Obviously we aren't going through the London Embassy, but domicile is domicile smile.gif We both live in Canada. I don't think your questions are laughable at all, you are correct that the domicile issue is important.

I entered U.S. as my country of domicile on the I-864. In discussing this with another member (Colin Wilson - also a Canadian) they entered 'Canada' - he was approved.

As mentioned, you are basically going to need to go with item C on the list you posted - which is what we are doing. I did receive an RFE from NVC to provide more proof of domicile with my I-864. With my initial submission I sent a letter from my Sister (stating we would be living with them), joint U.S. bank account information and a letter from myself, stating that I intend in good faith to reestablish my domicile in the United States no later than the date of the intending immigrant's admission or adjustment of status

I opened a joint bank account with my Sister (she is in the U.S.).

When I resubmitted it I included (for reference - we sent in our I-130 in March of 2007):

- U.S. Bank Statement (with Sister's U.S. address on it)
- Copy of my application for a SSN from March of 2007
- Print out of online moving quote for March of 2008
- Letter from my Sister - stating that we will be living at her address and they should feel free to contact her to confirm this.
- Letter from me as I mentioned above.
- Copy of a letter from our Lawyer regarding the sale of our house from February of 2007

Certificate of No-Criminal Conviction (CNCC)

Available from the Hong Kong police only to an applicant upon his and/or her written request, for whom there is no criminal record, and delivered in person or by mail. The written request should be addressed to the Commission of Police, (Attention EO CNCC),14/F, Arsenal House, Police Headquarters, 1 Arsenal Street, Wan Chai, Hong Kong. The request should provide the applicant’s full name, date of birth, and must be accompanied by:

A bank draft in the amount of 165 Hong Kong dollars for each person, made payable to “The Government of Hong Kong Special Administrative Region.” Drafts in foreign currency must include an additional bank service charge of 100 Hong Kong dollars.

Documentary proof that a visa application has been made (letter from an American consular office requiring the certificate will suffice) and the location of the office where the application for an immigrant visa or adjustment of status is being made. If the person applying for a CNCC is a derivative applicant, the name of the principal applicant should also be included.

A full set of fingerprints of the applicant taken and certified by a recognized official police or law enforcement agent. The officer should endorse the fingerprint form with his or her signature and official stamp, attesting that the fingerprints are indeed taken from the applicant. Fingerprints taken by private or commercial agencies are not acceptable.

A photocopy of the applicant’s Hong Kong identity card or travel document. The Chinese commercial code number must be shown if Chinese characters are used for their names.

The applicant shall authorize the Hong Kong Police to retain his/her fingerprints and to disclose details of any criminal conviction recorded against him/her in Hong Kong to the appropriate Consulate/Immigration Authority.

Following the return of the completed personal data form and a fingerprint consent form, a "Certificate of No Criminal Conviction" or an appropriate reply together with the applicant's police record will be sent directly to the Consulate and/or immigration office. If a court record is required, the applicant should write directly to the Registrar of the High Court or the First Clerk of the Court. The applicant or his/her attorney should have a record of which court he/she attended for the hearing of the case.

NOTE: It is essential that applicants for the Certificate of No Criminal Conviction (CNCC) inform the HK Police Force which U.S. Embassy/Consulate General will be handling their visa application process. If they are applying for immigrant visas, their visa case number is useful because it bears the country code (for example, HNK for Hong Kong). If they are applying for adjustment of status with the U.S. Citizenship and Immigration Service (USCIS), applicants should declare the location of the USCIS office where they are applying for their immigrant status. All derivative applicants should list the name of the principal applicant in their application for a CNCC.

I don't have any Hong Kong specific information, however generally this is the letter they will send you regarding the DS-230. All it has is a web address you go to, you then choose your embassy from the drop down list - the next page has information specific to your embassy which includes:

- Information on which documents you must submit with the DS-230 and a link for the DS-230 form you will fill out.

I would imagine you cannot submit your DS-230 without your police clearance, or rather, you can - but they will just send you an RFE (request for evidence) and will wait for you to send it to them.

Unfortunately that doesn't help, if you read the page from the link you posted it states the following:

REPORTING THE BIRTH

A Consular Report of Birth can be prepared only at an American consular office overseas while the child is under the age of 18. Usually, in order to establish the child’s citizenship under the appropriate provisions of U.S. law, the following documents must be submitted:

(1) an official record of the child’s foreign birth;
(2) evidence of the parent(s)’ U.S. citizenship (e.g., a certified birth certificate, current U.S.
passport, or Certificate of Naturalization or Citizenship);
(3) evidence of the parents’ marriage, if applicable; and
(4) affidavits of parent(s)’ residence and physical presence in the United States.

As the OP mentioned, her Husband was not able to provide enough proof of physical presence in the U.S., after his 14th birthday.

I don't really have any advice for you Lostgurl as I am not familiar with children applying for a visa to the U.S., but I wish you luck good.gif

The shortcut that is currently published in the Wiki is a bit misleading, they either want your transcript OR your tax return with slips.

As for the certificate of employment, what I was saying basically is that if you can only get the contract and you are going to go ahead and submit your I-864, then that is what I would send with it.

That said, anticipate that they may send you and RFE for a letter of employment.

Not necessarily always required, but in your Husbands case they may request that letter with an RFE (so be prepared for it). Because he has been employed at this job for such a short time, I wouldn't be surprised if they did request a job letter.

2) Job Letters and Proof of Income Pay stub(s) showing income for the most recent 6 months and letters from all current employers are no longer required as initial evidence

The applicant, however, may submit either or both of these items (1) in response to a request for additional evidence (RFE), or (2) with a Form I-864 if the applicant believes doing so would help establish that the sponsor meets the governing income/assets threshold. If submitted, letters from current employers should show dates of employment, the nature of the job, wa ges or salary earned, number of hours/weeks worked, and prospects for future employment and advancement. Photocopies of the IRS transcripts shouldn't be a problem. I don't understand why you would be sending copies of tax refunds? Did you mean tax returns? If he is submitting IRS transcripts there is no need to send the returns as well. As for bank statements, are you two using your assets as part of the income qualification? If so, then I would include original copies of bank statements (should be able to get as many copies as you need from the bank).

You don't mention whether or not his Mother is using assets as part of the qualification for the affidavit of support. If not, if she is purely using employment income, then no, she does not need to provide the deed to her house.

If she is using the house as an asset then:

(A) Evidence of assets. Evidence of the sponsor’s assets should be attached to the Form I-864. Evidence of the principal sponsored immigrant’s and/or household member assets should be attached to Form I-864A. In each instance, the evidence should establish the location, ownership, and value of each listed asset, including any liens or liabilities for each listed asset. Evidence of assets includes, but is not limited to:

· Bank statements covering the last 12 months, or a statement from an officer of the bank or other financial institution in which the sponsor has deposits, including deposit/withdrawal history for the last 12 months, and current balance;

· Evidence of ownership and value of stocks, bonds, and certificates of deposit, and dates acquired;

· Evidence of ownership and value of other personal property and dates acquired; and

· Evidence of ownership and value of any real estate and dates acquired. (link as above)

Hi Marjorie,

Don't be too hard on yourself - the photos for NVC are new this year. I see you only started dealing with NVC in March/April. It is possible you read the instructions before they had actually put the photo requirements on there (like in February). It was discussed here at VJ as people were getting RFE's for them - but the website instructions hadn't even been updated yet:

Marieford - they want two U.S. passport size photos, although you can take them yourself (and they won't care if they are taken on film or with a digital camera) you will have to meet U.S. passport photo specifications.

You could try to drag your feet at the NVC stage (if you haven't found a job by then). You don't have to send in your sponsorship information until you submit the I-864 - which happens at the NVC stage.

Well it's not quite the same, unless your NOA2 said the same thing that his did.

What would be helpful, you mention in your post that you were able to get through to USCIS and speak to someone about it - perhaps you could tell teh original poster what number you called and how you managed to get through to someone?

You know Paulo - your wife should really get an infopass and go and talk to someone at USCIS as well, if you don't get a helpful response over the phone.

we sent the i-130 back in november 06, they got it a week later, I have a notice of action with a WAC number (is that NOA2? - I don't even know...) we sent off the affidavit of support form with the DS230s early July, 07 then they sent us that we are missing some info (which we didn't - they just didn't bother to read the letter we attached about how my wife wasn't living and working in the US in 2006 therefore has no tax return for that year).

right now we are waiting on the NVC to let us know the embassy has all our stuff... not sure how long will it still be, but I'm starting to get edgy... my wife is returning to the states in October, and I would love to join her. I hope the interview will be before that.

In general we've agreed on that the first part is for DS-3020/I-864 generated, the second is for IV bill received but we haven't really agreed on what the DS-230 stands for, so I just tend to put there what ever dates are avail (mostly it has become the generated date but I'm not sure if it's the most usefull, it depdens wether one want's to know the temporal difference between IV received and DS-230 generated or between DS-230 sent and NVC Complete).


I like DS-230 sent by NVC and NVC complete, personally. There is variance between when people get the DS-230 and when they send it back, there is also a variance, depending on where you live (ie: posting time), however if we use the NVC sent and NVC complete dates at least there is some type of consistancy there?

Then again it still depends on when the person sends it back. haha

Erm, yes, Jigi, I know we're more or less in the same boat, but you still haven't answered the question many have asked you: has your I-130 been approved yet? Have you ever gotten a document from USCIS saying that your I-130 had been approved and was being sent to the NVC for further processing? As far as your timeline is concerned, your I-130 has yet to be adjudicated.

I just talked to my wife on the phone. She said she phoned NVC today again and no news from the bill. It seem that the NVC had messed it up (and they partially admited this on the phone). The NVC promiced to resend the IV checklist so that we can pay the same bill again once we receive it. Our plan is to give them time till Friday to cash it out and if they haven't done so by then we will cancel the money order and send in a new one with the new NVC checklist (which hopefully arrives on monday the latest).

My wife found out where she can track the money order and apparently where she can cancel it. But as is clear from above we won't do so untill this Friday.

The irony is that in most cases the government is overly eager to steal your money by taxes and inflation and spending it on stupid things that produce a bad results and are filled with incompetence. In this case they are even incompetent to steal the money...


I'm sorry this is happening to you guys. You do your best to rush everything in to move it along and poof they mess it up for you.

In my case, the IV BIll entered into system Aug.6,2007 message has changed wednesday night(Aug.8). Well I called the NVC today - they are sending a checklist - the auto message said: We have sent you a letter as we found info missing or incomplete on your financial evidence - mailed a checklist letter on august 20th for correction, please return this information to the NVC in Portsmouth New Hampshire.

I called and they said I didn't answer the domicile question (I did but I guess they didn't like my answer perhaps?) and they don't like my income amounts for the last 3 years. Will await the checklist to see what's up - oh well! Don't mean to get off topic here as this is the timeline - just thought I would share the info smile.gif

Can anyone here tell me how long it took their IV Bill to be accepted, if they know?


Hi Geist and Stabu,

I too called them yesterday to see if they had received my I-864 and IV fee bill (which arrived there on the 8th - I mailed it on the 2nd - so they have had it for a week).

Our automated message still says something about the fact that they sent out the I-864 or whatever back in July. Anyway the operator said they have received our I-864 however they haven't received our IV fee bill yet. She told me the same thing about the 10-15 days to process the payment.

Not really helpful to you, except our dates for sending them back are quite close (I don't know if you sent yours overnight). :)

This is actually a good quesiton that I ponder myself almost everytime I update the list and someone has gotten their case completed. Some members have used one shortcut and they thus say that they've used none. Others used one shortcut and say that they've used shortcuts. In most cases people use one to three shortcuts but rarely all four of those. The shortcut collumn seems to be less useful than I originally thought it would be; it won't give you good information about how much days you win by using shortcuts.


Yes, good point. We could use 'some' I guess. I agree that probably most only use 'some' of the shortcuts, myself included. Or would you just like to get rid of it?
