I am surprised that this wouldn't be a 'Red Flag' issue.

I hope things go smoothly! It seems like you were aware that this MAY be a red flag issue and made sure your application provided plenty of proof which seems sensible!! My husband and I both lived together in Scotland and knew each other for a couple of years before we filed for the K1 and we also front loaded the application! Everyones situation is different I guess it's all about preempting any RFE's and being organised! :)

No matter what the situation, everyone worries about RFE's and delayed processing.

I cannot edit my post. I forgot to mention that at my K1 interview in London I was asked if I had visited my fiance since filing for the K1. When I gave them the information he confirmed this with pictures that were attached to my file of me arriving in Boston on the VWP a few months previous. Big brother is watching :)

My case was approved quickly without any delays or problems.

I too am in the U.S.A. and my Fiance is in the UK. Since we filed for our K1 he has been back twice without incident. As soon as you mention a significant other the Border Patrol raises an eyebrow, but every time they did he would say "We are going about it the proper way and have filed for a Fiance Visa I am just here to see her while we wait." He also shows them his return flight itinerary as proof that he will be departing the country again. They always say have fun and good luck, congrats, etc! No need to fear as long as you are up front and honest and can prove they will be returning they have no reason to deny entry :)

I visited my fiance (now husband) for 89 days on the VWP while we waited for our K1. He arrived in the US, sent the packet and I joined him 5 days later.

Letter from employer saying 'see you in 3 months',
A copy of the I-129F packet.

They did not ask to see any of it.
Just be honest and up front as the above poster said. It should be fine :)

The K1 is a fiance visa. If you get married, you no longer have a fiance. The main condition of the K1 visa is getting married within 90 days of entering the United States.

This seriously needs to be stickied, it shocks me how many people think they might be able to do this.

The rules are very specific. The K1 is a very limited visa and you must get married in the US, within 90 days,or leave.

Many people do the legal part in the US quickly to meet the requirements and file for the AOS, apply for AOS and do a bigger 'ceremony' where you renew your vows in your home country later.

The period between entering the US on K1 and getting your documents to work, leave the country or your GC can be tough for some people. It's kind of an 'immigration limbo', As I said, the K1 is a very limited visa. it allows you to be together as another poster says, but you are allowed simply to wait here. We did the K1 because we didn't want to be apart for the first year of our marriage. It's worked out fine for us. When I wanted to enter Alaska for the first time, I had to be straight out honest. When I lie, my face goes pink.. So I was like, here goes! I told the officer I was visiting my fiance and he joked with me and just said, well as long as you don't get married on this trip!



Me too! :) The CO in Boston was so amused that the address wewere staying at was in 'North Pole', Alaska, he chatted and joked about visiting Santa. I was also honest and up front about visiting my fiance and it was fine :)

K-1 Fiance(e) Visa Process & ProceduresK1 Process, return to foreign country and more

Me and my fiancee are currently residing in the UK, where she is a resident and I am on a six month tourist visa; we both want to travel to the US in the beginning of August/end of July.



I have a few questions here:

1) Regarding proof of financial support, I work as a computer consultant on an exclusive contract with a company, and therefore for tax purposes I would be self-employed.
However since I have only started with this company late last year (where I did not even make enough money to file a tax return), I don't have any documentation to prove this.
I am sure that my employer (read: exclusive client) can provide a letter stating my salary, but I would not have any W-2 forms to provide alongside with it, since I am not technically an employee. I can provide receipt printouts though. Can/Should I just file an early tax return for 2011?

Additionally, I don't exactly know *when* to actually file the I-134 form.
We are planning to send out the I-129F and associated G-325A forms ASAP, however I am wondering whether I'll need something else along with it (e.g. the I-134 form) as well.

2) We hope to spend as much time together as possible. Initially we were thinking about doing a B2/VWP -> AOS, however my research on this shows that this is both illegal and risks a ban, so this is out of the question.

While a K-1 would require a return to the UK for my fiancee, we were thinking we might be able to spend some time in the US together either on the VWP, or more likely, on a B-2; hoping that she will have had her K-1 approved before the B-2 itself expires.
This means that she would need to go back to the UK for a given period of time and then return to the US on her new K-1.
While this is feasible and allowable legally (or so I have come under that impression), how much time would she actually have to spend in the UK on her return?

Also, regarding the B-2, it would be a waste to purchase a two-way ticket when the date of her return would be unknown - would it be proof enough to show at the POE that we have applied for a K-1 and she plans to return to the UK at some point in the future?

3) How much proof does she need to present at the interview? We live together and are holders of a lease agreement on an apartment, but we don't have much in the way of photos, emails, or letters (the only thing we actually have is a facebook status, which apparently nowadays is quite a statement). Would the fact that we've been living together for a while be good enough?

4) Not really related to K-1, but my visitor visa to the UK will expire in about a month.. any suggestions on how to handle this?

1. Self employed people require tax returns. I don't know too much about this but you may want to think about having a co-sponsor. I am sure someone else can give you better advice on this :)

You don't file the I-134 until the interview stage so it will be a couple of months. It has been suggested here before that the USC get another, job in the interim to cover the minimum poverty requirements.

2. What would the advantage of getting a B2 visa be over the VWP? Check out the current processing times for your service centre because it took less than 3 months for our NOA2 to come. I was able to be in the US for 88days on the VWP and when I got back to the UK I was able to organise all the appointments, forms and the interview as soon as I got back. It took 8 weeks from then for me but this is different for everyone. I would suggest being organised and knowledgeable about this process when you begin so that you can be prepared for anything that comes up. Visajourney has a lot of step-by step guides to help.

I don't know about the B2 visa, but turning up at your POE without a return ticket might be a huge red flag.

3. My fiance and I also lived together in the UK. We provided our council tax bill and a few pictures and were not asked for any further evidence. The pictures we provided were with each others families and included breadth of time. You send copies of this with your I-129 form.

4. I imagine if your visa in the UK is up you'd have to leave, right?

My fiance' is coming to the USA. She has a Vietnamese driver's license. What is the procedure for getting a driver's license if you have a local (ie. Vietnamese) driver's license already (or does it make no difference)?

Checking with the DMV is good but if your fiance is coming on a K1 also check with the AAA. They have a publication called the 'Digest of Motor laws' that another visajourney member directed me to when I had difficulty with my foreign drivers license. I went into a AAA store and they let me photocopy the information from the book. I now carry evidence that I can drive legally here in my car.

Also check out the 'international drivers permit' to see if one may be required.

Everyone is so harsh!

If my husband tells a girl he likes her hair or outfit or tells a guy he likes his hair or outfit or tells my Mum he thinks she looks nice today... it makes me feel good to have a husband who wants to give a genuine compliment to other people.

Don't make flirting sexual and you have no problem. You should not be showing sexual interest in other people when you are married. Obviously.

If your wife/husband is insecure they may have a problem when you compliment another person and accuse you of 'flirting'.

If you are intentionally being sexually suggestive and this is your definition of 'Flirting'...then it doesn't matter how secure the other person is...they probably won't like that...unless you have that agreement in your marriage. In addition to this...there is a time and place for everything, even when you are single, 'Flirting' in this way in the work place is likely to reflect badly on you in the States.

(in my opinion...which doesn't even matter...what matters in the opinion on your spouse)

Vietnamwhat you do to pass time?
I always go prepared for flights. I am 5ft10 with long legs and I can't get comfortable for long on most planes. (Jet Blue airlines are easier)

I take knitting, books, a newspaper, a notepad and pencil, laptop, ipod, snacks, watch the movies, talk with the person next to me. Depending on the flight I also take niquil (night nurse) and get a few hours of sleep.

As a UK citizen you can also have a copy of that certificated 'deposited' in the national registry.

I plan to have my passport changed soon after my wedding (tomorrow) and I shall carry my certificate with my passport until then. Thanks for the advice!

Interview payments can be made online but I just paid at the London Embassy at the time of my interview. (They said it was preferable to pay online before the interview)

It is worth trying to track down your records. I had records in other countries too and it took time to track down...in the end I just had a hand written note from my GP that said I'd had various vaccinations in another country. I have filled all the forms and ready to send off to the US embassy. My police certificate has also arrived 'NO TRACE'. I called the knightsbridge doctors and the can not schedule me earlier than June 1st. I am panicking cos I have left this too long ( I had to travel to africa for family occassions). Our NOA2 expires June 17. Will this be a problem??? Cos the embassy might get the result of the medicals June 5/6 and can't schedule and interview till July whe the NOA2 is expired. Please can anyone offer an advice..



I imagine you'd be fine. You are not required to have had your medical prior to your interview, though the visa cannot be issued without it, so it's better to have it before.

You could ask Knightbridge to keep you updated if they have any cancellations.
Do you have an interview appointment date yet?
Have you sent your 'I am ready' form? (Can't remember the proper name for it)

So i was wondering, on the I-129f form, in the "state/country", "Country of Citizenship" etc boxes, what do I write? Does it matter whether I put United Kingdom, or Great Britain or not? I've been using "Great Britain", but just wanted to be sure I was putting the right one down. Thanks!


I always put "United Kingdom" on my forms.

I am not sure if it matters.

Officially your passport is from "The United Kingdom of Great Britain and Northern Ireland".

SO I donot think it is incorrect to write "Great Britain" if you mean England, Scotland or Wales. I decided to write United Kingdom. (I also wondered about this matter at the time.)

If there is a problem with writing Great Britain then I am sure someone can advise you on that.

I'm new to Visa Journey and am hoping to get some information.

My boyfriend and I are trying to get married and live together in the US but theres a few problems so we're trying to find out how to go about this.

I'm from the US and hes form the UK, we wanted to do the Fiancee Visa for him to come to the US and get married but I won't be able to sponsor him, and I don't have any available co sponsors. In the UK however he would be able to sponsor me with the help of his parents as co sponsors. The only problem is we don't want to live in the UK we want to live in the US.

So we're planning on having me come out for a few months on a wavier (because its been 2 and a half years since we've seen each other) and then I come back to the US (I also need to find out if I can apply for the UK Fiancee visa while in the UK - I don't think you could though?) and apply for a UK Fiancee Visa for us to get married in the UK.

Here are my questions:
1. If we got married in the UK on a UK Fiancee visa would we be able to both come back to the US and live (I've heard of Dual Citizenship)?
2. If we got married in the UK on a UK Fiancee visa would we have to apply for another visa for us both to come back to the US?
3. If we got married in the UK on a UK Fiancee visa would we HAVE to live in the UK for 2 years then apply for Indefinite Leave to Remain (ILR)? Or would we have to live in the UK for 2 years then get Dual Citizenship?
4. Would I be able to apply for the marriage visa UK Fiancee visa while I'm on the UK wavier? (I wouldn't have thought so)

I know this is a US visa site but I figured there might be some kind of visa we'd both have to go on or just he'd have to go on to come back to the US and live.

Figuring out what path to take is very confusing :) It seems people have given good advice for your questions about moving to US. Here's what I know:

You used to have to apply for a "Certificate Of Approval" from the Home Office to get married in the UK. That law has now changed: http://www.ukba.home...ship/documents/

If you want to stay in the UK after marriage, you need a Fiance visa: http://www.ukba.home...dcivilpartners/

If you just want to go to the UK, get married then start proceedings to move to the US. You need to apply for "entry clearance for marriage visitors": http://www.ukba.home...hip/documents/#

In my (limited) experience, I found that companies in the UK who offer wedding packages to foreign couples had good information on this stuff.

Or...do the K1 and get married in the US :) (in order to do this you will have to (get to) see each other as you must have met in person within the last 2 years)

In the end we decided that the K1 was the route for us because we'd rather be apart during our 'engagement' than the first 6 months of our marriage. (plus the Certificate of Approval was still required then)

Whatever happens,you are going to be apart and you are going to have to find a way to sponsor him if you want to live in the US.

I think you're right. I knew a girl in Scotland who was born in the US and she was 18 trying to get dual citizenship to come and live in the UK and was having some difficulty. I didn't know her well and that is just anecdotal, I just remember it. I hope someone can answer your question! :)

How long does a child (born in the US) of a UK born citizen have to file for dual citizenship? Does it need to be immediate? Or can they do it when they are adults?

The reason I ask is - my father, grandmother etc are all UK born citizens. Eventually Allan and I would like to move back to the UK (4-5 years). I was thinking it might make it easier to move back if I applied for dual citizenship. Also, I was thinking it might make travel for visits to/from the UK much easier for now too...

We decided to move here, for now, because my husband got a job here. And he missed the States. He'd lived in Scotland for 3 years and unfortunately, unless they get rid of the Monarchy he'll never ever swear allegiance to any Queen or King and become a British citizen.

Now if Scotland becomes independent...that might change things! :)

I think 2 hours is bare minimum.

I had 2 hours in Newark and I wish I'd given myself longer. I got off the plane (10 minutes), I queued at immigration (40 minutes), I was taken to secondary (20 minutes), I picked up my bags and went through customs (10minutes), I put my bags back on the belt and then ran through Newark (20 minutes) to clear security again (15minutes) before getting on my flight just before the doors closed. Newark was a blur. The only reason I made my flight was because the lovely lady at security eventually let me in the 1st class line.

All international flights into the US must collect baggage and clear security again, add immigration process to that and it takes a bit of time. Plus Newark is a large airport.

As Nick-Nich said, try to get a seat at the front of the plane.

And wear running shoes! :)

People do make judgement based on appearance so it's a good question! I dressed nicely for my interview for that very reason.

I shouldn't think it'd be a problem, as with all of us, he should just be cordial to the officers, have his documents in order and make sure he doesn't take anything he's not supposed to. The only people I would think would be an issue might be security at the front door, they didn't seem to be overtly friendly :)

The CR1 route is the best way to go for you. Im also from scotland and had to do 2 trips to london which was not cheap at all, its a bit unfair the embassy in edinburgh doesnt give visas grrrr!im not sure what the CR! fee is but the medical is 200 which he will pay on the day, the visa fee you pay before the interview



There is no embassy in Edinburgh. It is a consulate. It all goes through the embassy in London.

It would be great if it could be done at the consulate in Edinburgh instead of the Embassy in London!! :)

It doesn't have to be expensive to go to London. I made the 2 trips very cheaply on the megabus. It was time consuming but worth it!

When we come to the US we want to relocate to Vermont (I am now in Texas,) preferably near Brattleboro. I am concerned about finding work there. I currently work as substitute for the school district, but I am willing to take a simple job at Wal-mart in Vermont simply to get there and pay for a place for us until he finds work. Do you recommend any sites helpful in this, as I have googled many times finding work in Vermont but am not satisfied with results.

I think most of met online. I am from US and him from Morocco. We met on dating site. But they did ask for proof of how we met and how I paid for the site in my RFE. So, keep proof of that for later. I suggest to keep all emails, chats, phone calls, cards (we send 123 greetings and they let you print them ou tnow). Just be able to prove a real relationship.


I am not sure if most met online.

If you met online, and since you only "met" 6months ago. You will have to be more creative in finding proof of bona fide relationship if you haven't lived together or even met each other yet. Make sure you provide as much evidence as you can and check out what constitutes primary evidence. If I were in that situation, I might organise papers to have joint accounts/insurance etc for when you go over there so that you can show proof of mingling of finances as part of your application.

Helen, not sure what the snippy, lecturing tone is about. My grandmother was not a whatever, her name was Priscilla Alden. I have travelled to Scotland and found the people quite nice; you are evidently an exception. The rules may be there to protect us, but the procedures are draconian, redundant, and executed inefficiently. Meanwhile thousands cross into our country every month with no permission whatsoever. Where is the greater risk?

I am sorry you read it as you did. No harm intended. I see you do not appreciate my sense of humor. I shall also presume you are stressed and tired of this process. We've all been there and we all understand. America is a country founded on immigration and so your post amused me a little because it should be easier in theory. But as you also state...illegal immigration is rife so the process is hard to protect its citizens. Your wife will get here, and I hope that that will be soon. When you think about the Mayflower no doubt you, as I, think about those people and the journey they endured. It will be easier than that! :)

Just remember that these rules are there to protect the citizens of your country.

I hope your wife's journey is relatively swift and easy.
Certainly it will be easier and less time consuming than your immigrant great-great grand whatever's journey.

Thailand and Cambodia have recently passed laws which discriminate against older men marrying younger local women and in some cases prevents it!

This is not a one way street.

As others have said, work on getting proof enough to satisfy the embassy and reapply. Your husband may be a genuine man and it may seem unfair but Nigeria is a high fraud country so you just have to wait it out and work extra hard.

That's funny, I was worried about travelling on a return ticket when I entered with my K1 since I knew I would be unable to leave for a while :)

As has been said, you are fine, K1 is a visa to stay and they didn't mention my ticket at POE. The only question I was asked by secondary immigration was 'When will you get married?", I said "Within 90 days", they said "Ok, Have fun!". My husband booked a return ticket to get the cheapest deal.

Hi Everyone,

I have my interview coming up soon and I am getting nervous thinking I have forgotten about something I am suppose to take. I am sure this gets posted a lot but here is what I have...way over prepared

I-134 with transcripts, W2's, every kind of financial document imaginable, pay stubs, bank statements and employee letter (from USC)
Birth Certificate
Police Certificates
relationship evidence (photos, phone records, emails, skype, wedding invitation and receipts for upcoming wedding)
Letter of Intent to marry from (USC)
Copy of packet 3
Copy of every letter received from NVC, DOS, USCIS, and consulate

Am I missing something? Also, I have read a few consulate reviews from London and a few people have mentioned bringing a deed poll...I am not exactly sure what it is and I don't have one. Can someone please clarify.

Sounds like you have all the same stuff I took! My interview was also in London.

Take your passport and make sure you are taking the originals of all documents! I met a fellow K1 in the Embassy and he was not approved at the time of interview for not having his original Police certificate. I took lots of finance stuff too but they only needed to see the employer letter)

Deed poll is how you change your name in England...I guess people take that if they got married and changed their name? Unless you have changed you name for another reason you shouldn't need that for K1.

They ask for your appointment letter when you arrive at the embassy at the security enclosure so have that handy! :)

Better to be over prepared than under prepared!

I have just read on a review for London that they take your original police check certificate. Is there anyway I can keep the original as I need it for AOS? I had a very hard time obtaining one from the Middle East and I dread to think about having to get another one.


At my interview in London they took the original and a photocopy to look at. I was given back the original and they kept the photocopy. Take photocopies of all original documents.

Indeed for K1 he can wait till AOS to get vaccinations. However it will be cheaper to get his GP to administer them, plus if he does not have the vaccinations complete then it will be an extra hassle when you are doing AOS. If he calls up to book his medical now he can probably get some shots from his GP before he actually goes to the medical? He should just focus on getting TDaP and MMR.



Yes! Definitely!

Try to get as many as possible from his GP in the UK. Some will be free, some will have to be paid for. But it will be cheaper than having them done here in the US, for sure!

I am not sure about the list above...perhaps someone else can answer that one.

They are trying to avoid confusion...but it seems they have confused you by trying to do this :)

Knightsbridge is actually the name of an area of London. The Knightsbrige Doctors is not in this area. They are in the West end, behind Oxford Street, at the address you have. (Bentwick mansions)

This can be confusing to those of us not familiar with London as we just see Knightsbridge on the map and think we should go there!

Call if you are still unclear or think it refers to something else.

Item 32 of for DS-156 asks: "Do You Intend To Work in The U.S.?" Yes or No

What is the proper answer for a K1 Visa? Obviously my fiancée will not be working immediately, but she will want to work after we are married and she obtains permission to work. I'm thinking that the correct answer for this (for a K1 visa) is "No" since she will not have the right work immediately, and because there is no answer to the following up item of "If YES, give the name and complete address of U.S. employer."


Read the "Example form" provided here on VJ, they are very good.

The correct answer is YES (if your fiancée does intend to work) and then you have space to explain: "With work authorization, employer unknown"
