US Embassy and Consulate DiscussionK-1,second denial...i am devastated, help plz,
leorc,

All you can really do is supply what they are asking for. The rest will take care of itself. The process scares all of us, it's not just you. Especially scary through Guangzhou!

You may be able to use your stepdad as a sponsor. But, if it is going to be a big hassle to prove his income/worth, you may want to consider getting a different sponsor that has a full time job with steady, substantial income.

Just curious... Why does your fiancee have to make 12 hour train trips to Guangzhou? Can't you just mail your items back to the consulate? You should not have to travel to Guangzhou until your interview. I have never heard of this happening.

With the packets it's usually best just to follow their instructions. The forms vary widely from place to place, so just complete and return what they give you according to the instructions. Best to avoid any trouble/confusion.

US Embassy and Consulate DiscussionBlacking Out Info On I-134 Documentation
Should be fine as long as it's obvious what you are redacting. Leave the string that says "Account #:" visible so that it's obvious what the information was. Shouldn't be a problem any way, but you don't want to leave the door open for any unwanted questioning.

You must say yes regardless. If you choose to lie about it and they find out, you will most likely be denied and maybe banned for a while. Chances are that they won't pursue it any further at all if you are truthful about it.

US Embassy and Consulate DiscussionPurchasing a bond for proof of affidavit of support
Things like stocks and bonds are only supplementary to salary related income. If the sponsor has no steady salary income that is over the set poverty level, then stock and bonds won't help much.

If the bond has a very high monatery value, then you might have an arguement. But, they are really looking for steady salary income as the primary source of support.

I don't have any advice on what else to do, other than try to find another suitible sponsor or have the petitioner try to find a decent job. These rules are in place to keep the fiance from becoming a public charge. If the petitioner doesn't have a steady job and can't find a co-sponsor, then the fiance is of high risk to become a public charge.

Removing Conditions on Residency General DiscussionIs one Tax form enough!
For removal of conditions they are not concerned with financial support. They are concerned that your marriage is still ongoing and that you live in the same household. For removal of conditions you would have only been married for two years anyway, so it would not be possible to have more than two joint tax returns. Both would be better than one.

Might not be a bad idea to schedule an infopass appointment to find out what your options are at this stage, but it seems you don't have the evidence to prove abuse. You may just have to pursue it as a divorce from a good faith marriage.

Removing Conditions on Residency General DiscussionI-751 timing question
Good point about the walk-in biometrics ELW. You may want to check to see if the Miami office allows walk-ins for biometrics. That might decrease your risk a bit as far as getting everything done in the time window that you have. I would still have a contingency plan in case that doesn't work out. You just never know.

Removing Conditions on Residency General DiscussionI-751 timing question
I don't think you should count on the USCIS fitting such tight restrictions with their processing. Theoretically, that might work, but I wouldn't bet on things like processing times. You never really know how long things will take when it comes to USCIS. Some people get lucky, some don't. I would have a contingency plan in place if you are going to take that risk.

IR-1 / CR-1 Spouse Visa Process & ProceduresPolice certificates from a country other than your own!
My fiancee has to supply three police reports: Germany, Australia, and China. The consulate does not request these. My fiancee had to supply all of them.

She lived in Australia for a year on a working holiday visa, so a police report is required. To get this one, you have to send a money order in Australian Dollars to the Australian Federal Police (AFP) along with a self-addressed stamped envelope. Here is the link for the AFP info for anyone that needs it:

http://www.afp.gov.a..._history_checks

We have lived together in China for over two years now, so we are in the process of getting a police report from China as well. It involves a bit more beaurocracy than Australia (obviously).

The length of time depends on the country, but the EU countries usually have their ducks in a row. It doesn't usually take long (maybe 2 weeks), and the process for EU countries is relatively painless. It will probably just take a phone call, fax, or online request with a minimal payment. Many of the EU countries will supply documents that contain multiple languages (including english), so there may not be any need to have it translated. Overall time for the consulate to obtain the report will depend highly upon how quickly the consulate makes the request.

K-1 Fiance(e) Visa Process & ProceduresApproved! ....but no USCIS website status change
We received our approval letter in the mail today (8/30) which shows an approval date of 8/22, but the USCIS website still shows the old status with no indication of approval. The only thing we noticed was a touch on 8/25, three days after the approval date.

Anyone have this happen? Seems worthless to try to track the case on the website if they don't update the status.

Happy regardless, even though it took CSC 5 months  ...now we just have to gear-up for the circus maximus that is the Guangzhou consulate. Maybe gluteus maximus is a better comparison.

China is a fun place to be living and working, that is until you decide to marry your German girlfriend who lives with you in China. Trying to do the K-1 in a land where signatures mean nothing, employment contracts are non-binding, and pay stubs may or may not be issued is monotonous at best. Having to deal with both the US and China governments is like Don King promoting a super-heavyweight bout featuring the reigning champion of beurocracy vs. the #1 contender as they duke it out for world beurocratic supremacy.

Maybe people should try reverse psychology by sending their inquiries in canned formats such as this:

"Attn Mr. Officer:

The USCIS received my RFE on July 21. If you do not receive an additional RFE, or I do not receive a decision within 60 days of this date, please call my house to inquire. In the meantime, you can continue to follow the status of my emotions regarding this case by referencing my case number at: www.rollercoaster.org.

Thank me for my inquiry,
Joe Blow"

Sorry kitkat, just trying to provide people with an alternative plan. ;)

K-1 Fiance(e) Visa Process & Procedureswhere is the noa2 that makes lots of people get worry?
I see that you filed at TSC, not CSC. That's slightly better than CSC, but it is hard to tell how long it will take regardless.

Hopefully you will be approved soon, but you should also be prepared to wait a bit longer if needed. Our NOA1 was March 14 through CSC and just recently it was approved after 5+ months. Many people are still on that ship.

Looking back at it, it was a horrible wait. But you have to keep in perspective that it is, after all, immigration. They want to make it hard to weed-out the people who aren't serious.

K-1 Fiance(e) Visa Process & ProceduresWhat does this mean
It looks like VSC has everything it needs to make a decision. They are working on it. Hard to tell how long it will be for sure, but as others have stated the VSC is cranking through cases pretty fast at this point. You will probably get approval soon based on recent activity.

Don't stress too much though. VSC folks have it easy these days. Many people are on the 5+ month mark through CSC, and still counting.

Welcome, and good luck on your journey!

K-1 Fiance(e) Visa Process & ProceduresWho to contact?
I don't really think there is any proof that contacting a senator or rep will for sure help your case get processed any faster. Getting your senator or rep to launch an investigation is a task in itself. Most likely, at 110 days, your senator or rep will get a canned response from USCIS saying that you haven't waited the required number of days.

If they received your RFE on 7/11, wait until after 9/11. If you don't get an approval or reply from the USCIS shortly after 9/11, you should call them. After 9/11 you will have waited the required 60 days since the RFE correspondance, and you are entitled to an inquiry. Maybe they will have a decision at that point.

Based on that, think positive! I think you will receive an answer soon.

K-1 Fiance(e) Visa Process & ProceduresHelp? Newbie here
Thersch,

First and foremost, welcome!

I echo the sentiment that you will need some patience. The good news is that there is probably nothing wrong with your case, it just takes time. The bad news is that it usually takes quite some time to be processed (often more time than what the USCIS says). Keep reading the posts on this site. It will help you to understand the information/issues associated with the visa processes.

In response to your question about touches.... A touch is when some one from USCIS touches your case file in some way. It means nothing other than assurance that your case is being juggled, and is likely not lost. To see touches, create a case portfolio on the following site:
https://egov.immigra.../jsps/index.jsp
Once you create a portfolio, the date shown next your case number is the date of the last touch.

Cheers, and good luck to you!

K-1 Fiance(e) Visa Process & ProceduresHelp Plz :(
Trying not to beat a dead horse, but I'll elaborate a bit on the I-134.

For you to be the sole sponsor, you have to show that you can adequately support your fiance should he need help or have employment related issues down the line. The most important thing is your work-related income. You must earn a percentage above the poverty level to qualify. If you don't have a job, then you don't qualify. You will need to fill-out the I-134, AND find a co-sponsor who qualifies that will also need to fill-out the I-134. The co-sponsor doesn't need to be a family member, but it is probably best.

They do look at whether you have money in bank accounts, other assets, or stocks and bonds. But, that is really in supplement to your income. If you don't have any income, then you will need a co-sponsor. They also consider if you are having to support anyone else, like a child or other family member.

K-1 Fiance(e) Visa Process & ProceduresHelp for a South African
In answer to your above question.... If you are free to travel to the US as a visitor (i.e. if you able to get a vistor visa somehow), you can go to the US during the K-1 process, HOWEVER....

1.) You cannot permanently change your address to the US. You must maintain your residence in SA. You will also receive your consular interview packet in the mail at your SA address, so you need to be able to check your mail in SA (or have a friend check it for you).

2.) You will have to return to SA for your medical and consular interview after your I-129F petition is approved.

It may be hard for you to get a visitor visa to the US while you have a K-1 filed. As Mew says, you will have to show substantial proof that you will leave the US after the visitor visa expires.

K-1 Fiance(e) Visa Process & ProceduresTransferring paper work between consulates
What consulate did you specify on your I-129F application?

If you said SA, it will go to the SA consulate. If you specified UK, transfer will depend on when you will leave the UK and head back to SA.

If you will head back to SA before the case even gets to the consulate, you should contact either the CSC or NVC (whereever the case is when you get ready to leave the UK) and have them formally change your address and your specified consulate. If the case is at the UK consulate, you need to contact them and have them transfer it to the SA consulate.

I don't think you should have a problem changing consulates, but it may result in a delay.

Just to repeat what I said above.... Don't rely on any emails or online status reports. Until you actually have an approval letter or an RFE in your hand that arrived by mail, you can't speculate either way.

Sorry, I missed your last post!

Don't get too upset just yet! Until you actually receive physical mail on status of your case, you cannot assume either scenario is true. Wait to see if you receive either an approval letter or an RFE request in the mail during the next few days. Until then you can't speculate, even if the email update or online status says so.

We have already received our NOA2, but our online case status still shows as pending. So, don't worry until you receive mail from USCIS confirming the status.
