IR-1 / CR-1 Spouse Visa Process & ProceduresI-130, Question Number 22
hello everyone! smile.gif it's me again, asking the most mundane questions that anyone can think of. *worry* *worry* unsure.gif

on the I-130, question number 22 states "Complete the information below if your relative is in the United States and will apply for adjustment of status." But just within that question is "If your relative is not eligible for adjustment of status, he or she will apply for a visa abroad at the American consular post in:"

My husband will be in the UK during the CR-1 process. So are we qualifying for the second part of the statement "not eligible for AOS" and "apply for visa abroad" and therefore put London, UK? Or do we just not answer the question because it starts out with "if your relative is in the US"? wacko.gif wacko.gif

i heart all your VJers for answering so many of my lame questions smile.gif heart.gif heart.gif

IR-1 / CR-1 Spouse Visa Process & ProceduresG325a question: biographic info and birth certificate info
Okay, on the MAIDEN name part: Put her maiden name, same one as on your birth cert. But above MAIDEN name, put her current/legal name as her family name. And yeah I would put her name change certificate in this for just in case, I rather be safe then sorry, but that is just me. Yeah worry, worry is part of USCIS. I hope I have answered your question and did not confuse you .
yes, got it. smile.gif smile.gif thank you for your help! good.gif

so for my mother's name: while the birth certificate says "Hye Suk Yi", the G325a will say "Susanne DeBacker/Yi". and i will include the name change document...

but where do you guys think i could include an explanation? like maybe a short note printed out and attached to the photocopy of the name change document??? hmhmhm.

hearts to you all for your wonderful advice and support! heart.gif heart.gif

hi all!! star_smile.gif

perhaps this question is irrelevant as the problem may be so minor, but just double-checking to see what all you VJers think:

on my US birth certificate, my mom's original Korean name is listed. and just like 5 years ago, she finally legally changed her name to her American/English name--which is what I will be listing on the G325a.

should i include her name change document just so they don't think i'm lying on the G325a? or is it really not that important to even address it in my I-130 package?

thank you all who can offer some insight!! star_smile.gif biggrin.gif

It ask for her Maiden name, put her maiden name on it, and that should be the name on your birth cert too. Right?

hi beth!! hmm, yes you're right about her last name. but let's see on my birth certificate it says "Hye Suk Yi", on the G325a I put "Susanne DeBacker, maiden name Yi". so because there's no link between "Hye Suk" and "Susanne", should i include her name change certificate which she did relatively recently (and not at her marriage and not at her immigration)? or is just obvious and will it not at all be question.... *worry* *worry*

QUOTE (Bunzarelli @ May 21 2009, 11:27 AM) <{POST_SNAPBACK}>
i'm guessing its because there are not enough ppl getting approvals so they are unable to give an estimate anymore

and i was informed that there is normally a slow down at this time because they focus on work visas so that might be the reason so many ppl are not getting approved ..... just a guess

*gasp* really?? does anyone know about how long this slow period might take?
(though we haven't filed yet, i was hoping the fast CR-1 processing times would last as we'll begin filing in june. crying.gif )

IR-1 / CR-1 Spouse Visa Process & Proceduresgetting a joint bank account
QUOTE (trinket @ May 22 2009, 10:52 PM) <{POST_SNAPBACK}>
If you are wanting to do it just for the petition then I would say hold off. First you would be going through a pretty easy consulate, so that's a big advantage for you, plus you are newly married living in different countries, USCIS doesn't expect you to have joint bank account.

Most people don't have joint bank accounts or much of financial mingling (in some countries financial transactions might be seen as a Red Flag). Concentrate on photographs, making trips to each other, phone records, emails, postal letters and things like that.

Good luck!

thank you, trinket, for the advice. biggrin.gif this is great to know.

though he's a polish citizen, he has lived/lives in the UK. so we'll be going through the london consulate (i don't know if everyone can see that just within the forum). is this an easy consulate as well?? (i really really really HOPE so!)

and to everyone else, thanks a billion for your tips. i totally just closed my BOA account about a year ago. perhaps i'll open another account, in the near future, and just add him... just so we have this worked out for the future.

Will your bank accept and ITIN? Individual Taxpayer Identification Number

Link to the IRS ITIN page -->> http://www.irs.gov/i...87,00.html#itin

QUOTE (cornbread @ May 22 2009, 10:20 PM) <{POST_SNAPBACK}>
We applied for an ITIN number it is the equivalent of an SSN but for people who are not citizens or LPRs but conduct business in US that might require the paying of taxes. Some banks and lenders will accept an ITIN.

The form you fill out is a W7. You can get it from the IRS website. When you send it in you will also need to file a 1040.

Doing this really depends on whether you really need to add your SO to your accounts for additional proof and have the time to wait for the ITIN to arrive in the mail otherwise some people just wait to get the SSN when qualified or find an account that will add your SO without it.

yea good point. if we don't really need now, we can just wait to do it in the future when he's got the ssn. there's nothing really special about our case, other than we're newlyweds and we've lived together for a year and a half prior to the marriage. so you guys think we should have the extra evidence of a joint bank account? i was thinking of adding photos and documents proving our cohabitation (do they even need to see that?) on top of the marriage certificate. if that would be enough, then i suppose we could do without the hassle. hmmm. ? i suppose i'm a little indecisive about how much evidence to submit.

IR-1 / CR-1 Spouse Visa Process & Proceduresgetting a joint bank account
just tried the other day, to add my husband the beneficiary to my bank accounts as a joint owner. (mainly, for evidence of bonafide marriage for the I-130. and partially, in prep for the future once he's finally here.) however, both banks said they required a SSN from him to be able to add him.

how did this work out for others? did you provide evidence of a joint bank account for the I-130? and anyone know of banks that allow you to add a non-US citizen to your US bank accounts? if there are any, what kind of documents did you need to add your non-US citizen spouse?

IR-1 / CR-1 Spouse Visa Process & ProceduresQuestions regarding the CR-1
really is this true? i thought i spotted a post on VJ suggesting that it was best for the USC to change their name with Social Security before submitting the I-130.

eek... i think my husband and i will be doing all legal name changes (me in the US, and him in Poland and the UK) for my visa to the UK... if we do that and then in the future when we file for his immigration to the States would that create problems????

K-1 Fiance(e) Visa Process & Procedures325A Employment history
gasp!! also!! while travelling, i did some casual restaurant work in the UK. i have my tax records in the UK showing all of this. but oopsies!! i didn't file when i came back to the states. in fact, my parents and i didn't know i had to, so they filed me as a dependent (i've been a student forever and i've been a dependent all along).

so my other convoluted question is: since my husband and i are considering filing in London (as opposed to Poland, but that's another topic wink.gif ), should i list this UK work history (it was like FOUR! restaurants, all at once and intermittently, but all documented for tax purposes in the UK, but i was working 30 hours a week on and off on minimum wage...) because they might be able to find out?? or should i not list this UK work history on the G325A, since i didn't file my taxes in the US.

(yes, for anyone that's wondering. working on and off for over a year in between travel abroad to make 10,000 dollars, if that, counts as "income" that must be filed for taxes in the US. or so demands the immigration lawyer that i briefly consulted with.)

major oops! anyone that has any idea and can share some information would be considered a legend in my book! good.gif

Keep in mind it is the US Citizen's work history that will be of concern, this has to do with Income and support of the immigrant. The Immigrant's work history is not of concern.

this is great to know! i'm so glad, there're so many here with answers!

just to tack onto this topic: how important is the US citizen's work history if they have a co-sponsor? blink.gif

my situation is that after finishing my grad studies, i travelled around (which is how i met my husband-to-be). i've only just come back to the states and i'm looking for work. in the meantime, i make a pittance through freelancing. we have my dad as a co-sponsor--so even with my transient situation, will this be ok??? blush.gif
