Hi Everyone,

I'm going to skip ranting about how angry I am at the Visa service that my fiance and I paid for and myself for not catching the error, but my I-129f petition was sent with all of the necessary documents except for the intent to marry letters. I realized this after speaking with a friend yesterday. Today I received "USCIS Acceptance Confirmation" stating that "Your case has been accepted and routed to the USCIS California Service Center for processing..." I have a feeling it will be denied because of this error, but now I assume I need to wait a few months to find this out. Are there any courses of action I can take now to either speed things up or fix this error?

Nothing you can do but have the two originally signed letters ready when you receive the RFE, that you will in about 5-7 months.

My fiance from Chile received her VISA 2 Jun 14.  She will be in the US by 24 Jun and a week later we will marry.  I am scheduled to leave the USA on 10 Jul 14 to live/work for at least a minimum of two years.  I can bring her along as a dependent, but she will still be a resident of Chile.  I would like her to get a US Permanent Resident status while living abroad because she will be able to work.

Can't do that.  She needs to permanently be residing in the US to receive that.

 

 Is that possible while living abroad in processing paper work to get her a permanent residence?

 I will be working on a US Military Installation.  Can I apply for her permanent residence while we're still here in the US and then get it modified due to my status?

No, she needs to reside a minimum of 6 months per year to maintain the GC.

Get married and do not adjust status.  You two move to the new country and when you are ready to come back permanently, you file for a CR-1 visa for her......or....you leave her here and come back to visit every so ofter (good friends of ours do this).

The K-1 is for fiancé visas, you need a CR-1 if you are already married.

We looked at http://weddingbeacon.com. They have Facebook and Twitter comments. I am thinking the comments can be used to verify that the wedding is real and that our friends and family are involved. What do you think?

Shouldn't be needed for his special case.  Call the county clerk.  SSNs can be obtained in about one to two weeks.

No, most likely not.  Most here on VJ do it themselves.

Apply for the SSN about two weeks after arrival.  It should come in the mail within a week.  Inquire to the local court clerk as to the need for a foreign fiance.

Hi all. I'm back with another question, which I'm fearing the response to.

My fiancee (US), who is also the sponsor for our K1 visa, re-entered the education system last September and consequently left her old job. At present, she is not working -- taking summer -- but looking for part-time employment.

Am I right in thinking that when I attend my interview at the London Embassy we are likely to have our application denied based on the affidavit, as she does not fulfill the 125% poverty line requirement? I'm extremely worried now as I imagine I will receive my interview date within the next few months...



London allows the beneficiary to sponsor themselves, if they can.

If we were to add an additional sponsor (which I believe you're able to do), does this sponsor have to be an immediate relative, or can they be a close friend/ past work colleague etc?

Any USC can be a cosponsor.

My question is this: if we were to marry immediately upon his arrival in, let's just say early November, how likely is it that he will be able to return home in December for the holidays?

Not at all likely.  Once you file for AOS and the AP after you get married and have the marriage certificate in hand, figure about three months to receive the AP which allows him to re-enter the US once he leaves (anyone can leave at any time, it is the getting back in that is the tricky part).

 

 

Being home for Christmas is a very important item for him and would be heart breaking if he is unable to be there because of admin details over here.

Then have him delay coming to the US in the first place until after Christmas and then you guys get married and proceed along the process.

 

Can we file the permission to travel document prior to him receiving his visa?

No

 

I asked this same question a few times to USCIS and got mixed responses from them. 

Of course, like talking with the IRS>

International relationships and immigration to the US to become married and permanently reside here require couples (and their families and friends) to understand that things have to be done differently.  Most will understand this and not hold anyone hostage over the requirements.  Also priorities must be made and set and followed.

I tried to go to the U.S. on a J-1 visa (student exchange work visa) this summer but I got denied because I failed a year on my faculty and had breaks in my studying.

As the beneficiary, you can just not go to the interview.  You have to wait out the process before any other visa will be considered.  Sucks but that's the deal you have.

You both have to be legally able to marry when you file the petition; what happened before that USCIS cares less about.

Sure, but shouldn't be an issue.  Many folks had a visa prior to a K-1.

  1. Lastly, we haven't had a big engagement party or even really officially announced it. Honestly, we would probably keep 'living in sin' at least a couple of years longer, except he's missing his family a lot and wants to go home.

Only need two signed Letter of Intent to Marry; no other requirement.

 

Also, if all that weren't enough... I have serious health issues. Nothing communicable / on the exclusion list, but bad enough that I get disability pension here in Australia, and am not physically able to work a normal, 'go to the office every day' job.

 

The USC petitioner is the one that has to provide the financial support.

 

AND last time I was in the US, I might've technically overstayed by 2-3 weeks. I left before my visa expired, but after the date written on the entry stamp. I did have genuine reasons, and put in the application to extend my stay, but I've never received the response (which arrived after I'd left the country). So I don't know whether they said OK, or whether they said no and I'm now in the system as an over-stayer.

 

Usually is not an issue.  Make sure all the dates of previous visits are honestly portrayed.

As long as you abided by the requirements of that visa, ti should not affect a K-1.

USCIS doesn't care about all that.....they only need two signed Letters of Intent.
