No way around it with the K1. If you do K3 you'll have to spend thime apart after you are marrried to wait out the process, which, incidentally, often takes a bit longer than the K1.

Julezabelle.... I am scared, you just posted exactly what I was going to say, pretty much word for word. :blink:

Why ask questions at all if you are going to take the (accurate, but not what you want to hear) responses so badly and start with the 'actually, I'll have you know, blah blah blah' stuff? Believe it or not, the vast majority of people here would like to help and advise you on the options you have, but it makes it a bit hard to help if you're going to apparently take offence at anything that doesn't fit in with what you wanted to hear.

How's this:

Yes. Enter on your J-2 visa, get married, and adjust status from there. No issues at all. It'll be fine. No, really. It's definitely the way to go.

There, problem solved! Shame I just went for the 'telling you what you want to hear' approach, rather than basing my answer on any actual facts, but never mind...

Sorry. Maybe a little uncalled-for. But people aren't saying these things to be unhelpful, to spoil your plans, or to keep the two of you apart... really, they're not. The waiting that's involved in this process sucks, massively, no doubt about it - and there's not a person posting on here who doesn't want to make the waiting time as short as humanly possible. But there's only so much you can do to speed things up if you're going to do things properly...

Oh, and as for the J-2 visa... nobody's SAYING the visa was applied for with the intention of you using it to enter the US, marry, and immigrate... but in the scenario you suggest, you would be entering the US using your non-immigrant visa, with the intent of immigrating, no? And that's not what the visa's for...


Seriously feather, I am so sick of the "tell me what I wanna hear" people! We all try to be nice, helpful, but most importantly, realistic and in return get snotty, thanks but no thanks replies.

Getting back to her J2 topic, she will be coming here with intent to immigrate, which is a no-no. I have no use for people who want to cicumvent the system. NONE of us want to be away from our SO's BUT that is what we must do! Suck it up like the rest of us!

Regarding the proof of ties, in a word: none.

I can hear you all groaning and rolling your eyes - but just didn't know better and didn't expect that kind of reaction. Ignorance is costly, even if it isn't willful ignorance. Extenuating circumstances for us also included: we met because he was living in the US for an extended holiday. He had decided he wanted a career change and decided that it was best to go on holiday before beginning a new job. He had also split from his wife a year or so earlier. As part of the split, she bought him out of his share of their house. You see where this goes: he had no job, no house, and no wife (and has no children). He could have shown ample financial resources that might have assured them he wouldn't become a drain on public resources, but I challenge you to prove on paper that you love your family enough not to leave them forever or for a good long while if you aren't their parent or spouse. We were dead in the water before he even sat down in that interview room. We're "don't" poster children for those starting their immigration journey.

As for julezabelle's questions: if you've never violated the laws, and, as that woman at the airport probably had, a steady document showing that she did indeed come and go without violating any laws, then they would have little grounds to deny entry - not only from a legal standpoint, but a practice standpoint. That wouldn't stop some border agent from stopping her someday, but on what grounds? If she's come and gone for years, she probably has plenty of stuff to show ties to home and everything to show that she won't overstay. Why wouldn't she have done so already?

It's another example of why Catica probably doesn't have any problems to lose sleep over. Take some documents. Take that phone. Be reasonable with them - truthful and upfront but in a smart way - use the right vocabulary, avoid the danger words.

Julezabelle: I'm not sure I understand your question about requiring a waiver for the overstay - can you explain what you mean since there might be information out there I don't know about yet that relates to the K1 process. Thanks!



Thanks for the details Daisy!! I hear what you say about the coming and going and the established patter with no overstays. I just worry cos when my fiance came over last July after 8 months away he was given a hard time - POE wa the Peace bridge in Buffalo, NY - he flew into Toronto. He's been back since then via Philly w/o incident. He's never had an overstay either.

As for requiring a waiver - I know that others who have had overstays have needed waivers, or if you are denied another type visa or worked in the US illegally, you might need a waiver. I'm not sure what the rules are when the country is on VWP. What happens if a waiver is needed is that you'll be told at the interview time, so if you know its coming you can have the docs ready at the time of the interview to explain the overstay and why a waiver should be granted - that reallly expedites things. Sorry I don't know more - you might want to check out the waiver forum for better info.

I ask Daisy because I also have the fear that one of these days my guy will be turned away and we haven't yet filed. This whole thing is so stressful! (But still SO worth it!)

And don't beat yourself up for the turn back! How would you know? I didn't until I found this site!

I would love to know what prrof of ties they asked for and why they found it inadequate? Or was it solely because of the so-called overstay?

I also wonder if age makes a difference in their decisions? I met this Brit in the Philly airport who comes over on the VWP every other month, staying for a month at a time and has done so for years without incident (she stays with her fiance)- she was in her late 40's. I wonder if they think you're less likely to stay illegally if you're older?

One more for Tim'sDaisy - will you guys require a waiver for the overstay? I've heard mixed answers on this when the country involved is on the VWP.

You don't need to prove an ongoing relationship at this point in the process, only that you 2 have met in person in the past 2 years. What you have sounds fine. Phone bills and the like aren't needed until the interview.


Thingee is right - at this point you need only establish that you have indeed met in person within the last two years. The evidence that you have stated seems adequate. One point, you should copy all pages of your passport - even if there are blank pages. You will submit evidence of an ongoing relationship at the interview, including things such as emails and phone bills.

As for the employment history - put exactly what you have done. The amount of money you have earned will become more important at interview. If you do not meet 125% of the poverty guidelines you can get a co-sponsor, or if your fiance has enough assets he can self sponsor.

Tracy means that Vermont is typically faster for NOA2 so if you file NOW you might have the visa by June to get married according to your plans. She did not mean close as in go out of business!

I have taken everyone's advice and immediately began making phone calls.

I am somewhat devasted by my findings, but it is certainly better than the "not knowing". At least now I know that we need to start cancelling all the many wedding plans we have already completed.

Come find out my dumba** (can I say that on here) of a lawyer filed my I-129F petition at the National Benefits Center, which is where my paperwork still remains. We are applying for a K-1 visa since we are not yet married and in order to file at the National Benefits Center, you would need to be applying for a K-3/K-4 visa. Ours should have been filed at the Nebraska Service Center.

I then contacted my lawyer's office and they insisted that I was misinformed and the National Benefits Center indeed is the correct place to file my petition. For me not to worry. I even told them that on the USCIS website if you go into the processing dates for the National Benefits Center, it lists the I-129F petition for the K-3/K-4 visas only. No where does it list a K-1 visa. Once again, they assured me that it was filed correctly but she would have my lawyer return my call as soon as he is available. I was speaking to an assistant and I am still waiting on his phone call, although at this point, I have been so emotional over this, I'm not so sure I could compose myself well enough right now to speak to him.

Since I already had very little faith in my lawyer anyway, I then decided to call the NCSC back just to double check the original info I was given. Sure enough, I spoke to someone different and given the exact some info. He even looked into my case a little further. I then filed a claim with them to have my case transfered to the Nebraska Service Center where it should have been sent in the first place. I have no idea how long this will take. I now get to start all over! I have a claim number and if I do not hear anything from them within 45 days, I am to check back.

I have not yet spoken to my fiance about any of this because of our time differences, he's been asleep. I'm sure he is going to be just as disappointed and devasted as I have been. My suggestion to him is going to be for us to cancel everything and not reschedule the "big" wedding plans. When he finally does get to come to the USA, have a very small ceremony and call it a day. (Take a great honeymoon though)! I have a beautiful wedding dress and veil, decorations, bridesmaid dress, flowergirl dresses, not to mention our deposits with venders, etc etc etc. Sell what I can on ebay and what I can't, take the loss. I think I am about drained dry of tears and my feelings are now beginning to turn to anger. I'm sure this will pass soon and I just need a few stressfree days...sometime soon would be nice.

Thanks again to everyone. Although this has turned into a very chaotic day for me, at least now I know!

Wow Kym. That is so awful! Your poor file has been so unfortunately mishandled! First by the dumba$$ lawyer, then National Benefits Center just lets it stay there in limbo. UGH! You'd think they'd at least have sent it back to you or the lawyer if they had no plans to process it! I really feel for you guys. Hang in there.
