Well I am sane again. My last post was a little out there, but as I said I am sane again, it must be all these extra pregnancy hormones that sometimes make me climb the walls waiting for some action with this visa.

But I am grateful that we have seen some movement in the last weeks. This is a good sign and I am very happy for all of those who have been approved.

Isn't it funny how they manage to take your money but can't find the damn paperwork! Since you are taking the K3 route, did you receive approval for both the I-130 and I-129f???

I would just run with the approved petition because I would be scared that if I emailed them to cancel the petition you sent in Feb 08, I'd be worried they'd stuff it up and cancel the wrong one. You would also wonder whether they would go ahead and approve a couple's petition for the 2nd time if they already had an approval for your names.

Hi Everyone, please put my worries to rest. Hubby and I just had an update on the USCIS website and I'm not sure if it means our petitions have been transferred to CSC or not. There was no mention of CSC on the update. Is this the standard update? Will he also receive a hardcopy letter to say that it has been transferred?

SteveColo, this spreadsheet is for IR1/CR1 tracking only. The K3 gang have a seperate spreadsheet which I'm sure you'll find informative.

Yes Paul, I'm sure its at CSC as well. The website update was vague but hubby said the hardcopy specifically stated ours is transferred to CSC so I'm sure you're the same boat. Thanks to those who let me know their details. Makes it so much easier.

Hi Everyone.....back from another work trip! I must admit it was nice not having to think about USCIS for abit - less frustrating. Phillip2....sorry to see you aren't approved yet. Once your RFE is in, it should be soon!

HOHOHO - I nearly fell over when I say you had been!!!! Big Congrats - I know its been stressful for you!

NicoleX08 has kindly offered to share the load of the spreadsheet with me (as soon as we cross paths again) since I will be away with University committments. So please let either of us know if there is anything missed/incorrect.

I dont know why I'm telling you this but it is my Grandmother's birthday today. She passed away a month ago completely unexpected - she wasn't unwell, in fact she was very full of life and had many plans. Both her and I had booked and paid for our flights to see my husband on her 80th Bday - today the 19th Sep! It was to be her first overseas trip and she had just ordered her very first passport. In fact we would have been travelling between Honolulu and Houston as I speak - I cancelled my trip and will wait this process out. Needless to say....today is a hard day on many levels.....

Hi Everyone,

Just touching base once again. Medical appointment coming up on August 18th and then off to Sydney for August 25th interview. My stomach does a lil turn everytime I think about it. Due to past DUI, I have been advised I have to pay an additional $55 for an alcohol assessment at the medical. They love milking it, don't they! So basically, I think most of it will depend on that aspect. The interview itself doesn't phase me. Actually looking forward to taking the rugrats to Sydney to catch up with my best friend.

qantas.com.au had flights from Melbourne-New York - $1076 return including taxes on sale that ended last week. Yeah, plane tickets have been hella cheap for the last couple of months. I'm going to visit Jess for our anniversary (2 years! It's flown!) in August and return to New York with United Airlines was only $1131 (tax included).

I think if everything goes amazingly smoothly I might be looking at an interview time of around late November... but I really don't want to plan on it and I haven't decided on my Christmas plans either. My family is really quite sad that I'm moving so I think it would be smart, for their sake, to stay for Christmas with them. I guess it will come down to how much money I have, that will be the decider on when I leave.

I'm glad someone asked about the Super, I got a letter from my super fund the other day and I was actually thinking about it... I only have a couple hundred in there so it wouldn't be worth the effort, I guess it will just sit there until I'm old smile.gif

Just wanted to you let you all know that we have our CR1 visa interview on the 25th August. I don't know how that fits into your schedule Pinto. Please drop a line and stay in touch. I'm assuming by your dates that your interview is before mine so I would appreciate a heads-up! Right now I'm chasing immunisation history in preparation for the medical for myself and the kids.

Does anyone know what the process is in Sydney for a CR1 interview? What else is there to pay for besides having a pre-paid self addressed package ready for them to post out the visas? I'm still waiting on word from Sydney as the interview date was communicated to us by NVC.

That is an indication of processing times for CR-1/IR-1 visas. Jan & Feb NOA-1's are only starting to get a look in. Hope that helps

Hi,

I have also posted this in the aussie section but thought it might help to post here as well.....

My circumstances are this........

I am about to go through the K-1 process with my Fiance in Texas.......but here goes....

In 1991 (16 years ago) at the ripe ol age of 19 years, I was arrested and charged for drink driving. In 2005 (only 2 years ago), I was in a situation where I had consumed a couple of drinks in a club in the company of very blotto friends as I was the driver for the night. I had timed my 2 drinks so that I could savely drive home under the legal limit around 2am, however, when I had returned from the ladies room, I couldn't find their drunk a**es anywhere. I found myself in a situation where I was uncomfortable being on my own in the club and then also tried to find them in 2 clubs nearby without any luck. Anyway, my point is.....I drove earlier than I had anticipated because I wasn't expecting to be in that position and was only 0.03 over the legal limit, resulting in the minimum one month suspension of my license and a small fine. Call me stupid if you will, but it was a choice I made in that situation. So then, I have 2 DUI charges.

My questions are:

1. Has anyone seen any documentation on whether there is a time frame in which offences were committed and being able to apply for the K-1? I mean, do you have to wait a certain number of years after a DUI before you can apply?

2. Regarding Form DS-156 (Have you ever been arrested or convicted for any offense or crime, even though subject of a pardon, amnesty or other similar legal action? Have you ever unlawfully distributed or sold a controlled substance(drug), or been a prostitute or procurer for prostitutes?)

Is this where you are supposed to acknowledge your drink driving offences and answer yes or is this question purely for criminal matters? Do I answer no to these and then still provide details of the court hearings??

3. Does anyone know if I will need a waiver???

I am really needing some accurate information so that I can properly prepare. It is also comforting to know of other people going through the same.

I don't know -- my limited understanding of "criminal" charges is that it depends on how it's treated in legally the US. But given that it was more than 5 years ago, it doesn't appear to be a problem. If anything, my impression is that it could come up at the consular interview, but again, doesn't appear that it would be an issue. Consult with a good attorney would hopefully clarify.


I thought I read in Laurel Scott's chat logs (www.immigrate2us.net), that the consequences/seriousness of the crime committed is viewed by the Consulate in terms of the law in which the crime took place. If the DUI took place in the states then it would be viewed according to Texas law, but if in another country, it would be based on that particular countrys' law. Thats how i understood it to be anyway.

Oh, he then needs to complete a one page sheet (which can be faxed) stating approximately when the crime took place, what the charges were and consequences. They also want to know why you wish to obtain the documents. Very simple form. Hope that helps.
