hard not to allow them to question your relationship in anyway.

I got my NOA2 and the notice date was July 27th... I got another NOA2 in the mail yesterday and it was dated August 4th ? I went online and said the notice date was August 4th.. Was it a mistake on their part or what ?

That is crazy! I would just call USCIS and ask them what is going on. I have personally never seen heard of this happening.

It is best to send as much information as possible. You don't want to get an RFE. So I personally say it would be worth it to have her send you the copies. Can you just have her fax it to you, or scan it and email it to you? You are only sending a copy to USCIS anyway. It is always better to be safe than sorry when dealing with USCIS.

The case number NVC gave you is the new case number that will be used at the embassy. Your case number with USCIS is not necessary at this time. So if you need to obtain information about your case from now on you will use this case number. The embassy will send you packets 3 and 4 after they have received your case. Whether they send them both at the same time, I do not know. You can go find your Embassy through the Embassy Info tab and see if it tell you there.

Generally you are supposed to provide police clearances for any counties lived in for 6 months or more from the age of 16. Is there any reason why you cannot obtain a police clearance from Saudi?

My fiance doesnt work though - neither of us do, we are both fulltime college students. My father and and maybe his uncle will be our finacial support until I start my job once we are married. Will that be a problem? How do I go about doing this form then?

If the embassy in Australia accepts co sponsponers then you should be ok. Look around VJ and see if you can find a case where a co sponsor was used or ask in your portal and see if someone responds. You will still fill out the I-134 but your cosponsor will have to as well. Both of you must provide financial info, paystubs, tax transcripts, proof of employment, etc. The I-134 isn't sent to USCIS though.

Hi All!

I would like to know why we were put on AP. My Fiance's interview went well with no problems. I hope everyone who is on AP can write about their experiences so we can find out why we were put on AP.

My fiance is moroccan, his name is Youssef 33yrs old. His interviewed lasted 20 mins back June 30, 2011. Everything went well on his interview, he answered all the questions and the CO said everything is good you will have no problem. The CO didn't even wanted to see more supporting evidence of our relationship he said it wasn't necessary. He checked the computer asked him some questions then he told my fiance to go have a sit in the waiting room that he will be called again. He was called again and the CO checked the computer once again then he wrote on a small GREEN piece of paper and put it in between my fiance's passport then he said you will be put on AP. My fiance didn't know this will take long so he never asked why or nothing. Since then we haven't hard anything. We have emailed the consulate but all they say is that our case is still pending AP.

I really hope this AP doesn't last longer than 60 days :crying: . I will not stop bothering the consulate untill they process our case.

Contact DOS and see if they can tell you anything. Your guy is a MENA guy and AP is common for our men. Inshallah your AP will be over soon. In the mean time, call DOS and see what they say and check out the AP forum for some support. Best of luck to you both.

Anyone have an idea what might be up? Interesting that the processing time on VJ is holding steady in the 73 range.

I know it is easier said then done, especially when all you can think about is time, but don't read too much into the lists here. Don't get me wrong, they are helpful, but not always accurate. When we were waiting for our NOA2 I watched that list religously, every change gave me hope, but when it all came down to it, they were stil focusing on petitions for the beginning part of November when we got our NOA2 and then next thing you know the list jumped from beginning of November to tons of December filers being approved.
I promise you that this time passes before you know it and then you will be where I am now.....watching the clock......every second seems like an hour......just waiting for my honey to board that plane tomorrow (not my honey, yours :lol: ) and waiting to know he landed safely and I get to pick him up and take him home :D Sorry :o I trailed off at little bit there :blush: But it will go by before you know it.

I don't know the answer to your question, I'm going to say I don't think so. Medical is to determine overall good health to the best of my knowledge. X-Rays are taken though and I don't know how they will proceed with that.

We have been approved for the K1 visa and my fiance is coming over in 5 days. Do I need to change my address with the USCIS? I moved this past Saturday and the address that was on our petition and the one that my fiance was going to come over and live is not the one I just moved to.

I just have a baby and there are lot of benefits for the baby in canada than in US not to mention the free healthcare in Canada and the economic crisis of US. Im just wondering if i can still travel to US when my passport have the K1 visa in it. I have a visitors visa for US valid for 10yrs because im not yet a citizen of canada. should i wait for the expiration of the visa before going to US?

I don't see why you cannot go. On the K-1 you can stay 90 days without marriage. Plus you have a visitors visa, I think it should be fine.

I feel your pain. We have been waiting 33 days for our NOA1. I tried calling USCIS a couple times after the 2 and 3 week points and they told me that I would have to wait 30 days to contact them. So 30 days passed and it was the weekend. I finally got my call escalated to an officer and they told me the post office returned the document as undeliverable (I moved here 3 months ago but the post office is well aware of my new residence). The officer gave me my case number and I ended the call and went online to check my status. It said this:

On October 14, 2010, the post office returned your document I129F, PETITION FOR FIANCE(E) as undeliverable. We will hold it for 180 days from October 14, 2010 to allow you time to contact us. If you do not contact us at 1-800-375-5283 within 180 days, this document will be destroyed and you will need to file a new application or application for replacement with fee.


My blood was boiling and I quickly called them back to see if this was my NOA1 that was sent back to them or if they were actually sending me back my I129F, as their message states. Fortunately, it was the NOA1 that was returned. She gave me the date of the NOA1 and get me at ease (for now). I just hope that the info she is passing along to me is correct and they are not sending me back my I129F for error corrections.

She was talking about me. I apologise. I read waiver and the I-601 mentions K1 but I probably didn't read it thoroughly enough.

Regarding a limit I remember reading that many many times.. especially in relation to MCat and how there was a limit so he can't apply for anymore and his last was his 4th (from memory).

If I'm wrong oh well but the OP has his answers. Waiver filed with the K1 petition. Rate of success of the waiver is apparently fine. So good luck to him.

I don't pretend to have an exact answer on how to file a waiver, only an approximate one, and I even missed a point, corrected by someone else, that you file the waiver request with your new I129f and not before.

I think it would be a good idea to include copies of your letters (which explain what happened to the two previous petitions) along with your waiver request.


Can you explain exactly what the waiver request is? Does the OP need to submit additional forms such as the aforementioned I-601?

No, I saw the metaphor. But it's still irrelevant to the OP's question.

He is requesting information about a waiver in order to petition for a second I-129F in two years and 3rd overall. He's not asking for relationship advice. His is a serious and important question that doesn't get answered clearly around here, as is apparent from the responses in this thread.

If you contiually filed paperwork incorrectly several times we would tell you to go back, take your time and do it right the first time. The same idea applies here.


I think the OP wants to make sure he does the paperwork correctly so he doesn't have to be told to do it correctly after the fact. Makes sense, no?

It seems nobody knows the answer to his question but I have read from other peoples' experiences that they simply included a waiver letter (request) along with the I-129F packet.

I don't know if that means you need two waivers but I doubt it. So you send the waiver WITH your petition. Figure that means you have to pay the fee of the waiver ($585) as well as the K1 fee ($340 - fees were changed Nov 23, 2010: http://www.uscis.gov...0004718190aRCRD ) at the same time and if your waiver isn't approved you lose both amounts.
