We too are hoping for quick processing in Guangzhou, but we're preparing for the worst. We remain optimistic, but unless they speed things up it will probably be another 5-6 months. Hope we are wrong!

Haven't heard of this happening, but I wouldn't worry about it. Maybe someone made a brief mistake and thought that an RFE was needed, but realized the mistake after the online status was already changed.

Unless you actually get an RFE letter in the mail, I would not worry about it. The online status is not always completely accurate.

OK, I get to play devil's advocate. I apologize if I offend anyone with the following comments, but I feel the need to vent.

Although I don't wish hardship on anyone, Jah242 you should have been denied for several reasons:

1.) You are not serious about the process. Anyone that was serious would have been able to (and would have made sure to) provide plenty of evidence. Even after an RFE requesting extra evidence, you left to up to someone else instead of doing it yourself to make sure it was taken care of properly.

2.) The person whom you relied on is not an expert. Your info on this is still somewhat vague. If they helped 3 or 4 other couples through the process, then their experience is valid yet minimal. If they went through the process 3 or 4 times themself, this is called "visa abuse" or "immigration fraud". Anyone that refers to this process as a "breeze" isn't familiar with the process.

3.) Even after all of your explanations, we are still having a hard time understanding your situation. Even the more experienced people here are having a hard time understanding. If you presented your case to the USCIS in the same way that you presented it to us here in the forum, then it's no wonder the USCIS officer was confused and not convinced. After 3 pages of posts, we still don't even know which country your fiancee is from.

I'm trying not to criticize, but you need the hard facts. Good luck to you on your appeal.

I agree with the previous posts regarding the reasoning behind hiring/not hiring a lawyer. We probably would not have hired a lawyer if it weren't for the fact that my fiancee and I live together in a neutral country. This adds some complexity.

Also, it means that I can't be in the US to act as a point of contact. So it is nice to have a lawyer in the US that can act on our behalf.

Yodrak has hit the nail on the head. Large age difference could be a red flag depending on the cultural norms and immigration problems related to a particular country.

That said, age difference cannot be the sole reason for denial. As long as you have sufficient evidence and can prove your relationship, you should have no trouble.

I think that Jamaica does have some US immigration related issues, but Jamaica doesn't have a track record of abuse that some other countries have. Things like age difference won't raise many eyebrows there.

BTW...Jamaica is an amazing place with amazing people. I would love to go back and spend more time there. :joy: Cheers, and good luck to you!

There are 5 major items that you will receive during the process:

#1: NOA1 letter (sent by USCIS) - Petitioner will get this in the mail. It just states that your case has been officially received, and that processing has started.

#2: NOA2 letter (sent by USCIS) - Petitioner will get this in the mail. It states that your case was approved by the USCIS, and that it will be forwarded to the National Visa Center (NVC).

#3: NVC letter (sent by NVC) - Petitioner will get this in the mail. This letter states that NVC processing is complete, and that your case will be forwarded to the consulate in India.

#4: Packet 3 (sent by consulate) - Beneficiary will get this in the mail. It includes forms that need to completed and returned to the consulate. It also contains information about some items that you need to gather for the interview process.

#5: Packet 4 (sent by consulate) - Beneficiary will get this in the mail. It will contain a letter that shows your fiance(e)'s official visa interview date. It will also contain forms and information for the medical exam, and information about other items that you will need to gather for the interview.

The petitioner may also receive a RFE (request for evidence) in the mail sometime before the NOA2 letter, but you will only get this if something is wrong or missing on your petition.

The consular items above may differ slightly depending on the country, but hopefully this will clarify the process a bit for you. There are lots of people going through the India consulate, so you may want to search their posts for India specific details.

Not to beat a dead horse, but just to make one point more clear...

You can come to the US and marry on a tourist visa. HOWEVER, if you later try to file for a green card/residency you will be found guilty of visa fraud and your green card/residency will be denied. Unless you can provide mountains of evidence that you had no intention to marry when you came to the US as a tourist, you are asking for trouble.

Read the K-1 guides and follow them. Doing the process the right way will keep you out of trouble in the future.

I am not an expert on your situation, but there is some information you should know before proceeding.

When you file, you will have to list his current address. I don't think the USCIS will check his residency status in St. Maarten. But, once it passes the USCIS phase, the NVC and consulate have a right to do a background check on him. It is common for them to do background checks on beneficiaries.

Once the case reaches the consulate stage, the consulate will ask you to submit police reports for all countries in which your fiance has lived for 6 months or longer. If he doesn't supply a police report for St. Maarten and they find out that he was living there for 10 years, they may deny your case. Likewise, if you try to get the police report from St. Maarten, the police might find out about his situation and bar him from St. Maarten.

I think you should consult a lawyer on your case to figure out what your options are. There will be other options to make this happen, but you will both have to be a bit more flexible to make it work.

On a side note... Most immigration departments throughout the world look for patterns of visa misuse (overstaying, working without a permit, illegal entry, etc) when you apply for immigration. By knowingly living in St. Maarten illegally for 10 years, your fiance has assumed responsibility for all future immigration problems that could arise from that. And now, you are also assuming that responsibility by trying to bring him to the US. Understand that you are the K-1 petitioner (not your finace), so it is your job to prove that your fiance is not a risk to the US in any way (visa risk, fiancial liability, or safety risk).

This whole story topic concerns me greatly, especially the part about "seeking-out foreign spouses". It sounds to me as if this reporter is going to make a mockery of those that use websites to meet people.

Keep in mind that IMBRA really has nothing to do with the subject of seeking a foreign spouse (online or in person). IMBRA has to do with protecting people involved in the immigration process, regardless of the manner in which the people met.

I met my fiancee oversees, and I still live with her overseas. IMBRA has affected our case just as much as those people who met through a website. We were part of the March CSC group until a few days ago. The real story is that everyone is affected by IMBRA, and it is not necessarily related to people meeting each other on websites. If the reporter is genuine, he will be more interested in covering the botched USCIS process.

You shouldn't have any issues regarding these stamps.

Funny though, they stamp my passport every time I enter/leave the US. I usually go through SFO or LAX. I think they look at where you have been and for how long. I don't think they like the fact that I live in China most of the time. It gives the officer reason to stamp it.

If you received the letter from the NVC, then your case should be on it's way to Manila. It usually takes a some time to get there. Once it arrives in Manila, it may take a few more days before it gets entered into the computer system. You should receive a packet of information from the Manila embassy soon. Call them again in a few days and check again.

I wouldn't worry too much yet. It usually takes the embassy a while to enter your case into the system once they receive it. The embassies will not tell you if they received the package, they will only verify once it has been entered into the system.

With some of the busier embassies, it could take 1-2 weeks for them to enter the case into the system. Wait a few more days and call them again.

2 hours used to be plenty before 9-11, but now 2 hours will leave you short in most cases. The last few times that I made connections from international flights, 2 hours wasn't enough. Try to leave 3-4 hours just to be on the safe side. The worst that can happen is she will end-up sitting around for an hour or so. That's better than missing the flight.
