There must be a specific reason why it was returned unprocessed. If you give precise details you are more likely to get meaningful answers on this forum. But as others have pointed out, there would be no reason to cough up the fee again.

If you paid by money order and have the payment stub you can contact the issuing company to verify whether or not the item has been encashed. If not, you can place a stop payment and start over. If it has bee encashed, ask them to send you a copy so you can get your case number off the back - that way you can determine what might have happened to your file.

I'm just very unclear as to what has actually happened here. Sounds like you sent it off, it was retuned to you fiancee and sent off once more? Help me out here!!

I understand the frustration from CSC filers - I honestly do. The government is never predictable and they take too long for everything. However, when one posts in the correct sub-forum, specifically for announcements, they have the reasonable expectation not to feel guilty after receiving bitter responses from people.

We are all in this together: I don't give a damn if you get your visa two weeks after you apply, it still is too long to be apart. Same thing goes for someone's case that takes 10 months to get a visa. It's not fair; but life is seldom fair. We should live with the person whom we love when *we* want to, and not deal with arbitrary rules set in place by the government. But we don't and we have to accept that, as a community of visa applicants.


I never saw your other thread. The treatment you received is wholly uncalled for. I realize it must stink for CSC filers to see VSC filers zip through, but our happiness is just as valid as theirs. VJ is a forum for ALL people going through the visa process, not just those with longer wait times or more complex issues. I don't think that kind of abuse is funny. At all. I live on the Canadian border and my fiance and I frequently travel to Canada for dinner. He shows his passport with the I94 from his original entry and is allowed back in the US. They have NEVER given him a fresh I94, so I don't think your plan will work. Furthermore, you will also need to be really careful about frequent, long stays in the US. My fiance is here on his 3 long stay since last July, after 3 months in the UK. He just barely got in, not because they think he'll overstay but because they said he is essentially living here, despite all of his ties to the UK. As others have noted above, you definitely should be prepared to be turned back, in which case your eligibility for the VWP is canceled. Be very careful as there are no hard and fast rules when it comes to the VWP. Ultimately the officer at the POE has the say in whether or not you'll be granted entry to the US, regardless of what the USCIS says. Good luck!

Obviously, since the fee increases are taking place at the end of the month we'd like to get the I129F in ASAP. I know we need him to bring the original or certified copy with him to the interview at the London Embassy, and that it would be nice if we included it with the packet to VSC, and that photocopies are OK in the I129F packet, BUT do you think a FAX copy would be OK? Does anyone have any experience with whether this is acceptable or not? Or would a scanned then emailed copy from the solicitor be better?

The bottom line is, time is of the essence and we want to be in the K1 process ASAP!

Given that you don't send the original anyway so long as the fax is clear and readable and of course it has been stamped you will be fine. I would maybe cut the header and footer with the fax details off and then re-copy so that it looks like a standard photo copy.

Your biggest problem is finding a fax that prints absolutely legibly and I don't think that exists.

He could apply for a Tourist visa, which would allow him to stay here for a finite amount of time during which he would not be permitted to work here. As mentioned above, his only option would be to be sponsored for an H1B work visa which requires you to be highly skilled, like medical ot IT professionals, to name two.

If you marry in the UK you will need to apply for the K3 Spouse visa, since a K1 is a fiance visa (to bring a fiance to the US and marry here in the US). If you marry in the UK the K1 becomes null and void, so you'd need to start over and go for a K3.

So I'm sure a lot of us have heard MANY things and think different things about the new fees affecting the California process times.

I've heard that it will not have much affect at all, maybe only slowing the system by 2 weeks or so.

I think we should just sit back and wait for our NOA2's, however long it takes. No other choice, really. I can't be arsed speculating about this. I'm just grateful I have the option to bring my fiance to the US and will wait it out, no matter how long it takes.

There have only been 2 processing centers for a while now. (Petitions were forwarded to CSC from TSC and NSC) With the fee change they are now dividing the states a bit more evenly between the two that actually process I129f petitions, so, in theory CSC times will be shorter and VSC times will be longer. However, reality is what we're faced with and only time will tell what the true effect of all this will be! Sit back and try to relax. That's what I'm doing!

Yes, of course based on what we now know as the USCIS, my ideas are like Santa Claus. But nothing I mentioned is science fiction.

1. Why on God's green Earth, can't USCIS accpet electronic payment?

2. Have you ever bought concert tickets or movie tickets online? Bar code prints out like a charm and you go right to the show, the ticket taker scans it and away you go.

3. We are so accustomed to crappy, slow and de-humanizing bureaucratic treatment, but it needn't be so.

I never said your ideas were like science fiction, just unrealistic given that it IS USCIS that we are talking about! Don't get me wrong, I'd like things to be different/better, particularly since I did just file my I-129f and better systems would benefit me! In aswer to your points:

1. I have no idea, but I expect that its because they accept paper applications, not electronic ones and don't want the hassle of wrong credit card #s and rejected credit cards payments. Using merchant services costs big bucks, and frankly as a self-funded arm of the government, they likely can't afford it!

2. Yes, I have. So you're suggesting a ticket be printed and enclosed in the packet? Interesting, but again the merchant services processing fees, I suspect, are the biggestdeterrent for this option.

3. Another saying from my Dad, "There's the way we want things to be, and then there's the way that it is." Evolution in USCIS is extremely slow and we won't see it in out K1 processing, or even AOS. Maybe for the 10 yr greencard....but I can guarantee you I'm not holding my breath. I accept it as I have no other choice but to do so.
