One of my friends hired a lawyer for her AOS. It cost $1,500 excluded fees for AOS. It took 8months to get her GC and there's no RFE,I think she was so proud to hire a lawyer because she keep bringing it up. If I compare her case to me, I think I did a good job with Vjers because I waited less than 6months with RFE back and forth (for both AOS) and also my K2 were rejected but adjudicated on same date of my AOS approval.
Personally, I still have phobia with incompetent lawyers and if I will hire a lawyer, I'm gonna check their performance before I hire him/her.

General:

Marriages performed abroad are conducted in accordance with the laws of the foreign country. U.S. Foreign Service officers are not permitted to perform marriages (Title 22, Code of Federal Regulations 52.1). The validity of marriages abroad is not dependent upon the presence of a U.S. diplomatic or consular officer, but upon adherence to the laws of the country where the marriage is performed. Marriages abroad are subject to the residency and documentation requirements of the country in which the marriage is performed. In general, marriages which are legally performed and valid abroad are also legally valid in the United States. Inquiries regarding the validity of a marriage abroad should be directed to the attorney general of the state in the United States where the parties to the marriage live.

Vietnamese Marriage Requirements:

Any application for marriage between a citizen of a foreign country and a Vietnamese citizen residing in Ho Chi Minh City should be filed in persons at the Principal Registrar's Office (Justice Department, Ho Chi Minh City). If the Vietnamese citizen is residing elsewhere, we suggest that you contact that person to inquire where an application for marriage may be filed. It is our understanding that non-Vietnamese citizens are required to present the following documents.

An application for marriage legally registered (the form is available at the Principal Registrar's Office);
A notarized, authenticated photocopy of your passport;
An authenticated copy of your birth certificate;
A notarized, photocopy of your visa registered at the city policy headquarters in Vietnam (exit/entry control office);
Medical certificates for marriage;
An authenticated statement from the local registrar of marriage documents from your state of residence attesting to the fact that there is no record of a previous marriage in your state of residence for two years.
An authenticated copy of a death certificate or divorce decree terminating any previous marriage.
A certificate of no impediment to marriage.
Certificate of No Impediment to Marriage:

Many countries require persons who wish to marry to provide proof issued by a governmental authority that there is no legal impediment to the marriage. There is no such authority in the United States. The Department of States does not issue any statement or authorization regarding whether a person living in the United States is free to marry abroad. No such document exists in the United States. In the United States, marriage laws are enacted by the governments of the individual states, and there is no federal (national) marriage law or federal record of marriages. The laws of the several states with regard to marriage differ, and the stipulations for, or impediments to marriage vary widely. Marriage licenses in the United States are granted upon written application by the individuals concerned who declare themselves free to marry and are required to present evidence of the termination of any previous marriage. Thus the individuals concerned are held responsible for and accountable for their statements. Since 1888, U.S. regulations have reflected that U.S. consular officers are not competent to certify officially as to the civil status of persons domiciled in the United States and proposing to be married abroad. Moreover, 22 C.F.R. 52.3 provides that although a consular officer may have knowledge respecting the laws of marriage, the consular officer shall not issue any official certificate with respect to such laws.

Affidavit of Eligibility/Freedom to Marry:

Generally, Americans who wish to marry abroad execute a sworn statement regarding their civil status in the form of an "Affidavit of Eligibility/Freedom to Marry" before a consular officer at the U.S. Embassy or Consulate in the Foreign Country. In the absence of a state or national certificate of no impediment to marry, this sworn statement seems to satisfy foreign local requirements.

Completing the Affidavit of Eligibility/Freedom to Marry for Use in Vietnam:

The following information is drawn from experiences provided by persons who have been married in Vietnam. Essentially, a U.S. citizen wishing to marry in Vietnam must execute an affidavit of eligibility to marry. This may be accomplished before a U.S. consular officer in Hanoi or before a notary public in the United States.

1. Sworn Statement before a U.S. consular officer: The U.S. citizen may appear before any consular officer at the U.S. Embassy in Hanoi located at 7 Lang Ha, Ba Dinh District, Hanoi, Vietnam, and execute an Affidavit of Eligibility to Marry. The signature and the notarizing consular officer and the U.S. Embassy seal must then be authenticated by the Consular Department of the Ministry of Foreign Affairs located at 6 Chu Van An Street, Hanoi, open on Tuesdays and Thursdays from 8:00 to 11:30 am.

2. Notarized Statement Executed in the United States: The U.S. citizen may prepare a statement of eligibility to marry and have it notarized before a notary public in the United States. That person would then follow the procedures outlined in "Authentication (or Legalization) of Documents for Use Abroad" in obtaining further certification from his state's Secretary of State, the Authentications Office of the U.S. Department of State (515 23 rd Street, NW SA-1, Washington, DC 20520), and the Vietnamese Embassy (1233 20 th Street, NW - Suite 501, Washington, DC 20036, tel. (202) 861-0737.)

3. Authenticated Statement from Local Registrar in Your State of Residence: As noted in item 6, above, Vietnamese authorities apparently also require that foreigners wishing to marry present a statement issued by the local office responsible for marriage records in their state of residence in the United States. This statement should reflect the absence of any marriage record for that individual for the past two years. The state or local registrar's statement must be authenticated in accordance with the procedures set forth in the enclosed information flyer regarding authentication of documents. This means that the document must be authenticated by the state Secretary of State's office, by the U.S. Department of State's Authentications Office and by the Vietnamese Embassy (addresses provided in item 2). Please note the original registrar's statement will not be accepted by the Vietnamese marriage authorities more than three months old.

In all fairness, from the research I've done, and lack of detailed instructions, this process of going about confirming my date of birth and location seems the most reasonable. Well I hope no one ever has to run in to this nasty problem, because believe me, it's annoying!!! This was our first LONG snag through this process. It says last 5 years. You said that you lived in uk for the majority of 4 years so you will need to put that first then the year prior that 4 years is in italy? then thats what you need to put. And yes you will need a police certificate in Uk. good.gif

My fiance then(now husband) just send copies of his employment letter, bank letter, tax returns and actually even I-134 is just a copy and I didnt have any problems with my embassy (philippines). But then again, if you want to send originals to your fiancee then thats better since she will bring it with you when you got together. Try to find a civil surgeon who will understand your wife's case, maybe better if is she had a pregnancy test verified by the CS too and explanation that she cant have the vaccines that will be harmful for the baby. k1 fiancee visa is good for 6 months so you can stay in australia (toget ready/pack/finish work etc) then when you decide to come to US keep in mind that K1 is ONE entry visa..once you're here you need to be married within 90 days..and then later on proceed to AOS application with that you will apply for AP travel document so you can go back to australia once you had the approved travel document..good luck,,congrats. good.gif

NO, you wont get the medical papers back, you will just need to do any completion of vaccines once you're in US or if you already completed everything just submit the copy of DS-3025 vaccination worksheet that they gave you in your medical. Hi all VJers!

so here's my problem..My fiance and I filed the papers March 25th.we got our NOA1 couple days later..its been almost 6 months now and we still havent gotten our NOA2.is there something wrong?we plan on calling them September 26th as our lawyer said we can only do that after 6 months since the initial filing.
I just don't know what to do.can they deny us at Vermont?what's going on??

It took us 14 months to have our NOA2..it can be due to pending FBI name check...After 6 months my hubby contacted a congressman and thats the time we knew that it was pending on FBI name check..

Alternatively if i filed for the k3 visa went over to usa married her, then came back for the interview is that easier??--K1 WAS BELIEVED TO BE FASTER

for the k1 visa is it not possible for me to stay in the usa while its being processed? or do we have to stay apart til the visa issuing:(--IF YOU CAN HAVE TOURIST VISA OR IF YOU CAN GO HERE TO US EVEN WITHOUT A TOURIST VISA THEN WHY NOT

Cant the medical and interview take place @ the usa embassy in usa?--IT SHOULD BE AT US EMBASSY IN YOUR COUNTRY (COUNTRY OF THE BENEFICIARY-YOU)thanks in advance

First Day!!

I arrive at St. Luke at 12:30 pm I did not stay in the hotel I went there by jeepney tongue.gif hehe
I asked the guards where will I go and then he asked me if I am for US visa I said YES!! and he asked my appointment letter I showed him my appointment letters and asked him which of the two appointment letter they want, the one from the website or the one from embassy confirmation email. He get both of them anyway lol.

He then went to his desk and grab something and that was the forms that I need to fill up. So I went at the corner where I can able to write and fill up the forms.
PS: Just fill up those box with red check marks and nothing else. In my case I was carried away so I checked those box that has no red checked marks hehe, but anyway I did not have problem about it. The box that I filled up was the box that the Physical Examineer Dr's. worked. Oh well i gave her less work hehe.
After filling up the forms I asked the guard again if whats the next step that I have to do he instructed me to go to reception area at the same floor (ground floor). I hand the forms, Passport, and 1 2x2 picture to the receptionist and she checked it and she gave me 1 form to fill up and told me that I can fill the forms infront of her. While filling up the forms she was asking me some question like: When was your last day of mens?
Was it my first time in SLEC
If I had given a tourist visa before?
Did I worked in Hongkong?
If I have previous X-RAY I said YES. so she asked what year was it taken then I said the YEAR.
After the question I gave her the form that she let me filled and she told me to have a photo scanning in their little office/room. I was wondering why should I take photo scanning since I gave her my 1 2x2 picture, so I think that maybe it will be kept for their computer records/files.

Done with the picture, she then reffered me to the other receptionist just beside her, and this receptionist hand all my forms and passport and instructed me to go to cashier at 5th floor, I took the Elevator. the cashier is just right by the elevator you will see a grab bars there where lines are being held I was luck it was not that busy.
After I paid for the medication examination fee which is $213:00 ( their rate was too high $1=P43) the lady stapled the receipt to my forms and instructed me to hand my papers to the US COUNTER at the same floor ( 5th floor). USA COUNTER is located at the right corner, the left side was the CA,AUS, NZ counter. After I hand my papers to the US COUNTER receptionist she told me to sit down and wait for my name to be called. After about 15 mins. my name was called for eye check up, the nurse that conduct eye check up was very nice we had a litte chit chat hehe. She let me read the letters by the mirror I read it well, she asked me if I used glasses I said NO and its done. She told me to be sitted outside I said SURE hehe and she smile and said SURE too.
Watch out: do not hold the DOOR KNOB or else you will be grounded hehe. It needs repair.

I was sitted for about 20 minutes and I hear my name was called for weight and height check up and it was fast and easy. I sat again and wait for my name to be called, after another 20 minutes I was called for Vital signs it was fast with no REPEAT, just relax so your heartbeat will be normal or else they will tell you to wait another 10 mins to have it done again. The nurse that took my vital signs told me to go to second floor for immunization interview. When I got there, I hand my forms to the guy sitting in the table that collects the form he will be the one to call your name to fall in line when u need to. After 5 minutes I was called to fall in line and after about 10 minutes its my turn for my immunization interview.
The doctor here was so nice she keep on smiling infront of me while asking some questions
like: Any diseases etc?
History of Illnesses
Family illness history
and she will ask you if you have received any vaccines before and she will look for the scars she found 1 in my arms so she
told me that I will receive for vaccines, oh no hehe.

She then told me to go to 4rth floor for blood extraction, the line here us a little long. It will nice if you will talk to other applicants so you will have someone to share the sentiments and the waiting boredom hehehe just like mine I met ate VINA from VJ we talk a lot. And after 30 minutes it was my turn for blood extraction ( oouch)

Advise: If your afraid of the niddle just don't look at them just like me, the next thing I knew it was done hehe though it hurt atleast you did not see how big the niddle they stick unto your veins hehehe.
The nurse here told me to go outside for the urine test and when I get out the receptionist in the bathroom will hand you the small piece of plastic where you will have to put a little bit of your urine for pregnancy testing.
When you already gather some of your urine give it to the receptionist that gave you the plastic she will be the down to hand it to the nurse. Don't forget to wash your hands before you get out hehe. And then sit down and relax and wait for your name to be called. I was called after 30 minutes and my forms were given to me and the receptionist told me to go to 5th floor for Physical Exam. I gave my papers to receptionist at US VISA COUNTER and she looked at my papers and she told me that I have to go to 3rd floor first for my X-RAY. I went to the X-RAY receptionist I hand my papers to her and she asked me the last date of my menstruation and my previous X-RAY. I gave it to her but because my name on my previous X-RAY was mispelled she told me if I will submit the old X-RAY I have to get and affidavit of discrepancy, and she told me its OK if I will not submit it so I did not. So she gave me a little paper to fill up that state they cannot get any of my previous X-RAY FILM. Asside from signing that I also signed 3 forms.

After signing I sat again and wait for my name to be called..

After 30 mins. the waiting is over I was called to sign to their logbook and BINGO my signature does not match good so I have to signed again they have this what they called " MEMO" but its ok it does not make a big deal to me so don't worry. Then after signing I was told to get in their X-RAY room and was told to get undress ( top only) hehe, P.S. don't forget to bring hair lace or hair clip cuz you will need it so u can tie your hair.

After the X-RAY I was instructed to go to the US COUNTER.

And this time in US VISA COUNTER the waiting was very very long, so I asked the receptionist if I can go out and eat she nicely answered YES so i go down and eat in the restaurant just infront of ST.LUKE after eating I went up again I was afraid I will be called and I am not there.

I waited until 6:00 pm and my name was caled for my applicant number and room number I was assigned for ROOM # 5.
The doctor here was really really fast and quick maybe she was hungry, she asked me anything with a NO & NEVER answer hehe. She was reading it too fast maybe she have done it for formality hehe. tongue.gif
She asked my age, what did I finished in school. And after that she told me to get undress as in bare naked hehehe. It took her less than a minute to examine me and that was it, she told me that I will go back the next day at 2:00 pm. She also told me to gie my forms to the US VISA COUNTER. The US visa counter receptionist told me to go to 3rd floor for check out. When I get there the lady get the forms while she gave me my passport and my receipt form. And Im done with my first day!!

I ride a jeepney to get to my aunts house in Q.C. it took me 3 hours in the jeep since there was a rally going on so some roads were blocked. mad.gif That that lucky day but atleast it was a good one at SLEC blink.gif tongue.gif

and Remember your first day and last day of menstruation- they will asked this multiple times so better have the same answer.
PEN - You will have to sign a lot of papers and st.luke receptionist will not let u use their pens since they have too many papers too sign as well.
Whiteout - Just incase you have to erase something atleast you can make it neat and clean
Bottled Water - I forgot to bring bottled water and it happens that st.lukes drinking water is not working or not available so I was thristy to death.
crackers - You will be hungry waiting for your name to be called that is for sure.
candy/ chewing gums - to enjoy the waiting moment hehehe
Don't wear high heels or stick heels - It will kill your legs, the walking, the running, the standing is too tiring much of when u wear high heeled shoes. A flat sandal or slippers will do. In my case I wore stick heel the first day and Ive learned from it so the second day I wore flat flip flops.
Don't wear sleeveless - It's cold in st.luke. I did not felt it but I can see the other wearing jacket and putting their legs in the chair.

Second day!!

This day I got up at 10:am to get myself ready for the 4 vaccines in SLEC hehehe.
It was exactly 11:30 am when I got out in my aunts houseit was raining so I had to buy umbrella at the sidewalk vendors.
I ride a taxi to get to J.BOCOBO st where ST.luke is located I paid P 165.00 for it ( above P 200 is a scam) so better watch out.
I was hungry so I had to look for a restaurant and I found " SHAKEYS" hehehe.
I got out at shakeys at 1:00pm so I head directly to ST.LUKE which is just a walking distance from SHAKEYS.

@ SLEC I showed my passport and receipt to the guard and he look at his PC to check for my PDS # and records in his file and after a minute he stam my receipt that state " IMMUNIZATION AT 2ND FLOOR" So I was happy cuz I know I had know problem about my X-RAY. He stamed something on my hands with a SLEC logo.and told me to go to 2nd floor.
I went to 2nd Floor and I hand my receipt and passport to the receptionist and she told me to wait till my name is called for my vaccination it was exactly 1:10pm when I sat down to start waiting for my name.. the waiting is very long here I was upset a little bit with the waiting but anyway I found someone to chit chat and share some sentiments hehe. We had fun talking...

My name was called at exactly 6:00pm for my vaccination. So here it goes 4 shots were given to me I thought it would hurt but it was just a minimal pain which u can tolerate. I was done easy and quick!
The nurse that gave my shots told me wait at ground floor for releasing area. I waited there until 7:30pm until my name was called, The receptionist asked for my receipts and passport and my 2 2x2 pictures with my name at the back of the picture and he told me to wait again for my name to be called. After 15 minutes my name was called for window And ohh I have to redo my signature since it does not match good on my forms hehe my bad, after I signed I was told to wait again at 8:00 pm my name was called for window C for my X-RAY and vaccination results releasing.
The nurse here asked for my
Middle Initial
My birthdate
My last and first date of mens.
How many vaccines did I received
Was it my first time at SLEC
If I did bring someone with me to have medical exam too.
And she showed my my picture printed ( That was the picture that the receptionist in the ground floor took in their photo scanning in the first day of my medical) at the back of their file and she asked me if it was me I said YES!!
So after that she explained to me the vaccines that I received, she told me to bring my x-ray FILM in the USA and she hand me my vaccine & X-RAY copy.
Got out at SLEC at 8:10pm with a big smile! You can buy a plastic bag outside SLEC for P35 so it wont get wet.
And than me and my newly met friend ( SALLY) went to eat at pancake house!! and went to STO.DOMINGO ADORATION CHAPEL.

And that was it done and approved!! Thanks to my friends who are always there to support me you know who u are, thanks to VJ for the great support, thanks to my family, and to my honey and above all thanks to GOD for all the Blessings.
