I love this thread!! Encouraging words are so important during this time for all of us. I think it shows how true your love really is if you are willing to go through this whole process. Sometimes it's angering to have to go through this, but then I sit there and smile and feel grateful that I have found someone that makes it all worth it. It's a great feeling, isn't it? 

 

I always tell myself that we are stronger being apart than we would be if we had been by each others side this whole time. We are tested in unimaginable and unfair ways with this process. But if you can make it out the other side (and you will!!), you guys will be so much stronger and appreciate your time together so much more. I know that any time I have ever had with my fiancé, it has been cherished so much.

 

It's also good to find distractions throughout the process. Looking into the next steps, looking for wedding inspiration (which can sometimes cause MORE stress since you can't really plan!), and talking to your fiancé and connecting through the distance as much as you can always helps. There have been days when it seemed like we would never make progress and we were doomed to an eternity apart, but there were other times when the hope and positivity was overwhelming. Enjoy the ups and downs, because I promise, one day you will look back at the downs and laugh. Good luck to you on your journey. :)

You don't have to wait until you visit him in his country. You can file now, you won't have issues as long as you met in person in the last 2 years. It doesn't matter where you met, I'm telling you this based on my own experience. I went to Malaysia in 2005 and worked there since 2006. I met my then-fiancee (my now husband) in 2010 during his deployment ( Malaysia is one of the countries they visited). Started dating online in 2011, the he went to visit me in Malaysia in 2012 and spend 23 days together. He proposed on Dec. 4, 2012, filed for K1 on Dec. 12, 2012... I went back to the Philippines on Dec. 31, 2012. My husband haven't met my family yet in the Philippines, but we're planning of visiting them next year. As long as you have met in person in the last two years and have a proofs that your relationship is bonafide, then you have nothing to worry about.

Hi!

My fiance and I are getting married on Friday and are starting the Adjustment of Status documents.  I have a few questions:

 

1) For the I-864, what type of proof of income do we need to send in if any?  I just started my job (I was a graduate student last year) so my 2013 taxes don't reflect my current income.  We had my dad co-sponsor for the Visa.  Should he co-sponsor for this too?  

 

2) I'm a little confused on who the Cover letter should be from/signed by.  Visa Journey's guide says the "petitioner"  For an adjustment of status does that mean the US citizen? Or does that mean the Immigrant?

 

3) He had his medical exam overseas before his interview. Do we need to submit proof of that or do they have record of that?

 

4) His birth certificate is in Spanish, do we really need to translate it? If so does it need to be notarized or something?

Not necessarily a given...that you'll be allowed to use the tourist visa.  They will see the K-1 in the system and you could be turned away.

Probably best bet....as long as waiting to submit the form will extend beyond the period within which you have to do so.

If you attempt to enter the US< the K-1 WILL be used, you don't get a choice.

I met my wife via the Internet.....and actually I paid $99 for the opportunity to choose my young blond Russian hottie from an online catalog.

It really is the truth. 

Now, if one thinks that's all there was to it,,,,ie mail-order biride......I have a bridge I want to sell you!!

 

We met with the assumption, at least, that we were serious of considering a relationship and the possibility of marriage and immigration to the US....but trust me, those subjects were never discussed during our early conversations.  Luckily for us, we both were adept at using modern communication means, email, SMSs, photo-taking, Skype video....and used that to our advantage.  We later agreed to meet in person.....and during that meeting I proposed and she accepted......at least accepted to begin the K-1 process.

 

Our relationship grew during that process and at any time we both knew (and talked about) that at any time, either could say stop and it would all end.  Even when she came over, she had the final say in going through with the marriage and if she said no, then she could go back within the 90 days of the visa allowance.

 

Come on over for your visit to your friend.....if you guys decide to pursue the K-1, great, if you decide you need more time, great, you will be fine. 

 

Concentrate now on meeting this person and you two vet each other out.  Be honest with her and with yourself.

I'm not sure what the person meant about not being able to visit again on a VWP, did he mean that I can only go on a VWP once or that I can't visit the US on a VWP if I'm in the middle of the K1? I've also looked up things to do with a B2 visa but I'm unsure about my qualifications about it, a lot of the information I found was vague.

 

 

I'll be happy to clarify.   Despite having ANY visa placed into your passport is not guarantee that you'll be allowed to enter the US.  The CBP (border control) answer to a different authority and have the means to deny entry to anyone, regardless of the visa and regardless of what they say.

 

What was meant, and what can and sometimes (sometimes the operative word) is the once the K-1 petition is filed, the CBP officers will see that in their system. Here you come along, using the VWP, attempting to enter the US.  The K-1, by definition, assumes there is intent to reside in the US.  CBP could conclude that you may be trying to enter the US earlier than the K-1 and could deny entry if there is not sufficient evidence that you understand the rules and will return within the VWP deadline.

 

Many are allowed entry and sometimes some are denied.  The generic warning is don't be too angry if you are denied....there are many of things one can do to ensure entry.....we can discuss those after you guys file the K-1.

 

 

 

And being totally biased, the majority of foreign fiance(e)s are not even allowed to have a visitor's visa, let alone a VWP....ir in the case of Canada, no visa required to visit.  consider yourself lucky to be allowed into the VWP program.

I do not initially plan on marriage, however getting engaged would be a nice thing but I don't think I could go so far as to say I "intend on marrying" which is why I have sort of dismissed filing for a K1 so soon. However, if we do like each other a lot and do want to get engaged during my 3 months stay on the VWP, what steps should we take?

 

You can do that.  Yes the K-1 is only for those couples who have already agreed to become married within the timeline the requirements require.

 

I don't want to lie or attempt to 'cheat' the system by circumventing, and right now I plan on telling the IO that I'm visiting as a tourist and staying with my girlfriend and friends and I will be showing my return ticket and also be telling the IO that I plan on returning. 

 

Must tell the truth.  Come over on teh VWP and leave when it is time to do so by the VWP requirements.

 

 

My problem is that I don't know if my girlfriend and I would get engaged during my stay so I don't know about the 'we might' being an intent to get married, however if we do wish to get engaged, would it be safe and okay on the VWP since at the current time of arrival I do not 100% intend on getting married because of being unsure how it all could go down? 

All seems fine.......but you must leave the US within the time requirements of the VWP process.  You two CAN begin the K-1 process while you are here.  You may be able to revisit on the VWP later during tthis process.....but maybe you will not be allowed back in.  Plan for the latter but try for the former.

 

 

 

Visit America on VWP with intention to stay with my girlfriend as a tourist and see how things go between her and I, and make a play based on what happens with the following:
Perfect

 

- We want to get engaged and plan on filing for K1 and have me depart to Australia during the processing time, and return back when it's finished

Excellent

- We don't want to get engaged at the current time but we do in the future, which will result in filing for K1 before my next visit and go up there on the K1 instead on another VWP.

You can try to revisit on the VWP but may get turned away.  Staying away until you have the K-1 works also.

I have a question about document translation.  I was under the impression that all documents in a foreign language must be translated such as police records and such.

 

I just read on the NVC website that only documents in a language different from the interview countries language must be translated.  For example my fiance is Japanese and interviewing in Japan. Does he still need to provide a translated version of his Japanese documents?

 

Everything is Embassy-specific.  I don't think all allow no translations of local language.  Need to check with your Embassy directly, not NVC.

Right now, our only home is an apartment in Shanghai. A kind relative has let us use his US address for purposes of filing our petition, and that has worked up to now (we are at the consulate interview stage).

 

What problems will we encounter from the bureaucracy once we are in the U.S. if we don't have a permanent address?

 

We would prefer to live in a long-stay hotel for a month at least before settling on a place to live. Is that type of address permissible? Or can we continue to use my relative's mailing address in dealing with the USCIS?

 

No need to own your own home... Many couples rent apartments or townhomes and never have an issue.

I completely agree. I convinced him to use his real house for his home address and he says that they use the Municipal Post Office in Russia as their means of receiving mail, not to his actual house. So now we're trying to figure out how to format these address to fit American formats. This is so stressful :cry:

 

It's not.  Do the best with the address or refer to a supplemental page if needed. USCIS and especially the Embassy in Moscow deal with this all the time.

That is disappointing that it takes that long for a fiance visa.  How hard is it to get a visitor's visa during that time and does applying for a visitors visa cause any issues with the fiancee visa application?  If it is revealed that you have an fiancee visa pending it is impossible to get a visitors visa?

Someone told me another alternative is to apply for the I-485 directly instead of a fiancee visa and it will take about the same amount of time.  How does that work?

 

Bad info.  The 485 form is for AOS, not a visa.  Read the Guide.s.  Your alternate to a K-1 is to marry there and file a CR-1.

I am a current college student and don't really make enough money to sponsor my fiance to come on K1...When he has his interview we were hoping I would have found a full time job by then so that I could. We assumed it would be about 9 months to a year before he got his interview based on estimated processing times and his country. I just submitted our appliction.

 

So, I recently obtained that full time job that would enable me to make enough for the requirements to sponsor him, however, it will not start until August of 2015, about 6-8 months prior to his estimated arrival and approval time.

Shouldn't be an issue.  Current income at the time of the interview is key.....or get a cosponsor.

 

I will have 10,000 dollars in the bank though that I can use to help us until then.

Is there any way he could still be approved if I don't have a cosponsor and don't start this job until 2015?

I can get a letter from my employer stating I have the job and my salary and all.....

Still are GTGs and other visa abusers out there.....but there is no requirement to even having sex....just becoming legally married within 90 days and the intent to remain that way while permanently residing in the US>

I have some questions about some items after K1 is approved and marriage has taken place.  She was born in Spain.

 

1. Do I understand this correctly: After we apply for AOS she can receive 2 year conditional residency.  90 days before this expires we can apply for restrictions to be removed, then she receives the 10 year green card?

2. After 3 years of residency can she can apply for US Citizenship by naturalization?

Assuming she stays married to the K-1 petitioner....if not then it's a 5 year wait.

 

3. This has to do with Spain laws, I've researched a little but not completely sure: When she becomes US Citizen through naturalization, does she lose Spain Citizenship?

Depends on a country's acceptance or not of dual citizenship.

 

4. If a baby is born in Spain to us, will they have US Citizenship and Spain Citizenship?

Can have both, if Spain permits it.

I am a US citizen filing in the US for my fiance in Cuba.  Do I need to notarize my divorce settlement that I will be sending with my I-129F?  Do I need to notarize and translate it into Spanish for his copy of my I-129F packet?  If in doubt is it just best to notarize because that is the only thing on VJ that seems to have mixed comments. Any help/suggestions would be gretaly appreciated :)

Yes but you highlighted copies of the W2s which could confuse someone into thinking just this.  They need copies of all documents sent to the IRS....which includes many forms and other stuff....like W2s, 1099s, INTGs...etc etc.  Everything.

The doctor can not but that information can be put into the medical report and then the Embassy makes the final decision.  And yes they can change their mind versus what you were told at the interview./  It's all part of the usual AP following an interview.

 

 

And from what I've read, former drug use can be a one year ban.   All you can do is wait and follow their instructions.

Can someone confirm that the original signatures are absolutely required for the letter of intent and the G-325A form?  I'm just worried with the post office that things will take such a long time.  He lives in Romania, and when I sent him a package for Christmas, he received it in March, with priority shipping!  If original signatures are needed, then I guess we have to just stick it out.  I just wanted to make sure.  Thank you.
