I was looking for this thread. I am technically an April filer, but I was following and commenting in this thread more. We've been approved and he entered the US this past sunday! We'll be getting married on the weekend of Sept 20th. :)

I can imagine am sorry to hear you have not seen each other for so long. I feel the letter of employment should suffice pending they don't go checking.
What field of work are you in? Are jobs in that field easy to come by?
I do pray you find something soon. I will be keeping my fingers crossed for you guys.

 

Argentina is not exactly a high fraud country. I don't think they will. I planned on sending along an updated I-134 for myself as well as my mother who's willing to co-sponsor.

 

I'm a web developer, I can always work for myself. I typically can bring in between 300-500 a week once I have some steady clients. Jobs are fairly easy to come by, once you have experience. I have about 4 years, so I'm still a "Junior" developer, but I'm not an "entry level" developer.

Wow I thought you had already got visa sorted and were done with the k1. Glad to see you back here. I am sorry to hear about your job. But surely they will go by the fact that you had a job before the application. Do you have a letter from your last employer already written cos if you do that should be ok. You may have to get into another job pronto for AOS though.

 

Nope, I wish I did! It's been over a year since I've seen him in person and it's killing me.

 

I hope they do... I had that job for 3 1/2 years. Yes, I had a letter from my employer, which I sent to him which was signed in September. I planned on getting a job asap. I don't particularly want to be unemployed.

Still alive & waiting here.

 

My fiance's been fighting with getting paperwork together. A lot of offices shut down because of heat and power crisis issues in December & January.

 

I am a bit nervous, because he just sent off packet 3 yesterday and I got laid off today.

 

I don't know how that will effect things.

His mother lost his bc and didn't tell him until he went looking for it. LOL

I see your almost there. That's good. Start checking for cheap tickets for flight. I managed to get one for Boxing Day december really cheap. Better to buy in advance. Yes hopefully London will catch up maybe this week coming a interview date.

 

I was planning on booking his flight once we knew he passed the interview a few weeks in advance. The prices are pretty much the same so long as you book 3 weeks out. :) The flights still cost about $1k either way, which I can save up most of that in about a month or so, it's just a matter of putting the money away.

How you getting on with things so far?

This stupid backlog is affecting the embassy interview times as well. Still waiting on interview date. Hopefully this week coming I get a letter from them.

 

 

I got packet 3 in an email (which I forwarded to him) & they mailed a copy that same day him (dates in my signature), my fiance just got the papers I sent him today in the mail, and his medical is Monday. He's waiting for his birth certificate to come in the mail, it takes about 25 days to process, and he filed for it 2 weeks ago. While he's out for his medical he's going to go get his police certificate, which should take about a week. Once he has his Birth & Police certificate he'll send in packet 3. Then it'll probably be a couple weeks until his interview. There are not a lot of cases going to the Buenos Aires embassy for visa. There were only 6 on the day that mine was shipped, but it averages 5-10 Visas a day, so they process them faster than they receive them.

 

Hang in there though, the backlog probably isn't too bad for the UK. They'll catch up ASAP. This just gives you more time to prepare for your love's arrival. Getting stuff in the house they'll need. I don't even have the money for my fiance's flight yet -- I ended up having to spend my savings on a new head gasket job for my car. :C

MNL is the Embassy/Consulate Code, it is different depending on the country your beneficiary is at. Mine is BNS for Buenos Aires, MNL is for Manilla.

just curious, is anyone here get the same notification skipping the DECISION part of the process? and just go directly to post decision activity?i know its says approve but does it mean they are sending our approve petition to nvc already?

 

To add to what Nursling said, try and download packet 3, if available at your fiance(e)'s country's embassy website, so you know what you send to your fiance(e) for the interview.

 

Typically you should send:

  1. Signed Fiance(e) letter of intent with a new date (original)
  2. Affidavit of Support with original signature
  3. Copy of 2012 Tax Return or Tax transcripts
  4. Copy of W2
  5. Letter from Employer
  6. Copy of your last 4 paystubs
  7. Evidence of ongoing relationship (phone logs, text logs, Instant Messenger logs, proof of you going back there to visit them, etc etc)
  8. Certified copies of: Birth Certificate, Death Certificate of Deceased Spouse (if applicable), Divorce Decree (if applicable), and any other official documents they may require.

 

What I recommend also sending along:

  1. Statements from friends/family/co-workers stating that your relationship is genuine and why they support it, etc.
  2. Copy of your entire I-129F petition with original signatures where the USC needs to sign, and the original date you signed it on.

I believe it's 2 or 3 in our case, as my background(the beneficiary) is in Sweden and UK -thereby unlikely to be hard to track.

The lack of "touches" on our case since we got the Alien Registration Number was getting quite frustrating and we were not sure what to ask in order to get to talk to a TIer 2.

You would have to call the USCIS Customer Service number, and once you get a hold of a Tier 1 IO, give them all the information they need to pull up your record. They need this information to transfer you to a Tier 2 IO.

 

From there once they have your information, you can ask them to transfer you to a Tier 2 IO, and state is case-specific related inquiries. Once you have a Tier 2, I would recommend you ask them more than just about what's going on with your case and why you're not approved yet. Write a list of questions, and try to get as many answers as you can from them. I have heard from many users that the IOs can be quite rude, so do your best to remain polite despite their tone towards you if they get nasty. Remember that they're people too and they're just massively overloaded and overworked, due to a bad system. Their time is valuable so be as clear and concise as you can be, and try to keep it short without missing anything.

Here my obsessive personality will shine through but...

 

Looked up some WAC's around my number, our ARN May 21.

 

There's 3 in front of us that are in process, same last touch for ARN (May 21), the last approved one before us was July 31.

 

3 after us also under initial review with ARN May 21 before one approved on August 6.

 

Then another ARN May 21, next one Changed address June 20, next RFE August 8, next two initial review May 21, followed by an RFE August 5,

next a post office return as undeliverable on June 12, next an August 19 approval, followed by another May 21 ARN, next an RFE August 9, another ARN May 21,

followed by an July 31 approval, an August 5 RFE,next a May 23 ARN, August 20 RFE, August 28 approval,

 

next another May 21 ARN(this being 150 numbers behind us, keep in mind that they're intermingled with other cases too tho)

 

Do apologize for the messy paragraphs, felt single lines would be slightly overdoing it tho.

 

It seems very random?

 

Petitions are grouped in a box, the grouping appears to be based on petition number range. If there are cases being worked on around your case number, it could mean one of several things:

 

  1. They're waiting for background checks - the beneficiary's background check can take a while to come back if they're from a country which has yet to digitize all the records.
  2. They haven't picked your case out of the box yet, they don't go in order, they just grab a case.
  3. The electronic system hasn't been updated for you yet -- you can call and speak with a Tier 2 IO to get an update on your petition. The Tier 1 IO's only can see what you see.

If you've created an account with them, you will be able to see when your case was last "touched", this will give you an idea if you have had anyone working on your case recently. I didn't get ANY updates with the cases around mine for weeks and then I got notice I was approved 3 days after I was actually approved. In some cases people get their NoA2 in the mail or told over the phone by a T2 IO and no electronic notification at all! I wouldn't rely too heavily on that system. smile.png

So the EAC number directly after me has been approved as well, so i feel skipped.

 

Feeling very low right now sad.png  Feel impatient, still well within the guidelines, only really just been over 3 months.  I wouldn't say I am from a high risk country, gave evidence that we lived together for nearly 5 months last year.  She stayed with me.  This site is a blessing and a curse at the same time lol.  But congratulations on all those that have gotten their approvals.

 

I guess I should just appreciate that I am in love.

 

They might just be waiting on the results of your background check. Don't fret too much, you'll likely see something in a couple days if you're getting approvals all around. :)

I still feel they sent all the transferred files to NRC instead of NVC that's why things are lost after approvals. You should have received all this ages ago and it seems your not the only one ritually all the transfers have the same complaints.

 

They haven't even transferred my case according to the USCIS Immigration officers. It's still at TSC. The mailing of the approval notice is a glitch apparently, that happened without it being really sent out, and since it was indicated in the system, it never got sent as it was flagged as sent.

 

Basically it looks like TSC is f*cking stuff up left and right because they're so unfamiliar with the process.

I just got off the phone to dos. I still have not received packet 3 even though I have been stalking the mail man lol. Anyway they told me packet 3 had not been sent out yet. And then the lady said hold on I see we received it today from you lol. Then I had to explain to her that I didn't wait for them to send it to me I downloaded it and sent packet 3 and the DS-2001 readiness checklist on my own accord. So she started laughing and said good for you well done. She can see they received it today and they have logged it on as received and I will be getting a letter with interview date in a week or so and they won't be bothering to send packet 3 again lol.

my thoughts to you guys is don't wait for these people to do their job do their job for them or it will never get done. I say a big thanks to Royal Mail. You have let me down in the past but you didn't let me down today lol. My mail man can rest in peace now till next week when I start stalking him again looking for the interview letter smile.png

 

We plan on doing the same. :) Once we have our case number we plan on booking the medical and sending out the packet 3 response. Argentina has the downloadable packet on their website.

This is why I contacted the Ombudsman about those of us stuck at VSC and who haven't been transferred - hell, when Blakcajun rang VSC, they told her they hadn't made a decision on whether to transfer us or not, which is simply not good enough. They've had plenty of time to make that decision and they're now messing around. Regardless, the Ombudsman has passed my concerns onto a manager there who will get in contact with USCIS.
 
While some of the old timers here may disagree with this course of action, I do urge anyone who is stuck at VSC to make your voices heard and contact the Ombudsman. Give them your receipt number too so they know we're not just complaining for the hell of it. Eventually they will either transfer us, or they'll start sorting out approvals quicker.

Redirecting Form I-129F

Starting the week of July 29, 2013, USCIS began redirecting all newly filed Forms I-129F from the VSC to the TSC. The receipt notice will bear a TSC receipt number beginning with ?SRC?. The case will be processed by the TSC. The CSC will continue receiving Forms I-129F.

USCIS will post additional Web updates to inform customers of any future workload realignments.

Oh my goodness you been. Missing for a while hope your doing good. Still no case number wow whats going on with these people.

 

 

Awe! Yes, I've been okay. Busy with getting the kids ready for the new school year and summer in general is busy with the children not in school.

 

As for what is going on, I'm not sure... I emailed the TSC myself on August 16th, and I am supposed to wait 30 days to hear back. I've been waiting a month for them to transfer my case to NVC and I call NVC once a week to see if they received my case. Nothing.

 

No NoA2 hardcopy, but I have had several T2 IO's confirm I was indeed approved.

 

I emailed TSC 2013-08-16 asking them to resend me my I-797C approval letter.

I called USCIS who also emailed TSC (and told I should get a response in 2 weeks) on 2013-08-20, they put in a request to resend my approval letter.
I emailed my congressman on 2013-08-22, informing him of my situation and stating that I was not the only person having such issues with the TSC and his support and assistance would help a lot of people.

Still nothing on my end. I contacted my congressman, I emailed TSC, I contacted USCIS who also emailed TSC.

 

My case has not been forwarded yet, and I still have yet to receive the paper copy of my NoA2 (I-797C Approval Notice).

 

If I don't hear from them soon, I will be going further up the chain.

I know the Whole transfer thing was suppose to speed up approvals but it seems to be slowing it down. i think those that stayed T vsc should thank their lucky stArs cos at least once they get approved they don't have all these problems the transfers are having you were approved on the 26th days before me. Ideally you should have got a hard copy before me and a case number before me.i can see why people are fed up.I suggest you get on the phone to them again.

 

I emailed my congressman, explaining the situation and explaining it seems to be a recurring issue that is happening to many people in the TSC.

Hey welcome back. I do believe a lot of people who were Tsc transfers have not received their noa2 hard copy yet. There obviously a problem with the system. I don't suppose you have a case number either? Mines just in-transit to London as of Tuesday.

 

No news as to my case being sent via electronic notification. I planned on calling to find out in a few minutes though.

 

I just find this frustrating, because I could get NVC to inquire to TSC if I had my NoA2, but I don't have my NoA2, because they "mailed" it but didn't really mail it.

 

Then when I call I'm given a line of bullsh!t and left sitting wondering ####### is going on. The process has gone fast for me, and I'm thankful for that -- but it's supposed to pick up speed now, not slow down. :C

I still didn't get my NoA2 hardcopy.

 

I called and spoke with a Tier 1 and they told me I would have to file for a duplicate and pay a $405 fee. I was like "I don't see how I should have to pay for a duplicate when I never received the original". I asked to be transferred to a Tier 2 and they sent an email to the TSC requesting I be sent another copy. If I don't get one in the next couple weeks, I'm contacting my congressman.

 

They still have not forwarded my case to NVC.

From my understanding (which I could be mistaken, so if there's a senior VJ'er, correct me if I'm wrong), they run a thorough background check on the petitioner at the point of the application, but they also run a routine one on the beneficiary. The police record is to ensure that their background check didn't miss anything, and to provide a more complete check. Background checks are not just a criminal background. It's checking all that information that you provided (name, address history, parents, job, etc) and making sure they are who they say they are. Making sure they're not on any ban lists, wanted lists, or known criminals.

They run a background check on your fiance. Depending on the country and whether that country has made its records all computerized -- THAT is what can hold up a petition. Also keep in mind that some countries tend to process faster than others, so keep an eye out on other petitioners from Jamaica. You might just be petitioning for a country that has a slow turn around.

I agree with you. You should have received it by now. Are they sure they have sent it out. I quiet agree about calling them . Somebody needs to give you the correct information. Keep us updated as to what they say.

 

I was told to give it a full two weeks before I call. That it got dropped off for mailing that Sunday (that wasn't a glitch), that I was actually approved on the 26th, and that if I don't have the paper by Monday to call again.

 

But I have the date now, so I'll be able to finish the rest of the paperwork.

Just saw your question. No I haven't even gotten my NoA2.

 

The tier 1 rep said it can take up to 30 days, that the electronic notification is when they generate it.

 

I think they're full of sh!t, because it specifically says "we mailed you a notice" and you know how the USCIS is quite specific about that, so I asked to be transferred. I'm waiting for the call back. I need my actual approval date so I can finish filling out the forms to mail to my fiance. I believe it's caught in some kind of glitch state.

 

Once that is settled, I'm sure things will move along quickly. I'll let you know what the Tier 2 Rep says. smile.png

hi I'm a may filer too noa1 may 10th I'm reading the whole convo here buy How do guys know that people get approved behind you an ahead of you I hope can get an answer congrats to all that got approved!!!

 

This is what I'd been doing (466 is mine, so that's why it's highlighted):

Which basically shows me the progress through the case files. There's no K1 apps in the 500's and I didn't see any in the 600's either. There were only a handful in the 300s, and very few "stragglers" that got transferred.
 
This is how I did it:

It's pretty easy you go here, which you can get to by visiting the USCIS website and entering in your receipt number in the "case status" box on the left navigation.
 
It looks like this:

Then you'll be on this page:

From there you change the last 2 digits in your case number down or up and submit the form. Your case number will start with EAC or WAC. :)

So 411, 412, 465, 466, 489, 490, etc

Give it 2 weeks from the date they said they mailed it. If you didn't get a notice that they mailed it, bug the USCIS about forwarding your case to NVC -- but you'll have to speak with a Tier 2 IO.

 

If you don't have a US number you can get this nifty little device, which you can leave with your daughter when you come to the US so she can call you free. :) It includes the device and 1 year of service. The service costs about $30 USD a year. I got it for my fiance, and it's been a life (and money) saver.

 

You can use any USB converter for a phone/device to power the device, so you don't have to get a plug converter if you have a usb/plug outlet converter thingy-mah-bob (technical term right there, yessiree).

Lol I like that. And too right and yes capitalism is costing all of us a fortune. This process has not been cheap at all. Yes like you said it's hardly worth it since it will all expire before she comes. However I bet someone's going to tell me she needs it just say they can make more money. Oh we'll cant complain still onwards we go. How are you getting on with all the DS forms etc? I downloaded all forms now plodding through them while waiting fon file to be sent to NVC. When do you think we should start harassing them ? I meant calling them lol. To get the new number. Called the Knightsbridge docs they said 2 weeks wait to get a appointment for medical. I was going to wait a week or do need to give them more time lol.

 

I used Rapid Visa to prepare my paperwork, so it's all pre-filled out when I answered all their other questions, aside from the DS-156 (which I already filled out). I don't have to worry about much aside from getting my fiance the documents he'll need like my birth certificate and my divorce certificate. I plan on mailing those to him this weekend.

 

As far as I'm aware you're likely going to want to schedule your medical after you get your number from the NVC. The doctor will need that number when identifying you in his medical report. o.o Might want to call the embassy to find out for sure.

I have no idea, but I imagine if you're not applying for a K2 visa for her, than you wouldn't need to go through with all that.  However, the process may still require it for some obscure money-grubbing-capitalistic-american reason.

You would have to check to see if it's required, but I don't think so. The police certification is only valid for a certain time (6 months in most countries) and the Medical is only valid for a year. So both would expire well before you'd need them.

The AoS can take anywhere from 3-8 months or more. I hear it's typically 5-8 months, like with the K1 it depends on processing times for the Service Center, but at least your partner is there with you. After 2 years of being married you can apply to lift conditions unless you're AoS is granted after your 2nd anniversary, then you just get the standard 10 year GC.

 

As for the I-130:

  1. Any U.S. Citizen or Permanent Resident is an eligible sponsor for the I-130.
  2. The I-130 process can take upwards of a year, this depends on the Service Center.
  3. You will be her sponsor which means you'll have to file an I-864 and meet the income guidelines.

The K2 visa is valid for 6 months once it's been granted. Once she enters the US on a K2, she'll have to file for her AoS, her EAD and her AP (just like you!). Once she has her AP she can leave the country without her AoS being considered "abandoned", but she would have to take time off school to do so and she can still have issues on re-entry.

In this instance I would recommend either delaying Uni for her for 1 year while your sort this out and she gets her AoS done, or going the I-130 route.

 

In my opinion, the most logical in this instance is the I-130 route, but a veteran VJ'er may have more input.

To be honest all i have been doing so far is downloading DS forms and checked where medical was going to be, found a place to get US passport done. It's not too far from where the medical is going to be done. Ordered my 18 year olds birth certificate. Even though she will not be coming with me just yet they want birth cert of all children. My sons is already a American citizen I gave birth to him last year 2012 so he is good to go with no probs. the dilemma right now is my 18 year old who is going to stay as she is going to university in October to study chemical engineering. It's a 4 year programme so am going to have to phone uk embassy tomorrow to find out if I can still get a k2 visa for her even though she won't be using it right now or if I should just wait to adjust status. I understand k2 is only good for 1 year so kind of weary about that. She will be 21 in 3 years time. I would like her to come join me when she finishes her engineering degree. But the timings a little short before she reaches 21. Am trying to find a solution to this problem. Any ideas about this area of things? Or do I need to call them up and ask them questions.

I don't know much about K2 visas, but if push comes to shove after she graduates, if she wants to immigrate to the US you could always apply for the I-130 for her. The process is a bit longer, but you could always apply for one on her 3rd year at Uni. smile.png Until then she can always come visit for holidays and summer break on the VWP.
