I was hoping I can ask if anyone went to an immigration lawyer for consultation prior to interview

Reason why I ask is that my wife and have a unique case . We got married in 2008 in CT. At the same time I still had a pending green card to remove conditions from a prior marriage
Then I lost my job in the US and came to Egypt when a great opportunity presented itself. My wife owns a tax business so she travels back and forth between US and Egypt specially since the birth of our daughter. Old case was closed and my wife filed the current one

Just not sure what to expect at all come the December interview

Well it looks like your prayers have helped. I seen someone with a Case complete at NVC on August 5th get a December 15th interview date. God Bless!!
So, I think that means that Cairo will do all CC from NVC from June, July and some August for December interviews. Thank you God and everyone praying for Egypt members.

If you are not planning to move to the US don't bother with the interview. The purpose of the visa to move to the US and live.

If you are planning to live in the US after obtaining the visa then you should not have any big problems. You can explain that you never followed up on the removal of conditions petitions and let them die/expire. (The "I never received notice" story is kinda weak. )


Definitely moving back to the US, my in laws , brother and siter reside in the US
Besides I spent more time there than in my own native country

In terms of the notice, I can assure it never came , otherwise I would
Have happily attended the interview instead of filing from scratch

Hello everyone

I think I have one of those unique cases, I will share the History as an experience to anyone similar and seek advice as well

I used to reside in the US, student visa back in 94
Had a a conditional green card in 2004, stamp renewed every six months but they never removed the conditions
Divorce march 2006- primarily financial reason we had filed joint bankruptcy
2008 moved to NY and married another US citizen who's is dual citizen, her dad is Egyptian
We knew each other since summer 2006
Another interview to remove conditions summer of 2008, and still nothing
2009 - lost my job, ran out of unemployment -
Then an opportunity for work came up in Egypt. So I moved here summer 2009 and my wife came with me (she owns a tax business so has the luxury to be able to freely travel. Besides, we had a lot of credit card debit so I needed a job
We travelled back to the US for the Christmas holiday ( no issues)
Jan 2010 - I get a removal letter to appear in immigration court for not showing up to my conditional removal interview. What a joke, because we never got the notification of such interview in the mail, and I had been to two conditional removal interviews already
Wife travelled back to US for tax season - hired a lawyer and went to the immigration court - case was closed on the basis that I had left the US prior to any legal judgements and
Had always maintained legal status while residing in the US
Now e wife travels back to Egypt (she was pregnant and did not want to deliver the baby away from me)
Our beautiful girl born summer of 2010
Once again my wife stays with me until jan 2011 at which she travels back to The US for tax season

She files the I30, since our trip to Cairo was only meant for like a year or so until things went sour

Case complete, interview scheduled for December 21st - I think she will come with me since she has been living here anyway

But oh boy - no idea what to expect and lawyers given me different stories. Such as old green card and leaving the US will be a problem - someone else said, your biggest battle will
Be to prove that your intentions are to move permanently to the US since I left and am gainfully employed here in Cairo

I hope our story gives others the courage to know that there is a light at the end of the tunnel

I used to live in the US for over 15 years- had a conditional green card then bankruptcy then divorce
So I filed on my own, first interview nothing
A year later another interview and once again nothing
Just a stamp after stamp - last Officer in NY, said you are better off in immigration court ( issue revolved our separation date)
Then I met my current wife, and we got married in 2008
Another interview July of that year and yet one more stamp
Now I lose job - so a prospect comes up in Egypt and we move here summer 2009
Jan 2010- my in laws get a letter for immigration court removal proceeding , what ?
Apparently I missed yet another interview, what a joke and heart breaking
So My wife travels to attend the immigration court on our behalf- based on a lawyer advice
Then pregnant and scared, the lawyer calls her a week before court claiming that it's best she goes alone
Mind you I am hearing all this all the way in Egypt- but at the end my wife proved that I had departed the US prior to the notice of immigration
Court was issued so the case was terminated without prejudice
Now the lawyer files for us the I30 July 2010 , and we are happy thinking we would travel back to the US by December or so
Months go by and nothing, lawyer claims its under control , only to find out March 2011 that w were denied because he did not respond properly to an RFE
That requested my divorce decree nd passport pics
Heartbreaking again, my wife and daughter were in the US, she owns a tax business and is half Egyptian so we were blessed that
She can travel freely between both countries and spend the bulk of the calendar year in Cairo
So we refiled the I30 on our ownin April and today was our interview

I must say the walk to window 15 was a tough one. The first thing she said; As you well now , this is a complex and interesting case, you had a green card that you lost plus
Immigration court proceedings. No questions about current marriage , prior ones - pictures evidence nothing- it seemed that she does not question that we have a bonfide relationship
But has an issue with the green card that I lost. We showed her the immigration court terminating the case. I told her the former green card was a privilege but I left for financial reasons . I had to do what's best for the family . She smiled. Finally; said I respect the decision and understand why you had to leave the US
Case is approved. You will receive your passport in two weeks, and please ensure traveling prior to May

Sorry for the long notes, but I have been reading here different experiences for the past year, and learnt a lot so I had to share our story

But then again I am a former green card holder so my case as an Egyptian male is a little different

Hello All:

I just called the DOS Thanks to Habibi83 for the tip. They said my immigrant VISA was issued today - so I will be checking with the local DHL office soon
the interview was on the 21st so just shy of two weeks that included christmas holiday :)

I was hoping I can share our travel plans and please advise if you forsee any hurdles

First Week of Feb - P.O.E JFK - with my wife and daughter - but only staying for a week

End of April for two weeks,basically lining up some interviews - Officially resign from my current job

August - One way ticket for the whole family, after tieing all loose ends & personal affairs in Cairo. Besides; I have a pretty sensitive position with my employer so I need to give an adequate notice

Re-applied and just got my visa in the mail

At the interview , all the CO was interested in is why I lost the initial green card

YES! it sure will! take tons of pics and you can always make more proof! when my fiancé was here we rented an apartment together and sent them the lease, also u try to buy something from the same shop in the same time with your credit card and her credit card so they know you both were in the same place in the same time.. i hope that helps

how to get a case number
what papers that the support affidavit needs beside the form itself (in details please)
do we need i-485 for the sponsor or should they fill the i-134
what else does my fiance has to send me beside the copied package? should there be the originals of the documents?
more evidence means (new emails, more pics they didnt see and should i put the skype chat log? )

*i might have few other questions but that's all i remember right now and if i remembered more i'll edit the post :blush:

Sorry to bust in here. I was just wondering. Is it enough if I bring my phone records to the interview, or should I bring the phone records of my fiance´as well?

We talk alot over the yahoo messanger on I´phone and there u can´t keep a rocord of the. We have sometimes day where we can´t talk on the phone because of the time differnce and we both work in shift.

Does anyone have other suggustions of proof of ongoing relationship?

My American fiance and I have been waiting since July 16th when we got our first NOA, and having filed with California, and their average time being 5 months, we thought we should have heard from them by now.

Can anyone else tell me their experience in regards to time between NOA 1and 2? I was hoping they'd contact us about an interview etc but so far, nothing.

CSC is being slow! i just read another message saying about them delaying some people for 5 more months! trust me it's all cuz they have tons of applications but they will try to keep the time line going! keep the faith and it'll be ok! try calling them to check your status! and log on the website and get email updates!

Based on the info I gave you, How much money would I have to add to my savings in order to have the petition approved from a financial point of view? Also if I need to get a co-sponsor, what are his income requirements? He has a wife and 3 minor children. Does his income have to show that he is 125% above the poverty level with a family size of 6? (himself,wife,3kids and my fiance) I hope you can clarify this for me. Thanks so much for and assistance you can give me on this matter. If anyone else has any advice please don`t hesitate to respond.


YES he has to count all the household members including your fiance! i'm stuck in the co-sponsor bit too!!

and you have to add 5 TIMES the difference between the required number and your income

my question is can i add SSI as income or can i send i-486 instead of i-134? as in i-486 we can combine income but we cant do it in i-134 :(

How long is the wait? and if it is approved where do they send the paperwork with Egypt a messed right now. Will they hold it until the chaos ends and a new government is established? What if (worst scenario if the radicals takes over will our US Embassy close for that reason)? i am so afraid of the unknown knowing that i might never see him again. I am in contact with him everyday and he made a comment saying he is afraid of the future of Egypt and what tomorrow will bring to their people. dont worry about the waiting part... they take up to 5 months but some cases goes faster than this.. yer case -as Jim said- is with the USCIS and it wont come to the embassy until u get yer second notice of action that says yer approved!

my advice at the same time yer waiting just finish few papers that'll be required soon

The visa process, start to finish, almost exclusively involves the US government - not the Egyptian government. The only exception is that there are some documents he'll need to obtain from the Egyptian government, like birth certificate, police certificate, passport, etc. When things settle down in Egypt then the US Embassy will reopen. If there's a new government in place then the US Embassy will probably remain as the diplomatic guest of the new government, but nothing will change in the visa process.

There is a possibility that a new government in Egypt might not be friendly to the US. If that happens then the US might be forced to close the embassy. This is what happened in Iran in 1979, and in Cuba in 1961. In that event, consular duties would be shifted to another US Embassy in the region, or to an in-country embassy of a country which is friendly to the US. In the case of Iran, they shifted consular duties to the US Embassy in Turkey. In the case of Cuba, consular duties were initially shifted to the Swiss Embassy, and a US Interests Section staffed by Americans was installed in 1977.


True Jim but someone like me who has an interview date already will not be shifted to a different embassy. my interview is supposed to be on thursday 17th of feb and the consular section is closed.. no one contacted me from there and their office has an auto reply so i'm one of these people who doesnt know what to do.. my case has been a mess so far!!

Oh gee, that is SO annoying. Come on, how can the lawyer forget to send a form :bonk:. I'm so sorry to hear that. Well, I don't know exactly how this works with the RFEs, I've been asking myself whether you can get more than one...? Wouldn't make much sense though cause you would think that they check the whole petition and then request ALL the missing information. But making sense is not exactly what the USCIS is about, right? :wacko:. It is so frustrating. I wish you all the best and that your journey will go speedy from now on. Thanks for what you wrote about our story...yeah, it took us a while but now we hope that we can be together soon. It was a tough week. My fiance was in a hospital for heart problems. Sounds like the US Citizen petitioner DOES have a domicile in the USA. It's his mother's home. Having a domicile and being physically present in that domicile today are not the same thing.

It can take a year to bring her to usa but if you file when you are living in egypt and they see on the paperwork that both your address is in egypt then you will get through the first step in less than a month (sometimes)
If you file from usa the first step can take 5-7 months

Please I need serious help and trusted words on my problem from an honest member & hope I can get some advice for our situation.
I am a US Citizen who spent the last 8 month working in Egypt where I met my wife, who is from Egypt. We plan now to move to the USA but we are very confused over few matters... if anyone can help us that would be so much appreciated!

First we have married now for 4 month, Both working in Cairo but now i decide to go back to America and planning to take my wife with me but after reading a lot about CR1, we realized to sponsor my wife I have to have a place in the US to live plus a job.but since we live together in Egypt I dont have a job nor a house in America and we were thinking to live with my mom when we go back to America until I stand on my feet and my mom is fine with that since she is living alone in a big house and also she is ready to be a cosponsor for my wife.
Now our questions:-

1- do I have to have a separate place for living from my mom?
2- do I have to have a job for atleast 6 month?

his mom can sponsor he doesnt have to have a job but i think itll be a better move if he came to the u.s to file because youll be waiting for egypt to send everything to the states like the uscis and nvc and he would need all the original documents i think itll make ur transition alot smoother and easier if he filed from th u.s. unless time is not a issue then file from egypt but i wouldnt recommend that


The embassy here in Cairo said that they no longer deal with immigrants visa and that we have to send all the documents by mail to Chicago lockbox!

we are Egyptian American couple.. we live together here in Cairo, Egypt. But now we plan to move back to America.

First thing we read is that " the American petitioner to be eligible to get his spouse to the US,, he/she has to have a job and a place to live to be the "sponsor" .

Now my question is that true????

cant we file from Egypt now because he is not living in the US RIGHT NOW and doesn't have a job or house?

putting in mind since last year no longer we have direct counsel filling in Egypt through the embassy we have to mail everything to the USCIS!

second question we have is that " can his mom be my sponsor instead of him in everything ( the house and the income)or he must present in the US ???
