K-1 Fiance(e) Visa Process & ProceduresCanadian wants to stay in America - urgent
QUOTE (JenT @ Nov 26 2007, 02:13 PM) <{POST_SNAPBACK}>
Sorry Mods, but I'm with Becc on this one. I advocate diplomacy as much as the next person (well, ok, there are not many 'next people' on VJ) but there are a couple of members who continually jump on their holier than thou soapboxes with misinformation and accusations.... I don't see them being reprimanded and it's getting really, really old.

We are, for the most part, a blunt bunch here on VJ....

I agree Jen. Many people have pointed out to D&N that his responses are over the top rude, insulting, and accusatory but he pays no mind and continues posting in the same manner making no apologies for his rude posts. Maybe something a bit more "in your face" was warranted in this instance.

If you enter with intention of not leaving, you are committing fraud. Do you think we would all just be waiting for the process, apart, if it were legal to fraudulantly use a tourist visa for a purpose other than a round trip?

But she intends to leave and thus is not committing fraud. She clearly stated that she wants to stay in the US as long as she can while the I-129f and K1 is processing and will return to Canada for medical and interview. The scenario she described is not fraud.

She is merely asking questions to determine what she can and cannot do before she makes a decision, which seem perfectly reasonable and responsible.

I find it offensive for you to immediately jump to the conclusion that she is intending to commit fraud.

She will likely be subjected to extra scrutiny at interview time, but as Jen pointed out above, if she answers with confidence and truth and the interviewer believes her story, then it should be OK. Just make sure she is well prepared to handle some tougher questioning.

Best of luck to you!

Lawyers, Hell's gift to the world. Unless your case is extremely complicated with numerous problems, attorneys only make matters worse, do nothing to expedite things, and suck funds better spent on your future life together. This process requires immense patience. This journey is like a cross country trip on foot (bare foot, for some) not on a private Lear jet. You'll get there, be patient. yes.gif

With all due respect, Mel & Syl have been extremely patient! They filed in APRIL, responded to an RFE in early Oct and still have no NOA2. I just wanted to make you aware that there's just a bit more to this story!

Yes! He can send it from anywhere. It just requires an original signature, so it must be mailed!

Good luck Syl, now tell Mel to get moving!!!! Fingers crossed for you guys!!!

Syl, most lawyers, at least good ones, will give you an initial consultation for free or for a nominal fee. So, you could try it and see if they have any good advice without committing to any contract.

With that said, I really believe at this point your better course of action is to involve Mel's Congressman. He can do that for free and will likely have better results.

Remember if he's tried with one congressman, and they weren't helpful he another congressman and a state senator he can turn to for help. If you go to their websites they have the forms you need to complete in order for them to make an inquiry.

I sincerely wish you the best of luck. You have been waiting wayyyyy too long!

Thank you so much! I told Mel the same thing but he things that a lawer will be better. However i will try to prepare the letters for his congressmen and when he comes on Dec. 07 he will send them off. I am still praying to hear something befor then though.

He just needs to complete a standard form to get congess involved. And congess is way better than a lawyer. For real! Just tell Mel to get online to his congressman's website, download, complete and print the form. Then pop it in the mail. They have liasons whose jobs are to do case investigations and they have better connections to the service centers. Don't wait until Dec 7!!! Tell Mel to get off his duff and tae the 10 minutes it will require to complete this form! Time is a-waisting!! Its so simple even a man can do it!!!! laughing.gif laughing.gif

Regarding #2. HOw long does it take to get EAD card ? Is it between 3 months ?
Regarding#3. At the time of AP can he give reason of "Getting back to UK to finish of college",will that be good reason? or will they doubt that AP was pre planned ? b/c it is indeed pre planned to get back to Uk to get the degree and come back to USA again.

thanks for your help

If he's going to be out of the US for an extended period of time, you might be better just getting married and filing for the CR-1.

K-1 Fiance(e) Visa Process & ProceduresTracking Question
QUOTE (MasikAndKisya @ Dec 6 2007, 09:03 AM) <{POST_SNAPBACK}>
Hello VJ'ers,
Spending most of my time on this site as opposed to doing actual work at the office I came across a very interesting phone number post. I can't find it again. The post had this number: 202-663-1225 and stated that this number was given out by the NVC to track packages from the NVC to the Embassy. When I contacted the NVC to verify whether or not the packet had been sent to the Embassy I inquired about the number with the representative on the phone, they knew nothing about it. Given that it is usually the case that some representatives are more knowledgeable than others. I took the not-knowing with a grain of salt. Is anyone here familiar with that number? Furthermore, if you are, have you any idea how to use it for tracking purposes? Thanks in advance. And, Merry Christmas!!!

HAHA I can relate to your bolded statement above! Guilty as I type these words! blush.gif

Anyway...

The # you listed is for the US Department of State. You should choose Option 1, then 0 should you choose to call. They can tell you where your file is and things like whether packet 3 has been sent yet and if you're interview has been scheduled. I have only spoken to them once, but found the gentleman I spoke to, to be friendly and helpful!

K-1 Fiance(e) Visa Process & ProceduresTourist Visa while waiting
My fiance was denied a tourist visa while the I129f was in process. The embassy told him he was clearly an intending immigrant and therefore could not issue him a tourist visa. With that said, I have heard of a touris visa being approved once or twice for those with pending I-129f petitions.

K-1 Fiance(e) Visa Process & ProceduresUSC Visitng Me, Surprising outcome
I have actaully heard similar stories several times, including from a young lady I sat with on the plane to the UK last time I visited. So, I'm not really surprised at all. Like visiting the US, its a privilege to be allowed to visit the UK. They must feel confident that you don't intend to stay forever. So, its a good thing that she was prepared for questioning. may have taken a bit of time, but all's well that ends well! Enjoy your time together.

Just google "IRS transcripts", click the link and follow the directions. It will take just a few minutes.

Congrats on the approval!

The police clearance takes about 40 days to get, so you should get on that ASAP! You can return Packet 3 without having in hand it as you bring it with you to the interview, just bear in mind if you don't receive it before the interview, they will give you a conditional Visa approval, pending receipt of the clear police record.

Some would say not to send it back without the document in hand. I say you're an adult and can make that decision for yourself.

Good luck on the rest of your journey!!

While we waited for the NOA2, I was a ball of stress. Now that Packet 3 is about to be delivered to his door, he's the one stressing. We KNOW that we'll be together, and overall have dealt pretty well with the wait. Now that its nearly the end of the road, we're really getting excited!!!

K-1 Fiance(e) Visa Process & ProceduresNOA skipped NVC
Call the Dept. of State (DOS) as they know what they're talking about. I've never heard of a petiton bypassing NVC since that's where the consulate specific case #s are assigned.

DOS 202- 663- 1225 option 1, then option 0

Give them your EAC/WAC # and they can tell you if it has been processed through NVC.

Well julezabelle I think that sum up my suspicions - paperwork that was fine a few weeks/months back is now being RFE'd ... maybe!!!

It has always been thus. I have heard of this RFE a few times before this one. What is good for one adjudicator is not enough for another, but I suspect inexperience with what each country's documents look like plays a big role in the RFE requests.

I bet this is the new people processing cases and having never come across these before they don't know what to make of them.

I'd better ring the court house and get that letter ordered for my RFE.

Fun, eh?

R

When I sent in our petiton, the court had faxed the decree absolute to my fiance's solicitor, who then scanned it and emailed it to me. I printed it off and included it our I-129f packet and was approved just a few weeks ago. We did have an original sent to me in the meantime, just in case of an RFE.

K-1 Fiance(e) Visa Process & ProceduresQuestion RE Divorce Decree
I have heard of this problem with a UK Decree Absolute once before. That person asked the court to draft a letter stating that the Decree Absolute is an official document which does not bear a signature and attached it to an original copy of the decree absolute. It was on letterhead of the court and signed by a court clerk. That did satisfy USCIS.
