K-1 Fiance(e) Visa Process & ProceduresTravel while petitioning /applying for K-1
I've visited my fiance twice since we applied for the visa.. Second visit connected in Vancouver and I did get drilled a bit more than I do at Calgary (asked who was moving, when was our wedding, what are our jobs, last visit date, etc, and also reminded me that an overstay would mess with getting a green card). Possibly a Vancouver thing but it may have also been because I was really nervous and briefly messed up a couple of questions as a result. But you can still visit. However, it's up to the discretion of the officer interviewing you as to whether you'll be allowed into the United States or not. I brought my work contract and HR time off request as proof of ties, but ended up not having to show anything.

That's a relief, thanks. :) I'm hoping it goes well too - apparently Vancouver's Consulate is a good one though..

K-1 Fiance(e) Visa Process & ProceduresSufficient Evidence for interview?
Hi everyone. :)

I know this question has been asked before, but I just want to be sure that I'm set with my evidence as I tend to worry too much, yet sometimes overlook things I need to do. My interview at the Vancouver US Consulate is coming up pretty fast - this coming thursday. This is what I've prepared as evidence:

Evidence of meeting since application:
- Several photos from a trip to visit my fiance in April (about 6 or 7).
- Plane tickets, visa bills, and misc bits of evidence (such as some reciepts and itinerary) from my april trip and my november trip last year.
- Email correspondence with my fiance's family (this includes mentioned itinerary as his father booked our hotels for us).
- A hand-made valentines day card from february, not dated though.
- Gift reciepts from Christmas.
- Skype Logs (list of phone call dates and lengths).
- A few full AIM chats.

General evidence of meeting:
- A plane ticket I missed adding to the original I-129F.
- Other older visa bills from my trips (had to order these as I usually toss them).
- Receipts for my engagement ring and the ring I got him in return.
- Some older gift receipts.
- Older email correspondence to my mom by myself and my fiance of what we were up to.
- a couple more AIM chats.

I've been told I might actually be overdoing it but most of our correspondence has been over the internet so I'm not sure how much weight a lot of it holds. As a note, my fiance will also be joining me in Vancouver.

K-1 Fiance(e) Visa Process & Proceduresdo i need a passport to file for a k-1
At minimum, the beneficiary needs to have a valid passport (that's also valid for at least 6 months beyond intended period of stay). Hopefully you have a passport as well (with stamps from travelling to visit them) as it will be good proof of a relationship for your K-1 application.

Took us 4.6 months (Late october to mid march). Some people luck out and get it really fast, some get it in the shown processing time, and some hit roadbumps for whatever reason. Good luck!

K-1 Fiance(e) Visa Process & ProceduresEntering USA after submitting I-129
I'm not sure how much information the custom officer has, but it's possible. They'll ask you why you're visiting, and there is a chance you'll get questioned if you tell them you're visiting your fiance. My only "grilling" was at the Vancouver airport in April, probably because I was nervous about my first connecting flight, but fortunately I didn't need to show any ties. They asked stuff like who was moving and when we were getting married, but never mentioned the K-1 (I think I might have mentioned it though).

K-1 Fiance(e) Visa Process & ProceduresEntering USA after submitting I-129
I went down to the US a couple of times during the application process - the first time being less than a month after our NOA1, and not a question asked. If you want to be safe, you can get them to bring evidence of ties to Canada as mentioned above.

K-1 Fiance(e) Visa Process & ProceduresDid you send your sexual conversations?
You could just send a summary list as to when the conversations were (if your program has chat history), to show that you talked frequently. That's what we did.. They didn't even ask to look at any actual chat conversations.

K-1 Fiance(e) Visa Process & ProceduresTime from NVC sending petition to consulate, to receiving packet?
Thanks for the responses. I emailed my consulate and they said that it had been mailed, and asked to confirm my mailing address.. They gave me a digital copy of the letter. Hopefully that means I'll receive the hard copy this week and that it didn't get lost in the mail, since the letter seems to have the correct address. :)

K-1 Fiance(e) Visa Process & ProceduresTime from NVC sending petition to consulate, to receiving packet?
Was hoping you guys could help me with this question. The flowchart for the K-1 visa lists the times for the NVC sending the petition to your local consulate as being about a week, and the consulate sending you the packet as about another week. My fiance received a notice that the NVC was sending the petition on March 26, and it was dated March 22nd. It's been about 3 weeks now since the March 22 date and I was just wondering how long it took you guys to get to the packet step? I realize that the week is probably an average but I was hoping it to be quick. I guess I shouldn't be expecting any speediness though.. the police check they said would take two weeks.. More like a month. :P

K-1 Fiance(e) Visa Process & ProceduresQuestion 18 on the I-129F
It might just be me, but being able to fit it in the box might raise red flags in the adjucator's mind. I'm sure they are used to seeing long narratives about people's relationships and the unique circumstances of how they met, how their relationship progressed and why they are putting themselves through hell to be together (ok it aint all bad...but still).

The last thing you want is an RFE to explain all this evidence you provided. So if you are able to be together, explain that (even though it's obvious with the J-1 visa).

You don't have to write a book certainly...but if it was me and I was adjucating an application and the answer to question 18 was able to fit in the box I'd be asking myself some questions.

K-1 Fiance(e) Visa Process & ProceduresGetting marry within 90 days

How did you guys/gals get marry within 90 day? I got fiancée from apply to arrival in 5 months, much faster then I had planned. So fast, that I had not planned out every detail. Now she is here, I am scrambling on getting married with in 90day. Did you guys just go to a church and get marry, in normal cloth, so you can get the marriage certificate ASAP. Then the REAL marriage with banquette later? A proper marriage planning and execution takes much longer then the given 90 days.

Thanks

I am so happy!

CONGRATS!!

I guess it really depends on what you want out of your ceremony. I've seen some VJers do a civil ceremony and then a second family/celebration ceremony later. I've personally never wanted a huge wedding. We were able to plan out everythingwithout paying and explain to our vendors the flexibility we needed in dates.

Now that we have the interview date, we actually had to move everything up because the process was quicker than we expected!

So yes it's possible, but it depends on what you want it to be.

IR-1 / CR-1 Spouse Visa Process & ProceduresWhat is best? Apply for CR1 or have a job sponser lined up?
Haha that's what I read too which is why I want to stay far away from the K3...
We just got married here in Canada on Monday! We have been in a long term relationship for nearly 5 years prior to us getting married. I am a Canadian Citizen and he is a US Citizen. He lived in Canada for some time and recently moved back home to California where we would like to reside.

IR-1 / CR-1 Spouse Visa Process & ProceduresWhat is best? Apply for CR1 or have a job sponser lined up?
I did read through the Guides yesterday and maybe this is where I got confused. When I look at the Guides it gives a link to apply for the CR1 visa, however when the link opens it looks like it is in reference to the K3 Visa? So I would now assum after reading the guides again, that I need to file the I-130 form along with the G325A and wait for a response? How do I let them know I want to proceed with the CR1 at that point? I do not want the K3 or to be told to submit an I129 ect.
Just straight forward I know how I want to file and don't want any unnecissary paper work or forms that might only confuse me more?

Ok thanks so much. So I should just get the paper work started for the CR1 and start the waiting game. I just wasn't sure if I had a job sponser if that would make things happen much quicker.

IR-1 / CR-1 Spouse Visa Process & ProceduresWhat is best? Apply for CR1 or have a job sponser lined up?
Hi All,

So I am happy to say that my Fiancee and I were married this past Monday!!!

My question would be if I should start the process for CR1 Visa or see if I can get a job Sponser in the US were we will be residing? My now husband will be going back to California where he is a US Citizen on Friday. He may be able to get a job lined up for me? So we are wondering if it would be quicker to have someone Sponser me for work or if we should just be patient, apply for the CR1 and then I can start work once it's approved? Ideally we just want the quickest way that we will be able to be together? Any advice would be greatly appreciated!

One more thing, what is the difference from a CR1 and IR1 Visa?

IR-1 / CR-1 Spouse Visa Process & ProceduresMarried Without Copy of Divorce Decree! Help
Hi,

I am a little ashaned to be asking for help on this, however I am really starting to stress out over it. Any advice would be most appreciated.

My now Husband and I have just recently been married. He lives in the US and I in Canada. Prior to getting married, we have been in a long term relationship for 5 years. He lived in Canada for some time and recently moved back to the US. We had plans to get married and recently decided to do a brief ceremony here in Canada. With a few phone calls we had someone available to do the ceremony for us. We did obtain our Marraige Liscence as well as the Marraige Certificates. My issue is that with all of the excitment we did not think nor obtain his previous divorce decree and proceeded to be married.
Now since I have pulled the I-130 forms so we could get the paper work started for the CR1 Visa, it states this inf. must be provided. What should I do? Should I leave it as is and hope they do not do a Public Records to see if either of us has been married before? Or is there something I can do to correct this mistake we made?

Thank you for your understanding!

K-1 Fiance(e) Visa Process & ProceduresAdvice? How to proceed with Immigration while engaged to US Citizen?
Sorry I used the wrong terminology. My Fiancee is a US Citizen. He was born in California and lived there most of his life. Maybe if I explain the situation in better detail it will help. He came to Canada on a work contract playing a professional sport. This contract was expired after 2 years, however he had enough in savings to remain here and didn't have to legally work in Canada.
He did travel back home a few times a year for no more then a week at a time. He did own a home here in Canada and also has a son here.
He never applied for Canadian Citizen ship. He was always approved back in Canada with no hesitation. This is where I am not sure if we will qualify for DCF? Because he is a US citizen that has been living in Canada for the past 5 years will that be classified as legal? This is why we would like to contact the US Consulate for advice. If he explains our situation, they can at least let us know if we even qualify. Otherwise we will have to take the long route.

K-1 Fiance(e) Visa Process & ProceduresAdvice? How to proceed with Immigration while engaged to US Citizen?
Thanks to everyone for the links, advice and suggestions. It has given me a better understanding to the process. Reading more on the DCF this seems to be an option I am considering. From one of the links posted, I should be able to have my Fiancee contact the US Consulate in his area for guidance. It was posted that he can explain our situation in detail and they will let him know if DCF is approved for us to file. If we are denied, I believe I will file for the Fiancee Visa.
The DCF seems to be the most convinient and cost effective method. So I hope we are eligable
I was actually advised via the phone by an Immigration lawyer that I could apply for a work visa, then get married and adjust my status once in the US. So I am glad I found this forum as I want to be sure to get this right the first time. Any small error seems to have a long term impact.

K-1 Fiance(e) Visa Process & ProceduresAdvice? How to proceed with Immigration while engaged to US Citizen?
No he is not considered a permanent resident of Canada. He is still considered a US resident. I have been informed that I should apply for a work visa. Enter the US for supposed work purposes only. In that time frame, we get married while I am there and then apply for an adjustment of status. I would think because we have been in a common law relationship for so long, they wouldn't really pose a problem with why I want to reside there, however I don't want to take any chances being denied. He is planning on moving fairly soon and we need to be pro active and do it right so I can join him as quickly as possible.

K-1 Fiance(e) Visa Process & ProceduresAdvice? How to proceed with Immigration while engaged to US Citizen?
So should we get married here in Canada? And would we need to get married before he goes back home to the US? Or would I need to proceed with this Direct Consular Filing first before we do anything? Would it be wise to ask about a job transfer in advance or would it be in my best interst to wait until we are married? I like how simple your recommendation is. Is it really that easy?

K-1 Fiance(e) Visa Process & ProceduresAdvice? How to proceed with Immigration while engaged to US Citizen?
I am looking for any helpful advice!! I am at a complete lose on who I need to contact and where to start. My Fiancee is a US Citizen. He arrived in Canada 5years ago with a Contract to work. We have been in a common law relationship for a little over 4 years. We have recently became engaged.
He is now wanting to move back home to the US {Los Angeles, California}
My question is since he is currently living here, should we get married here in Canada? Or should he move back home and in the mean time I apply for a Fiancee Visa? If I can get a job transfer, is this the best method? Then we get married during the time I am there to work? I just don't have aclue on where to start or what we should and shouldn't do. What Visa's do I apply for? I have been in touch with a few immigration lawyers, however the cost is much more then I am wanting to invest. Approx. $2000.00-$4000.00 I would really appreciate any help and advice

Thanks

K-1 Fiance(e) Visa Process & ProceduresApplying for K-1 Visa. What forms start to finish will I need?
Hi, I am going to apply for the K-1 Fiancee Visa. I am trying to determin all of the forms and costs that will be required from start to finish. I checked the search field as well as the guides, however I have a feeling something is still missing? I have the following

I-129F Petition to be filled out & mailed in by my US citizen finacee. Cost for I-129F is $455.00
G-325A one form to be filled out by each my finacee and myself - No cost for G-325A form

Once the I-129F petition has been approved an appt is set up for me to attend the US Consular office for a meeting. I will bring the I-129F approved form along with the I-134 affidavit of Support form? Cost for I-134 ?? Is there one?

Do I need to fill out the DS-3025 for recent medical exam? Is there a cost for this? Or is there a cost to file this form?

How about the AOS. Once I enter the US and we marry, I will then apply to adjust my status correct? What form will I require and what is the cost? Do I need to fill out any forms for wanting to legally work? What form is required and what is the cost?

Sorry for the questions. I am hoping someone can assist me as this is a little confusing to me. I would like to print off all of the forms at one time so I am aware what is required. I can then sit down and fill them out one by one. Even if I get some filled out in advance, I would just prefer to be pre-pairded then waiting. Thanks in advance.

K-1 Fiance(e) Visa Process & ProceduresK1 Visa Process & Forms
I am hoping someone that has filed for the K1 Fiancee Visa can assist in answering some questions for me. I would like to determin the forms that I will need or even a step by step guide. I realize there are steps noted on the Guides, however I would like to be sure I have all of the forms printed out so we can start filling them out, even if it is in advance.
I so far have the following forms printed out. If someone can confirm I have all the forms I will need, or let me know if I have in fact missed some, it would be appreciated.

I-129F to Apply for K1 Fiancee Visa
G-325A x's 2 Biographic Inf. forms to be completed by both myself and my Fiancee
I-134 Affidavit of Support
I-765 Application for Employment - Am I able to request a work Visa in advance? I don't particularly want to sit around for 3months until I adjust my status once we are married? I read that you may request to work when coming into the US in order to marry. Sometimes it's approved?
I-131 Application for Travel Document
Lastly the Adjustment of Status Form which I have yet to print

Many thanks

K-1 Fiance(e) Visa Process & ProceduresCan I send photo copies of photo's or do they have to be originals?
Just a quick question,

I am filing for the I-129F For the K1 Fiancee Visa. I need to provide them with details of our meeting along with proof or documents of relationship. I have a number of pictures to send, however some of them are my only copies which I would not want to lose. Is it ok if I photo copy some instead of sending my single original copies? Or should I only send originals?

Thanks so much

K-1 Fiance(e) Visa Process & ProceduresRCMP background check for Canadian alien?

Yes you will have to get a Canada wide criminal record search....and if you lived anywhere else in the world for 6 months or more. The hitch here is they might not allow you to do the criminal check until after you have gotten your NOA2 paper work so that they have proof of reason for the search. As far as cost and time goes it varies office to office but if you need a international search done it can take anywhere from 2-6 months. From what I have seen on VJ most RCMP Canada wide checks take no more than a week sometimes it can be done the same day..again just depends on the office..hope that helps!

FYI..there is a great discussion forum here..for regional groups...and on the Canada one there are a lot of helpful people who have gone or are going through this as well...http://www.visajourney.com/forums/index.php?showforum=93 in the meantime my fiance and I have just been putting together more proof of relationship/evidence for the interview...keeps our minds from dwelling on the time....Goodluck!

Thank you! That's all pretty much exactly what I thought and had derived from the Canadian regional forum. Just had to be sure for time's sake because, of course, surely it's going to be tomorrow when I get that phone call........

Hello. I am the Canadian alien of a US fianceeship in the phase of waiting for our NOA2, preparing as much as I can for the passing of the process into my hands. All I know about my turn is what I've read here and I have spent my evening reading here, and reading here, and reading here... I apologize if this is an echo of a post that my searches did not catch.....

Is it I who needs an RCMP background check? Both of us? If it helps, we're oriented towards the Vancouver embassy.

Thanks all for your time and any help. :)

...the fast approvals aren't irritating me. It's the lack of progress made at the CSC and the 20 posts I see daily about quick approvals at VSC.

Exactly. It's the inequal treatment that gives me inequal moods.

I do think we should all continue to post our approval dates as this assists in each other having some sort of reference point at guesstimating how much longer we're knocking on doors, and I think this can be done eloquently and helpfully. I think it's very important to find productive ways to support each other and while finding healthy outlets for ourselves.

As in:

"Daniel and I were approved today, on August 31, NOA1 on March 9 2006." (tomorrow...... always tomorrow..)

Rather than:

"HAHAHAHA YAY HOLY TAMALE WE GOT APPROVED TODAAAYYY IN 12 JUST DAYS YAY! YIPPEE!!!!!!!!!"

This is a forum, after all, not realtime: We are able to edit what we type, so "I was excited" isn't really a fair argument for using language, like the above, that may seem obnoxious to those going on 100+ days and the second Merlot of the night. Generally you are going to get lots of congratulations, regardless of how you phrase your approval, and that should be your source of communal satisfaction rather than tempting the others with carrots. Let's keep it clean, not vain, peeps.

Well hello there!

Hiiii. (F)

I agree with the original poster. Let's stop complaining just here, let's DO SOMETHING about it.

I have started a petition online.. Yes, I know this is a simple start, but I am extremely hopeful and optomistic that eventually this petition could have thousands of signatures so that we can get USCIS to be accountable and to actually allow greet people with the "open arms, not long lines" that is spouted off at the political mouth.

Anyway, here is to us, let's see how many people are willing to help a little and give it support.

Yes, you file the I-130 first. Then you file the I-129F for your K3

Cr-1 is a FAR superior visa if you ask me! Good luck on your journey

Thanks for all the info. Just have one more question for anyone who may have experience in this area.

If after we are married, I go to the U.S., get a job offer, and obtain a work visa, can I stay with my husband while the CR-1/K3 is processing?

Hey Ashlee,

I am in the same situation as you are. I am in Canada and my fiance is in the U.S. We want to get married in Canada and then work on moving to the U.S.

Is your fiance just going to come up to Canada to get married then go back to the states after a few months and start filing for a K3? If so, I know from reading the guides that there has to be evidence of a bona fide marriage. I'm just wondering how easy that will be to fulfill, if your fiance like mine, is going to go back right away so we won't have a joint lease together (as usually a lease is for six months or a year). Are you just going to get sworn affidavits and open a bank account? Do you think it matters if his name is only on assets in Canada?

For newlyweds, some pictures and evidence of visits and communication are sufficient at petition filing time. No worries there. Unless the visa can be issued in Vancouver, K3 is a poor option. I'd go the CR1 route if Montreal will do any K3 interview and maybe even either way.

Since I live in Western Canada, I'd have to deal solely with the Vancouver office for my K3. When I file for the K3, it also defaults to filing for the CR1 too correct?

the I-130 petition which is required to be filed first, is for the CR1... the I-129F petition for K-3 is optional

Sorry, I am a bit confused. Since we only want to file for the K3 at this point, we have to file both forms and see what gets approved first?

Since I live in Western Canada, I'd have to deal solely with the Vancouver office for my K3. When I file for the K3, it also defaults to filing for the CR1 too correct?

IR-1 / CR-1 Spouse Visa Process & ProceduresCanadian to marry US citizen in Canada then move to US

IR-1 / CR-1 Spouse Visa Process & ProceduresAfter NVC receives checklist, how long 'til they close the case??
Sorry if this question is redundant:

If the following message comes up after trying to login to the payment page on the NVC Website:

"Sign In Failed. - Please be advised that the case that you have attempted to access is not eligible for further processing by the National Visa Center at this time. Please click on the Contact the NVC hyperlink if you believe that you have received this message in error."

does this message mean that the NVC is done with the case and forwarded it to the appropriate consulate or does this mean that there is a problem with the case?

I submitted my DS-230 and civil documents March 24, '10, but still haven't received an appointment letter. Is it normal for a month to pass from case complete (if that's what the message means) without receiving an interview appointment letter?

Any input would be greatly appreciated.

IR-1 / CR-1 Spouse Visa Process & ProceduresDS-230 Part II Not Required at Montreal Interview?

You already sent in DS-230 at the NVC stage which they have already, but for the interview you should bring all the copies of everything you sent to USCIS + NVC just incase. I am sending everything I sent to USCIS + NVC to my wife for her interview just to be on the safe side.

Once you get approved, they will make you sign the 2nd part of the DS-230 which they have already with them. Goodluck on the interview :star:

Thank you for your input!!
