To be honest all i have been doing so far is downloading DS forms and checked where medical was going to be, found a place to get US passport done. It's not too far from where the medical is going to be done. Ordered my 18 year olds birth certificate. Even though she will not be coming with me just yet they want birth cert of all children. My sons is already a American citizen I gave birth to him last year 2012 so he is good to go with no probs. the dilemma right now is my 18 year old who is going to stay as she is going to university in October to study chemical engineering. It's a 4 year programme so am going to have to phone uk embassy tomorrow to find out if I can still get a k2 visa for her even though she won't be using it right now or if I should just wait to adjust status. I understand k2 is only good for 1 year so kind of weary about that. She will be 21 in 3 years time. I would like her to come join me when she finishes her engineering degree. But the timings a little short before she reaches 21. Am trying to find a solution to this problem. Any ideas about this area of things? Or do I need to call them up and ask them questions.

I don't know much about K2 visas, but if push comes to shove after she graduates, if she wants to immigrate to the US you could always apply for the I-130 for her. The process is a bit longer, but you could always apply for one on her 3rd year at Uni. smile.png Until then she can always come visit for holidays and summer break on the VWP.

They can also be waiting for the background check. Depending on the country, the background checks can take up to 2 weeks to come back. Especially if they have to go through physical files to compose it.

They might post some of the approvals that didn't go up yet, but it won't be "new" approvals, it'll just be approvals that haven't gone into the system because of their issues lately.

 

 think it's mainly fixing the issues and getting the data right.

But would it at least give a message saying your case status is unavailable pls contact uscis. At least that's what I saw for some cases right before it changed to a approval or a rfe?

 

In some cases.

 

In others it's still stuck at "Initial Review"; I remember one person said their case status still said "Initial Review" and they already came here on their K1, got married and filed for their AoS!

I haven't noticed a change for any K-1 petitions around my number. It is great to see others in May are being approved, though..Hoping for the best!

 

 

 

USCIS has been having issues with their notification service. Some people who are signed up never get notified and their case status still shows as "Initial Review" after they get a physical NoA2 approval in the snail mail. So don't rely wholly on that case status and electronic notification! It's (unfortunately) rather unreliable.

Also to add to the "last update" date you'll sometimes get an email (if you're signed up) and there will be no milestone activity -- this means there was case activity that may not have lead to anything, but it's a good indicator that someone's poking around in your case, and MIGHT indicate a decision is following shortly thereafter (or an RFE), if you didn't make any actions to prompt the activity.

The USCIS will often send out an RFE on the first run-through of the case if there is something amiss, like missing paperwork, or missing signatures. This is not uncommon within the first month of applying, and it does not mean they're approving the petition, it simply means that someone didn't fill the paperwork out fully, and they can't continue putting it in the system until they do.

 

Also occasionally people will expedite their K1 (Military personnel, Medical emergencies, etc) and those cases will often be processed in less than 3 months -- you only filed in May, and while the waiting sucks I wouldn't expect to hear much until 5 months out. Right now I'm seeing January and February filers getting approved, as well as a couple early March filers, depending on the service center. 

 

You can see when your case was last touched, if you go to the USCIS website, check your case status and "sign up for an account". When you log in you'll see an "updated" date, which is the last time someone touched your file -- this will mean that an immigration officer was actually looking at your petition.

The petitioner will have to fill out the I-134 and send their supporting financial evidence, the co-sponsor will have to do the same. They will want evidence that between the petitioner and the co-sponsor that you meet the income requirements.

 

The co-sponsor has to make enough for his own current household (himself, spouse/significant other - if applicable, children - if applicable, dependent adults - if applicable), and the petitioner's household (petitioner, fiance, any dependent children - if applicable, any dependent adults - if applicable). So, for example, the co-sponsor has is married, with one child and a disabled parent whom lives with them, their household would be four. Say its you and just your fiance(e), then their household size would be 6, and they need to make enough money to support 6 people.

Hi :) thought I would start a topic for those that filed in February and is sitting at TSC. It was getting a bit depressing reading all of the CSC filers getting their NOA2 while ours still sits. I just got back a few days ago from being with my fiancé in England for a week and a half. Was hoping to get our NOA2 before leaving but no luck lol. I've stopped checking the USCIS website as it will probably be a few more months yet before I hear anything. We were hoping for an October wedding but now I'm thinking we may have to change that.

I finally was able to speak to a T2 officer today, and I don't think I've ever been spoken to like that in my life. My NOA1 is March 1, transfer to TSC on 7/10. So technically I am a few days under the 5 month estimate, but with all these approvals left and right for other transfers, many of which aren't updating to the USCIS website I just wanted to check on mine. It's a simple inquiry and I was extremely polite. She literally yelled at me for calling, essentially yelled at me for even applying for a K1 visa. I'm just shocked. 

 

That is ridiculous. I would've demanded to get her Employee ID (they're required to give it at the beginning) and make sure you always ask them to tell you slower so you can write it down. Then if someone does this again, you can report them. For now give them the time of your call, the number you called from and your RN. They should be able to track the person down in the database and listen to the recorded call. They'll likely end up fired.

I have never had that issue. I give them my receipt number and information so they can pull up my file (they have to enter the call into the database on their end), then I tell them I have case-specific questions and ask to be transferred to a tier 2 immigration officer -- they transfer all the case details to them via computer service, including receipt number, so the T2 IO doesn't have to ask the same questions. If they offer you a call back in 3-5 business days or the opportunity to wait, tell them you'd rather wait.

 

Then I opt into the "automated call back" typically you get a call back in the time they specify your wait will be. You won't lose your place in line, they'll just call you back right before you're transferred to a T2 IO.

I spoke with a Tier 2 Rep who was very polite (seemed slightly condescending, since she was talking really slow, but I don't think it was intentional).

 

Basically she said that once you're approved, TSC actually ships your case BACK to VSC, who has the basic post-processing to do, who THEN ships your case to NVC.

From my understanding she says TSC has been a little off on shipping them back immediately, and tries to ship a group of approvals together, which is why things take so long.

Then VSC will update your online status, since technically they have jurisdiction, and not TSC.

You have to be persistent-and let them know you still wish to speak to an officer and that you have waited the normal processing time--blah blah blah--eventually they will transfer you.

 

The tier 2 officers can actually see your case--if it werent for me even speaking to one I would still think to this day my file was still being reviewed since it never updated--the front rep cant see your approval.

 

I never had to persistent. I just had to ask once they got my receipt number and necessary info to put into the database that I wanted to be transferred, and told them I'd wait, and I opted into the "automated call back" when my place in line was coming up.

Prepare for Packet 3, the Medical & the interview now while you wait.

 

You can get packet 3 for Manila here and for New Dheli their K1 page contains the list of what you need. You'll likely need to bring/ship the USC's certificates with you (birth/death/divorce) as well as a fresh new original of the Intent to Marry (sign in blue ink on a magazine so the imprint is visible).

 

Go through the interview questions with your partner. They're going to ask about previous relationship, finances (where he/she works, how much do they make, do the rent/own, etc), Family (where does his/her parents live, does he/she have any siblings, etc).

 

Start buying the necessities and prepare the house for their arrival in the US. The more you prepare now, the faster things will go for you. smile.png

Thank you for providing me with this. 

I just got a case number from NVC and they said that the file was prepared and will be shipped to consultate soon. 

I tried to sign on to the Invoice Paymet Center and its asking for the NVC case Number and an Invoice Identificaiton Number. 

 

Will my NWDXXXXXXXXX be the NVC case number and if yes, then what is the Invoice Identificaiton Number?

 

 

 

 

No idea! Call and ask? I could be mistaken on how to track that, I haven't even gotten my NVC case number yet!

Hello All VJ Members, 

 

I just got approved NOA 2 in the mail and three days later i get an email that my approved case was shipped to the Department of State for visa processing.

 

Now that my case seems to get getting some traction, I have a few questions in order to better prepare myself for the next steps.

 

1.    Case shipped to Department of State: What does this mean? Is the case at NVC or with the consulate office for visa processing in India.

 

2.    What documents do I need next? I keep hearing about a packet 3 but don?t know what goes in it.

 

3.    I read that I need to provide my fiancé an Affidavit of Support and Employment Letter. Will I need to mail her the hard copy of this or can I just email her this. I suppose that email should work, but just wanted to ask the fellow members.

 

Please let me know if I am missing something here. I hope that the process from here on out is smoother that what it was so far.

Viewing the visa guide will help you prepare. As well as the India portal will contain some valuable embassy specific information for you.

 

1. NVC is the Department of State, once it goes to NVC USCIS stops tracking it. You'll need to get your case number from NVC (start calling) which you can then track online via the NVC website (I'm not sure how yet but I believe it's by logging into the Invoice Payment Center).

2. You can view the necessary documents at India's US Embassy website.

3. If I recall correctly, you'll need to mail him/her the hard copy. You'll need the hard copy of any certificates (birth/death/divorce) of the USC, as well as affidavit of support with your real signature (sign on a magazine so the imprint shows in blue ink!), and a copy of your I-129F so he/she can sign the papers on his/her end to bring to the interview. However each consulate/embassy is different so you really need to look at your embassy/consulate portal and read the reviews as well as the information that's already gathered there. That will help you the most.

As far as I am aware, It doesn't need to be notarized but since you got an RFE for it you could always get it notarized so they can't say it's not the "real signature" a lot of times they just think it's a photocopy.

as a web developer then, you should realize that the uscis and nvc use antiquated systems that don't talk to each other

the inaccessibility of case files on uscis site is not new

 

A database is still a database. How they function is still essentially the same from 10 years ago, they just hold more data and respond faster. I didn't code their website, so I wouldn't be able to accurately judge how their database/website structure is set up. I wouldn't be one to presume such a thing, because with how massive the system is, and how intricate it could very well be, there could be very many contributing factors that could cause issues.

 

If for any reason, one case is not accessible and another case is via the same method, than it's an issue with the data, not with the method. Otherwise everyone would have the same issue.

 

Considering the form itself posts the Receipt number to the database via a query of some sort (possibly a stored procedure), I would guess they look up directly by that, which means if they can't see the RN in the database, or the case has been marked as "inactive" somehow (or for whatever reason).

 

Depending on how they handle antiquated data, that the case may have accidentally been marked as inactive or removed from the database (those pesky foreign keys cause issues like this all the time to an unbeknownst newbie developer). This can also happen when you do a data dump for an update and it doesn't complete (happened to me a few times because the server hiccuped). The issue is that they're likely not sure how to roll the data back without rolling back previous approvals so if I would have to guess, they have someone going in and manually correcting all the data integrity issues.

If that's what the IO said, then as a web developer, I would say, in all likelihood something got overwritten in their database and they haven't figured out how to roll it back or restore it without losing all the data. 

 

Give it some time and someone will manually enter it in again. None of the approvals/denials from TSC got posted today, as far as I can tell, either.

Your case was removed from the database for some reason, your best bet is to call the USCIS Customer Service line and speak with a Tier 2 IO. It could be a glitch, it could be a mistake, or maybe something else happened.

 

Either way you or your fiance(e) needs to call asap, that's the only way to know for sure, and everything else is just speculation.
