Instead of transferring so many files for past few days why don't they start approving them, haven't seen approval yesterday or today.

As i keep telling people since you don't know the details of this particular case you can't know if it was even supposed to be transferred. They're transferring I-130 for immediate relatives filed by USCs. This could be something else. All those reports about transfers do look like a trend to me.

 

 

you are right.. we just have to discover what kind of trend??? for the moment mine is not transferred yet..

Hi everyone! We just joined the forum after reading quite a bit here and getting a lot of helpful information from it. Thought we should share some of our infos.
We are March filers, PD March 4, and received the message today that our case was transferred to our local field office. So it looks like they are moving on to transferring cases filed in March.

Hi.. Ive seen a couple march filers who reported that they got transferred today

 

hi,  i can't say that's impossible but still no large transfers are occurring, which makes me believe that information needs to be validated and still not be generalized unless there is a massive "transferred" trend going on..

 

i keep track of a lot of cases direclty from uscis case status and see no transfer at the momenteb0dfafc.gif

current status is this: (please add information or correct me if i am wrong)

 

** FEB filers are being transferred to Local offices or other benefits centers

 

** MARCH filers 

                             A) those who are DCF or Expedites are being currently approved

                              B) rest are getting transferred to local offices. 

 

** APRIL filers   - still in limbo whether they will be transferred to LOCAL field offices or other                                      benefits centre is not known????

 

 

 

March filers are being processed for the moment at NBC, i see no march filers transferred at local offices, mine certainly not for now. And i believe it will be processed at NBC.

 

DFC or Expedites are no different than the rest regarding transfer in another center, especially the last one.

 

i keep track of many cases and i don't see any large transfer of March filers.

Just got the same notice as well, case transferred to local field office which is PHOENIX in my case:

 

On October 23, 2013, we transferred your I130, IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN, to your local USCIS Office for further processing. The new office has jurisdiction over your case and will send you a decision as soon as processing is complete or you will be notified if further information or action is needed. If you move, please use our Change of Address online tool to update your case with your new address.

 

 

 

it looks like all February filers are being transferred and March filers right now  are being processed at NBC ..

there were a couple approvals on Saturday the other week. ( 2 April filers)     That approval is for an I-130 but it could be for something other than a spouse.  Or maybe for someone who is here in the states already.  Not to take away your thunder.... Sorry.  You can't go by picking random case numbers... There are too many I-130 types out there.

 

it is for a spouse or orphan.. and i believe 99% it is a March 11th petition.

i will dare to do a calculation like this:

 

as per August 31, 2013, uscis is processing October 1, 2012. That means if you start counting it's 11 months from Oct 1, 2012 till August 31, 2013.

 

Now if we assume that today they are processing say March then from Oct 1 till March 1, it's like 5 months.

 

So, the next update will be effective as of September 30, in a month and the processing time may go: 11 - 5 = 6 months.

 

But today it's Oct 16, so it's like 2 more weeks from the next update of Sept 30, which means that on Sept 30 they will be processing February 2013. Not exactly March 1.

 

And October and November are our months, otherwise we may end up on this situation where we will have 8 months of waiting but the processing time they will show will be April, May or June: This situation: IMPORTANT: If your receipt notice date is earlier then the processing date shown, we suggest you call our USCIS Customer Service Office at 1-800-375-5283 for assistance.

Yes, they did update it although not completely.. it still is effective as of July 31.

So, maybe they are just going to keep that date unchanged from now on.

 

Now the processing it's at 11 months, imagine if that thing goes down to 6 months, what does that mean?

OK the national average processing time now stands to 11 months, this makes me think it may go to 9 months once other data are included (if they are included), because there is a lot of errors with their estimates... like the Vermont center is never updated on processing of i-130 for spouse of USC, 

 

as well as other service centers throughout the nation which i believe are not processing anymore i-130 for spouse of USC, same like Vermont one which has stopped on Oct. 22, 2012, and their processing is 0.

in short there is a lot of service centers with 0 processing that are included in the estimates.

 

they only increase or keep the processing time artificially high.

We didn't get married for my husband to be able to immigrate. We lived in his country for nearly 8 years together, 7 1/2 of those were while we were married. We have two children together and plan on trying for more. I don't understand why a fiance visa would be processed faster than a immediate relative one. It really makes no sense. The whole point of having the distinction between the IR and the CR is to lessen the amount of fraud that goes on. (At least, that's what they say.)  What I'm seeing now, is that if I hadn't married my husband, he would have been approved in under 90 days, but because we got married, we could be waiting nearly 2 years for him to finish the process and be able to come over. This is absolutely ridiculous.

 

With a fiancee visa you have to get married within 90 days of entering the US, if NOT, then a fiance visa is as good as a tourist visa which is approved within a week. Practically it grants you nothing. Both of them are classified as non-immigrant petitions visa categories.

 

A i-130 is an immigrant petition, and grants you a lot of things. No one is doubting the marriage of two people, but the two things are not the same. A tourist or a fiancee are not committed to immigrate in US, a marriage is not forced after you arrive in US, so that's why they are treated different. But according to the law we with an i-130 immigrant petition do intend to live in the US because we are committed through marriage to live together with our spouses, create a family wherever we are, especially when intending to live in US.

Ok, it is like 4 people going in a bank to open a bank account, they all get a number and wait in the line, then they go to the 3 service desks according to availability and the number they have got,  but that doesn't mean that everyone will finish according to the number they got, or spent the same amount of time at the desk. Number 2 can finish work before number 1.

 

In the Olympic games, every athlete gets a number, but that doesn't meant that number 1 will win the race.

 

This is how uscis works.

They even write in their form-797C this:   THIS NOTICE DOES NOT GRANT ANY IMMIGRATION STATUS OR BENEFIT.  because many people believed that if they got number 1, so they should be served first.  And i believe that they wrote this notice in form 797C because many people were believing that 797C was granting them something.

I believe that NBC is working, and there is no reason for them not to.

if anyone wanted to go so badly in the US, then they should not have been married to do that. If that was the goal, then they took the wrong road... there are shorter ways to do that.... apply for a K1 visa for example.. and do all the rest of the paper work in the US, while in the same time being with your fiancee.

 

for march filers a K3 is pointless, because what if you go to the US with a K3 non-immigrant petition and then your immigrant petition i-130 is not approved?

this makes the K3 in most cases not approved before the i-130, because they will wait for confirmation for i-130.

the K3 is for special cases, anyone can apply but not everyone gets it. It's like applying for a touristic visa, while you have an immigrant petition pending, that tourist visa is only approved if you can fulfill specific criteria, but anyone can apply, but not everyone gets it.

etc, etc.

 

at USCIS all paper works after are officially certified, are scanned and are added to your electronic file, no matter what for it is, i-130 or i-129f, marriage certificate, etc, they all go together..nothing is separated or taking dust somewhere.. it is a continuous process with procedures from the first day they receive it to the last, the starting point is the same for everyone (their PD), while the finishing line is different (their NOA2) because our situations are different, and the approval time is different.

 

Hope everyone gets approved very soon, and if u think USCIS complicates your life, at least don't complicate it yourself.no0pb.gif

The lawyer has no control over the USCIS and how fast they process....and anyone who hires a lawyer to get processed faster is barking up the wrong tree.  so the statement about him not delivering is silly.  he is doing what I hired him to do.

 

I didn't hire a lawyer in hopes to get better treatment,   I hired a lawyer because my case is NOT a straight forward case.  I wanted a professional to do my paperwork. I could have done the initial filing , but why if the price is the same flat fee?  And there is alot of preparation with the tail end of my case...Its much easier if he has everything  together. Plus, it is more paperwork if I add a lawyer later. 

 

The K-3 is free to file for anyone. If it is free, why WOULDN'T you file?

and not all petitions are free.... You had to pay the $420 for your I-130, just like everyone else

 

 Nobody is making a promise as far as processing times go... Everyone knows they are only posted estimates

so with that said, Doesn't it make sense to file a FREE petition that has an estimated 5 month processing time rather than sit back, relax and wait for a petition that is estimated at 16 months?  It makes sense to me....

 

all petitions are free to be completed by anyone, even i-130 was free for me, i didn't have to pay anyone. The 420 fee for i-130 is for the uscis processing service and for K3 there is no processing fee by uscis. i don't understand the services the lawyers provide, or it is very basic service.

as i read above even K3 have MSC#, if that's true...then how comes...

 

i won't file because i think in my case it is a waste of time same as sitting back and do nothing..

According to the 16 month estimate posted by the USCIS, I am nowhere near getting approved.  I am actually closer to being approved with a K-3 since their posted processing time for that is 5 months.  I can sit here and hope I get an approval soon until my heart falls out of my chest or I can file a K-3 and have 2 different avenues to follow.

 

Also, I was told that  the K-3 and I-130's are processed at different service centers.. so My K-3 does NOT impact the processing at the NBC. 

 

 

true, but every petition requires services from different agencies like for example for a i-130 nowadays they can perform over 20+ background checks ...

 

even if it is at a different service center, it still increases the workload of that center, and meanwhile it's not that they are staying at that service center and drinking coffee all day if they don't get any K3 petitions..

 

there is a process and every application enters that process that same day it is received, it's not that new petitions will delay old ones.. rather than themselves and who is coming next...

 

i believe that when they received mine at March 11, it has entered the process on that day and i will just wait for when my i-130 gets approved.. and go with the flow.. if we were delayed it is because of a lot of petitions being sent before and on that very same day as ours.
