March & April filers were transferred out of VSC, likely to TSC, so it's likely that they are approving a lot of cases that have been there for a while. A Tier 2 IO has access to your case and all the case documents. If you're not sure of how correct they are you can call again in a couple hours.

 

The electronic notification system is limited. The notifications are generic and will not contain any sensitive (confidential) case-related information. This is to ensure security as people's emails & phones can be compromised.

 

If you didn't receive an email, I would double check your account settings on the USCIS website, and your spam settings on the email account the mail is being sent to.

Yes, but this is not for Juarez. This is for the I-129F petition, and it is still the case. The consulate is not the USCIS. Things at the consulate do not need to be translated if they are in English OR the native language of the country. So, anything in Spanish there is fine.

 

 

OH! I thought they meant the paper they need to bring to the interview with the original signature! I heard that had to be in English or the native language, and some people had to get it translated (and certified) depending on how ####### the embassy/consulate is.

California seems to be cranking out some April filers, Texas is cranking out the filers that Vermont is transferring to them, and Vermont is still working on Jan/Feb filers.

 

I could be wrong, but that's the trend I've noticed.

 

You haven't made it to the 5 month mark, so don't start worrying yet. :)

It depends on the adjudicator. Some will send an RFE, some will deny you.

 

What you do entirely depends on your preference.

 

If you're going to wait for the RFE, I would make sure you take the time to gather all the necessary documents, pour over threads about the materials needed to submit, and get everything together.

 

If you're going to send it in I would recommend the following:

 

  1. Make copies of everything, you don't need to send any originals in, aside from the documents that require signatures. Everything else can be a copy (just make sure the copies of gov't documents show the raised seal) -- you'll need to provide originals at the embassy interview.
  2. Wait until you know where your case was transferred to. Just because the Jan/Feb filers were transferred to TSC doesn't mean you were. If you send to the wrong Service Center there's a possibility it'll get lost in the shuffle.
  3. Put your receipt number at the top of every single paper, picture, document, etc. This will ensure that it goes to the adjudicator assigned to it.
  4. Write a brief concise letter explaining that you didn't understand the process and these are the documents that you should've provided which you didn't. Keep it short & simple. The adjudicators don't need your life story. smile.png

Don't freak out about a denial. You can appeal a denial, and you can always re-apply with everything done right. The wait will suck, sure... but it's just a delay when you will have a lifetime together. smile.png

Ok. I guess I should be receiving that in the mail soon? Online it said on July 10, yesterday, that it was sent to my local USCIS..

 

You'll get a paper in the mail telling you where your case was transferred to within a week. I would go through and get together everything you need, check all the threads, etc. Make sure you have everything. :)

 

The "local USCIS office" thing is bull. That's just a generic case transfer message and not correct. Local offices do not process I-129F petitions. Vermont, Texas (which is new), & Cali do.

Just my two cents of watching threads and pouring over everything I find on the K1 Process.

 

  1. You won't get denied unless they find something in the Background Check, your petition wasn't signed, your payment wasn't included or couldn't be processed, or you have a permanent BAN that supersedes the K1 visa authority.
  2. Your case has been transferred from the Vermont Service Center (VSC) to either the Texas Service Center (TSC) or the California Service Center (CSC), these are the only offices that handle I-129F petitions, the email contained a generic notification. You don't know for sure until you get that transfer notice. I wouldn't send anything along until you have that in hand and you know exactly where you case is.
  3. You'll most likely get a Request for Evidence (RFE) a week or two after your case is transferred, when you do they'll have an itemized list with detailed instructions on how to respond. Follow these instructions and read up on VJ on how to respond. If you don't send enough information you'll either get a second RFE or a denial. The denial will most likely take place if you fail to provide proof of meeting the primary requirements such as Passport Stamps, Boarding passes, photos, etc.
  4. No need to freak out. If push comes to shove you simply re-apply again. The waiting time sucks since you'll be shuffled to the back of the line again, but it's not a permanent "no".

My personal recommendation is wait for your RFE. You'll most likely get one, so respond to it with all the information and documents they need. Don't worry about getting a denial, sending in the documents now will likely slow things down as they'll be in the system once received and then the adjudicator will have to wait for them to be forwarded and go through a pre-processing before getting to him. With an RFE you'll be sending them much more directly to him.

Hi...its been a long time waiting and on july 3, 2012 i get an RFE...just my luck.

 

so, i got the hard copy finally today, july 11, and it was so vague what they want that im very confused what to send...The RFE states that i did not submit proof that we have met in the last 2 years, but i did submit pictures with dates and names on them and my airline boarding passes, passport stamps, and hotel receipt...when i called USCIS today about this, the customer service rep told me MAYBE submit affadavits from people who know we were there in UAE meeting  and also she suggested possibly showing his plane boarding passes(as he had a pakistan address until june 2012 and we met in march 2012) and passport stamps...

Just so vague what they want sent in...

she also suggested that maybe we are trying to commit fraud, which we are NOT doing...

 

any advice??

 

Customer Service Reps are completely useless. They give bad information all the time. You need to call and ask to speak to a "Tier 2 Immigration Officer". They will be able to give you more detail and information.

 

What will help us guide you along is if you posted the evidence you provided already, and exactly what the RFE stated you need to provide.

Have you contacted a Tier 2 Immigration Officer? Many of the Tier 1 Immigration Officers (the first people you talk to when you call the customer service line) are parroting from a script and cannot tell you anything that you, yourself can't find out by checking your case status or on the USCIS website. If you want to get a hold of someone who can see your case you need to ask to be transferred to a Tier 2 Immigration Officer. There will be about a 2 hour wait once they transfer you but you can sign up for the call back service and they'll call you back without losing your place in line, if you are calling from the US or have a US phone number. Otherwise you'll have to wait on the line.
 
You can check your case status by entering your receipt number (found on your NoA1) here (for Vermont it will start with "EAC"). You can check to see when your case was last touched by signing up here. Once you're logged in there will be a "last updated" date, which will tell you when your case was last handled.

I just got in contact with a representative and she told me that the case was originally at the Vermont Service center and that at the en of the hard copy should say where it has been tranferred to, which she said would be Newark given that it is the local office of New Jersey, where I live.

Now that makes a lot more sense to me. I also asked her since we filed in April 5th how long would they take to finish the process and she said "about two more months". I know this is not too accurate though...

 

Local offices do not process I-129F petitions. You will most likely be transferred to the Texas Service Center (TSC) (as the previous Vermont Service Center (VSC) filers who were transferred) or to the California Service Center (CSC).

Once you call them and get on the phone with a customer service rep you need to ask to speak with a "Tier 2 Immigration Officer". The customer service reps don't know what is going on and won't be able to tell you anything. A tier 2 IO has access to your case and can look up what is going on. 

 

You should get a hard copy letter within 7 days telling you where you got the transfer. I got my "hard copies" 2 days after I got electronic notification. I haven't gotten the hard copy for my transfer yet.

I just called to check where they have transferred my case and it was actually to Vermont! I am so excited right now! dancin5hr.gif  So when you call in the automated service tells exactly where the transfer has been to.

 

My service center is originally Vermont and I also got the transfer notification -- so I'm not sure how much this makes sense.

Make sure you talk to a Tier 2 immigration officer, the customer service reps that you initially talk to can't see anything more than what you can when you look up your case status online. They will be absolutely no help to you whatsoever and often give you incorrect information.

That is a notification that the service center your file was it (which appears to be Vermont for these transfers) is behind schedule, so they're transferring your case (and many others) to a different service center for prompt processing to avoid getting further backlogged. 

 

This is a good thing, from what I've been reading typically you'll hear back with an RFE or NoA2 within 4-6 weeks of your transfer. You'll get an electronic notification in about a week that the Service Center your case was transferred to has received your case and is currently processing your petition. Once someone has touched your file (after the whole initial transfer mumbo jumbo) you should have a decision or RFE within a week or two. 

 

I would expect to at least see your file touched within a month of the new Service center getting your file. :)

Your petition was likely transferred to the Texas or California Service centers because the Vermont Service center is backlogged and they don't want your petition to take longer than 5 months. This is a good thing, try to read through threads more.

 

You'll get 3 emails. First email states that your case is being transferred and they're notifying you. Second is when they actually send the case over, and the 3rd you'll get a week later and it'll be to notify you that the service center picking up your case has received it and will start processing it when they get to your case in the queue.

 

You can log in and check your "last updated" date to see when your file was last touched -- this will tell you (after the transfer is complete) when an adjudicator is poking about your file.

We were NAO1 of Feb 15th, and received the I-797C, notice of transfer to Texas dated June 21st.

 

It's about 19 days past that and no approval or RFE so the poster who said you'd get approval in a week or so does not seem to be correct.

 

A few weeks more and we're in the estimated range anyway.

 

Depends on how straight forward your case is, whether you're from a high risk fraud country, how well your petition is put together, among other factors.

 

Keep in mind every case is different and what works for one may not work for another. I have been hearing that you'll get an NoA2 or RFE within 4-6 weeks of being transferred. Many have been getting NoA2's back in 3 weeks. :)

Tier 1 Immigration Officers (the first people you talk to when you call the customer service line) often feed people misinformation.

 

They don't know anything that you... yourself, cannot find by checking your case status and searching the USCIS website.

 

If you want REAL information or action on your case you'll need to speak to a Tier 2 immigration officer.

 

If you have a US number for them to call (such as by using Magic Jack if you're the beneficiary ) you can opt into the call back, they will call you back, you won't lose your place in line, and you can go on with your day. 

 

You can also sign up for an infopass appointment, they may be able to help answer your questions and concerns, if a Tier 2 Officer doesn't help.

 

Just an FYI on the Tier 2 Officers, I've been told they can be very rude, so please remember to keep a cool head and be polite. They are busy people stretched very thin, and their time is valuable. When I called the man was curt at first but then he was very polite and helpful once he realized I wasn't going to be aggressive.

Was looking at a fellow July filer that got their NOA1 today and at the bottom of their timeline, it said: "Based on timeline data, your I129f may be adjudicated between December 24, 2013 and December 31, 2013*."...
 
By adjudicated --- what "step" in the timeline does this go up to and include? Do they mean visa granted and beneficiary is able to travel to POE?

 
Adjudicated means you've gotten from "Initial Review" to "Decision". This means your approval or denial.
 
Somone correct me if I'm wrong, but typically the timeline goes much like this:


  • Send Petition
  • Receive Electronic Notification of acceptance [Typically within 24-48 hours of your file being delivered to the drop box -- varies on postal delivery]
  • Receive NoA1 [Typically within 1-2 Weeks]
  • Wait...
  • Wait some more...
  • Keep waiting...
  • Wait some more... & when you're ready to tear your hair out or go stalk the USCIS office closest to you....
  • IF APPLICABLE
    • Electronic Notification of Transfer (email 1)
    • Electronic Notification of File being mail (email 2) [Typically within hours of email 1]
    • Receive NoA-T (Notice of Action Transfer) [Typically 1-2 weeks from email 1]
    • Electronic Notification of file received at new Service Center. [Typically 1-2 weeks]
  • RFE / Decision [Varies, but the Federal goal is 5 months, check processing times for your center -- note these do change too]
  • Electronic Notification of your file being sent to NVC [typically 1-2 weeks]
  • Stalk NVC for Case number [2-6 weeks, used to be typically 2 weeks, recently they seem to be slow -- may change]
  • NVC Forwards your case to the Beneficiary's Embassy/Consulate [typically 2 week]
  • Embassy sends packet 3 [typically within a week of file being transferred]
  • Mail back completed Packet 3 [Depends on you]
  • Embassy sends packet 4 & Interview is scheduled [typically within 1-2 weeks of receiving packet 3]
  • Interview [Varies... depends on consulate/embassy, I would recommend checking your country's reviews to find out]
  • Visa is issued / Denial reason given / RFE
  • If Visa is issued, Visa is available for pickup/mailed [Typically within 2 weeks, but varies on embassy/consulate]

Gosh, I really hate the waiting. I know it's only been 5 days but it makes me stalk these forms like crazy and I read and re-read things and then psych myself out...
 
Hoping someone can put me at ease about something...
 
Regarding Form I-134 (Financial Support Affadavit)
 
On my form, I indicated that I have annual wages of $30,500. I have a life insurance policy for $130,000.
 
I see the Federal Poverty minimum is $27,570 for a household of 5 (Myself, three kids and fiance). If I look only at these numbers, am I assume that we won't have any issues here? Will it matter to the CO that my fiance will be moving to the US with about $10,000 of his own money that he has saved up?







I don't think his savings matters as much as yours do, but I could be mistaken.

 

Regarding the I-134, as long as you meet the minimum income requirements for your household, which includes you, any of your dependents, and the beneficiary, I don't believe you'll have any issues.

 

You have to make 100% the federal poverty guidelines.

 

However when you're doing the AoS you'll need to make 125% the poverty guideline, and if you're below that you can supplement it with assets, such as savings, bonds, etc, but it must be 3x the amount of the difference.

 

Best to find out from a Seasoned VJ'er I know a little but I haven't gotten that far in the process. I haven't even gotten my NoA2 yet. :c

Okay, I do have a question, two actually...

In my I-129F packet, I included the form G-1145, E-Notification of Application/Petition Acceptance. I'm only reading now that I should've clipped it on the first page of my immigration form. I'm fairly certain I overlooked that and put it at the back of the packet.

 

1) Has anyone else done the same thing and still gotten an email and/or text?

2) What email or # did the notification come from? I want to add it to my safe-senders list so it doesnt filter the email into my junk/spam folder.

 

As soon as you get your NoA1 and you have your receipt number, you can:

  • sign up for electronic case updates on the USCIS website here.
  • check your case status on the USCIS website here.
  • change your address on the USCIS website here.

There's also the K1 Guide,the K1 flowchart and the K1 tips, which are super helpful.

If you're more like me and want to know ALL the facts you can I would recommend reading this Q&A with a former USCIS adjudicator. :)

 

Also, if you haven't already... don't forget to fill out your timeline! This helps keep the estimated dates people see more accurate and helps people who are answering your questions know where you are in the process!

This is the new standard protocol, you get assigned one once your file gets to the assigned service center.

 

If your fiance is approved for the visa that number will be on his visa paperwork. When you get a second Notice of Action you'll find out what the ARN is.

They tend to transfer cases in batches, so yours was not in the box (or batch) that they transferred, Either you were outside the date ranges they specified, you were already assigned an IO, or they're just randomly picking boxes and haven't gotten to you yet. I wouldn't worry because once a transfer occurs there's a lot of approvals shortly thereafter for both service centers. :P

I would guess you didn't get transferred because someone either has already been working on your file, or you're one of the few batches that have already been assigned an IO when was the last time your file was touched?
