My fiancee already has the visa. She travels here tomorrow for our wedding next week! Filling out the marriage license now and wondering which address I should fill in for her address. Would it be ok if I just put my address?

If that's going to be her permanent address once she arrives, then yes.

 

Will this have an impact on the license, certificate or AOS process to follow?

No

 

I know I may be nit picking here, but you can never be too sure with this type of process. Thanks!

Hello, im just a newbie here and me and my fiance were looking for some advices about k1 visa and someone on facebook told about this site. Me and my fiance from Georgia are planning to hire lawyer and she said it will cost 5k dollars

, what she said that she can assure that she can really help us in k1 visa, is that the real cost of hiring lawyer or it will cost more? i know its kinda same topic from everyone and maybe repeatedly discussed but we really need some of your advices. My hubby said it will cost overall 10k dollars just to fix the visa including hiring lawyers and some papers needed.

a)-They don't give you any documents at POE right?   Yes

b)-Is it ok to apply for SSN before marriage since I am not having my name changed?  Yes

c)-I took my Medicals in August. I am not sure what else is remaining or if it is incomplete . How do I make sure of this?  Need the 693 vaccinations transcripted by a CS

d)-How much would the fees be?   CSs charge what they want, the AOS fees are found on the instructions for the 485

e)-G325 a is needed for both petitioner and beneficiary ?   Read the Guides and the Instructions.

f)-Do I need to wait 2 weeks before I apply for SSN?   Usually that's suggested.

g)- Do they hand you the marriage certificate ?Can you ask for that , than waiting it to be mailed to you?  Mail to you, have extra certified copies sent for future uses.

h)-We are planning a court wedding and then a church wedding. Would the court wedding help us to receive the marriage certificate faster?   Yes

i)-Do you need to submit any proof of relationship such as wedding pictures or affidavits ?   No

My Wife canadian visa expires end of November, if we don't get the interview date before that what should be our best approach. Can we get the case now transferred to India? I really don't know what to do. please please help

You can email the Embassy and delay the interview until the new one comes in.

1. K-1 all the way

 

2.  Visitor visa, get married, then he returns and you file for a CR-1 visa.

 

 

Coming here on a visitor visa and getting married and him staying and trying to AOS is visa fraud and could face a lifetime ban.

I met my fiancé back in year 2012 and we get engaged soon after, she will be turning 18 on november2015. To answer the question about California law for minors to get married is to have a written consent from one of the parents or a legal guardian . The only thing is her age relevancy to her K1 eligibility, which I'm still not getting a clear answer. I'm sure there be a lot of VJs came across through same situation, hope that VJ heard me n solve this mystery.

 

BTW , I'm the petitioner and I'm legally eligible to file for her K1 petition, she is the beneficiary.

 

You have two issues to clear up...on your own..

 

One what is the minimum age to marry in the state you intend to get married in.

 

Two what is the minimum age that the Embassy will allow a K-1 to be issued to.

I search to find the answer for my query but haven't got a perfect and correct answer yet, I request VJ members to help me  get  the right answer.

My fiancé is 17 years old in Pakistan and i'm going to file for her K1 visa petition BUT before doing that I want to make sure i'm on the right path and just dont want to waste the time. Is she going to be eligible for the K1 visa if she is not yet 18 years. I live in California and in order to get married in CA the person who is under 18 years must have a written consent from one of the parents or the legal guardian , so that is fine with us as we will be getting married in california , but I just want to know if her age is going to be a problem in getting approved for K1 fiancé visa in US embassy Islamabad. Also what is the difference of time period in approval for K1 and CR1.

According to the attached memo, a signature is not required by the foreign beneficiary on the G-325A form.  However, this USCIS memo dates from 2005.  The last mention of it I could find searching the forums is from 2009.

 

Can anyone confirm whether this rule is still in effect?  I ask because of an error we made in our application triggering an RFE on the form - I would much rather just send in a corrected version immediately rather than waiting about a week to get my fiance to send a version with her actual signature.

 

You need an original signature on the Letter of Intent from the Beneficiary, so they can send the signed G325A at the same time.

Just to let you know that I got in successfully at Chicago O'Hare. Really long queue for passport control and took about 75 minutes to get to the head of it (my fiancé was going spare and my US mobile couldn't get a signal).

Was asked why I was coming to the US - I said vacation. I was asked who I was staying with - I said 'fiancé'. She asked when we were getting married and I said 'Once all the paperwork is finished and I got back for the medical and interview'. She mentioned that I had stayed the whole 90 days last time. I said I knew but I had a ticket for two weeks this time. She asked to see my return ticket and then stamped my passport to leave by 1 July anyway - so still the 90 days.


Good to hear they let you into the country. I still wonder if it's that easy to get in after the petition was approved.

No, I wouldn't cancel my flight as it would still be approximately 6 weeks after that I would hear from the US Embassy - see K1 flowchart here. I don't intend to fly back until i know that the US Embassy actually have my paperwork (assuming I get in, that is).

I realised that US Immigration would have logged each trip to the US - didn't know that they would know how much I paid for the flight! Must ensure I don't say something like 'I got a cheap flight so i decided to come just after Easter'.


I guess they can see other trips that don't involve entering or leaving the US, too…though, I don't know for sure, it's just what I found online.

Make sure to post about if they let you in this time around - NOA2 or not - and what they asked you please :)

Sorry - I didn't mean to suggest that you would do anything illegal. What I meant was if you entered the US on, say, 15 April with proof of a wedding on 3 June, how likely is it that the Immigration Officer is going to think that you will leave on the date of your 2 week retunr ticket?

I don't know what immigration can see on their computers when they scan our passports. I have often wondered. Some people have said that, because you don't put your passport number on your K1 application, it won't show up. However, you do provide a copy of your passport with the petition, so I would have thought they would link it. I would think it would only say that a K1 application was in process - not what stage it was at. I have entered the US once since we received our NOA1 (it was 4 months after the NOA1) and stayed for 90 days. I am going to attempt to go back again on 3 April.


So, if you got your NOA2 before April 3rd, would you cancel your flight?

I just did a quick search online and supposedly they know a lot more than they need to know. Apparently they have info about past travels (I would imagine, every time your passport gets scanned it enters into some insane security system), and someone was even talking about credit card expiration dates and how much you paid for your flight, that kind of stuff. So yeah, I would imagine they have info about the K-1 petition/application.

Proof of wedding is probably not a good idea especially as it may be within 90 days of your entry to the US this time. Immigration may see that as proof that you are going to marry on the VWP and AOS from within the US (whihc is illegal).

Return ticket is an absolute - if e-ticket, ensure that you have a print-out with you. Offical letter from school on headed paper is good (although if you were marrying in June, how were you continuing at school until July?).

Any other proofs of ties? Phone contract? Your living arrangements?


No worries, I know that that's illegal and it's not what I'm planning on doing after going through all this, preparing all the paperwork, getting all my shots and the whole bs. Trust me, I know, and the last thing I want to do is risk getting my K-1.

I'm still enrolled in school, but I don't really have classes anymore, I have to finish up an online class and my thesis and another paper (works pretty differently in Germany)…I had originally planned to be done with school now, but the frustrations of having to wait for the NOA2 and the drama with having to reschedule our wedding has been taking up quite a few of my capacities, so I didn't get all my schoolwork done as initially planned.

Phone contract is not a real option, and I'm moving back in with my mom next week (all because I thought it would only be 5 or 6 months until our NOA2), so I don't have any proof there either.

Another thing I was wondering about is how much information the immigrations officers at the airport have about me in their computers? Like, when does that show up for them that we are trying to get a K-1 for me? Do they read my passport with their computer and it pops up on their screen that we are waiting for our NOA2 or the interview at the consulate or whatever? Just out of curiosity.

How likely am I to get denied entry for a two week visit (with a return ticket, proof that our wedding is planned for a later point in time etc.) at the POE after we receive our NOA2?

We already planned our wedding for June, but since CSC is so slow, it looks like we'll have to reschedule. The problem is that my family already has their ticket to fly to the US and won't be able to get their money back if they cancel (and they can't reschedule they're vacation time), but there is no point in them flying over if I'm not there. So we thought maybe I could visit my fiance and his family along with my family, use the time to make final arrangements for our wedding, then return to Germany and get the K1.

I'm also still in school until the end of July...will a letter from my school be good proof of ties to Germany?

Does anyone have any experience with this sort of thing?

One of the things that we found lacking when my wife got here was the employability factor. Building a resume, having skills that US employers are looking for, and searching for a job that she likes doing has all been a struggle. There are some professions which travel easier than others, medical field vs. the legal field, for example.

So - while your situation is easier because your SO's country is so similar to ours in so many ways, there are still some classes that can help the assimilation process when he gets here. That will pass some of the time.

Hold your head up, just know that the end result is SOOOOO worth the wait!

Photos are secondary; so are letters from relatives, neighbors or acquaintances, bus/train tickets and essentially anything that cannot be used to prove your point with a very high degree of certainty.

To sum up; very good Primary evidence with some secondary evidence = NO RFE
very weak Primary evidence with some, or lots of secondary= Possible RFE
No Primary evidence..........................................................= RFE
No Primary, lots of secondary.............................................= RFE

So, I actually called the Immigration office at the O'Hare airport and spoke to an immigration officer who was very helpful. I explained my case and my concern about being turned away. She said of course ANYONE can be turned away for a variety of reasons BUT if there is concern and documents (which everyone here has already mentioned) can be provided to show ties to her home country, there should be no problem even if she is Russian. She said this is no guarantee, its always up to the officer at the desk but again, have the documents.

So based on that I think we're going for it. I think its worth the risk because we have all the proof, especially that her 8 year old son will be staying at home with her father.

I have a question about the Affidavit of Support form. I've never had a job, so I have never filed for taxes before(I was on my parents taxes), but by the time I will need proof of income, I will be having two incomes, and I will be making more than enough so we wont need a co sponsor. So, I'm not sure how to answer the "annual income" question. Should I just add it up myself, or is there other ways besides tax return to show how much I would be making yearly? Also, it would be two different jobs, but at the same company, so it would be two different checks I would be getting, and I'm not sure how I would fill the form out for this.

then, to agree with Hank and NLR`s previous posts,and to add (not knowing when you are planning to move to the Phils)it would probably be best to correctly abandon your 2yr. green card so you will be in good standing with the U.S.C.I.S.,then, if you decide to return to the U.S. a few years down the line you can DCF at manila embassy a CR-1 visa and receive 10 yr. green card after you return to the U.S.

once you have you`re EAD/AP combo card, you can travel to any country that allows you entry with you`re Brazilian passport and then you re-enter U.S. using the U.S. issued  combo card. AP while adjusting status (AOS) from K-1 visa is NOT only for emergency use, vacation travel is fine.

not necessarily refused, but,...it is true that some embassies,as msbau764 stated, do not look kindly towards money transfers to the beneficiary.Is best to check country specific forums to see what others have done. In our case we were told not to submit money transfers so we did not, the only evidence we submitted (secondary) with the I-129-F petition with my passport stamps for 6 previous visits and about 12 photos with us and family. At the interview they accepted a photo album and asked questions about the photos, we brought text and phone records but these were not accepted.

obviously, at the I-129-F U.S.C.I.S. application stage the beneficiary is not "checked"...having met and free to marry are the basic qualifications...now, at the consulate stage, of course, the embassy can, and very probably will check and verify the information submitted by the beneficiary without spending $1000`s of dollars and extensive man hours. While every embassy is different, as Ning stated in a previous post, in Thailand at least it is well known that these checks are done, before OR after they receive a "clean" police clearance.

I agree with Zedayn, but going over the original post, if he and his ex were married in aug.,2012 it is possible he will be past the 2 yr. period requiring a waiver by the time he files a new I-129-F. Someone with more knowledge than I will have to comment on the issue of this man`s ongoing responsibilities...(theI-864)One point I am sure of,NO letter is needed to explain filing the new I-129-F so soon after a divorce. As I said tho,if he moves forward with this petition,it is definitely a case that will require extensive "frontloading".

hi raven...I filed our I-129-F petition 3 days after divorce, I received certified divorce document same day I went to court...Chicago,illinois  Your friend must meet this woman first just to meet minimum requirement for I-129-F but due to such a recent petition he should prepare for extra scrutiny to a new petition,also I do not know if he might need a waiver for filing a new petition so soon.

assuming you have not come to the U.S. yet, you must go back to the embassy to have the envelope sealed correctly, also, if you are still in you`re home country, maybe you can return to the hospital and request , or bring a blank DS-3025 and request they transcribe you`re vaccination records to it. If you are in U.S. now and somehow got thru border patrol with a torn envelope, then ,as Robbie stated, you can file AOS and hope you`re DS-3025 is in the sealed envelope AND completed correctly, if it is not ,you will have to see a civil surgeon`s office and have you`re vaccination record transcribed to a I-693 when you receive the RFE from U.S.C.I.S.

I thought I would share my RFE experience here even if I already said it in the september filers topic.
So they want more evidence that we met in person...

Since I started to read on this website only some months after I sent our application, I did some mistakes.
-I sent them copies of my passport stamps BUT without the first page of my passport (which shows my name, picture, ...)
-I sent them only one picture of me and my fiancé together, without the dates on it.
-I did already sent plane tickets at least

So I guess that from correcting those mistakes, we will get our NOA2 soon *cross fingers*


When did u send ur RFE reply???? after receiving the reply at CSC did uscis update online status from RFE to some other and in how much time did they change this status after receiving reply to RFE.
