Thanks again for the help! I remember reading somewhere else that they might be considered household members of mine even though I currently live abroad, but since I can't find that I will go with the official word that you linked to me and is on the I-864 forms.

I understand what you are saying about household members. Your Father and Mother could probably both use the I-864A - if you are using them in your calculation of 'household members' on your I-864. Then again, do they really have the same principal residence as you? They will when you move, but do they now - I don't think so. Principal residence is not to be confused with 'domicile'.

Sponsors who use Form I-864 may qualify based only upon their own income and/or assets if either or both are sufficient to reach the income requirement. If, however, the sponsor’s combined income and assets are not sufficient to meet the governing threshold, the sponsor may include the income and/or assets of another household member if the household member: link

· Is at least 18 years old;
· Is included in the calculation of household size;
· Has the same principal residence as the sponsor (or is the sponsor’s spouse); and
· Has completed and signed a Form I-864A.

USCIS should ensure that each Form I-864A is completed and signed by the sponsor and the household member.

From form I-864A:

If you check box b (not married to the sponsor), you must provide proof that you currently have the same principal residence as the sponsor and that your income will continue from the same source.

So I think I have this down now. I need to file an I-864 regardless of my income. Because my income is not enough, I need to find a joint sponsor (co-sponsor? are these two different?) which my parents have accepted to be. My father is the primary earner in my family and his income alone is enough to surpass the 125% above poverty line, but because he files jointly with my mother (whose income is less than my father's, but not negligible) she will need to file an I-864 as well.

The 'correct' term is joint sponsor - or that is what they use on most documents. Co-sponsor works just as well.

Technically, according to the guidelines, maybe your Mother doesn't have to. However there have been a few cases lately where, at the interview, the CO has asked for an I-864 from the joint tax filer - they may understand the guidelines differently - this may go back to the whole Sponsor vs Joint sponsor interpretation.

(same link as above) - If a sponsor filed a joint tax return with a spouse, but is qualifying using only his/her own individual income, the sponsor must submit evidence of that individual income. This evidence would include, for example, the sponsor’s own W-2(s), Wage and Tax Statement, and if necessary to reach the income requirement, evidence of other income reported to IRS which can be attributed to him/her, usually on Forms 1099.


In the "individual income" field on the I-864 they will each write in the sum of their W2 forms and in the "household income" field they will write their combined income as it appears on their tax return. They will then both provide copies of their joint tax return (1 copy for each I-864) as well as copies of their supporting documents (W2 forms, etc...). Is this all correct so far? In my situation there needs to be a total of 3 I-864 forms (1 from me, 1 from my father and 1 from my mother), correct?

My only confusion is why my mother does not fill in an I-864A form in this situation. From what I read it sounds like the I-864A would be applicable in this situation because while my father is the primary earner, my mother's income is used to supplement his when they file their taxes jointly every year. Is the word "household member" on the I-864A only used in relation to the primary petitioned / sponsor (me in this case) and not in relation to the joint sponsor (my father)?

The way I read it is the way you have outlined it - with Sponsor vs joint sponsor. Your father is not the sponsor, he is the joint sponsor.

Sorry again for all of the questions, but no matter how many times I read over the forms and these forums I can't seem to find a definitive answer. I called the American embassy in Tokyo yesterday (they charged me $20 for the phone call!), but unfortunately the person who talked to me didn't seem to know exactly what to do. She said that she *thinks* I should have both of my parents just file the I-864 which is what I plan on doing.

The affidavit of support documents are not 100% clear and transparent. I can only surmise that they were written at a time when immigration lawyers ruled the U.S. immigration process and therefore several of the items are implied rather than spelled out - ie: you are supposed to know a lot of this before you read the guidelines. A few examples on the forms might help!

I called one of the pay by the minute lines for the consulate here in Calgary once. It cost me $36 to explain to the person on the phone what an N-600 is.

as per their definition,tax return and tax return transcripts are the same thing..

Definitions:

A tax return transcript shows most line items from your tax return (Form 1040, 1040A or 1040EZ) as it was originally filed, including any accompanying forms and schedules. It does not reflect any changes you, your representative or the IRS made after the return was filed. In many cases, a return transcript will meet the requirements of lending institutions such as those offering mortgages and for applying for student loans.

A tax account transcript shows any later adjustments either you or the IRS made after the tax return was filed. This transcript shows basic data, including marital status, type of return filed, adjusted gross income and taxable income.


For the purpose of the I-864 you can either submit the 1040 with all supporting income slips OR a tax transcript, both are acceptable.

Why don't you have tax returns? Did you not have any income or only very little?

If you did not file because you had little to no income (according to IRS guidelines) then you just need to include a note with your I-864 that you were not required to file.

Or did you just not bother to file? If so, then you have to file the returns before you can submit your I-864.

My take on this,

If you ask NVC if you could send a certified copy of the originals , then NVC will ofcourse say "yes" because they only know the word "Certified Copy". They do not know how the certified copies are made unless and until explained. For example , in the case of the russian documents it was , i am sure , explained why the certified copies were not available and therefore they accepted the "photocopies of the originals and notarized."

On the other hand , the word Certified copies of the original, in governmental term means a copy of the original that is certified by the issueing agency, not by a notary or some clerk or someone else not related to the issueing agency. It is very important to know this difference.

For exmaple, say a person was divorced and now gets married to a foreign spouse and is filing I-130 for the same. Then the Certified copy of the Original Divorce Decree is required. To obtain this, that person goes here in America, to the Circut court of the place where his divorce took place and was recorded. Then he requests a copy. The clerk will produce a Copy of the Final Divorce Decree and will Sign and Seal it with whatever that Steelmade Pinching Stuff, that creates a Raised Seal. when signing, The Clerk writes "Certify Copy of the original as maintained in this court"

Now on this doucment becomes and will be accepted as the Certified Original Copy of the Divorce Decree fo that person. He can submit this to any government Agency as the Original, because the original Always and always remains at th Circuit Court.

Therefore, the word here, Certified Copy of The Original is not to mean a photocopy of the original and thence Notarized by any Notary. NVC will not accept that.

No, it's not ok to send copies, if you are talking about photocopies, ie: if you went and photocopied the originals and had them certified by a notary or someone - they will not accept those.

You need an 'original' from the issuing entity.

Doesn't matter if it's full time or not. If you make the $ 18,212 specified on the I-864P (I assume it's just you and your spouse) - then it shouldn't be a problem.

No you don't necessarily need a letter, that is optional. If you think it will help to prove your income, then include one.

I can't speak for any other countries documents, but Canadian police reports don't have an expiry date on them. They only have the date they were produced.

How long ago did you get the police report done? Generally they are good for a year for U.S. immigration purposes.

You will want to have a look at a Canadian Panel physician's website to see which vaccinations you need to show that you have already had and to determine if you need to get anything else.

You must have a record of the vaccinations to present to the panel physician. That can be a letter from your doctor for instance, or your vaccination card.

If you find that you have not had one or more of the vaccinations required you can have them done at your regular doctor - or alternately you can ask him or her to do a titer test, which basically proves immunity.

Keep in mind, when looking at the flowchart that payments to NVC are now done electronically, rather than sending a money order, so once the bill is paid and accepted the person can print out a cover sheet almost immediately and send the forms in.

He already submitted it to NVC with his Affidavit of Support? If so, they will have it at the interview. Everything you have sent to date will be at the consulate now. Not sure where you read that you need to take another copy?

By all means if it makes you feel better you can take an additional copy, but it's really not necessary.

Why would you send both an email and a hard copy?

It seems to me that they are going to receive either one. When people like yourselves send both, what does that accomplish - well it slows them down. Now people on VJ make up a small group of actual immigrants, but not a tiny group.

Each time one of you sends an email and a hard copy you are asking 2 people at NVC to look at your DS-3032 - how many person hours does that equate to?

I see no logical reason to do this.

Also remember to bring strong proof of ties to Canada when you travel to the U.S. - mortgage or lease document, bank statement, letter from employer, letter from the person looking after your other children while you are in the U.S. - noting the date you plan to return etc.

He should not have been looking at the net, he should have been looking at the gross amount as stated on the I-864/tax return.

The thing is, you went in there without the correct documents - he should have had a copy of his 2008 taxes at least and probably should have had 2006 and 2007 as well. While only 1 year is required, they can ask for the other two at any time if they feel it will help prove that the petitioner can support the immigrant.

Plus he needed to provide a letter from his employer and several recent payslips - to verify his income, did he provide that?

Technically you shouldn't need a co-sponsor but you are not going to get the answer you seek here. You need to get that answer from the consulate. He needs to find out why, since he does meet the income requirement, he needs to get a co-sponsor, no one here can tell you that.

Folks,
I had a question regarding the automated message indication for AOS bill and DS 3032 getting generated. Does the message explicitly mention that the AOS bill and DS 3032 has been generated?
Its been about 2 weeks since my case was received @ NVC and a case was assigned on July 2nd. I was hoping today i would hear about DS 3032 & AOS bill generation but nothing has happenned. Also when you choose to speak to the operator it sends you back to the automated message line due to heavy call volume.

I brought originals and photocopies of each. I even renewed my NBI license. But they didn't even take a look at them. I saw in the window the original documents the NVC has requested. They were forwarded to the USEM. To be sure just bring the orig. It doesn't hurt to be ready all the time. yes.gif


However, if you don't want to waste money and time getting documents you will not need for the interview, I would recommend you contact the embassy where the interview will be held and ask them for their specific policy on original documents.

Most embassies do not require you to have a whole set of new civil documents, the ones you sent to NVC are forwarded to the embassy and things like birth certs and marriage certs which were submitted to NVC should be returned to you, they aren't always - but generally they should be.

That said, it is ALWAYS best to contact your own embassy to see what they require.

Do you know this for a fact? Have you seen a review from someone who interviewed at her Embassy or received written instruction from the embassy asking that you bring originals to the interview as well?

Most issuing offices will give you as many copies as you want, that is basically how it would be accomplished - IF it is required.

Yes, if his case number starts with MTL they are assuming he wishes to be interviewed in Montreal. If he has legal status in Canada and he can prove that he is able to stay there for 6 months or more (say he has a student or work visa or is a permanent resident) he will have to submit that proof with the DS-230 - they don't ask for it when they send you the DS-230 - but they will send you an RFE if you don't include that proof.

That said, is he perhaps just visiting and will be returning to Ireland for his interview. If that is the case a call to NVC should be able to straighten this out.

Mind you, that was NVC. Goodness, I'm glad the London Embassy don't seem to be that strict....I'd never get a visa in a month of Sundays.


Mostly I have heard only good things about the London Embassy - not all, but mostly. You will probably be fine good.gif

Obviously we aren't going through the London Embassy, but domicile is domicile smile.gif We both live in Canada. I don't think your questions are laughable at all, you are correct that the domicile issue is important.

I entered U.S. as my country of domicile on the I-864. In discussing this with another member (Colin Wilson - also a Canadian) they entered 'Canada' - he was approved.

As mentioned, you are basically going to need to go with item C on the list you posted - which is what we are doing. I did receive an RFE from NVC to provide more proof of domicile with my I-864. I opened a joint bank account with my Sister (she is in the U.S.).

When I resubmitted it I included (for reference - we sent in our I-130 in March of 2007):

- U.S. Bank Statement (with Sister's U.S. address on it)
- Copy of my application for a SSN from March of 2007
- Print out of online moving quote for March of 2008
- Letter from my Sister - stating that we will be living at her address and they should feel free to contact her to confirm this.
- Letter from me as I mentioned above.
- Copy of a letter from our Lawyer regarding the sale of our house from February of 2007
