Although the case website hasn't been updated, my USPS delivery confirmation shows that our package was received yesterday.

Our response to the RFE is highly organized, while using a simple and concise style for increased accessibility by the readers. Lots of bullet points and bolded phrases to call things to their attention, and minimal use of text.

We included information from the trip in 05, proof of delivery of the previous application on Feb 1, 2007, and details from his current visit.

If nothing else, we have gotten ourselves organized for our appeal/reapplication...

Prayers and positive energy would be appreciated!!!

Thanks Yodrak. The meeting requirements in this case were cut fine and it appears that the NOA1 date is what counts for the meeting requirement. However, you cleverly edited ou the fact that I was only surmising in my original post. I never claimed to be preaching the USCIS gospel truth! With that said, thanks again for the clarification.

If the NOA1 date is what they use, then you lose by two weeks. Ugh. But I guess that date is what makes sense because it is the date that they acknowledge your petition was received. I've never seen where the postmarked date matters. It will be very interesting to see how this all plays out. Good luck!

Yes, you can send in the forms from the UK. She does not need to be in the US for this process to be a success. As long as you have a straight forward situaltion, there should be no need for an attorney.

can we get away with her not going back to the US till her visa is up?

Yes.

I forgot to add if your fiance does not have income, she will need to find someone to act as a co-sponsor for your visa. Unless you have enough funds of your own to self-sponsor. You need to have someone who make 125% of the 2007 Proverty level.

Do some research using the guides above and you will get thorugh this process with relative ease.

If you marry in the Phils, the K1 becomes null and void. The purpose of a K1 visa is to allow a foreign fiance to enter the US to marry his/her US fiance(e). If you marry before leaving the Phils you are no longer a fiance.

My only other advice would be to prepare yourself mentally for a very long wait. Its a tough process, with all the waiting.

I used only the space on the form, indicating where/when we first met and dates of subsequent visits to each other's country. Copies of our passport stamps, boarding passes, itineraries, photos, etc. substantiated the statment of our meeting in the last 2 years. It really does not need to be a major essay, otherwise they'd allocate more space on the form.

Its a combination of the fee increase coupled with some issues related H1B visas and renewals and AOS from H1B status, if I'm not mistaken. There was a big problem with those and USCIS ended up extending the deadline for these, which caused a huge influx of petitions. The guaranteed processing times for those types of petitons is much shorter, so they have priority over everything else, including our I129f petitions.

Your congress person willnot become involved until you are outside of the 6 month processing window. If you get beyond the 6 months without your NOA2 the inquiry will typically move your case along.

May as well pull up a chair and wait it out with the rest of us!

In reading your other thread, it sounds like your visa was approved but not issued. The six month ticker will begin once the visa is issued, so you will have even longer than until March 2008 before you actually have to use the visa to come to the US.

Once issued, the K1 visa is valid for 6 months. If you don't use it before 6 months, it will then expire. However, as long as you arrive in the US prior to the six months, the visa will still be valid and you will then have 90 days in which to marry your fiance.

AP = Administrative Processing, which is quite common for Casa. Its just a fancy way of saying that they are doing some more background checks on you.

I can't see why you'd need to keep it. You have been approved and have a visa. The copies are to ensure that if a question arises at the interview you are prepared with copies of everything in the original petition. Besides, you said your fiance has originals. Toss 'em!!!

I copied every page of both of our passports and where the stamps were I made notes that these was when I/he entered and when we left. Black & white copies are fine. If you do use passport copies, make sure to copy ALL pages of the passport to include in the packet. Passport stamps are really good evidence.

Yes, but the immigrations officers are trained to be suspicious. If they think she is going to stay they won't let her in, as happened last time she tried to visit you. The burden of proof is upon her to convince them of her strong ties to her home country, which they didn't believe last time. Its very unlikely they'll belive her this time.

Trust me, we all know how much is stinks to be apart. We all want to be able to wait out the visa journey together. But I really think if you look at this objectively, you will come to realize that her buying a plane ticket and flying to the US will be a waste of money and time.
