I don't know the times at VSC but did you call and ask for a service request since you are waiting longer than the current processing time?



I called about a week before the 5 months was up for the service request. The service request was specific to say that it was beyond processing time. I got a response about 11 days later saying a decision should be made in 60 days. Weird to say things are taking too long, just wait longer. I called back the NCSC because when I put in the service request the rep told me everything should be answered like whether its been assigned or if they need anything from me, ect. Nothing like that was provided in the response to the service request. With calling back I was told they need nothing from me, it wasnt assigned yet, and their processing date was Dec 15.

Anyone call the VSC lately for updates on their case? Did they provide you with the current processing date for the I-129F.... something like "We are currently procssing applications from January 15? If so, what day did you call and what date did they provide? They seem to be working slow lately.

Anyone who's just going to say something like 'chill out' or 'they will get to yours' blah blah blah, I don't want to hear it. Those kind of answers are worthless.

Wow. that is crazy that you're still waiting. have you talked to your representatives? Congress? Senate? There has to be something they can do at this point. They should be able to at least get you some information on the status of the case. You're way outside of processing times which gives them more power to at least get you some information and maybe bring enough attention to your petition that someone approves it.



Oh, yes. Jun 29 was the time I called and was connected to the tier 2 who refused to divulge any information. All I got was "even if it doesn't say assigned means nothing. It can pass through many hands and when it waits after passing hands it can show as not being assigned to anyone." I did specifically ask "can you tell me if there is anything holding it up? Can you tell me if it's under AP status?" and I got only "I can't tell you that". But on Jun 22 I contacted the congressman. I got asked for the privacy release on Jul 6. I sent him it July 12. July 20 is when I got a reply saying he called and it is currently with an officer and to wait 30 days. Also he said he will inquire again in 15 days. One thing to notice is that the first service request 60 days is up on Aug 1.

CSC is now overloaded and behind like crazy. They all are. The processing times go from bad to worse back to bad. There isn't a fast processing time anymore. It is what it is.
Not all petitions are adjudicated at the same time. There are reasons why some go longer than others. Background checks from different countries take different times. Depends on a lot of different factors. What country is your beneficiary from Hoy123?
Also, your timeline shows you should expect adjudication sometime in August. You are coming into your window of expectation.
Everyone here has waited, some longer than others. Nothing to get mad about.
How has the government "lied" to you. They called you and told you something that didn't come true. There are no rules about when to get adjudicated. There is an average timeframe they speak about. Not a guarantee to process your petition. There are no "rights" here.
Right now K1 applicants who have filed for AOS back in december 2011 haven't received anything yet. That is over 7 months. From our original application until our interview in Rio was 246 very long days.
Try focusing on other things rather than getting mad. It isn't going to do any good for you or your significant other.


Actually, there are rights. I'm a December filer just FYI before you make any remark. As filers we have rights to know about our cases. We prove our identity when we give them case number, address, and social security number. Do you need to read the FOIA and Privacy Act? However, the last few times I called I was denied rights. A petitioner has the right to put in a second service request when 30 days have passed since the response from the first service request and no approval was made. I was denied. Idk... maybe the rep was having a bad day. The other time, the tier 2 rep would not tell me if my case has been assigned or if there was any AP status or anything holding it up. NOTHING THAT WOULD REQUIRE A WRITTEN FOIA REQUEST... and I was denied. So yes, it does happen.

Apparently a lot have been pondering this. Watching TV, there is a computer available and I know my fiance will want to talk with her family often when she is here. I'm in the north east, so she can only go out for walks when its warm out (and she wants to get used to how it is here before just going out 'cuz she won't know where anything is.) I know my fiance is good at arts, so I can get her supplies to do that. I don't want any judgement, but even doing things around the house like cleaning. That is not what I am having her here for, but I don't think I need to explain this on this forum but only to the people who are ignorant and ask why I needed to find someone in another country. Just any marriage, both need to share responsibility on things.

Wow!! how can you assume this merely because it didn't happen to you. Our petition was submitted in March, complete with G-1145 form. We didn't receive an NOA1, and the check wasn't cashed till May. By then, we were frantic. It has taken some unravelling but it appears that our petition was split up and sent to several places. It HAPPENS !!!!!!!

OP, do not assume that your USC partner is at fault. Get them to follow up and ask to speak to a Tier 2 person at USCIS. There are several other people that have posted recently that didn't get an NOA1, the system is in a mess.

Best of luck... don't automatically doubt your fiance. Also, the Case Status is unreliable. In many cases the status never leaves INITIAL REVIEW. Updating of this is not a priority and many people have been approved and beyond and their status has never changed from Initial review. By all means check with USCIS with a Tier 2 person before accepting what you have been told on this thread. Believe me, its not unusual for this to happen... best with your process.. (F)


Well, Hmm. I'll answer for this. Maybe because the date of initial review is when the packet was received at the Texas Lockbox, not at the service center. The dates on my case : DEC 27 received. DEC 29 the NOA1 was sent from VSC. And the last action on the website about my case was DEC 30. The date of the initial review provided on the website is 2 days before the NOA1 date which means the date Texas Lockbox received it and scanned things into their system. DEC 30 is when they cashed the check. I sent the G-1135 form too, but only for email and I never got one when they received it. I had to set it up via their website. It's the service centers that have a huge time delay. Not the lockbox facility. I bet your case that you are trying to use as a basis, even tho you didnt receive an NOA1 to provide you with the case number until May, the USCIS site still stated it was received sometime in March when you initially sent it in. Correct?

Just to clarify. Both the I-134 and I-864 are considered affidavit of support. The difference is with the K1 you will first use the I-134 and THEN do the I-864 when you do the AOS. With the IR/CR1, you will only need to do the I-864. The I-864 happens to be the legally binding one because the green card or conditional permanent residence = the beneficiary is here. The I-134 isn't because you can always change your mind before marrying and the beneficiary has to go back to their country.

I couldn't edit my post, IDK why. But the correction is that the $15,130 is for a USC in active duty in the armed forces and the $18,913 for anyone else. So, it is the same for the I-134 for K1 (and then I-864 for AOS) and the I-864 used for IR/CR-1. The difference is ONLY if they are in the armed forces.

How did "they" know this figure? Both the I-864 and I-134 state minimum requirements are 125% of poverty level. No number is provided. The only documentation I was able to find was for the I-864 stating the $18k for household size of 2, $23k for size of 3, ect. I'm not understanding how the I-129F for fiance K1 could have a minimum of $15,130 on the I-134 form, but when you do an AOS after marrying it becomes a minimum of $18k on the I-864. Shouldn't they both be the same, or do they think a company gives you a $3k raise right after you marry someone??

QP, Canadian_wife..... There is no guarantee that the consular won't ask, yet there is no guarantee that they will ask. Stop with the assumptions. Obviously from the OP, it appears that they intend to marry and then file for IR/CR1. You have to think, if the marriage is outside the US, will family of the USC attend?

I can easily think of a situation for K1 where the family might not attend. Maybe the processing center took so long that the marriage has to take place sometime during the winter months, and the petitioner/beneficiary are only granted 90 days to complete this. They don't want to marry in a church, so they do a civil marriage first where it is cheap and serves the lawful part of the requirement, and then have a mock wedding for family during the spring/summer. I'm sure there would be pictures from the mock wedding, but they are obviously from a different time of the year. Would this prove an issue with something like AOS? IDK...

Unless your criminal record involved a sex crime against a a child, it will not even come up as a question or issue in the process.



This part is wrong. You will be doing the I-130 which does not ask about convictions like the I-129F does, but the gov't will still do a background check on you (and her). The instructions for the I-129F state the offenses they check for. You say your's is very minor. Just be prepared that a hit on your record will make the process longer, even if it's something minor. Don't fret too much; I just wanted to make sure you got the correct information. FYI, they might ask her about your record at the interview 'cuz it's something they can ask to make sure she knows about you to show bonafide relationship.

The income requirement for the 125% is not big either can be worked around. It just means you need a co-sponsor. The longest that you can stretch out a visa is 10 months (if you need the time, however no one wants to be apart) which includes 4 months after the NVC (DoS) approves to make an interview and 6 months that the visa is valid to enter the US.

You can check the Philippine forum. The interview at Manila costs $240, the medical exam costs ~$218, and she will also have to attent a CFO course after.

I am sorry to hear about your fiancé’s denial; unfortunately these COs have the power of God and
can deny a visa without any good reason because they have the full authority of the Secretary of State.
I suggest you file another petition which is probably faster than tracking down your current petition.
You could also forget about the K1 visa and move to Morocco, get married and apply for a Moroccan Resident Card. You get to be with your husband and once you have the card you can DCF in Casa.
It is not that difficult for a foreign lady to marry a Moroccan. You will need:
- Birth certificate.
- FBI/local police clearance.
- Certificate of Eligibility to marry from the U.S. Consulate in Casa (you see there is no escaping Casa)

Hi,

I am posting our story (me the petitioner and my wife the applicant) to benefit all of you specially those
applying thru Hartford.
Yesterday, 2/22/2006, my wife and I successfully passed the AOS interview in Hartford and my wife's
passport was stamped with a temporary proof of conditional residence and hopefully the real card will
arrive in the mail soon.
The interview was scheduled at 9:20 am. We arrived at 8:45 am and stood in line for about 20 minutes
at the main enterance for the inspection. We then headed to the interview room and handed in the
interview letter. There were already a lot people waiting to be interviewed and the good thing is these
interviews are really quick and I mean QUICK, no more than 10-15 minutes per interview.
We waited for about about 45 minutes before we were called. We had an interpreter for my wife, just to
be on the safe side, but the examining officer told me, I don't need one and that I could interpret for
my wife.
First thing and before being seated, we were sworn in, both of us raised our right hands and swore
to tell the truth. then we handed our passports and my driver's license.
The officer asked me why I filed a fiancee petition twice, I told him I had an issue with my previous
foreign divorce and I had to file here in the U.S. He was satisfied with my answer.
He then asked my wife if she applied for a work permit or was given a work permit stamp at the
Airport, she said no. He asked her if this was her first marriage and whether she had children, she said
no.
I had piled all our documents and photo album in front of him; he was not interested in any relationship
evidence, he said he has all the evidence from the K1 file. I guess K1-ers have it easier than other
marriage based AOS. He said he has all the basic documents like the affidavit, my wife's birth certificate
and our marriage certificate.
He asked for a letter from my employer and 2 months worth of pay stubs.
He asked me what I do for a living. He said he can not find the vaccination supplement and he wants a
copy for my pile. I was quick with wipping out any document he wanted. He took my copy of the
vaccination supplement and the 2005 Federal tax transcripts. He returned my 2005 W2 without examining it.
He asked my wife those standard questions - if she was a terrorist, was deported or applied for another visa. She answered no to all of them.
I had already warned my wife not to giggle at these questions.
Then he proceeded to look at my pile of documents to see if there is anything else he needed,
I quickly thumped thru my pile and he was not interested in any more documents.
He then proceeded to stamp my wife's passport then he said not to forget to file an I-751 to remove
the GC conditions 2 years less 90 days later.
Then we said thank you and left. The whole interview was about 10 minutes.

I've just been looking through this thread and I can't believe what I'm seeing. My 130 has sat at VSC since July 12, 2006 with no movement at all and people with dates in August, September and October have approvals?? I'm glad for them but this is getting a bit ridiculous. And what's this about calling USCIS after 6 months have passed? I reread my paperwork and it only refers to them having to complete it in the processing time posted on the web which still sits in March 2006. My wife called the info line and they said the same thing. Am I missing something?

I remember when I was calling to check on our status they kept telling me that it takes 6 months for approval, so definitely once it hits the 6 month mark you can dig in with your teeth and request to speak with supervisors, senators, whoever ... Because their "standard processing time" IS 6 months as they state, before then you really don't have any grounds to request that they look at your case. 6 month mark, however, is a whole 'nother ball park
I wish I can be of help, but it seems all you can do for the next couple weeks is just wait...
At least you are all complete with NVC stuff, because that phase is a breeze if you got all documents ready!

Your interview took 210 days from your I-130 filing date. I am not sure if it helps, our CR1 interview was faster than K3.

I had the W2 forms from 2002 to 2007 plus my two jobs letters (Current job and new job) but they are interested in 2006 and 2007 TAX RETURNS.....what we are going to do is have the TAX RETURNS with us when we travel, just in case....I think you should get the tax return if possible, you know how strict the consul officer are...If you do that you are not going to have my same problem....I wish you the best!!!....

Hi Everybody!!!!

I dont have a lot experience writing in English....so sorry for the mistakes...
I got my CR-1 Visa the last Thursday (on May 29th)...but We had a bad moment with the Consul, He told us that We needed the Tax return to the last year...We didn't have that but We had the W2...We had his new Job Contract letter too for the last year (He is a teacher)....so He gave us the visa but He told us that We are going to have problem when We arrived to United States because The Aduana's Officer has the last decision about my Permanent Resident....My question....I got the visa....so can the officer in the airport denied my Resident????, should my husband to get the last year's tax return???....Somebody has had any problem when you arrived to state????....Can you tell your experience at the moment that you arrived at the airport???....WHAT I HAVE TO DO NOW!!!!!.....please, help me!!!!

You have to put your name like it appears in your passport...When i had my interview, all my form were with my married last name and the Consuler officer asked me if i change my name legaly because the name should appear like it is in my passport...because the visa is going to be in your passport and the visa should be the same that in my passport.
