Hi all
Just found VJC yesterday and all the info here has been very helpfull. I have met three times with my fiance, twice in Russia and one time in Spain. Just popped the question to her on 10-2-2011 while in Gran Canaria Spain))))))). Now I get to start the K-1 jorney. I am in the prosses of getting things together but am stil on the wall on wether I should do it myself or hire an imigration attorney. Part of me just wants the peace of mind to let sombody else handle all the paperwork. Any imput would be helpfull. Thanks.

No, when they say documents, they mean oficial documents, birth certificates, name change certificates, divorce decrees, marriage certificates, custody papers, etc...

I do not think those documents with the signature can be emailed. I think they have to be the original signature. Somebody correct me if I am wrong.

OP, if you have not received them I think you might have to have your fiance resend to you. I remember Pui and I sent a few things back and forth to each other. I think the longest anything ever took was about 10 days.

Yes, those have to be original signature and cant be emailed. What mail service did he use? If it was a reagular mail serv. and not DHL or UPS or such, it could take a very long time for mail to arrive>

There's no need to over-think these questions. My grandmother was born where she was born, but on the day she was born, her community was part of Texas. A few years later, the border was re-designated as another fork of the red river, making her birthplace a part of Oklahoma. Was she born in Texas or Oklahoma? Either answer is correct, as there would be no birth certificate. In the OP's case, where will the birth certificate say she was born? The question is only a curiosity, as either answer would be both understood and accepted.

Okay, I guess I have not been as lucky as most of the folks here.
My fiancee was first given a 221(g) 2 months ago. We provided the documents promptly.
Now the Mumbai consulate emails me saying that my petition is being sent back to the USCIS
for re-examination and for possible revocation. I checked with some attorneys and looks like
I have no other option but to start the process all over again.
Checked with the DOS a couple days back and they did confirm that it was being sent
back. However, when I called back again today, I am told the case is in 'Admin Processing'.
So, I am not sure what to make out of it. Will appreciate if anybody has any idea..?

My fiance and I are filling the letter of intent, but the 'template' i found on this site reference the USCIS address. The address where i sent the completed 129F package is in Dallas but what address would i enter on the letter of intent? i live in TX , would it go to one of the USCIS offices in TX or some where else?

You can only send what you have. If I remember right, once you file a return, it takes about a month for the transcript to be available. You can check right online, and it will tell you when the transcript is available.

If you are self-employed, you try to minimize your tax liability. It is possible that you are not showing enough income to qualify, even though you made more that enough money. In order to get past that hurdle, some filers create false income tax returns showing sufficient income, and send copies of those with their immigration filings, hoping to qualify as a sponsor. That would be misrepresentation, and could get you in a lot of trouble, not just a denial if caught.

What you could do, that would be legal, is to file amended tax returns, or use income averaging, and pay any additional tax, fines, or interest.


Oh I got what u are saying, I wish I was eager and make $50K but I was kind of layback so I didn't make much...I just hope that after all the tax deduct I still have enough to show that I am above the poverty line for 2 people with the 2011 tax return. I make a little over 25k and don't claim any dependent although I do live with my parents and younger siblings right now. 2010, I make too little. It's too funny to even mention, okay under 4000, that's the net, the gross was like 7k something...cause I was new into the market...was slowly building my clientele...

Form 1040-V is just a payment voucher. If you are self-employed, you should be filing Schedule C or Schedule C-EZ with your return. Go ahead and order transcripts for the last three years to see what was actually filed for those years. They are available free from the IRS.


Yeah I just found that out right now, my sister showed it to me right now..I have it. I didn't work 2009 so I will get the 2010 transcript. Then after I file the 2011, how long should I wait until I can call to request the 2011 tax transcript do you know? So since I didn't work 2009, which that would make up 3 years, do I just write a letter stating that I didn't work that year? I went to school from January to April for my massage therapy certificate 09, then didn't find anyone I want to work with or for, so I started my own business in summer 2010.

A tax transcript is the best way to do it if you are a sole proprietor. Your business income would be listed on Schedule C when you file your 1040. The tax transcript will contain all of this. This will show how much you make.

To verify your job, write a letter on your business letterhead explaining that you are the owner and operator of the business.


Okay got that, I found it where it says schedule C on my 2010 tax return Form 1040-V. Cool thanks. So you guys are saying I don't need to make copies of my business license, certificate, etc??? for additional evidence u know just in case they request for more evidence...then it's there already...

I have done both. They seem to like the transcripts better. Some people send the USCIS copies of tax returns they didn't actually file with the IRS. The transcripts are a little harder to doctor.

You don't. Just supply three years of tax returns (or transcripts). If you have any 1099's, you can show those. My business was retail, so I just photocopied three years worth of returns and sent those. The new rules say one year, but I would send three years if you are self employed, rather than get an RFE.


Thanks for the info...will I just have 2010 and I will be filing 2011 sometime soon. I dont have 2009, I didn't work that year. Providing tax transcripts from the IRS is the best way to show proof of income for self-employed.

If you have not even filed the petition yet, then you have time to get your previous tax transcripts from the IRS. They are free. You can call 1-800-908-9946. There is an automated system to order them and they should arrive to you in the mail within 2 weeks. You won't need this information until it is time for the K-1 interview, which will not be for months after you file the petition.

They want YOUR gross income, not the business. Line 22 of the personal 1040. They do not care about your business.

If you are writing off the revenue of the business as expenses, costs and depreciation you avoid paying self employment tax (you know this) but you also eliminate your personal income. That $8000 is not available for the family because it is business expense, NOT income.

What still bugs me is do they want the gross income or the net income since I am self-employed??

Say if I make about $28,000.00 and I spend $8,000.00 to operate my business for that year. Then I really just make $20,000.00. Which one is it for 2 people.

Email them the questions you have reguarding supporting documentation for you being a self-employed US Citizen. The only way you are going to find out exactly what they want, for your specific case is going to be to ask them. All K-1 visas, at all stages of approval are case-by-case. There really isn't a standard, we are humans capable of creating millions of different, but similar situations.
