Jeremy - Thanks very much for the heads up on getting the passport and permission together. We will definitely go this route. My husband is now in the U.S. with me - any idea on what type of permission he needs to sign so his daughter can go alone with her mother to get the passport and permission?

Franc - Women do have LOTS of rights in Costa Rica. Men there must pay any court-mandated child support by the appointed date each month. If the money is not deposited, the mother simply needs to go and file a claim at the local courthouse. Then the father must present proof of payment or is subject to arrest. Also, women can periodically (once a year, I think) apply for a raise in child support. If the father has not made a salary filing (I forget the CR terminology for this), the judge can order the highest amount allowed by law.

I tell you all this because these are tools your fiance can use to "negotiate" with the child's father. 1. She could go to court any date and file for all the back child support and he could and in jail. 2. If he wants to be difficult, she can have his support raised (and probably still file for sole custody, as these are two separate issues).

I am going to take a guess that by posts you are talking about FB. ...sometimes its a bane. As others have said, just keep an eye out for red flags. Both I, as the petitioner, and her as the beneficiary, there have been situations where we thought the other might not be ready. It happens. I am considered young for the men that start I-129F for the women in the beneficiary's country, by about 30 years. I'll admit that some jokes on FB that she can see may seem like flirting. But I will stand by her. With her, being young and leaving friends and family I was scared. There was something she said along the lines of not knowing what she wants to do in the future that made me scared as well. I just know that never asking for money from me was a big thing to know where her intentions really were. Take what you can from this

It isn't zero. It is less than your chances of being killed in a car accident today though.

Your petitin has been there just over ONE MONTH. Do not expect anything to happen for 5 months minimum. They receive your petition, pack it in a box and send it to the Service Center. It remains in the box until a few minutes before it is adjusicated and either approved or you get an RFE.


Isn't the 5 months more of a target date than an actual minimum? You seem to know a lot about this topic anyway because you do post a lot. But realistic he shouldn't be expecting anything within the 3 months after the NOA1 since he is not expediting. From the timelines, it seems the CSC average is actually closer to the 5 month mark for the NOA2... both the average processing date and the fact that most now NOA2 seem to fall before early November for NOA1.

I sent mine in at the end of December and there isnt a reply for mine either. You can look at the processing time tab that shows the average time for each center like the CSC for K1. I've been keeping track using the immigration timelines info and just sorting it out by the service center used. This is how you can guess when there will be an NOA2. And yes it does seem like certain countries take precedance over others due to the high fraud rates. No one states whether or not the military expedite proceedure is used by the petitioner, if it be the case. If country does matter even though it is never stated anywhere, your fiance is coming from a high fraud place just like mine.

Not the notice of action from the processing center. Sometimes the NVC can be forwarded the accepted 129F before you receive the second notice of action from the local processing center. This just means you are on to the next step and the embassy in Thailand will be getting the documents from the NVC sometime in the next couple weeks. The NVC will process it in a short time.

Did you expedite somehow?

Has nothing to do with trust and I dont think it tells anything by asking. What more would it tell the beneficiary than it would tell the petitioner? If you are talking all the time there is no need for two people to do the same thing one can. My only feeling is that it can give the beneficiary some piece of mind knowing they can check it themselves. With how many problems it seems people have already posted on this thread and how many people dont even see an update on the site before they get a letter in the mail that is two steps ahead, I figured this site was more useful to the beneficiary to see similar timelines and estimated approval dates..... and answers to any questions about all processes.

Not always can the foreigner get a visa to enter. As was stated on a previous reply there needs to be strong ties to the foreigner's home in the country of origin. Homeland security will just see a poor person entering the US so either I-129F or I-130 are the only means to get them here.

You don't need. He may need. However, It seems weapons possesion is not a crime listed in the 129f instructions. They will see it on his criminal record anyway, so I dont believe anything needs to be sent.

Something had to be done by the petitioner that was to be done by the beneficiary. The birth certificate is not required at the filing stage for the I-129F. I had typed up a letter of intent as well as filled out the G-325A form for the beneficiary, emailed both forms to her, and had her print out and sign and return to me. It says right in the instructions for the I-129F that a letter of intent is required. As far as the passport style photo, he might have taken it from pictures he had already of her. If the G-325A was missing a signature and/or there was no letter of intent, signed, there should have been an RFE.

What exactly happens if you are approved at USCIS, then withdraw, and then attempt to apply again within the following two years? Obviously the instructions state you need a waiver, but what really happens? Does the process that takes everyone else 5 months (we all know that isnt true...lol) but having names already in the USCIS system as approved make it much longer the second time around? Idk if anyone here has withdrawn and then re-applied for the same person within two years after the withdrawal. I'd like to know both cases.. the second attempt with the same person or the second attempt with someone else. Clarification : I am only talking about the initial stage at USCIS, not for being denied at the embassy or any other situation like AP prolonging things, ect.

There are all different cases. Its been said over an over, but a majority of foreigners believe its a better life here. Petitioners and beneficiaries do abuse the system. It's inevitable that someone will try. Some petitioners do believe that a woman from a different country is different than one he can find here. There are cultural and morale differences. Even petitioners have seen the warning signs but yet beg the foreigner to come here to marry. I cant list all the situations here, but realize that even with the best possible situation between fiances, you can learn something new about the other that wasnt prevalent before. There just happened to be a new situation that arose that your fiance showed something you can't live with them doing again and again.

And no, the 90 days is not designed as a test drive. It was set as that long to be realistic. But it does also work where you can do a slight test drive. Whatever.

Idk why right now you are worried about the I-864. For the K1 process, the I-134 is used by the beneficiary at the interview and as you stated there are only the petitioner's assets/income listed. The I-864 is used for the AoS after being married. The reason for the I-134, is to show that the petitioner's income can support you when you are here. I believe even with assets here in the petitioner's name, they still look at her income being 126% of the poverty level. The assets like house or saved money are help. Idk how you intend to sell your place, send the money to her (which I think it has to be in her name to be put on the I-134), and still have a place to stay while waiting for the interview.

I believe that you do worry too much. The part about criminal offense, you are only supposed to answer if you said a yes to being convicted of a criminal offense. If you never were, you dont answer the second part. Same thing with the military. It specifically says "if you are serving.... please answer." If you are not serving, then you don't answer. If someone had a problem, then it was the person interpreting the form (USCIS rep or wherever the petitioner had the problem) that didn't read it correctly.

Copying the blank pages is asked for, but it seems more like only the arrival and departure stamps were scanned, NOT THE FIRST TWO PAGES WHICH SHOWS PASSPORT NUMBER, PHOTO, DOB, ADDRESS, ECT... which are the identification pages for the passport holder.

The OP, you can scan the blank pages if you wish, but it seems like the identification pages at the beginning are what you need to scan. You can re-scan the entry and departure stamps as well (which I would recommend) and possibly the pages in-between (which I feel is extraneous).

Just some more aspects to consider with madtownguy's post. The majority of bar girls are into shabu (meth). She may have only done it for two weeks, but is she going to continue while you are waiting for the K1 to process? Bar girls tend to be high maintenance women. But, after you have thought things through very carefully and you still proceed, I agree that you only tell significants to how you met. Something simple like you met at a bar, and maybe give times where you met up to do things. I assume you did more together than just meet at a bar and had two times with the exchange of service, if you are planning on going through the K1 process.

Of course it would be in the beneficiary's country, Form I-129F, Question #20 specifically asks that:

"20. Your fiancé(e) will apply for a visa abroad at the American embassy or consulate at:"

I stated Guangzhou in my initial posting of last night. That was based on my personal experience, and I expanded that explanation this morning.

A review of the VJ site's "Embassy Info" pages for China (PRC) would show that there are two consulates that process K-1 visas, Hong Kong and Guangzhou.

Due to the specific differences and requirements of each US embassy/consulate in foreign countries, I have learned to defer to the people that have personal experience in the visa processes of that particular country's interviewing US embassies/consulates. :yes:

Yes, The point I was getting at was correct that it wouldn't be in the US. It would be in the beneficiary's country, i.e. China. It't misleading because the DoS lists all these embassies in China but you have to open each link individually and select the visa types to find out which place handles which type. So, yes it would be Guangzhou. I didn't see your reply before I posted. Again... misleading because anyone knows the K1 is a Non-Immigrant type visa and just like the Manila embassy site, it's listing the K1 under the immigrant visa category.

7. Other Names Used - Current or past names? I legally changed my name seven years ago (both first and last names), do I need to put the old name down? Will I need to show the court order for the name change later on?

10. My citizenship was acquired through... - I was born outside of the U.S. and naturlized at sixteen. I checked "Naturalization". I don't need to also check "Parents," correct? It says check one.

PART B

1. Should I go by what is on her passport? If so, her Chinese first name would be written "Yilin." I just want to make sure there will be no issues later regarding "Yilin" or "Yi Lin." Like I said, passport writes the first name without a space, should I stick to that?

2. Address - Which address should I go by? Her parents live in Henan, she herself up until recenlty was living in the dorms of her university in Wuhan. This year I rented her a small apartment... I guess common sense would be to use the address of the apartment in which she lives now, but as far as the bureaucrats are concerned, is there some other criterion by which to determine OFFICIAL address?

4. Date or birth - The date of birth on her passport is one month off from her actual date of birth (typical in China), but again, I go by the passport, right?

18. I wrote: "We met and were together in Wuhan from December 25th 2010 until July 2011, then again from September 2011 till February 2012, and finally from July to September 2012." Required evidence notwithstanding, is this what they want to see in this box?

20. I live in New York, should I put New York here? Or the U.S. embassy in China? If so, which one?

7. Other names used, just like the others replied, yes. Put the old name down and I would provide a copy of the change just so the information is at hand just to avoid an RFE. The US gov't has access to the name change so they can view records themselves with background check, however sending is being proactive.

10. Yes, only use Naturalization. If the situation was that you were not yet a citizen but had a green card (and your parents petitioned you as alien relative) you would use through parents. If you went through the naturalization, that's what to use.

1. I would recommend the passport name. The space might not be an issue. But the true guarantee is to follow what is on the birth certificate. Obvi the passport should match the birth certificate. My fiance had her name wrong on her birth certificate but got an affidavit. I used the correct name (which she didn't have passport yet).

2. Use the address where she will receive mail. This is obvi where they will be returning her passport with the K1 when it's complete. So, If you forsee she will not stay at the appartment by the expected time the visa is approved you might want to consider using the parent's address. You will be only required to put down one address here. The G-325A is where you will list all places lived for the beneficiary within past 5 years. For ONLY the I-129F, the dorm address is disregarded completely.

4. Use the DOB from the birth certificate. If it matches the passport, then I do not need to distinguish which to use because it's pointless.

18. Yes. That is sufficient. The copy of your passport stamps for Dec/10-July/11 and Sept/11-Feb/12 along with the photos of you together show the proof of having met. They just want a brief statement on how you met.

20. I'm thinking the only one is in Bejing, China. This is where she will do her interview. Way before she sets foot into the US at POE. New york, Nay.

That's because it actually takes very little to prove you have met, a passport stamp and a photo is enough for some countries. Some put in a lot to play on the safe side. But putting in nothing proves nothing. Not even a signed document from beneficiary? And it clearly states that if you have not met, you must include evidence of one of the accepted reasons why. In your other example it does not say if you have not been convicted of a crime you must prove why.If you have not benn convicted of a crime they see that as a good thing, if you have not met your Fiance, they see that as a red flag.

P.S. If you have never been married before, you do not need to include proof of divorce.


I do agree that it does state more than just the I-129F and payment are required and missing everything else is being oblivious. It is apparent that some proof of meeting is required. I was only saying certain points are not explicit w/c why some take it to extremes.

I hate to be harsh, but, the instructions on the I-129F are clear. If you only sent that form and money, not only you wasted money, you wasted time. Yes, I can assure you that's why you're denied. You must fill out all the forms and send evidence of having met in person within 2 years. So, if you haven't seen her in 2 years prior to filing, you must return to her home country and gather evidence of meeting her within that timeframe. Becareful with using western union receipts as evidence as it may look like a business transaction.

You will have to refile and spend more money and wait more time.


Actually I disagree that they are clear. The instructions do say proof of having met within the past two years, but its quite obvious how people interpret this differently. Look at previous posts and you see how some included very little and others put a lot; both were approved. Form part C, question 1, I have heard of people getting an RFE for having it blank. But it seems it could be read as "if.....blah blah blah". Therefore if you don't even meet any criteria you don't even bother to answer it. Not even with an 'N/A'. Another example would be "were you ever convicted of a crime? Y N" and the next question was "did the conviction result in prison time?" (just an example). If you answered No to the first part, why would you even bother putting something in for the second part?

Okay. Ouch. Well for obvious logistic reasons the earliest time that we can get married will be December. With that said - I opted for the sliver of chance of getting K1 approved. So the end result will be either REALLY GOOD (K1 approval) or REALLY BAD (lonely 2007).

If something dramatic changes and I can get married say in August, is it easy to withdraw my K1 filed application?

Okay - this is what I decided. Please tell me if this was foolish or mediocre.

I have a small wedding planned for 5 months and 2 days from today. I went ahead and applied for K1. I am hoping the K1 gets accepted in five months. The way I see it - this will enable her to come here fastest. If it is not accepted in five months, I figure I'll just withdraw the K1 completely, get married, and then apply for K3. Obviously this will take longer. Basically - K1 approved in time, she is here with me in January. If not, she's here with me by June via K3.
