I think it goes like this.

When in doubt, blame security checks. (USCIS, now part of the DHS)

Security checks falls under state secrets, because it means revealing classified data only shared with people who have a certain clearance.

Since the DHS and DOJ (incl. FBI) are the de-facto agencies which are responsible for such checks, are cabinets that's part of the Executive Branch, and the Executive Branch has chosen to.. expand it's secrets, and refuse to cooperate in sharing them, I believe filing a lawsuit against them sort of falls under the "snowballs chance in hell" of succeeding.

I wouldn't take those not updating too personally, and I wouldn't take the numbers on Igor's list too literally.

It's just more wise to use it as a guide, not to get antsy on when you're going to get your approval as you just might be setting yourself up for disappointment when others don't get it. For this the suggestion is have low expectations or none.

I tell you, I would not have the patience you have. I'd have packed my bags and left. Viva Canada or Greece, or, in your case, India.

With the rear end of the petitions coming in February and your petition being in August/September of last year, there's certainly a reason to believe it has nothing to do with security. A friend of mine (an ex of my mother) is an investigator/officer (also owns his own security company which needs these backgrounds to let guards use firearms) and these DOJ backgrounds are not this difficult to get. Even easier are employment verifications -- it's just a matter of calling the employer or looking at tax filings.

I know it may delay things, but what would canceling this petition and re-filing do?

That is, if going to the media isn't so realistic. Personally, I wouldn't let some asshat bureaucratic agency tell me who to be with, and would be with her even if it meant leaving the country. I would go to the media and find any way I could to tear ### on the USCIS / CSC if this happened to me.

I would definitely go to the media. Embarrass them. This is ridiculous. We shouldn't even have to go to this extent as citizens to be with the person we love, and have to prove it to a bureaucratic mess. I just pray this doesn't happen to us, and pray that something is done about this, because it's just not right.

As for plane tickets cost, it all depends where you are coming from and Port of Entry. I found out that first checking her countries flights and routes to America and then looking at connecting domestic flights to our home was the best way to go, because domestic flights are much cheaper than international flights yes.gif
Oksana is flying from Tashkent Uzbekistan to Seoul Inchon South Korea and then on to Seattle (my home state) She will then connect with Alaskan Airlines to Eastern Washington. Flight miles 8,412 . Best thing to do is check all flights to US major airports and then check domestic connecting flights to your nearest airport. You will save a little money yes.gif

Where do you see something about priority and quotas? Have a link? I think theyre probably fast tracking people who are trying to naturalize in time for the election. I had a friend who went through that recently, was told a wait time of a year and then managed to complete the process and have the ceremony in a few months time. She filed her paperwork well after I did. It would seem k-1's are pretty low priority looking at the processing times for other types of cases. It could be worse though check this one out >.<:

Has nothing to do with the elections, as it doesn't give them a pay raise, so they're not going to adjudicate any faster due to elections. It's based upon quotas and especially the fiscal year.

I'd say the most tasking part of this is both getting evidence of an ongoing relationship and getting the affidavit done (plus notary).

While the USCIS information from here is generally good advice, when it comes to questions about what you need for the embassy for the interview, contact the embassy itself. For instance, there are several things the post-NOA2 guides here have told me to do that I don't need to do, which saves money and time.

Congrats to the approvals!

It took us a month to receive Packet 3, as things are in chaos in Greece. I mean.. business as usual. We're not really behind schedule except maybe planning on her coming in January as ticket prices become a bit more reasonable. Like, nearly 1,000 reasons more reasonable. Still waiting for her police certificate from Germany (should be a week or so left), she has her Greek one, and getting ready to send all the other stuff off. They make her do her medical a day or two before the interview, so she has to stay in Athens a couple days, and for now we're still looking at the first week or two of December for the interview.

She also got a bit of a reality check, got a bit scared (I warned her of this last year), and is better again. Reminds me of all those movies with women running off during their wedding. We need to put women under some genetic therapy to include "rationality". tongue.gif

Ok so thanks to the time difference I called the Athens embassy (at 3am my time) and they received it a week or more ago (emailed for a specific date so I can put it on timeline), mailed it off on the 15th and it should be arriving any time. Of course, there are major strikes going on in Greece (not surprisingly) so it might take a while to get to her house. In the meantime, I have all the packet stuff for her to fill out, and they don't care to see a copy of my I-129F or G-325A. So entirely supportive evidence plus affidavit and fees I'll be sending to Greece in the next couple days. smile.gif

The big delay will be the German police certificate which takes 3-4 weeks. So aiming for a late November/early December interview, plus same POE of a few days after Christmas. The people there reminded me that few people actually want to leave Greece (this I knew) and they have very low rates of fraud, and are very straight forward and quick to decide, meaning it's very simple for them to see that we're together and want to marry. So should have no trouble with her interview.

Still awaiting word that the package has been received. Her being sick (40C/104F temperature) and illness hasn't been helping either. Expecting some delays as she tries to get a police certification from Germany as well, as she resided there around 5-10 years ago. She wants to spend one last Christmas with family, but if the German certificate does take a month (they should let her do the interview without it anyways, just delaying it until she gets it, right?), we want to make sure to get it at least on it's way this week to avoid any holiday slowness. And Greece is horrible already at managing, well, pretty much everything. Hell, good thing I bugged her consulate because they process I-129Fs and the interview process through their immigrant division, not non-immigrant. Very weird.

Oh, I also haven't yet received word the embassy received it, either. Any way to find out without having to call the embassy itself? They're really tough to even speak to, never mind ask questions regarding this.

Well, I shortened our evidence from like 150+ pages from Vonage calls to like 35. Only included a few emails and IM stuff, mostly because they involved things you wouldn't want to show them. Of course, I plan on canceling my Vonage service, thank god, at the end of this month when my first year contract expires. We'll see how that goes.
