That's not true. As discussed here, USCIS employer guidelines allow the employee to choose what documentation of employment eligibility to produce from the list of acceptable documents on Form I-9. The NOA1 is not listed. However, an unrestricted social security card and a foreign passport with an I-551 stamp are.


Yup, my advice would be to go and get an unrestricted ssn card immediately while you are still in status (if you haven't already done so). I would recommend showing your employer an unrestricted ssn and a state id or drivers license. That way they need never have to check your EAD or green card.

Hardly. As long as she files the I-751 before the expiration of her green card, she will not go out of status, regardless of when she receives the NOA1. So if she is still in-status, even without an NOA1, how can that constitute "immigration fraud"?

Plus she can always get her passport stamped with an I-551 if she needs to.

we sent a money order. i'll likely check on it tonight. since my greencard expired yesterday i'm officially "in limbo". no NOA yet... i just have the receipt from the post office that my package was delivered.... kind of a weird feeling.

my greencard expired on the 2nd of december. two days before, i went to the DMV and got a texas drivers license. its yet to come in the mail but per the clerk it wont expire until 2010. i watched her write down the expiration date of my greencard and it didnt seem to be an issue. she barely scanned my social security card. obviously i didnt push it, but it seems to have worked out fine. i guess this would be different for every state. good luck.

Good morning,

My I-751 is pending approval. I have received the letter stating work authorization is extended for 1 year. I have a social security card with a stamp on it that says "valid for employment only with approval" (or something to that effect). I have continued to work at my job within a large corporation with no problem. In other words, things are fine.

However--- I am beginning to look for a career change. I am quite concerned that a potential new employer would be hesitant to take my SS card / expired green card / 1 yr letter as valid proof. They could be concerned that I can only work for a limited time, for example.

-is there some way to update my SS card and get one that does not have the "under authorization only" stamp?
-has anyone had any experience dealing with human resources depts that is in the same position as me?

Had no problem at my current job because I had my valid green card.

Hello,

I am a happy US Permanent Resident. Citizen of Canada.

I was accepted into two Universities back home in Canada and would like to finish my degree.

School starts in September so this is not enough time (I dont think) to get US Citizenship.

I would like to return back to the states when I finish my degree (or at least keep that option open) as I love my new home in Austin. Will my husband and I have to go through the whole application for spouse permanent resident again? Will it be harder the second time, since I assume they will see that I have "abandoned" my permanent resident status?

My husband is a US citizen, we did the whole fiance visa process 3 and half years ago. He is currently studying in Canada also, as an International student on a student visa.

Does anyone know of any options here, or have you gone through the same thing? Posting in the citizenship forum too.

This is similar to my question in another thread about going back to school in Canada... I do not know the answer myself. I believe it would make sense to apply for a travel permit / re-entry permit, however I doubt that there are any guarantees tied to that.

If the permanent resident is employed while at school and maintaining a house outside the US to me it seems like that puts ones status in jeopardy.
