I don't see why not, your green card is still valid. I just hope they didnt flag anything, where they give you a hard time. I think you'll be fine though.

I'm sorry, but glad you can move on in life. Just renew every ten years, and you're good to go. At least this way, if you surprisingly get a letter one day saying you're scheduled for oath, it will be a pleasant surprise. If not, you're already at peace with it. :)

I just wanted to share with you guys that I just voted for the first time as a new U.S. citizen in the Primaries here in Illinois. We are not only voting to elect the candidate for the Republican party but also we are electing the candidates to Representatives from several districts as well as the judges from the both parties Democratic and Republican which means that everyone can vote today in Illinois. My experience today was so nice because i told them it was my first time voting so they were so helpful and friendly. :)

Got a letter stating fingerprints expired :angry: and need to get another one taken within 90 days...will be heading out to get a new set taken tomorrow or the day after. Hopefully, things will get going after this!

But here is my question: I thought fingerprints were good for 15 months, so they are really not expiring till April 30th 2012 (Taken on Jan 30 2011 for ROC), but even if it the fingerprints were only good for 12 months, then they had already expired January 30th 2012, so USCIS waited 2 months to tell me that my fingerprints had expired???



They probably just hadnt looked at your file since who knows when, finally got around to scheduling you and noticed fingerprints will expire before this dragged out process is over. Same thing happened to me, the good part is that after the fingerprints were taken, I was put back in line for scheduling, and scheduled the next day. I am still waiting for the letter though.

Back to step one for me. I received a text saying an update has been made, and of course it would have been too much like right if my interview were scheduled... Instead, I have been moved to the back of the class, and back to Initial review. On Feb 22, a notice for fingerprints has been mailed to me. I guess I'm just happy something is happening. :( :)

Just based on some earlier months, I realize that NYC is waaayyy behind. I dont really expect to see any updates for a few months. I would love to be pleasantly surprised, but oh well... I just am a little leery since i didnt get biometrics done. I hope they dont move us back to initial review and require biometrics. I will just sit and wait and hope everything goes smoothly. We have a really inexpensive ring that looks like it cost a fortune. I actually have two engagement rings...he made one over in Africa and mailed it to me. That's the one I love the most. The other ring is something he and my aunt cooked up because she thought people would be more concerned about appearances. We got it from Walmart.com for $327.00 (includes 1day shipping and tax). I love it! So if you want something that doesn't put a dent in your wallet (or his) You can take a look at mine. I'll be happy to give you more information if you'd like, just PM me.

I just received an email from the consulate where FH will be interviewing. There are instructions included part of which gives information on financial responsibility. This is what it says:

The individual who filed the non-immigrant K-1 visa petition on your behalf may be requested to show evidence of financial support by submitting form I-134, Affidavit of Support, however such evidence is not required.  No tax returns are required to accompany this form.  

Has anyone had experience being approved without tax returns? I do have my employment letter and paystubs.

Income requirements are actually pretty low, especially if you have no children. Perhaps he can get a job or two in retail just to meet the requirement for now. Obviously it's not ideal, but if he wants you in the US he may have to eat some humble pie.

I think you should be up pretty soon! My dates were 10/17 & 11/4 and I got my NOA2's on 4/29. My Rep's office was very helpful, but I waited until just before I was out of official processing times to contact them.

I would suggest waiting until May 13th and then start contacting ALL your politicians. Tell them you are outside of standard processing times. That should at least get your stuff to an Officer. Mine took about two weeks to get approval after I was told it was with an Officer.

K-3 Spouse Visa Process & Proceduresk-3 packet 3 -affidavit of support query
I suppose it can vary by country, but it is my understanding that an I-134 is not a requirement for the K3. I did not fill one out for my husband and he received his visa with NO PROBLEMS. You do need to show financial evidence that you are above the 2-person family poverty line (W2's, letter of employment and salary, pay stubs, tax transcripts, etc.).

If you send anything to New Hampshire that is for a CR1, so if you do not want to go that route, ignore them. Just follow the instructions from the foreign consulate.

Please be aware that both options have positive sides. The reason my husband and I opted for the K3 is that we waited so long, we just wanted to get an interview and get him here as soon as possible. (Costa Rica schedules interviews very quickly after receiving the packet).

He has been in the States for several months now and has all the necesities: a driver's license, work permission and a SSN. Once we are closer to our two year anniversary, we will file AOS. That way, he will automatically get a 10-year green card and we will not have to go through the involved removal of condtions process.

Just thought I would share my experience. Good luck to all!

If you have been married for over two years, my suggestion is to process the I-130 thorugh NVC and scrap the I-129F. This will add some time to the process (maybe 1-2 months), but then you will come with a ten year visa.

Regardless of which route, bare in mind that both the K3 and GC allow for entry and departure from the USA, so no need for worries on that aspect.

In all honesty, since the submissions are still recent, I would only make a concise list of what is needed at this time. Do the research on how to get the items (what offices need to be contacted, fees, certified translators, how to get documents certified in each country, etc.). While policies vary from Embassy to Embassy, most do not accept documents/exams that are over 90 days old. Just have your list ready, so that when the time comes, the legwork will be done. Good luck!

Namely, if the beneficiary begins work in the second quarter after arriving and remains continuously employed, then the obligation period is reduced to 5 years and 1 quarter (where they would actually have 41 documented quarters as a couple). I'm not sure about this, so will need to research but interested in anyone else's input!



Just a word of caution: While you may be allowed to apply for a SSN on entry with a K3 visa, that does not mean it will granted. Many K3 holders are turned down because the SSA does not feel that they require and/or are eligible for one. Once a spouse obtains work authorization, it is very unlikely that a SSN would not be issued, since there is a clear reason why one is needed.

Also, thanks PB for the clarification on the IR1/CR1. I knew the eligibilty requirements, just not which one was which. My husband and I are waiting until our two year anniversary to adjust status so that he will get the 10 year GC.

Not true. If you have been married less than two years, you will receive a two-year GC and then have to switch that to a ten-year. If you have been married more than two years, you automatically receive the ten-year GC.

If your fiance receives a K3, she can immediately file for work permission on entry to the USA. It usually takes 2-3 months to receive and then she can apply for a SSN, which takes a few weeks to receive. In my recent personal experience, my husband had all he needed to work legally in about 2.5 months.

As for your TAX situation, not filing can cause major issues with immigation. In fact, I am somewhat surprised your petition/s were even approved in the first place. I'm guessing you can get a bit of free help from the IRS helpline. I'm sure your state probably has a state tax helpline also. Do it now, as this is a less busy time of year.

If you were married at any time on '08, you can file married filing jointly for '08. That will save you some $. You will just need to submit a W-7 (tax ID request) along with your declaration. On the tax declaration, under her SSN, write "tax ID requested".

Make sure that your cosponsor is aware of his/her 40 quarter obligation, as the Officer may make a call to this person to verify that he/she truly understands what they are signing up for as a cosponsor. After all, it is a ten-year obligation!

Good luck and don't waste one minute. If you do something wrong, the IRS will get in touch with you, so don't let confusion slow you down any longer. Also, be aware that tax penalties are severe, so you may need to investigate a payment plan with them. Hope everything works out as well as possible for you!

Congrats! I remember all the paperwork we had to get together to legally marry in Costa Rica too. Not sure if this permission is in written form, but, if so, file it in your 'evidence for the interview' file!
