Hi first of all I'd like to say this website is brilliant and I don't know what I'd do without it! Thanks, secondly I have been with my us fiancee for a year and a half now and we met for the first time a week ago, we get along so well and I.proposed on the final night of being.there! And I plan on moving over to get married. Basically I'm asking.as she won't have a permanent address until November so I.would like to know if she files the i129 (I will be.living near St Paul! So I'm not sure where it will get send to) if it's send it november is.there a good chance I'll be able to get married in mid august as that's what's planned! The USC files the petition.  The NOA notices will be sent to whatever address she lists.  Your address is no concern but you will have to return to your country to conduct the medical and attend the interview.

1) It says your US fiancé has to provide an I-134 when you go to adjust status from k1 to k3.

No....you're confused.  The K-1 is a visa for fiances and the K-3 (now the CR-1) is a visa for married couples.  You don't adjust from one to the other.  He does need to provide a 134 for your interview to prove financial support.

 

I'm the usual breadwinner in this relationship, and as we've been living in Australia, my partner does not have a US job (or address). Will his parents be able to sponsor me on an I-134,

Yes, one of his parents can, not both.

or does it have to be my US fiancé as it states? Will he need to go back to America without me and get a job before I begin my application?

No

Or is it safe to apply before he gets one? (Hopefully in the 1-2 months before we actually get married he will get a job, but nothing is certain in this world! (He has no qualifications, and used to work a minimum wage retail job).

 

2) We are both currently in Australia. My partner flies back to the US in September and I was hoping to get the visa before then to go with him (any chance of that?).

I know you don't need to be in a state which permits same-sex marriage, you just have to go to one to actually perform the ceremony (is that right?). So using our florida address in the application should be fine?

Anyone had any experience getting hold of police records from the UK or Australia? I have passports for both countries and spent four years in the UK, never done anything wrong so should be good to go so long as I can sort out this I-134 business!

You've got it wrong.  The declaration is how you met in person.....not how you came to meet first time.

I am a little confused. The normal route is to send all the paperwork to NVC then NVC forwards to embassy. But it seems like it may be different for Haiti. It seems like we have to take the paperwork directly to the embassy in Haiti. Am I getting it right?? :unsure:

It's a difficult process. The distance and time are always hard. You just need to be patient with each other.

Nich-Nick's points are perfect. She should try and find a community in her area. St. Louis is a big place. It always helps to know you're not alone. Others are going through similar situations.

It's also a great chance for her to focus on herself and do things she enjoys. Especially the girly things that you won't be doing as a couple anyway. Shopping, nails, DIY projects, music, whatever. Also, you guys should talk about the future and what it will be like when you are together. Don't focus on the bad parts of the process that you can't change.
Focus on the wedding planning. It helped me bide the time to focus on our wedding plans while we waited for his visa to be approved.

In November I brought my fiancée and her 20 yr old son here, POE Chicago. I stepped forward, told the CO, "I've brought my fiancée here on a K-1 and K-2". He asked them to step forward, asked for the envelope, slit it open and looked at all papers inside. Stamped a few, kept the envelope, took fingerprints, and welcomed them to the US.

Hi A&B...no argument here,i respect your knowledge and the help you provide here but I just want to clarify so I dont give people incorrect information. The I-129_F form also requires name and date of  marriage termination with of course supporting evidence(divorce decree) I submitted certified copies with my petition. If you have submitted a previous I-129-F the form requests the A# and a box for "end result" of that previous petition. If you do not have the A# a dated and signed note that you do not know the # and have been unable to contact the beneficiary to acquire it will suffice with U.S.C.I.S. Also,  a signed and dated note explaining,for example, that the previous beneficiary is living and working in Indiana and is now a USC will also be accepted by the U.S.C.I.S. If you file a I-129-F while still under the"umbrella" of a previous I-864 is something I know nothing about and cannot comment on...thx and have a great day....stevie

in my experiences coming thru Chicago/O'Hare many times it seems that immigration control are not too concerned about non-U.S. citizen entries judging by how few agents they have servicing these lines. My wife had no "secondary" interview at immigration, she said the long wait was because of the long line leading to only 2 agents while the U.S. citizen line leads to probably at least 8 every time I have come back. (it took her 2-1/2 hours from landing to my arms)

If you have no criminal record or convictions just the standard police check is fine - getting mine took about half hour here in Saskatoon and was 30$.  Just ensure that it says the Canadian Police Information Centre (CPIC) or the national criminal records repository was searched using the name provided.  If you do have a record, you need to get the full check with fingerprints and what not.

My petition expired in June, but I did my medical and interview in July because I couldn't get time off work (and had to travel across the country for it).  The expiry date on the NOA2 isn't something to be too concerned about - and yes, they do extend it for another four months at the interview, as they did with mine.  I did email my consulate prior to the expiration date just to double check and they replied:

 

Dear Melissa,

 

No worries.  When you appear for your visa interview in July 2014, the consular officer will automatically revalidate your petition for a period of another 4 months.

In terms of choosing interview dates, I am not sure how Germany works, but I chose my interview/medical date in Vancouver ... but every place is different so you might want to ask about that in the regional forums.

You can get a co-sponsor to satisfy the income requirements of the K1 visa, but keep in mind there are a lot of additional costs involved with the process and your fiancee will not be able to work for a few months after entering the US.

Hello. I'm preparing my fiance's I-134 for her interview. Trying to double check a few things:

 

1. it says on the FAQ sheet that a "bank officer" has to write indicating when I opened my account, how many deposits I've made in the last year, and total deposits. Do I really need this, or would simply a series of Bank Statements from the last year suffice?

 

 

Where is your fiance from?  In Vancouver (Canada) we just provided printed off bank statements, employer letter and printed off pay stubs and it was fine, but different consulates may request different things (W2s, income tax transcripts, etc).  As someone suggested, reading through embassy reviews and lurking on regional forums is really helpful!  Good luck.

Hey guys, 

I have yet to see any topics like this and can't find anything about it on Google.. My fiancé has an irrational fear of flying (even though he's been on 6 flights in the past 2 years), so he is looking into taking a cruise ship from England to America to come over on the K-1. I am unaware of what the border situation would be like with that and if they would be asking to see visas and whatnot like when you are in the airport. I understand this might be vague and might vary by cruise line? Since he would be coming over on the K-1, we would need to make sure this would be allowed and his entry would be accepted. Does anyone have any information regarding this?

I have heard of plenty of people traveling to the US throughout the K1 process. As other people suggested, just have him bring information to show he has ties back home. If he works, have his employer type up a letter saying he's taking a leave of absence for x amount of time and will be returning. If he has a lease, have him bring a copy. I have heard of people bringing bank statements to show the account is still open and whatnot. It shouldn't be an issue, but we all know how immigration can be when coming into the US. Just have him bring as much evidence as he can to prove he has strong ties back home and will be returning. Good luck!

I have never heard of anyone getting the sealed envelope at the interview. Usually it is sent after the interview and approval. Are you sure what they gave you was the visa and passport and not something else? How long has it been since the interview?

I don't think it will be that big of an issue. I am pretty sure I left out my middle name on a photo and my petition got approved. If you are that worried however, it wouldn't hurt to reprint and add your middle name! Good luck to you  :)
