IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsNVC Filers - April 2013
Hi everyone, I did read the first two posts and think they are extremely helpful. Thank you so much Saylin and everyone else for posting this. I do have two questions though,

1) I cant log into the payment portal. Yes, I read the FAQs and know this is good news, I was excited all day yesterday that I would finally be getting this show on the road. However, now that I still cant get on, I was just wondering how long it takes to be invoiced? Does it typically take more than a day?

2) About the DS3032. I know theyre going to send one regardless, so if we sent the email, we can pretty much just wait for acceptance. Does it affect your case in any way if you DO sent another one in before getting the acceptance email.

My case had said in transit a few days ago, then Ready.  I checked today, and it says Returned to NVC.

What does this mean?

Yes, LOTS of "middle of the month" scheduling! It's blowing away the theories (and recent trend) of only scheduling in the first (and last?) part of the month.

energy.gifenergy.gifenergy.gif

C'mon, NVC, let's keep it rolling! I am getting lonely at the end of the April CC list. I wrote to my embassy to see if there is some kind of scheduling problem and requesting some insight into how often they submit their schedule openings - received a moronic boilerplate reply that didnt' even acknowledge my question and implied that I was requesting them to schedule an interview directly. rolleyes.gif Yipee.

I was actually patient with waiting at all the other steps, but now I can't focus, with all the things I have to do as soon as I find out our dang date (child immigration - much more logistically challenging than it was to bring my husband here tongue.png)

I hope you get scheduled today!!! C'mon NVC!

No there was no P4 attachment
I know that.
I was curious regarding this email.
I was thinking may be they schedule me for interview.

I got that email a few weeks ago.  I think its just a case complete email.  The email with the p4 will follow when the interview is scheduled.

HEY!!!!! Do we have to write RFE on the envelope!?!?!?!? Has anybody else had done this before???? unsure.gif

I dont think you HAVE to, but it will speed up the internal routing. They will know exactly where to send it, rather than have it sit with the new cases.

PhilippinesAnyone finished K1 tell me if missing anything?

You have to pay for the visa ahead of time through a BPI branch so give your fiance the case number so she can pay it and keep the reciept. You need that at the interview. You can't schedule the interview till after you pay. They didn't send us anything but confirmed they recieved our petition so we went ahead and paid and then scheduled the interview online at embassy website. Just don't forget to do the seminar after the visa is recieved because you need that stamp to leave.

The embassy info for Manila did say this. However, it said they should have sent the beneficiary information on how to apply for the K1. I believe there are four packets total. And the Manila embassy site did say three ways to pay for interview. St. Lukes website also allows you to book appointment online.

The seminar is for the beneficiary on domestic partnership info. Like laws here about abuse, ect.. Right? Good to know the stamp is needed.

PhilippinesAnyone finished K1 tell me if missing anything?

Seems like you are way ahead of the game. The only thing I see missing is evidence of ongoing relationship, that she will have to take with her for the interview. Like skype calls, phone logs, chat logs, email's etc...... Anything to show the bonafide relationship.

I think I did leave this from the list I made. I asked if she needed anything from me. She did print out all the emails already. The filipina I work with said she had brought boxes of letters with her. Only thing is today we just use computers so my fiancee will be bringing emails. But OMG with the slow times I have researched as much as I could. I also know that K1 uses the I-134, not the I-864. A lot of people can't tell this difference.
MangoAveMalePhilippines2012-03-26 10:49:00
PhilippinesAnyone finished K1 tell me if missing anything?
I am in the middle of the petition process; its been almost three months since I first filed. Can anyone who has gone through this process tell me if there is anything I am missing? There is a flow chart available on this website for the K1 process, so I am already aware of this.

The I-129F was already sent in along with a signed G-325A from both I as petitioner and her as beneficiary. A passport size photo was attached to each. There were two signed letters of intent, one from each of us. I sent in photos of us with defined landmarks as well as a copy of my birth certificate, passport main page, passport pages with Philippines stamps, some emails and chats.

Once I get the NOA2 from the VSC, I can wait a week to see if NVC in New Hampshire can provide their processing number for the US embassy in Manila. I will try to mail my documents as well as email as fail-safe.
Sending: I-134 form signed (not notarized)
Letter of employment
Copy of 2010 tax return and hopefully 2011 as well
(this is not required for employment but it is extra and will show real estate which is on I-134)
A copy of any stock assets (which I will try to put watermark and not provide account numbers)
Possibly simple bank provided page showing exactly what it says on bottom right corner of page 1 of I-134 instructions

She will be getting packets from Manila. Although she can always look up DS-156, DS-157, DS-156K, fill them out and print them. She is waiting on her passport still. She will bring Cenomar, NBI, NSO, an updated letter of intent including one from me. The support evidence I explained above. She will need a few more passport style photos. She needs to have medical exam within a week before interview. I work with my fiancee's cousin, who came here 20 years ago. She told me about Bear Brand... If anyone has heard about this for TB. She has had x-rays before for jobs already, but old equipment which is not as sophisticated as St. Lukes. I did provide her a copy of my appendix for question 18 how we met.

There is a bit of information here about Manila's embassy. But each review is different on which window's to use for each document. Its pretty obvious that the beneficiary will receive the visa about a week after interview. It lasts for 6 months, but its a one time entry here. She cannot leave until after the AOS. Once here, there is 90 days. Does the AOS have to be started before the end of the 90 days? I can submit the Employment Authorization along with the adjustment of status. I already found how to get a SSN for her, at a local SS office. After two years, there is another AOS so its permanent residence.

Anything I missed?

PhilippinesBooking round trip along with one way for fiance

Try being a bit more flexible and look at other airport options.
Flying into/out of Cebu will always more expensive as you have less options than Manila.

I just tried a dummy booking comparison - Round trip ORD to Cebu & Round trip ORD to MNL via Cathay Pacific website and the ORD/Manila was over $300 cheaper. I also tried 2 other airlines and the results were almost the same.

If you were to do JFK/MNL then you would have plenty of options from Manila - 5 daily flights on Cathay alone plus Asiana, EVA, Korean Air, AA, JAL & a whole lot more.

The main negative about flying out of MNL is that a lot of people do not like that airport, but you are only there for a few hour.

Also both Cheapoair & Expedia gave me more expensive quotes & less options than when I search the airlines websites directly. Also as previously stated before me, buying directly via the airlines let you select your seats after booking (depending on the class fare).

Also what is your final destination here in the USA?

I'm going for a vacation as well. So even if I try to go from MNL with the $300 cheaper, I will need tickets from CEB to MNL. For some reason, CEB to ORD is a little over 1000 but CEB to BOS is actually over $2000 for the same day. (like you said using dummy booking time). My best is flying from BDL.

PhilippinesBooking round trip along with one way for fiance

I been researching on this subject as I will be doing the same in a month or two. For me I'm opting to go with Philippine Airlines as I think it's much convenient (non-stop to US) for us and to make arrangement (same flight) also u can pick sitting arrangement prior to the flight. I suggest book directly with the airline of your choice and request seating arrangement with them. Online travel (Expedia, Orbitz..etc..) sometimes can't honor the seating arrangement..

I think i might have to go directly to airline. I went with Cathay pacific for my first trip and Korean the second. It was so much less time to go through Seoul than to fly into Hong Kong. Both did let me pick seating arrangements. Although the first trip was actually using booking agent. I know both have free drink service including alcohol since its international flight. Only a little less apt for Philippine airlines because less preventative maintenance.

PhilippinesBooking round trip along with one way for fiance

You don't have to buy the ticket in the Philippines. I purchaes a roundtrip amd a one way from the Philippines before using Continental. I think you can use other ticketing websites like Orbitz, Expedia, Travelocity or CheapoAir. When you buy the ticket you would at least need your spouse/fiancee's passport number. Might as well have her photocopy it for you and send it to you before you try to buy her ticket. Hopefully you can fin one with matching times and flight numbers.

Only thing with continental is that they only fly out of Manila. I only have up to 2 weeks vacation so I am not going to the interview with my fiance; the passport with the K1 visa is shipped back to my fiance's home address anyway. Orbitz and Travelocity don't work from Mactan. Expeida and Cheapoair were twice the cost of what I was able to find from Mactan to ORD using Cathay pacific.

PhilippinesBooking round trip along with one way for fiance
Has anyone been able to book their own round trip airfare from the US to Philippines, and have a one-way ticket for the fiance from Philippines to the US that matches the return fligh?

Cathay Pacific allows searching of the one-way tickets. Korean air states Philippine law requires tickets be purchased in the Philippines. As well, its much harder to fly from a normal airport that doesn't have certain carriers. For this I would have to either get a connecting flight (from ORD) or drive to something like BOS or JFK.

Philippinesprocessing k1

thank you i didnt know that i send it twice...what about the petitioner, when he should need to send his police record?
also my fiancee is asking a question about the I-134 question number 8, if he suppose to put his kids there, he mean about his kids to his ex wife...

The petitioner does not need to send his police record. Homeland security and the NVC will be searching this on their own during the background check. The only thing possibly related is if he had a record and went to court for civil violations. Then he needs to send the court documents, not his police record.

Yes question 8 is about any children of his that he has living with him or is paying child support toward.

Philippinesthis so bs this so so bad! ao upset what is going on

Here is what other documents can be, they may ask for this, at Cebu they probably will ask for this: Yeah they are required, if you can't provide them when asked then no certificate until you do provide them.

1. Original and Photocopy of Birth Certificate (From NSO or CTC from Local Civil Registrar duly authenticated by NSO).
2. Photocopy of Birth Certificate of Husband/Fiancee.
3. Photocopy of Passport of Husband/Fiancee.
4. Photocopy of a Divorce Decree of husband, if he is divorced.
5. Photocopy of Proof of Singleness of Fiancee {CENOMAR).
6. Photocopy or copy of picture together (you and your husband/fiancee.
7. If under 23 years of age a notarized/certified letter from parents giving permission to leave the Philippines, even if married in the Philippines.
8. If a fiancee is 18 to 21 a parental consent affidavit and letter from parents giving permission to leave the Philippines.
9. If a fiancee is 22 to 25 a parental advise affidavit and if under 23 a letter from parents giving permission to leave the Philippines.

Also you need to know about your husband/fiancee complete name, birthday, address, mother's family name, how many times he/she got married/divorced (reason of divorced), how many children he had (if there is any), kind of work/job/salary, address of workplace, husband/fiance's educational attainment, course, when, where and how did you met, etc. Be sure to be able to text husband/fiancee for other information they may ask.

If at all possible I would avoid going to the CFO in Cebu, the only way I would go to Cebu if my wife/fiancee lived in Cebu.

Where does it say this??? The closest I found was the Philippine-Korean embassy site under Consular Services Section IX. Im actually the petitioner and I'm waiting to go back to Cebu once the visa is in hand. LOL. And yes, my fiance lives in Cebu. She has to go back to cebu to wait for her passport to be mailed back with the K1 inside.
MangoAveMalePhilippines2012-05-10 22:18:00
Philippinesthis so bs this so so bad! ao upset what is going on

Cebu is the strictest, if she is 18 to 21 she will need parental consent, 21 to 25 she will need parental advice, just have a lawyer make a affidavit, also include permission to travel abroad and leave the Philippines on the same affidavit. Both parents must sign, and have 2 witnesses. Just did this in Cebu last month, because she did not have a affidavit, caused another trip to Cebu. When the CFO had the affidavit, then they issued the CFO cert.

That is strange. The Website for the CFO where it explains about the seminar and whether or not to use PRISM for Manila or SMEF-COW for Manila or Cebu, there was nothing listed about needing any consent. I looked through all the laws section. www.cfo.gov.ph

2.Original and photocopy of visa;
3.Original and photocopy of Immigrant Data Summary for US bound/ Confirmation of Permanent Residence for Canada bound/ Certification of Eligibility (for Japan-bound);
4.Original CFO guidance and counseling certificate;
5.Duly completed emigrant registration form; and
6.Payment of the authorized registration fee.

Requirements for Attendance to Guidance and Counseling Program

1.Two (2) valid identification cards (IDs) with photograph;
2.Duly completed guidance and counseling form;

If the other documents 'as may be required', is the category this affidavit falls under, YTF doesn't it say this is needed? Seriously, is it just a thing where word of mouth makes it official but no where does it say its required?

What exactly did they need to be signed by your parents? You are over 18, right? So I dont understand why your parents need to be signing anything. Let me know because at some point when they finally f'in approve my petition, my fiance will need to go to the CFO in Cebu.

Philippines10 Reasons To Marry A Filpina

Don't expect that to change when she gets here either. I've been trying with my wife for 8 months now, and I don't think I've made a hint of headway.
Her - "Can I ask a favor"
Me - "sure honey"
Her - "promise you won't get mad?"
Me - "sure honey"
Her - "No really promise"
Me - "sure honey. I won't get mad"
Her - "Are you really really sure you won't get mad?"
Me - sigh "Yes Honey! I won't get mad"
Her - "Are you positive you won't get mad"
Me - "Honey just ask! What gets me upset are these 20 minute productions before you ask"
Her - "Promise you'll say yes"
Me - "Will you please just ask me!"
Her - "Nothing"
Me - "Here we go again, the big production for nothing. You know every time you do this its never a big issue with me when you finally getting around to saying what you want"
Her - "Its nothing"
Me - SIGH

Usually about 30 minutes later she'll finally ask for something.
Her - "Can we send some money for a party for the twins? It's their 18th birthday and I'd like them to have a real party"
Me - "Sure honey, how much?"
Her - "Up to you"
Me - SIGH

Yes. It seems like you and I def found the right type of Filipina.
She was actually upset one time that she couldnt bring herself to ask me for help for her family. Her sister's tuition.

#6 I don't agree with.

Slight tangent: things like sending money for a wedding dress, I will not get told how much to send.

PhilippinesHow to Marry...
The one thing I will add, Schools in the Philippines are taught in English, not tagalog (or Bisaya for central visayas).

PhilippinesFinances and Such ... Philippines

That is the basis of the CON.... and a bunch of BS. The more your give the more they expect you to give next time.

Agreed. (Although wording it I would have said as long as you give they will keep expecting it)

PhilippinesFinances and Such ... Philippines

Don't generalize Filipinos. There are just those who are capable of spending money for extravagant things, it is because they strive hard to earn their degrees and work hard for it everyday. It's definitely not for everyone. Filipino cares for the brand names only? Not true. I have a specific favorite Coach bag that i often wore. I have had it for almost 3 years now and it's still as good as new. And as for Levi's, if you tell me it's not of good quality, you'd be fooling yourself. Just sayin'.

At least ? got what I was trying to say. Do u realize that your coach bag is a brand name? I will admit that some work hard. Their days are usually 10 hours and working 6 days a week. Some will work weeks straight before a day off for p35/hr. I was saying that someone was making counterfit Levi's. It wasnt from the actual distributer.

Filipinos, if they come into any money they will try to live like a king for one day. They don't care if they are poor the next day. They have a lot of pride, too. As was mentioned, they care about the brand name only. Levi's over there are knock-offs. I met one guy making the counterfits. Money goes a long way there, esp in certain islands. Manila, is mahal. Boracay, mahal. A coconut from the market in Boracay is like $3 US. I know one small market it was p15. It was p45 at a larger market. They will make due with whatever you send.

Thanks for posting this. There are only reviews of the embassy on here. I'm gonna forward the link to my fiance so she knows what to expect. She is definitely going with her mother, but was thinking of taking something like super ferry there. Might be better because the timing issue you had. We'll see.

PhilippinesHave you sampled Balut (philippines delicacy duck embryo
For the longest time hearing about it before I went and when I was there for the first time, I said there was no way. Toward the end of my first trip, right out front of Doll House, I tried it. I had asked for a lower number but I must have ended up with higher 'cuz it was crunchy. But the second trip I didn't want any and I don't intend on the third trip. Once was enough. Tasted a lot like a boiled egg, just the texture was gross.

I don't want durian either. I tried the durian candy, wala lami.

PhilippinesIs this typical for a Filipina?
How old is your fiance? Age might be a factor to not know everything she wants in her life. Like some posted on her, maybe her dream is to only be married and have a family, so she can't tell you any more. Pinay do tend to worry about the now with less planning for the future, so it's only a possibility she is like this.

Have you considered the fact that she may have realized that she knows nothing of how things are here? It's a culture shock and a big difference of climate. I mention climate because...well, how many people go to the beach or have barbeques ect during the winter? Life is significantly different during January than it is in July. She only has perceptions on how things are here so she doesn't know how to think about a future here. Dreams and goals when you are a realist, you need to have some experince first.

If you break the contract and quit before it is finished, it only means you cannot work for the same company again. Make sure she reads the contract, obviously.

PhilippinesAmerican vs Filipino
...but is it any bit upsetting to anyone? i.e. Just because you enter wal-mart being greeted with a "merry christmas", is it really something to get upset about if you don't celebrate the holiday yourself? Whether or not you celebrate it, its a nationally observed holiday that almost everyone has off work. Why cry about it?

PhilippinesAmerican vs Filipino
I was not aware there was such a way to do credit in the philippines. More or less, pinoy tend to have everyone involved. One person wants taho, everyone gets it. One person wants buko juice, everyone has it.

Ugh... everyone has to take things as stereotyping.

One thing I noticed is pinoy tend to not tell things in advance, or omit things to make it "don't ask, don't tell".

PhilippinesWhat to do?
The reason why many posters on here are able to tell him to get out of the relationship is that love makes people blind or oblivious. People will try to justify in their mind, that something wrong that the spouse/bf/gf did is actually ok. He needed opinions of people who aren't in his position, who aren't clouded by love. Truth is that there may be some grey area. Yes, everyone flirts to some extent. But there is a point at which it's crossing a line. You may make a joke with a co-worker about getting into their pants, but you won't actually make plans to go and have sex with them. You may tell someone they are beautiful, but you won't tell them you want to be with them. If someone is willing to cheat physically, they obviously aren't ready for a full relationship. It's really hard to trust them afterward, and pretty sure it will happen again. The saying "you can take a girl out of the bar, but not the bar out of the girl." The OP obviously made his choice. It was his to make so let him enjoy it. Like I said, Greg, there are pleny. You obvi have been there so you know what I'm talking about.
MangoAveMalePhilippines2012-08-15 19:21:00
PhilippinesWhat to do?
As one posted... in the Philippines two guys who are friends can hold hands and walk down the street and not be bayot. But Just because the OP may not know tagalog, there is no custom for telling a long time friend that you love them, which is specific to the Philippines.

For what Mimi said... it may be a Filipino point of view. She is right on some points like her closing down and being quiet and won't talk about it. I don't want to put any thoughts into your mind, but do you know if she was seeing the ex while she was there waiting for the K1, prior to the interview? Right now, it's only emotionally cheating. I'm not justifying it. You can't love two people. I wouldn't say take the internet away from her, but the only way she can let go of her past is by not being a part of it. If she's gonna keep talking to him, the feelings will still stay as strong. I agree with another poster about the feelings for a first love that remain, but they aren't prevalent when you dont speak to the person. If it truely is full-on cheating, get out. She is not matured enough to know what she wants. I would see the lying/denying as another red flag. She is supposed to be trustworth. And if it comes to where she realizes what she had and what she gave up, just push yourself to move on. There are plenty. Only you can make the choice.

To go against another thing Mimi said, what you found you have evidence to show she did not enter into the marriage under good faith. Save it, and anything else. So her trying to file I-751 alone, it would be denied and therefore no divorce will let her have 50% or even stay.
