IR-1 / CR-1 Spouse Visa Process & ProceduresI-130 approved Aug 05, still no case number as of Sept 21, 2009
My case took 4 weeks to get to NVC. But it really depends..keep calling them and bugging their pants off! I hope it gets there before the 90 day...period though. And if not, they'll put in an investigation.

I've heard of USCIS misplacing files before...maybe that's it.

Good luck! I hope you get your NVC number soon.

Like everyone else, I vouch for the CR/IR1 application. It's a better VISA, and your husband would become a permanent resident at POE and he'd be able to work right away. As well, he would not have to file for AOS/Adjustment of Status.

And in the meantime you should, COLLECT EVIDENCE. biggrin.gif
E-mails, letters, presents, pictures together. Go wild. You can never have too much evidence.

IR-1 / CR-1 Spouse Visa Process & ProceduresForm G-325a Questions
QUOTE (matt01 @ Nov 5 2009, 10:57 AM) <{POST_SNAPBACK}>
On Form G-325a for a 1-30 petiton, do I cross box ''status as permanemt resident'' or cross box ''other'' and specify ''I-30 petition''?

Also when I send the form off to my wife for first package to be sent, can she make 3 copies of the G-325a and send with the original? The original being signed of course.

If you are applying for the CR/IR1 and/or K3 Visa then you would cross the ''other'' option and specify I-130 Petition.

As far as the G-325a sheet, there should be 4 sheets to it, and the content should be the same in all 4 sheets. And yes, sign them!

Hello there, I completely understand your frustration. When my husband and I filed back in March 2009, a lot of other March filers got their NOA within the first 2 months. We waited 4, and that was with an expedite. I believe the max wait time is 5 months. Hang in there and good luck. :)

K-1 Fiance(e) Visa Process & ProceduresNot sure where to start. [K-1]
My fiance and I have been together for 3 years pretty much, and we met online, but we have seen each other on several occasions. We're in the process of putting the I-129F package for the K-1 but we're not really sure where to start.

Should we fill out all the forms and then work on the letters, and then work on getting pictures printed out, and everything? I'm just so confused, and would really like some help.

Also, he is currently in the army and is at Fort Bliss, Texas for his AIT training. What should we put for his home address at this time? Military address or his house that he used to live in, and where his parents still reside.

Thank you. : )

K-1 Fiance(e) Visa Process & ProceduresNevada or Texas Filing for K-1? @_@
So, my fiance and I just found out that he will be stationed at Fort Hood, Texas recently. We're going to file for the K-1 soon, but we're not sure to which USCIS to file. Should we use his old Nevada address (his parents) or should he just file with his new Texas address?

As well, where do we locate these addresses? We're just not having any luck. >_<

Thank you in advance!

Does anybody know about snail mail letters? I have around 10 that my fiance sent me while he was in Basic Training in the US Army. I have some from July 2008 to August 2008. Should I include these letters as proof of an on-going relationship? And should I send them the originals or should I make copies and send those instead? |: I'm quite confused on the subject. And I have some slips proving I withdrew money when I was visiting him when he lived in Las Vegas.

K-1 Fiance(e) Visa Process & ProceduresK-1 Questions =)
Hello again, I have more questions =)

Because my fiance is going to be shipped around a lot by the army, would it be okay for him to just use his parent's address on the forms? That way it is sure that the paperwork will not be lost in the mail, or something along those lines. Plus he lived with his parents before he enlisted. It was a kind of unique situation...he dropped out of school when he was 17 (he is 20 now), then he looked after his brothers for his mom (his dad is a trucker and always away.)

So I am wondering if using the parents address is fine, and his parents will be helping with the process, as in, they will have the copy of the K-1 Visa we send in, so they will be able to send everything that I need, to me.

As well, he may be deployed this March, but it is not certain. In the event that he does get deployed, and we get approved, is it possible for me to not enter the USA until he returns? I am so confused to how that would work... :S

K-1 Fiance(e) Visa Process & ProceduresFiancee holiday visit, need PoE advice
But, do they keep track of the reasons you give customs for crossing the border? |:

Because once I said boyfriend, the other time I didn't mention who just that I was attending a military graduation.
I've only seen him 3 times, 2 I had to go there, and they only asked me who/what/why when I was re-entering Canada.

K-1 Fiance(e) Visa Process & ProceduresFiancee holiday visit, need PoE advice
So let me get this straight, they keep track of the reasons that you claim is the reason why you entered the United States? In my situation, my fiance lives in Las Vegas. US customs has never asked me who I was going to visit or what I planned to do in the US. Its only when I came back that they asked me.

The first time I came back, I said that I was visiting a boyfriend and then the second time I stumbled a bit on my answer (I was really tired). They asked me where I went, and I said Las Vegas and they asked why, and then I was like, ''Oh, I'm sorry. I went to Las Vegas and Oklahoma for a military graduation ><.''

So my question is, do they keep records of that ):? They never pulled me aside or anything, they just let me through. I hate Canadian customs. I find them to be more strict than US customs.

I plan to visit again in December because my fiance will have time off from the military. What should I say to customs if they ask? And what documentations should I bring? I don't have rent or a mortgage. I still live with my parents and although I do assist my mother with mortgage funds...my name is not on the mortgage. So that's not an option.

Could I bring a credit card bill and banking information? Anybody with information on that. And I'm going to ask my employer for a letter of when I'm expected back tomorrow.

I've also found that if I give the customs officer my passport and itinerary, they don't give me a problem |:
Any suggestions on what papers I should bring, just in case?
(Hearing all these custom horror stories has made me paranoid.)

EDIT.
Would it be safe to say that I'm going over so we can put together the final pieces of the K-1? I unno...lol

K-1 Fiance(e) Visa Process & ProceduresHave to delay filing K-1
Having a fiance in the military is such a hassle. When I was visiting him last month, his recruiter told us to just get married and adjust status...haha. Anyway, it seems like it will be a total pain to marry once I even get down there. I'll be hard to schedule his leave, so thank god for the K-1 giving you 6 months to activate it.

Does anybody know if I could just enter the USA about 2 1/2 weeks or a month before his leave and apply for a SSN with a I-94(?) after 2 or so weeks by myself so that way I'd have it before he gets his leave? We'll probably get married at some random place in Las Vegas, which I don't think I need a SSN for..and that would be where I'd go until he could relocate me to El Paso. @_@

Sigh, it's so confusing ):
I'm sure him and I can do this but still

I think it would be a good idea to send it in now because the processing of the I-129F petition is around 5 months right now, by the time he gets back from his deployment you would be (hopefully) on track to having your interview by then! Then once he gets back he can prepare the I-134 Affadavit of Support for you and an updated fiance letter of intent. You could expedite it but then you would have to put off coming to the US to marry until he gets back from his deployment. Also he would have to prepare needed documents for you for the interview while he is in Kuwait, which may or may not be possible for him. Anyways, best of luck!

That would be a good idea but in the event that he doesn't come back as soon as we'd like, could we change the interview date? He is going to be in Kuwait for 6 months to a year. So I don't want to send it off if the dates will be whacked. I heard that once I get the VISA I have 6 months to use it then I have 90 days to marry. Hm..well, we'll figure out what to do once we find out how long he'll be away for. (:

But we CAN change the interview date if needed right? ):?

K-1 Fiance(e) Visa Process & ProceduresHave to delay filing K-1
Well, he is coming back up to Canada (hopefully) before he gets deployed for a visit. I personally do not want to get married first because it would be difficult to prove a bonafide marriage...or at least I think. I mean we don't have any children together nor do we share financial funds, although he does sometimes send me money via pay pal when I am struggling. The only thing we could do to prove a marriage is to have third parties write letters, etc. We are more than positive that the K-1 is the way to go.

The major thing I am wondering now is if he can send the I-129F to the California Service Center, 5 months prior to returning home. :S

Well, he should have his official orders by the end of the month. But he's getting deployed in 2 months. So, I don't think we could get expedite for that. :S Uh, this is so difficult.

Could he just take the petition overseas with him and send it off 5 months before he comes home? Or maybe we should just wait until he comes back to the United States. We just want to avoid complications.

So far we're thinking of just waiting until he comes home. But for now, I'm going to gather more information and make a decision once we find out his official orders.

K-1 Fiance(e) Visa Process & ProceduresHave to delay filing K-1
Soo, I just found out today that my fiance is going to be deployed to Kuwait(?) in March 2008. Needless to say, this sets us back a bit. We were going to send off the I-129F on the 15th, but now we cannot. We think it would be too complicated. ):

I was wondering if it is possible for me to send out the petition instead? Or does he, himself have to personally send it?

It's completely put together with all the signatures and documentations and I know it takes about 6-9 months nowadays to be approved. I was wondering if it would be a good idea to send it out 6 months before he comes home. (But we're still unaware at this point for how long he is being deployed for. It could be 6 months to a year.)

Suggestions are much appreciated. ):
Thank you so much everybody.

Once you marry in Brazil or any other place outside the USA, then the K-1 becomes invalid and you would have to withdraw your K-1 and file for either the K-3/CR-1. Think it over before you make your decision.

How long has it been since you filed the K-1?
