Welp, called the NVC and they shipped out the petition to Athens yesterday!

So within a few weeks we'll have our interview date. kicking.gif

Because she lived in Germany for college we might expect a 3-5 week delay because they have to mail her a police certification thingy. Hopefully her local German consulate in her town will let her order one from there.

Right now looking at a late November / Early December interview (just to be on the safe side), and she wants to spend one last Christmas with family, so also aiming at a December 26/27/28/29 POE (whichever tickets are cheapest as it's going to be an arm+leg), so we can start the new year together. smile.gif

I think the I-134 is 100% of poverty level, for 2 people (spouse and yourself), likely $14,000 or 15,000'ish. USCIS status won't indicate (didn't for me), but calling the NVC they will tell you if it's arrived, being processed, or left for the consulate.

I don't think you need any more pictures unless you visited each other since filing the petition (as in, I doubt it would help any more unless you two were together since filing), but from talking to the Athens consulate, myself, at very least, they would like to see some phone records or emails. Ironically, the lady I talked to might be the one actually interviewing her.

I also use Vonage (VOIP), myself, and am printing out a big stack of phone records that you can find a printable version in your online account manager. It sure is going to be nice to be spending a LOT less on phone calls. laughing.gif

I ended up getting mine online before receiving it in the mail. In fact, the petition arrived at the NVC before I got the approval in the mail, and I never even got an email telling me (despite having the e-mail notification set-up) I was approved.

I just happened to spot it on the USCIS website when I went home as I had been touched that day.

Very weird how these petitions have a pretty clear instructions on what happens yet things still happen out of order or in some chaotic way.

I'm not sure if you guys are being held up by security checks (as I mentioned earlier I've been through so many, plus certain clearances from the ATF and DOJ it's not like they don't know who I am) or slow adjudicator, but all I know is this is a bit ridiculous now.

Still, lets maintain a positive vibe this week as we should certainly see a good handful of new approvals. kicking.gif

Finally received the NOA2 in the mail. Was wondering when it would arrive.

Now to prepare the paperwork! Tends to hundreds of pages of phone records to print, along with an arsenal of IM and e-mail chats.

They sure as %#$ better be satisfied with this!

Also, I'm trying to calculate the costs of this. Police report, medical, and visa costs?

Plus the costly AOS. Yeouch.

I will say faith and patience. Most of us will never have to go through the time that some others have had to go through.

Off the top of my head, Sunnybear had to go some 7 months before NOA2, and of course, I keep bringing it up, but estadia has gone over a year without NOA2, and a really sh!tty time with the CSC to boot.

That's just why I'd like to see things a little more transparent. No one can really know why your petition is being held up, just some random theories. At your last touch, it could have still been pending, so it was put back into the stack which means it takes a while longer. That's why I was crossing my fingers when I got touched yesterday that it wasn't that case. I've gone through so many DOJ backgrounds, applying a few times to be an officer, getting ATF clearance to be able to handle highly potent explosives, guard card when I was going to help a friend out with his security company (requires yet another DOJ authorization), that I'm probably easy to get backgrounds on. It's like "background for [my name here]", "oh yeah, that guy again".

My only thought is when they went through the stack, there was something not done, maybe backgrounds, having trouble contacting people, who knows. So it was scanned in, looked over, then for one reason or another tossed back into the pile and maybe it went to someone else who's slow. I really wish for all the cost and time that's spent here regarding our petitions we could get more official answers.

As it is I find it ridiculous I have to go through the government to approve of my relationship.

Howdy,

Long story short - i'm approaching my 3 yr anniversary and would like to file for citizenship. I'm a Canadian citizen / US permanent resident. My husband is American.

As far as I can tell I meet all the requirements for being approved -- HOWEVER my US husband has been in Canada for the last 2 months going to a Canadian university. So there is a question about our residing together. I maintain our address and home in Texas, but he is up in Canada going to school pursuing a degree.

Am I out of luck? Thoughts?

Are you currently eligible to apply for citizenship? If so, I would consider applying immediately - you have 5 months - depending on your local office, this may be enough time.

If you don't apply, before leaving to attend school in Canada, I would apply for a reentry permit - this will permit you to live outside of the US for up to 2 years, without losing your permanent residency (greencard). This will resolve any issues you may incur, regarding staying out of the US for over 6 months, failing to maintain residency etc. However, i do not know how these would work if you wanted to return for visits to the US and then leave again - you would need to read up on that. This does mean however, that when you do return to the US to live permanently, your "residency time' for eligibility for citizenship will restart. IMO, if you simply start going to school in Canada, without gaining citizenship, or a re-entry permit, you will leave yourself in a vulnerable position.



I am curious if anyone else has used the reentry permit in the same way (to finish school abroad) and for how long they were outside of US...

I am a happy US Permanent Resident. Citizen of Canada.

I was accepted into two Universities back home in Canada and would like to finish my degree.

School starts in September so this is not enough time (I dont think) to get US Citizenship.

I would like to return back to the states when I finish my degree (or at least keep that option open) as I love my new home in Austin. Will my husband and I have to go through the whole application for spouse permanent resident again? Will it be harder the second time, since I assume they will see that I have "abandoned" my permanent resident status?

My husband is a US citizen, we did the whole fiance visa process 3 and half years ago. He is currently studying in Canada also, as an International student on a student visa.

Does anyone know of any options here, or have you gone through the same thing? Posting in the perm resident forum too, not sure where this post belongs.

Can you tell me more info, because your situation sounds like mine. I have my US green card but would like to return to Canada to finish university. My US husband is also going to school there (so we really aren't maintaining a US address). Did you get an application for travel document before you left the US for school? I am panicking because I don't want to loose my permanent resident status that I worked so hard for, yet we also want to finish our education.

I am worried I will have problems getting back in to the US after I complete University.....

(I am not so worried at this point about getting citizenship, I can wait patiently for that. I am more worried about impacting my perm resident status altogether)

So I am filing my CDN taxes for 2005... wondering if anyone has any advice on how to handle this. I became a US perm resident Dec 2 2005. My tax program is asking my province of residence Dec 31, 2005. (I used to live in Alberta).

I can put my mom's address (where I still receive a lot of provincial and government mail) ...or my new US address. I'm sure if I was savvy enough I would know the implications of this. In the future I would like to return to Canada with my spouse.

Does anyone know the advantages / disadvantages or tips on how to handle this? Sorry if this sounds confusing, I'm basically just looking for info on what other people did with their taxes...

how exactly do i file the federal T1 return (for non-resident or deemed resident) AND the provincial return? for example, i am using ufile.ca, and for the province i resided in on dec 31st 2005, i have to indicate "deemed resident" (since i was in the states)... then it creates the federal T-1 non/deemed resident return. or should i put "alberta"?

i realize you arent an accountant but i really appreciate your input! my taxes are SO simple - i was a renter with one T-4 and thats IT baby!!-- i REALLY dont want to have to send these off to an accountant and get charged a fee to finish them. taxes are not my forte. after doing all the immigration stuff myself, my brain has reached capacity.

Your taxes for 2005 will be prorated til lthe day you ceased to be a Cdn resident, in ur case dec 2 2005, so you will get most of the yr covered.



i LEFT canada june 7 but became a perm resident of US dec 2. would it make more sense to put dec 2 as the date i emigrated? since technically, i was a canadian resident in the US on a visa until that point.

Just a note...on that page it says if you aren't a resident, use the non-resident forms. However, when I called the International Tax office yesterday to ask for clarification, they told me that because I moved last year(2005), I would still use the forms from my former province for that year.

When in doubt best to call Canadian International Tax office, # is 1-800-267-5177

Does anyone know of any forums / advice / words of wisdom ... regarding going back to Canada and taking along a US Spouse? Thats right, I'm stealing a good one from Texas and taking him back up to the great white north wink.gif

I successfully came into the states on a K-1 and we are very happy here, but would always like to keep our options open. I have been confused by some of the stuff I've read about going back into Canada - specifically how I show that I can support him (when I havent had any Canadian income in 2 years and obviously I'm not in Canada).

I know this isnt probably the right forum but if anyone has any tips, much appreciated. I've reviewed the cdn gov sites but they're pretty thin on info.

I am a permanent resident (just under 3 years) living in Texas. I am a Canadian citizen. My American husband would like to study abroad in Canada, and I would like to go with him. However I understand this will mean I have abandoned my US permanent residency, forcing us to start all over and re-apply for return to the states as husband and wife.

Obviously I dont want to jeopardize my permanent resident status, and I dont particularly want to go through a whole immigration process again...

What options do we have?

(Re-entry permits appear to only apply to travelers... I would be employed in Canada...)

I'm a Canadian citizen and US permanent resident. My husband, obviously, is American. Ideally we'd one day like to have the freedom to move back and forth. But I looked at the Naturalization application and got spooked by having to sign stating I renounce any other allegiances and that I'd be willing to bear arms for the US. I wouldn't want to put my Canadian citizenship in jeopardy.

I also had one odd question...

I meet all the requirements for Naturalization with one weird exception. My American husband is not currently living with me - he has been in Canada attending University for the last 2 months. Technically he is still "residing" at our US address... but going to school in Canada. Any idea if that will screw up my chances of getting naturalized?

One last question -- no passport style photos are needed UNLESS you reside overseas / military service etc. "Regular" folks dont need to send in passport style photos right? Just copies of the greencard. No need for passport style photos. A digital picture will be taken when you go for biometrics.

One last question -- no passport style photos are needed UNLESS you reside overseas / military service etc. "Regular" folks dont need to send in passport style photos right? Just copies of the greencard.

dare i ask what happens if the SS card is "restricted"?

is getting a non restricted SS card an impossibility at this point (expired GC, no NOA yet).

if someone is continuing to work during the interim between GC expiring and NOA arriving, would wages need to be paid back or what? i mean, if the employer is not proactively monitoring and the employee continues to work during the "grey area" period is the employee/immigrant putting themselves into an illegal position?

i suppose the answer is likely = contact an immigration lawyer......
