I provided copies of divorce decree`s with

I would recommend downloading the packet 3 instructions and have all the documents completed so you are ready to submit as soon as you are SURE the embassy has youre petition.

K-1 Fiance(e) Visa Process & ProceduresEvidence of Support question (i134 related)

The I-134 can only be filled-out by the sponsor. So all information detailed in the form should be in reference to him only. That being said, "self-supporting" refers to your sponsor's capacity to be independent.

Perfect, thanks!

K-1 Fiance(e) Visa Process & ProceduresEvidence of Support question (i134 related)

Within my packet 3 it states:

"Applicants may submit a letter from the petitioner?s employer or evidence that they will be self-supporting. The Form I-134, Affidavit of Support, may be required when the consular officer deems it useful."

Does this mean that I (the beneficiary) can also use my own saving and assets to demonstrate I will not become a public charge, or is this just in reference to other types of evidence that should be brought with the petitioner's i-134 information.

Thanks!

Melissa

K-1 Fiance(e) Visa Process & ProceduresPackage to beneficiary after NOA2

I know it's a pain to send things and it can take a while, but personally I would rather be safe than sorry on everything. For original documents, I am signing them and mailing them to my fiancé. I would rather him have it and not need it, than need it and not have it.

K-1 Fiance(e) Visa Process & ProceduresCalifornia Service Center or Dallas Lockbox

As everyone else said, always follow the instructions on the website. Otherwise, you risk delaying your process, which is more than likely going to be long enough as is! Send it to the Texas lockbox.

K-1 Fiance(e) Visa Process & ProceduresSending I-129F

As everyone else said, you send it to the lockbox in Texas. They will decide if it goes to California, Vermont, or the Texas processing center. A lot of people will assume they are at the Texas center since that is where they sent their file, but that is not always the case. Make sure you pay attention to any notifications you get from them regarding where they are sending your file and change your timeline information accordingly. Otherwise, the data on Visajourney can be skewed. Good luck to you!

K-1 Fiance(e) Visa Process & ProceduresRelationships that started via Social Media

I also met my fiancé on Instagram! We started talking in July of 2012 and talked nonstop everyday for nine months until he finally came to visit. He stayed for three months, went home to work for three months, and then came back for another three months. At that time we filed for the K-visa because we knew the process was going to take a while. I visited him in Wales two months after we filed, and now we have NOA2 and we're waiting to schedule his medical! The timeframe that you have known each other doesn't matter at all. It only matters that you have actually met within the past two years, which isn't an issue in your case.

K-1 Fiance(e) Visa Process & ProceduresHow to deal with my anxiety through this whole process :|

I think everyone going through this process has severe anxiety! I know I sure do at least! I spent so much time making sure every little thing was right on every form, but I was still certain I would get an RFE. After I sent my package, I obsessed over it. I forgot to make a copy of my G-325A and I wasn't sure on what I wrote for a certain employment date, and I was constantly thinking about getting an RFE and having to resend the form and then the dates wouldn't match up and they would think I was lying and I would get in big trouble or get denied!! It kept me up countless nights and made me sick to my stomach to think about. But guess what? We got NOA2 after 90+ days and no RFE! It seems that all the silly little worries that seem huge turn out to be the former.. silly little worries.

I would always try to distract myself with wedding stuff, but it actually stressed me out more. Are we going to city hall or having an outdoor ceremony? Who are we going to invite? Should we just elope? Would we regret that? Are his parents going to make it? If my mom is there, will my dad still come? Are we going to have enough money for it? MY BRAIN!! It was nonstop thoughts followed by nonstop anxiety and stress. I finally told myself to stop thinking about anything regarding the wedding and just wait until NOA2 came through, because the stress of dealing with both at the same time was taking its toll. I knew I was overreacting and it took a lot of deep breaths and conscious thoughts to make it stop. I forced myself to be mindful of my thoughts and try to control them when those negative thoughts started sneaking in.

I did find VJ to be incredibly helpful. Reading other peoples stories, learning more about the process, knowing I'm not alone.. All of those things helped ease my mind. I think you should try to distract yourself here and take it day by day. Try to relax! Which is so easier said than done, but one day we will all look back on this and go, "Why the hell was I so worried?!"

K-1 Fiance(e) Visa Process & ProceduresHep B Vaccination Required?

K-1 Fiance(e) Visa Process & ProceduresHep B Vaccination Required?

Hey there,

I've been reading about what vaccinations are required for K1 (although I know these are just required for AOS) and have seen a few different lists floating around. I was checking the London Embassy site and it states that Hep. B vaccination is required "through 18 years of age." Since my fiancé is 26, does he still need to get it? I saw another post on this but didn't get a concrete answer. It's going to cost 75 pounds so if he doesn't need it, we'd rather not spend the money. Thanks!!

K-1 Fiance(e) Visa Process & ProceduresRequest for Expidtition on getting K1 Visa approval
OP the members here are just concern, I find this site very helpful since our K1 application to AOS. And speaking as a completely third party observer with no personal interest on the matter, I'll just give my opinion as a Biologist who have attended med school. Can an ultrasound tell if you are 2 weeks pregnant? The answer is NO. The number of weeks generally go by your last menstrual period, so 2 weeks would be around the time you'd be ovulating or in other words 2 weeks after the first day of your last menstrual period is when the sperm fertilizes the egg...that means you wouldn't even have an embryo yet. If you mean 2 weeks after conception, it's possible an ultrasound might be able to pick up a gestational sac but won't see an actual embryo until you are at least 5 weeks along. And most doctors would like for you to wait until 7 to 13 weeks before doing an ultrasound.

And for the expedite case in K1... I know that they expedite cases from the Yolanda victims. I'm not sure about pregnancy though, but you can try. Good luck!

K-1 Fiance(e) Visa Process & ProceduresHow many pages of proofs to be printed-out?

however will show proof of an ongoing relationship: Copies of land line and cell phone bills, appropriate letters and emails, stamps on the letters (to document the date they were sent), and other written documentary proof. Provide a reasonable amount; two to four of each type. Pick a range of dates up to and including the present. You can also include a copy of engagement ring receipt (this is something that is a big optional - do not worry if you do not have a ring yet!)

No it does NOT show proof of a relationship.  On it's own it only shows proof of regular communication.  It's all about the content within that will show proof of a relationship.  And, you don't want to send in everything lest you bore the poor adjucator or Embassy CO will all this stuff.

If all you talk about is visa fraud or some other criminal activity or planning of such, that's not the relationship that will get you a visa.

Every relationship goes through a fairly typical progression.....it is suggested that folks think about drafting a document that is tittled "Evolution of Our Relationship".  In it would describe how you first met, what you talked about first, getting to know each other, then maybe agreeing to meet in person....at some stage it grows and then eventually you agree to marry.  The conversation should change at this point and then agreeing to immigrate to the US and then about life in the US.  This document would then point to specific evidences from those you listed to show this progression.   That would be the proof of a relationship that USCIS and the Embassy wants to see.

K-1 Fiance(e) Visa Process & ProceduresHow many pages of proofs to be printed-out?

Print out a representative selection whose content will show the natural progression of a relationship.

K-1 Fiance(e) Visa Process & ProceduresHelp

Hello,

I'm new to the forum and received the link for the website through a friend who is going through the visa process at the moment.

My fiance and I got engaged on Feb. 14, 2014. We've been in a relationship now for a year and a half. We met working at a summer camp in New York.

I (Brittany) live in the US, and my fiance, he lives in England. We're planning on him moving here.

We'd like to start planning out a wedding. We would like to get married in September of 2015.

Is it a risk to do the wedding planning stuff before the visas are approved?  Yes

If were planning to want to get married in September 2015, when should I start the application process?

Working backwards, you two will have 90 days within which to become married after he arrives in the US....that's 3 months.

He will have about 6 months to use the visa to enter the US once it's approved.....that's now about 9 months total.

So you would need the case to be received at London about January, 2015.

So look at the Processing Times summary, link at the top of this page and estimate how long from submittal of the 129f petition to NOA2 approval to NVC and then to the Embassy the average cases are taking..  That should give you some idea of timing.

Thank you very much.

K-1 Fiance(e) Visa Process & ProceduresDid I get it right?

Thank you so much, Baron!!!!

I feel so stressed all these days, waiting for my final decree of divorce to be able to send the petition right away... Worrying about our chances...

What you've said is such a relief for my poor heart!wub.png

It's not to say that the "issue" as raised by others won't be brought up....most likely during the interview.

You are a new citizen, having come over on a K-1, and your relationship timeline shows that you engaged in another relationship while still legally married......now is where your particular case and history comes into play.  Make sure that your fiance has all the information and you two need to show a legitimate relationship with the intentions to stay in the US, marry and stay together forever.

You may want to write a letter describing your past and how your new relationship came to pass and is not part of a bigger "plan".

Good luck.

K-1 Fiance(e) Visa Process & ProceduresDid I get it right?

Do you guys think I should describe the story of my husband's betray, so to explain to USCIS that my intentions were pure?

No, not required for USCIS.  If you are legally divorced, then the only "splaining you needed to do is to the divorce judge.

Looks like your good to go with the K-1.

K-1 Fiance(e) Visa Process & ProceduresK1 approved, Entering USA on VWP

- Joanna needs to take a very short trip to the US in early May but cannot stay because if she did the 90 days would expire before our wedding day in August. Can she enter the United States for a few days with her German passport under the VISA Waiver Program (VWP),

Nope, they will use the K-1.  VWP is not an option once that is issued.

LEAVE the US a few days

Sure, one can leave at any time.

later returning to Colombia, and weeks later fly back to the US using her Colombian passport under the K-1 Fiancée VISA where she would then remain stateside?

Nope.  Won't be allowe back in because she doesn't have the AP or GC.  You'd have to refile all over again and wait the time out, again.

We are aware that once a K-1 VISA holder enters the US using the K-1 VISA, a premature departure from US territory would result in the cancelation of the K-1 VISA.

No, the K-1 is cancelled at POE and replaced with a I-94 visa valid for 90 days.

Joanna and I fear that if she tries to enter the US with her German passport under a VWP,

Not to worry, she won't be able to do that.

she could either be stuck in the USA unable to make use of her remaining two purchased flights

Yep, but isn't that the plan, to remain "stuck" in the US?  She shouldn't have purchased those flight.  Reschedule them if you can.

OR even worse, upon her second arrival would discover that her K-1 has been voided.

Yep

I would be open to any and all advice on the situation.

Forget all about this scheme.

T

K-1 Fiance(e) Visa Process & Proceduressame sex fiance visa

I am a US citizen but I am living in the Philippines with my gf and her daughter. Since it is now possible for me to file for a K1 Visa and K2 for her daughter, I plan to go back to California within the year so I could start with the process.

Questions:

1. How long should I be in a job before I could file for K1 and K2? Can I file right away as long as I am employed?  Yes

2. My gf has never been married, and no contact with her daughter's father, what does she need so that she can bring her daughter with her to the US?

Still will need either the notarized letter from the father allowing her to permanently immigrate to the US and to re-enter the Phils to visit and return to the US......or a court document giving the mother sole custody.  Is the father listed on the child's BC?  If not, then there is no father and you're good to go.  Contact the Embassy for what they will want.

3. Her mom and siblings live in the US. She was not part of the petition since she's over 21 at the time her family migrated. Will this be a problem?  No

I am really excited to move back to the US and start a new life there with my gf and her daughter smile.png

K-1 Fiance(e) Visa Process & ProceduresK-1 visa forms and other questions

Hello All,

I would appreciate all the info and advice please.

My Fiancee(the beneficiary) is a Chinese citizen with a 2 year old child(living in china) that is working in Jamaica. The child will not be accompanying her to the US(no K-2 filed).

I have sent in my I-129F packet and got NOA1. she will doing the interview from Jamaica.

If you could please answer the below questions:

1)  What other forms or letter will (I or her) need to complete besides the I-134 and DS-160?

Read the Guides and check out the Embassy web page for Embassy-specific requireemtns.

2)  Will my finacee need her birth certificate or will passport suffice?

Check out the Embassy web page.

3)  Does my fiancée need the birth certificate of her child? the child only has an ID paper(standard for all citizens)with NO pic.  the ex-husband is giving her trouble with getting the birth certificate.

If the child is not to receive a visa, then there is not need for any document for the child.

4)  I input the wrong birth date of my fiancée child.  Do I make a note (of the error I made filling out the I-129F form) when filling out the upcoming forms?, do I call or email informing of error, and if so, what department/phone number/email?

Send a corrected form to her to bring to the interview....again, if the child is not to receive a visa, then its a non0isue.

thanks for all the help. this process gets overwhelming at times.  I guess its not being familiar with it.  Im so appreciative of VJ.  I has helped me tremendously thus far.
