Your wife works in Canada half of the year. Is this reflected on her income tax returns? I see where you are going with this. Even though she has a PR application pending, she still has part time residence in the U.S. - so if you don't tell them and they don't ask, how will they know that she is also a part-time resident of Canada with a pending PR application? At least I think that is where you are going.

Well the answer is, they probably won't know.

If you decide to take that course, then you cannot file DCF. That is only for people residing in Canada and you have to prove long term residence in Canada (Canadian driver's license, health care card etc etc). Once you give them this information - you will have to prove reestablishing domicile in the U.S.

If you decide to mail your application in to the U.S. service center, then yes, perhaps it will not be an issue. I say perhaps because if she does get asked about it - well you better be prepared to prove reestablishing domicile anyway.

Yes, the link Darnell gave you, that is one of the ones I posted for you above.

As mentioned in the guide, you can now download the form and mail it back to NVC with the coversheet you printed off.

It is confusing, historically they used to send you a hard copy as well, so you could download it or you could mail it back once you received it/filled it out. Apparently they no longer mail you a hard copy - which is wise because who wants to wait for that.

From the adjudicator's field manual, however it is a bit vague - doesn't say - if you submit a transcript don't bother with this - so I suppose it really is open to interpretation.

Yes, as Bobby mentioned, the key here is what exactly did you submit for tax records with the I-864A?

Does your Father file a joint return with your Mother? If so, you are required to submit his slips - W2s, 1099s - any and all slips that accompanied his 1040 - even if you submitted IRS transcripts - so they can determine what is his income and what is your Mother's income.

My wife (beneficiary) and I are having my parents sponsor her. I am in Indiana, and they are still at my childhood home in Alabama. I was told by an agent that one of them needed to fill out a 864, and the other needed to fill out a 864A, since they were a household member. This sounded odd, but we really only needed my mom's income since she makes quite a bit of money. I'm interested to see how that pans out, though!

Well technically, you don't have to have your Mom fill out the I-864A. The guideline is - if you are only using one person's income from a joint return they you need to send in supporting slips for the sponsor's income (so they can determine what income is the sponsors and what is the other persons).

Now I say technically, because although those are their guidelines, I have seen a case where someone was told to get the I-864A from the joint tax filer, if you happen to get an inexperienced CO at your interview, that could well happen, so I would definately, at least, have it with you at the interview.

I would say no, he would fill out the I-864. His permanent address is not the same. He lives in Conneticut. That is just my opinion though - without researching what they might consider technically as the "principal residence".

Unless your FIL claimed your Husband as a dependant.

Yes, if your income was zero, you should write in a zero. I know it seems a bit silly, but it is a legally binding document and they need to you state exactly what your income was.

This other RFE is a new one? Sure you can email them, but you can also call them and ask them.

Actually the best description is not to be found in that Wikipedia page - I would venture to say that the best description/guideline to use is from the department of state.

You cannot say that they want a copy of the original - the reason you can't say that is that it does not apply to all countries. For instance in Canada we can get a copy of the original - however we also have another 'certified copy' that is not a copy of the original but has the parents names etc, here is it commonly called a 'long form' birth certificate. - NVC will accept either of these from a Canadian.

It is consulate/country specific and if you want the correct information just choose your country from the drop down box on the page below and go from there.

You need to state only your income on the I-864 income lines for each year.

You should also get tax transcripts, not use the 1040 and slips - unless you can also get your ex-wife's 1040s and slips. You need to be able to show proof of your individual income. Someone stated here, the other day, that these individual amounts are shown on the transcripts, although I personally haven't looked.

On our marriage certificate it says " Jami tatlock " but we got her name changed on her medicare card and state ID with service new brunswick before we left the province to " Jami Turner". With that, which one to use?


Use the married name, there is a place on the form to note 'other names'.

Just two things to note. Her green card will be issued in whatever name appears on her passport with the visa in it (so if that is still in her maiden name, she might want to get a new passport now). When she gets her Canadian police check, be sure to note her married name and maiden name on the form they use for the name search.

Oh and - Canada doesn't have States - we have Provinces :)

Two things you will want to look at. The first is the USCIS poverty guidelines - I-864P

So, it depends on how many people are in your household/immigrating.

Assuming it is just you and your Husband or Wife, 125% of the guidelines is $ 18,212.00 (so if you are employed, this is the amount of annual income you need to prove). If you are using assets only, for a spouse, you will need to prove that you have assets that amount to 3 times this figure - or U.S. $ 54,636.00.

The second is the actual I-864. The answer to your question is actually in the instructions for the I-864, affidavit of support, page 9, part 7. The I-864 is a really important part of this process and I would recommend you read all the instructions. Good luck.

If you only made a small amount of money, there is no need to attach the W2s as they won't carry any weight. If you were not required to file, you just have to state that and why.

The written explanation would be something along the lines of:

I did not file a return for 07,08 or 09. I was a student and in 2007 and 2008 and had zero income and in 2009 my income was $2000.00, which is under the filing threshold.

If you are sure you are under the threshold for each year, no problem. If you are not sure, look at the 1040 instructions for each year. In the instructions for each year it tells you what the cutoff is. For instance if you filed single in 2007, the cutoff is $8750.00

Just so you know - she doesn't have to change her name at all if she doesn't want to. If she is going to use her married name, have her use it from the beginning, right from the I-130, note her maiden name under 'other names used'.

The visa will be issued in whatever name appears in the passport at the time of her interview.

You cannot change a name - only - on a Canadian passport, she will have to apply for a brand new passport to make a name change.

Basically they look at the entire picture. From a completely technical point of view, the joint sponsor's income which is over the 125% should suffice, however the purpose of the I-864 is to ensure you don't become a public charge - so they do - look at the whole thing.

The technical point:

Employment evidence:
(a) Except as provided in 9 FAM 40.41 N5.4 a(3)© and (d), below, if the information on the Affidavit of Support (AOS) and tax return establish that the sponsor's current income meets or exceeds the poverty guidelines for the year the sponsor submitted Form I-864 in support of the Immigrant U.S. Department of State Foreign Affairs Manual Volume 9 - Visas 9 FAM 40.41 Notes Page 25 of 38 Visa (IV) application, either by submitting to NVC directly or to post at the time of application, you must determine that Form I-864 is sufficient without requesting any further evidence. (See 9 FAM 40.41 Exhibit I, Poverty Income Guidelines.)


It then goes on to say that if the AOS shows income below the poverty guideline, at that point they should request evidence of:

(1) Current employment or self-employment; and
(2) Recent pay statements, a letter from the employer on business letterhead - showing dates of employment, wages paid, and type of work performed - or other
financial data.

The joint sponsor - i'm confused - you mention he has an employment slip (W2) - but you also mention he has his own business - so this is the W2 he issued to himself? His salary? Nothing to be done there if that is the case, his income is what it is and since he is paying himself - well - you should be able to discuss that at the interview, if it comes up.

As for your Husband's income - has he filed for 2009? If he included all his cash jobs - then they are on that tax return anyway, so nothing to explain really - his income is what it is. If you mean he has had several cash jobs this year, he should have some evidence of that, if you want to present it as well.

Anyway, unless you are adjusting status from within the U.S. - you won't be called for a biometrics appointment.

This is all separate and apart from the Canadian police check, which you will submit with your DS-230. The check you get done is good for one year, it is too early to get it, you should wait a few months, or until you get your NOA2.

You only need a fingerprint version if you have ever been arrested - otherwise the Canada wide name check will suffice. You can have that done at he police station or at an RCMP station - some places will be same day service, some may mail it out to you.

I am asking this because I received a letter from USCIS that says :

This is probably better posted in the CR1/IR1 forum, rather than immigration news, but yes, the income required for a household of 2 is $ 18,212.00

I assume this letter was from the National Visa Center and not USCIS and I also assume that you are filing for a CR1 or IR1 - or are you adjusting status?

Anyway, there are a few possibilities here. The person at the center did not see your supporting documents, you filled out the form wrong or you did not send the correct supporting documents.

Well that information is wrong - good find, but it's still outdated:

Some editions of the Form I-864 and Form I-864A include a jurat to be completed by a notary or by a consular or immigration officer to show that the person signed or acknowledged the signing of the Form I-864 or I-864A under oath. The Form I-864 and Form I-864A, however, provide that they are signed “under penalty of perjury.” Thus, 28 USC 1746 (which deals with the legal effect of unsworn statements) makes it unnecessary for Form I-864 and Form I-864A to be signed in the presence of or certified by a notary public or an Immigration or Consular Officer. Note that the jurat has been removed from the January 15, 2006 edition of the Forms I-864 and I-864A. Form I-86EZ is a newer form, and therefore never had the jurat.

Perhaps they just include that in case some people are using older versions of the form? Or perhaps they never got around to updating their website.

I understand what you are saying, but you are overthinking that question, that's really the bottom line. It asks for your annual income, they don't want you second guessing their intent with that question :)

If you want to over-think it in the opposite way - then consider that people are told over and over again not to make any plans until they have that visa approved, so then you could say, because you don't have that visa in your hand, that the 12 month income figure is the correct answer.

In our case I-130 Acknowledged on May 8th 2009,Case completed by USCIS on December 8th, 2009 then sent to NVC and Case at NVC completed on March 10th, 2010 and sent to Montreal Embassy in Canada. NVC operator says we don't have case as it has been sent to embassy and please call embassy for further details.

So what your saying is, this is normal that after completion of case they don't schedule interview immediately and it takes 4-6 months for interview from time of completion?. But the thing I don't understand is why are they saying call Montreal for details as we have forwarded your case?


The operator gave you the wrong information. In fact you cannot call the Montreal consulate - they do not take phone calls.

They don't schedule the interview as soon as it finishes at NVC - it will be scheduled, probably, in a month or two and you will be waiting approx. 4-6 months until the actual interview.

Also, you won't contact Montreal to find out when your interview is or if it has been scheduled, you will contact NVC.

A relative who has the same principal residence as the sponsor and is related to the sponsor as a spouse, adult child, parent, or sibling;
A relative or other person whom the sponsor has lawfully claimed as a dependent on the sponsor's most recent Federal income tax return even if that person does not live at thesame residence as the sponsor;
The intending immigrant, in certain circumstances.

Just send the I-864. I have to wonder what the lawyer was thinking.

For the tax return question, that answer is in the I-864 instructions:

"If you were not required to file a Federal incometax return under U.S. tax law for any other reason, attach awritten explanation including evidence of the exemption and how you are subject to it".

So if you earned zero money, that's easy, just attach a note saying in tax years - 07, 08 and 09 I had zero income and therefore was not required to file.

If you had any earnings in those years, then you need to state why you didn't file. Have a look at the 1040 for each of those years, it tells you what the cut off amounts are to file. So say for 2007 that was 8 thousand, for married filing (jointly - separately) - however you would have filed. You could state:

I did not file in 2007 as my income was 12 dollars and the IRS filing requirement, for 2007, for Married Filing Separately was 8 thousand dollars.

Just a simple statement for each tax year involved.

1)I know I am suppose to staple the I-864 itself and the tax docs separately, BUT do I staple the entire package all together including the cover sheet and cover page, etc..?

I wouldn't - just use a paperclip to hold them all together.

2) I know you are not supposed to leave any spaces blank on the form, so do I put "NONE", "NOT APPLICABLE", or "N/A" in the boxes..? ex: the SSN box for the applicant.....

Yes, use one of them - depends what the question is - for the SSN, for example - "None" would be appropriate. Where it asks you to list your children, if you have none - N/A would be appropriate. But really - doesn't matter, just be sure to use one or the other.

3) It asks for the Applicant's A-number - Does the USCIS send the A-number on the NOA2 letter? or will she not get an A-number until she gets her Visa approved and enters the USA??? Background - she has never applied for a Visa before and has never entered the USA before.... I just want to make sure I did not miss getting the A-number already.....

I think it is on the NOA2 - I can't remember.

4) Also, if I have not filed taxes last 3 years - what do I put for question 25??
