i'm from egypt and my wife from usa we on k3 visa , i have two questions wish someone can help me ... is there a time line to getting the visa after the interview ? i got the letter from the embassy telling me about the day for the interview then they called me and changed it for one week later so what i should to do is to asking them to send me other letter or print out the email they sent to me about the new date to be able to enter inside the embassy ?

I am a k3 visa so i come to the us since 12/27/2009 then i stayed two years with my visa and i applied for the Green Card January 2012 so this January i will have it for one year since i got it also my Green Card is for ten years and i been married for four years now because i married my wife In Egypt a year before i come here ,i am confused really because someone told me that i can apply for the citizenship this January because they count the time since i am here and married with my wife , others says no you need to wait two more years since you got your green card does not matter how long you here and married .. so what is the true on here please .. please let me know when i can start the process for that so i can make my budget to pay the fee for that .

Hi ,, i keep hearing different opinion about that so please i wish to know all the info that's for sure .

i am waiting for my interview for the citizenship,, i don't know when yet because my case now is in line for scheduling for interview and of course i dont my fingerprint .. two weeks ago i got a DUI first offense and they write it's a misdemeanor , i have a court date at the end of next month so please my big concern is .. does that can get me deny on my interview or cause a delay on my case or not a big deal at all ?

Marisa, I would not recommend leaving the income for 2010 and 2011 blank! Put zero as an answer because that could be an excuses for them to give you a checklist! They want to see everything complete. If you don't have income, put zero. It won't matter if it's zero or not cause you already have a co-sponsor! they just want to see that you filled everything in! :) Good luck!



Thanks , so do u recommend the petitioner write 0 in all 3 years income plus sending a cover letter stating that he was in Egypt for family issues and wasn't working during this time ( he didn't file taxes for 2009,2010,2011,2012) . we are confused and we dont need any RFS

Hi Mady!! I was just looking at your timeline and your I-130 got approved so fast!!! :) Do you know any reason it took so short? I sent mine in in August and now its been more than 7 months of waiting!! My internet is so slow today, I think in Egypt in general! :(
Anyways, even though my I-130 isn't approved yet, I'm just preparing for the next step already! I am just going to put for proof of domicile that I have a mailing address there, my bank account there, driving license, and maybe show classes I'm enrolled in at the college. That is really all I have. But for sure a job offer would be good proof and a copy of the U.S Credit card. Just anything that could show proof I would think! I'm not an expert on this topic though! The more the better of course! :)



I think it was approved fast as we sent our Egypt addresses ( both petitioner and beneficiary ) , we are both actually from Egypt plus we do have 2 kids ( Both acquired citizenship through their father (Born to a US citizen) , And maybe cuz we have been married for 3 years .. that's all what i can think of

Hi Mady,

I am also preparing AOS i-864. We also are using a joint sponsor and filing from abroad. I'm currently living in Egypt with my husband (I am the petitioner). I didn't work for 2010 or 2011 and in 2012 I just worked for three months part time in a seasonal job. So I will put in the blank for income for 2010 and 2011-0 and then for 2012 I will put the little amount that I made. Also since I didn't have to file tax returns for 2010 and 2011 and I was exempt from filing for 2012 because my income was too low, I will attach a signed note from me saying this and the reason. I will also staple this note to a page of the IRS publication that shows proof that I am exempt from filing taxes. I attached that document here. It is in the part "Who Must File Taxes" in the 6th paragraph I am pretty sure. Just highlight the part that shows you don't have to file taxes if your income is too low or non-existent . :) I hope this helps!! I was stressing out about it too for so long and then realized it is so easy!

I am preparing aos i864 , i have couple of questions hope u help me in them .

We r using a joint sponsor since we are filling from abroad , this joint sponsor is retired from couple of years but his income exceeds poverty lines . Shall i send the i864 , copy of his us passport and tax returns for the previous 3 years only ?

My husband the petitioner will fill form i 864 too but since we are abroad , he doesn't have tax returns for the previous years , what shall we send with his i864 ? and what shall he write in his income part ?

Also in Q#21 , shall he write 1 in the box beside married ?? although it was already counted in line 10 ( as the immigrant in line no 10 is me his wife ) .

National Visa Center (Dept of State)NVC FINALLY gave us our CR-1 visa Case Number

We are just so excited to finally after EXACTLY 1 MONTH from our NOA2 (calling and calling several times a week for 4 weeks) to get our case number today. The NVC customer service guy actually said he HAD it in the system. I must have sounded so jubilant & giddy (remembering what I had read on Visa Journey to sound polite and sweet toward the NVC reps) because he was accommodating when I asked him for both the case number and the other INT number. He gave them both to me without any reservation. I asked him if I can pay right now & he told me that it would probably take a week for them to invoice the bill & that I would get a letter of instructions in the mail. I told him, I want to pay asap because me & my hubby have been apart way too long.

And sure enough, I went online...NOT INVOICED yet. But hey, I don't care. I am pretty euphoric right now just to be able to log into my NVC account (kinda similar to the USCIS timeline) and see my name as the petitioner. It now seems more concrete that we are moving PAST the NOA2/USCIS stage and onto the next part which is leading to the interview stage! I hope this helps for people who are still behind me. :yes:

But I do have two questions for the people who already ahead of this stage.
1) How many days did it take for you to be able to get "invoiced" and able to pay online after getting the case number over the phone?
2) How many days did you get that "letter of instructions" in the mail after getting the case number over the phone? :whistle:

You can give them your emails both to receive the instructions via email instead of snail mail

Hello all;


My wife is US born Citizen but has the Egyptian nationality as well from her father. She owns a tax business in the US, but has been staying with me here along with our daughter that was born in Cairo since
May 2011.

Our case has been completed at NVC since August 18th awaiting the long anticipated interview.

Last week I visited the US embassy here in Cairo requesting a non-immigrant visa. I had an invitation for a prestigious business conference in Boston and letters from my employer that they will pay for everything. A five day conference mind you, and I work for a large multinational organization that is well known in Egypt.

So I walk up to consular counter like an idiot all comfortable and relaxed. I have nothing to hide, I am actually a former green card holder from a previous marriage that went sour, and had left the US voluntarily on my own terms.

So the consular starts asking me about my life in the US and my current US citizen wife. I told her US has always been my home, but I left because we are all driven by our financial needs at one point or another. US citizen wife is staying with me until we finish the case.

She said I am sorry, US laws has my hands tied, I am sure you will get your green card but I cannot approve your non immigrant visa request.


It was heartbreaking - I just wanted to represent my employer. I told her, how you consider me a flight risk, because honesty does not pay - especially that she kept stressing on my statement that the US is my home ( I lived in the US for over 15 years). Hello everyone I am a bit confused on that item

 

Are you a male that lived in the US anytime between your 18 & 26 birthday? which does not include living as a lawful non-immigrant

 

and when you examine the instruction sheets , it states

 

 

  • If you answered ?Yes? and:
    • You are more than 31 years old when you apply OR
    • You are over age 29 and applying based on marriage to a U.S. citizen
      • you do not need to submit a status information letter from the Selective Service or a written statement explaining why you did not register

I am above the age of 31 applying for the naturalization, But I just feel a lot of grey area, cause I used to have a green card from a prior marriage that I abandoned when i moved back home

but I was always a non-immigrant until i was granted conditional residency in 2004 at which i was older than 26

Hello everyone

 

I am about to file based on three years married to a US citizen and had two questions

 

I have a misdemeanor from 95 ( minor consumption of alcohol) back in college that was dismissed and went into pre trial diversion

is that going to cause issues

 

also, part 8 is asking about time spent outside the US in the past 5 years!! but I am filing based on three years being here in the US

my wife and I field the paperwork overseas, so in reality prior to the three years I had no obligation to be in the US anyway

am I missing something?

I need to ask for my sister

she just filed based on the 5 year residency rule, and has a child who is an LPR as well -

if she successfully acquires citizenship before my niece turns 18 next year, does the child automatically become a citizen?

 

my niece was born in Kuwait - my sister divorced her father many years ago who is a kuwaiti national after long term abuse and came to the US - and was remarried which is how they both acquired the green card

 

 

does it all add up?

I am at a lost and sad from this whole situation. It doesn't help that I can call him (cheap phone cards) and he associates that (my ability to call regularly) with having loads of money. (even says "if you can call 3 times a day everyday, you must be rich.)


I am almost ready to stop the petition and wait until his head is on straight. lol
Any idea's?

the man here is telling his family that he doesnt care that she cannot give him chidlren and that he doesn't care about having kids. anyonethat knows the culture knows that is bonkers wacko.gif and maybe he is just lying to himself. he has made mention that he wants to go from canada to america and when they asked abou his wife (soon to be) he said shewould come with him. i doubt that.

It sounds to me like you are trying to justify not telling her? Hey, I'm not blaming you, it's a sticky situation you are in, not REALLY wanting to get involved but caring enough to want to try and help another human being from possibly being very hurt.

You might want to mention to him that when he does get to Canada, which could be a very long time, if they decide to apply with him outside of the country, he will probably be sitting waiting for that PR card for quite a while (based on the little we know of the relationship it sounds like it has red flags posted all over it). Even if they apply with him in Canada, he could be sitting around waiting for a few years, with nothing much to do!

Canada immigration can be just as tough as U.S. immigration and he might just end up in a review for several years, this poor woman will probably get to know him very well in that time.

She doesn't sound stupid.. she just sounds lonely and "in love" and not thinking clearly.

I know I've been there before... was in a 3 year abusive marriage as a result.. There are probably tones of factors compounding the problem, including this guys' ability to sweet talk and sell her the universe..
