I'm sure this question has been done to death, but I'm reading conflicting info. Can anyone tell me for sure whether or not children of the foreign spouse are included on the IR-1/CR-1 Visa petition? I know you list their names on the I-130 original petition form but does this mean those children listed are automatically included on the bill for Aff of Support, Immigrant visa bill, DS-230 etc along with the foreign spouse?

If anyone has gone through this process, please drop a line,

The thing is that she cant get her records, the clinic where she got the vaccines when she was a baby does not exist anymore, so my concern is if she gets the vaccines or w/e, will she be able to get her results by this coming friday???

She needs to get in and have a blood test to test for immunity for the injections she has already had. This will prove she has had them. Also, some of the vaccinations on this list are not needed for an adult of a certain age. I don't have the list but polio for example, is usually given to infants/children.

I haven't seen it mentioned as being an ineligibilty - the U.S is more concerned with whether or not you having a contractable disease or long term illness which would impact on your ability to support yourself and thus not becoming a public charge. They are also concerned about whether someone has a health problem which would pose a risk to society i.e drink driving (alcohol abuse).

If you've had chicken pox, all you would need is a blood test taken which will prove your immunity. In some cases you can have the chicken pox and it doesn't give you immunity so they need to see that blood test result. I recently had all my immunisations for everything (through work) and I don't blame you for not wanting to be a pin cushion

Get this blood test though your usual Dr to save time. Just take document as proof

Houston.......I think we have a problem.

You see.....originally we started this journey with a K3 application......but a month ago my husband got a letter in the mail from the NVC to pay the $70-00, and it seemed we will be going the IR1/CR1 route....so we abandoned the K-3 route. You are right.....when we originally filed for the K-3 , my child was automatically included in our petition. I did not know that she is not automatically included in the IR1/CR1 route. What do we do now?

I would try to send off the I-130 petition for child ASAP with covering letter explaining your circumstances, requesting they match both applications. I remember reading about a couple who went through the same thing as you and had to urgently send off the I-130 for children involved.

Don't forget that you have to pay separate fees using separate cheques for each application throughout the entire process.

She had advance parole and didn't have the actual form just a stamp in her passport and they wouldn't let her board the plane. She had to go to the embassy for a travel permit. You are a Permant Resident though and would most likely be able to come back but without the actually green card you could have trouble at the airport depending on your countries travel rules. I am considering the idea of not travelling in Sept to see hubby as I'm not sure I want to throw $2300 down the drain if I am turned back at POE - not to mention the heartache. I wanted to know if on a IR1/CR1 visa I could do the following:

Travel to the states for a 3 week vacation once I receive my Visa to take a load of luggage and to set things up before my kids come over on their IR1/CR1 visa. At least this way I won't be turned back. Here are my questions:

1. Even if my green card hasn't arrived once I get there, could I return home to Australia to finalise work matters and collect my kids with such a short stay in the U.S? Would I just need the visa in my passport to make another entry or would I need a different document to come back and return again with kids? (I know the visa is only valid for 6 months).

2. During my 3-week vacation (if it is possible), could I apply for a SSN even though I'm travelling back to Australia to collect the kids, to return in a couple of months?

It sounds like you will be receiving your NOA1 in the mail very soon. Yes, our receipt number started with EAC as well. Your notice in the mail will tell you which service centre you will be going through. Hang tight, you will soon be able to register online and login using that number. Sometimes although the number is available, the USCIS system is catching up.

1. Birth certificate not necessary to prove U.S citizenship but be sure to photocopy ALL passport pages
2.Yes, photocopy is sufficient.
3. No, all pages - yes, even the blank ones.
4. I would use U.S address so time isn't wasted in posting of documents. A lot of people do this.
5. I am assuming that although the Affidavit of support form can be downloaded and printed from anywhere, I would think the U.S citizen must show income from within the U.S
6. No, do not send originals - copies fine.

I didn't send any either. The marriage certificate is evidence of the marriage. That evidence is more for people adjusting status, who have lived together long enough to have proof. That is my take anyway.

Hubby sent copies of tax transcripts, work letter, pay stubs etc. with all separate I-864s. There was no RFE. When it came to adding the number of members in household, he just wrote a note next to it saying - this includes children of the petition - so the petitioned step children were acknowledged as part of the final household number. the $70 each im afraid.

no, whisper2me, you've encountered a brain dead SSA employee.

Go back, bring all yer stuff, ask for a supervisor, tell them to look in the SAVE database, also review ALL of yer documents.
Make sure you are applying in yer VISA name, as well (you can change up the married name, if you have one, later).

For a longer explanation, use the big search thingie here - use 'SAVE' as the search term, my user name 'Darnell' for the user, tick on 'show posts' instead of show topics, and have a read? It's a common problem, I'm tired of writing about it.

Don't you have to be living together in the U.S in order to qualify to file joint taxes?

Kids and I arrived on 19th Feb (12 days ago). Went to social security office to obtain SSN and was told they couldn't issue SSN until we had been in the U.S for 30 days since passport only shows stamp on IR1 visa. This doesn't sound given what others are saying. Was I supposed to have been given another piece of paper at POE?

I have no intention of staying there to marry and will go through the K1 process properly but the devious look of excitement on my face at seeing my finace might get them suspicious ...hehe :devil:

K-1 Fiance(e) Visa Process & ProceduresVWP - Proving ties to Australia
Hi Everyone,

I'm travelling to the states in Sept for just over 2 weeks vacation using the VWP. My fiance and I haven't submitted application for K1 at this stage but will later this year. I am worried about customs kicking up a fuss and needed advice on whether or not I have sufficient documentation to prove ties to home country.

So far I have:

1. Letters from 2 employers (I currently work full-time for the GOVT health system and letter shows my vacation dates as well as the date i will be returning to work. I am also on a 12 month contract (part-time basis) for a private firm and this letter shows this.

2. Original copy of my university enrolment. I am completing post-grad studies part-time and will not finish until the end of the year and therefore have to return home.

3. Recent payslips for both jobs.

4. Birth certificates for both my 2 children as well as Court Orders proving that i have sole custody - to show my family responsibilities here.

5. Orginal Rental Lease contract.

6. Utility #######...ie phone account, electricity account, both in my name and with current residential address here in Australia. Dont know if these will help.

7. Travel Itinerary from Travel Agent, showing my return dates in their origianl letter head.

8. Return plane ticket.

Could you please advise me if this is enough to show that I'm coming home after my 2 week vacation and whether I should expect problems??

About to finally start the process after all the reading and procrastinating...

Could someone please tell me whether or not my USC finance has to submit the Biographic Information form (and passport style photos) for both of my K2 children in the original application. From what i can see so far, he only needs to send his and my information in which my children are only mentioned in the application. No-where do I see that i send in their biographic information/photos at that stage.

Does anyone know for sure?

Hey there...

I am going through a similar decision in wanting to fall pregnant prior to the K1 interview whilst weighing up the cost of not having my USC fiance here for the entire duration of the pregnancy. On one hand I would love the ideal situation of being married and together as a family prior to the baby's birth, but I am also aware that the australian medical system enables you to have all medical services free of charge, allowing for the possibility of any complications/ C section birth etc. without costing an arm and a leg. Medical coverage in the US is ridiculous. I also like the idea of my family here in Australia being a part of the baby's first few weeks of life before I fly off over the pacific ocean to my faraway life. I would like to share that before leaving.

I have contaced the US consulate on this issue and was advised that if the baby were born here I would have to file a Report of Birth Abroad in which the child would have a US passport. This also entails an interview. A consulate officer also phoned me to advise that a paternity test is only necessary in circumstances where the evidence initially provided was not sufficient ie. proving my fiance and I had been together at the time of approximate conception time. I may be in a different situation to you in that my fiance and I already have 2 children from previous marriages, with the added fact that I am 35 and do not want to delay so if it happens, it happens. In the end, forces outside of human decision making, determine whether or not life will be created.

Just another perspective.
